INTRODUCTION AND BACKGROUND
This proposed development offers residential living and a public precinct that comprises commercial, dining,
retail and leisure experiences that is inclusive of a theatre.
O’Brien Harrop Access has undertaken a comprehensive review of the drawing set Issued for Client Approval
as listed below for 3 Oceans, Scarborough. The design has been reviewed in accordance with the provisions of
the Disability (Access to Premises – Buildings) Standards 2010 and Austalian Standards on access and mobility.
EXECUTIVE SUMMARY
This report provides a summary of our findings and support that the developing design will meet the needs of
people with a disability, the requirements of the Access Code of the Premises Standards and the MRA Design
Guidelines Policy 10 Adaptable Housing. It is evident at this early stage of design that principles of access and
inclusion are incorporated into the design for the public, commercial and residential areas.
LEGISLATIVE COMPLIANCE
For the purposes of this report an assessment of the provided plans as detailed below has been undertaken
to determine compliance with the National Construction Code (NCC) as it pertains to access for people with
disability, the Disability (Access to Premises – Buildings) Standards 2010 and referenced Australian Standards
on access and mobility, plus the intent of the Disability Discrimination Act 1992.
The assessment has been completed to the extent appropriate for the Development Approval process. The
report does not address elements for which design detail is not yet developed.
The plan review has considered all areas that are mandatory under legislation, to meet the access
requirements of people with disability including; external access, car parking, entrances, internal accessways
and circulation space, vertical access including stairs, lifts and ramps, wheelchair seating, residential common
areas, swimming pool access and appropriate provision of accessible sanitary facilities.

DISABILITY DISCRIMINATION ACT
All organisations have a responsibility, under the federally legislated Disability Discrimination Act (1992) to
provide equitable access to goods and services and to premises used by the public. Premises are broadly
defined and would include all areas within a building.
The DDA provides uniform protection against unfair and unfavourable treatment for people with a disability
in Australia. It also makes it unlawful to discriminate against a person who is an associate, such as a carer,
friend or family member. The Act supports the principle that people with a disability have the same
fundamental rights as the rest of the community and this includes the opportunity to be employed, purchase
goods and services, gain access to premises used by the public and the like. Equitable and dignified access
must be provided and a complaint can be made under the DDA if appropriate access is not provided.
Compliance with the Premises Standard and referenced Australian Standards addresses the mandatory
requirements for the provision of access for people with a disability. Meeting the intent of the Disability
Discrimination Act (1992) and therefore protecting your organisation against a complaint under the DDA may
require consideration of provision of access to the following areas that fall out of the mandatory requirements
of the Premises Standard, for example:
• The landscaped environment
• Shelters, bench seating, barbecue/alfresco areas and the like
• Staff tea preparation areas, offices, workstations and associated circulation spaces
• Concierge /Reception counter
• Common kitchen, dining and lounge areas
• Non-mandatory application of luminance contrast
• Non-mandatory provision of hearing augmentation
• Wheelchair seating spaces in auditoria
• Operation of some controls
• Wayfinding and associated informative, interpretive or directional signage
• Emergency egress

1. EXEMPT AREAS
INTRODUCTION
Clause D3.4 of the NCC / Access Code of the Premises Standards states that the following areas are not
required to be accessible:
a. an area where access would be inappropriate because of the particular purpose for which the area is
used.
b. an area that would pose a health or safety risk for people with a disability.
c. any path of travel providing access only to an area exempted by this clause.
The Premises Standards Guideline [Clause D3.4 Exemptions] provides additional clarity by the following
examples:
“These areas could include cleaners store rooms, commercial kitchens, staff serving areas behind bars, cool
rooms, rigging lofts, waste-containment areas, foundry floors, abattoir animal processing areas, railway
shunting yards, electrical switch rooms, chemical and hazardous materials store areas, loading docks, fire
lookouts, plant and equipment rooms and other similar areas.”
AREAS CONSIDERED EXEMPT FROM ACCESS REQUIREMENTS
Areas considered exempt for provision of access for people with disabilities and not considered as part of this
plan review were those spaces generally considered where access would be inappropriate because of the
purpose for which the area is used or an area that would pose a health or safety risk for people with a disability.
In accordance with the NCC / Access Code of the Premises Standards D3.4, areas considered exempt for the
purpose of this report are:
• Cleaner’s rooms • Residential Bin Hold /FOGO Resi/Bulky Waste
• Switch/Comms/Transformer rooms • Commercial Kitchen

EXEMPT AREAS TO BE CONFIRMED
To ensure that any declaration of exemption is not based on inappropriate assumptions about the ability of
people with a disability or people with a particular type of disability to undertake work or activities in the above
mentioned spaces, further clarification / consultation as to the roles of staff employed in and/or purpose of
the areas listed below, may be necessary. A clear determination must be sought as to whether the following
areas (and access between) are to meet access requirements for people with disability.
• Manager
• Staff room
• Concierge
• Theatre back of house, noting there are no applicable exemptions for performers and non-provision of
access would be considered discriminatory.
This is in recognition that while they may contain spaces within which duties or activities may be considered
inappropriate for access for people with disabilities, there is no strong argument that access should be denied
under the D3.4 Exemption Clause (D3.4).
2. GENERAL BUILDING ACCESS REQUIREMENTS (CLASS 2)
2.1 REQUIREMENTS FOR ACCESS FOR PEOPLE WITH DISABILITIES (COMMON
AREAS)
In accordance with the Access Code Table D3.1, for a Class 2 (residential) building, access for people with
disabilities is to be provided from a pedestrian entrance that is required to be accessible to at least one floor
containing sole-occupancy units and to the entrance doorway of each sole-occupancy unit located on that
level.
Further, where a ramp complying with AS 1428.1 or a passenger lift is installed, access for people with
disabilities is required to the entrance doorway of each sole occupancy unit located on the levels served by
the lift or ramp.
Comment
The Class 2 residential component of this development is inclusive of 316 apartments and 54 affordable
housing areas.
Access for people with disability is required from the allotment boundaries i.e. footpaths along West Coast
Highway, Scarborough Beach Road and Filburn Street to the principal pedestrian entrances of each residential
foyer i.e. Residential Foyer 01 and 02 (west) and Residential Foyer (east, off Filburn Street) and this is currently
demonstrated.

In accordance with the Access Code Table D3.1, for a Class 2 (residential) building, access for people with
disabilities is to be provided to and within not less than each type of room or space for use in common by the
residents, including a cooking facility, sauna, gymnasium, swimming pool, common laundry, games room, TV
room, individual shop, dining room, public viewing area, ticket purchasing service, lunchroom, lounge room,
or the like.
Further, where a ramp complying with AS1428.1 or a passenger lift is installed, access for people with
disabilities is required to and within rooms or spaces for use in common by the residents.
Interpretation
Areas identified as ‘common areas’ as defined under the Access Code Table D3.1, for the Class 2 (residential)
component of this development where access for people with disabilities is therefore deemed to be required
include:
• Residential Foyers
• Mail Rooms
• Lift lobbys
• Bin Chutes
• Level 3 Amenity Podium consisting of;
− Private Dining Amenity Kitchen and Amenity Lounge
− Pool and pool deck
− Residents BBQ Alfresco, Gym, Fire Pit and Sunset Bar
− Pet Exercise Area
− Associated sanitary amenity
• Level 44 and 45 consisting of;
− Public Lounge, Residents Bar, Wine Cellar and Theatre
− Lounge 01 & 02, Private Dining and Sky Terrace
− Associated sanitary amenity
Comment
Access is demonstrated to and within all above residential common areas.
As the design progresses, ensure compliant door clear open width, door circulation space and internal
circulation space (sufficient turning space forward of the chutes and mailboxes) for a person using a wheelchair
to turn 180° and to exit the space) as per AS1428.1 2009 Clauses 6 and 13.

2.2 MRA DEVELOPMENT POLICY 10 - ADAPTABLE HOUSING
The Metropolitan Redevelopment Authority (MRA) Development Policy 10 (Adaptable Housing) applies to all
permanent residential proposals in the Scarborough Redevelopment Area. This policy requires that 20% of the
total number of residential dwellings (rounded down to the nearest whole dwelling) should incorporate the
following Core Livable Housing Design Elements (Livable Housing Australia):
• A safe, continuous and step-free path of travel from the street entrance and/ or parking area to a
dwelling entrance that is level;
• At least one, level (step-free) entrance into the dwelling;
• Where the parking space is part of the dwelling access it should allow a person to open their car door
fully and easily move about the vehicle;
• Internal doors and corridors that facilitate comfortable and unimpeded movement between spaces;
• A toilet on the ground (or entry) level that provides easy access;
• A bathroom which contains a hobless (step-free) shower recess;
• Reinforced walls around the toilet, shower and bath to support the safe installation of grab rails at a
later date; and
• A continuous handrail on one side of any stairway where there is a rise of more than 1 metre.
Interpretation and recommendation
As the development comprises 316 residential apartments and 54 affordable housing areas (a total of 370
dwellings), of the 370 residential dwellings a minimum 74 are to be nominated and designed in accordance
with the core Livable Housing elements as described above to meet the MRA Development Policy 10 –
Adaptable Housing requirements.
2.3 REQUIREMENTS FOR ACCESS FOR PEOPLE WITH DISABILITIES [SWIMMING
POOL(S)]
Table D3.1 of the Access Code of the Premises Standard requires for a Class 10b Swimming Pool1, that access
for people with disabilities is required “to and into swimming pools with a total perimeter greater than 40m,
associated with a Class 1b, 2, 3, 5, 6, 7, 8 or 9 building that is required to be accessible, but not swimming
pools for the exclusive use of occupants of a 1b building or a sole occupancy unit in a Class 2 or Class 3 building.
Interpretation
1 A swimming pool is defined as: “any excavation or structure containing water and used primarily for swimming, wading, paddling, or the like, including a bathing or wading pool, or spa”. BCA 2014 Part A1 Interpretation

In accordance with the Access Code Part D3.10 (1) & (2), and as documented for this proposed residential
development, access for people with disabilities is therefore deemed to be required to and within all swimming
pools, with a total perimeter greater than 40m.
Comment
Our preliminary assessment of the Level 3 Podium residential common area swimming pool, indicates the
swimming pool has a perimeter greater than 40m (approximately 57m), therefore not less than one means
of accessible water entry/exit in accordance with Part D5 must be provided. An accessible entry/exit must be
by means of:
(a) a fixed or movable ramp and an aquatic wheelchair; or
(b) a zero depth entry at a maximum gradient of 1:14 and an aquatic wheelchair; or
(c) a platform swimming pool lift and an aquatic wheelchair; or
(d) a sling style swimming pool lift.
Note: Access Code Part D3.10 (4) states that latching devices on gates and doors forming part of a swimming
pool safety barrier need not comply with AS1428.1 (for latch style or installation height).
3. GENERAL BUILDING ACCESS REQUIREMENTS (CLASS 6 RETAIL)
3.1 REQUIREMENTS FOR ACCESS FOR PEOPLE WITH DISABILITIES
In accordance with Access Code Table D3.1 for a Class 6 retail tenancy, access for people with disabilities is
required “to and within all areas normally used by the occupants”.
Interpretation
Class 6 elements that are pertinent to this development include the path of travel (pedestrian walkways)
from the allotment boundaries i.e. West Coast Highway, Scarborough Beach Road and Filburn Street, and
any associated accessible parking within the proposed undercover public carpark area to the principal
entries of all proposed facilities that are located within the communal public spaces, these include:
• Food and Beverage (F&B)
• Co-Work
• Artist Studios, Artist Office, Gallery/Events
• Associated sanitary amenities
Comment
Access is demonstrated to and within all above Class 6 amenities.

As the design progresses ensure door clear open width and circulation space is achieved to all non-exempt
areas as per AS14289.1 2009 Clause 13 and Figure 31.
4. GENERAL BUILDING ACCESS REQUIREMENTS CLASS 9B ASSEMBLY
BUILDING (LEVEL 2 THEATRE)
In accordance with Access Code Table D3.1 for a Class 9b assembly building access is required:
“to and within all areas normally used by the occupants,”
except that access need not be provided to tiers or platforms of seating areas that do not contain wheelchair
seating spaces.
In addition, Access Code D3.9 requires that where fixed seating is provided in a Class 9b assembly building,
wheelchair seating spaces complying with AS1428.1 2009 must be provided in accordance with the number
and grouping of wheelchair seating spaces must be in accordance with Table D3.9. (For example, where the
number of fixed seats in a room is up to 150 then 3 wheelchair seating spaces and configured as one single
space and one group of two spaces).
Comment
It is understood the Level 2 Theatre will have a level floor surface and at this stage it is unknown if fixed seating
will be provided. Should fixed seating be provided in the Theatre ensure the required number of wheelchair
seating spaces are provided in groupings and locations as specified by Access Code Table D3.9 and designated
as described in AS1428.1 2009.
At this design phase, stage access details are not developed and access for people with disability to the stage
is not yet defined.
5. COMMON ACCESS PROVISIONS
5.1 ACCESSIBLE CAR PARKING (PROVISION)
At this early stage of design, allocation of parking to the various building classes and the numbers and location
of the accessible parking is not yet confirmed.
Comment
Accessible parking spaces will be provided at the ratio detailed in BCA /Premises Standard D3.5 and Table D3.5
for building classes 6, 7a and 9b (in consultation with the appointed building surveying team).
Accessible parking bays will be designed to the full rigours of AS2890.6 2009 as per the BCA /Premises
Standards D3.5(c).

5.2 PROVISION OF AN ACCESSWAY TO A BUILDING
Part D3.2 (1) of the Access Code requires that:
(1) An accessway must be provided to a building required to be accessible:
(a) from the main points of a pedestrian entry at the allotment boundary; and
(a) from another accessible building connected by a pedestrian link; and
(b) from any required accessible carparking space on the allotment.
Confirmation
In this proposed development, accessways have been provided:
• From the allotment boundaries (footpaths), West Coast Highway, Scarborough Beach Road and Filburn
Street; and
• From indicative accessible parking bays within the proposed public carpark, meeting requirements.
6. PRINCIPAL ENTRANCES
Access to and within the principal entrance has been achieved at the;
• Residential Foyers
• Commercial tenancies (F7B and Co-Workers)
• Breakout Bar and Theatre
• Artist Studios and Gallery/Events
7. PARTS OF A BUILDING REQUIRED TO BE ACCESSIBLE: VERTICAL
ACCESS
Lifts, escalators and stairs have been documented and where a stairway or escalator has been provided, a
nearby lift is proposed, providing equitable and convenient vertical access opportunities for people who are
unable to negotiate stairs /escalators.
Further, from the council footpath entry points, where stair access is proposed (due to the topography of the
site), it is understood alternative walkway access will be provided via the adjacent public footpaths.
There is sufficient circulation space documented on the lift lobbies for a person using a wheelchair to
manoeuvre in and out of the lifts.

Comment
During the Design Development stage, stairways, escalators, walkways and ramps will be designed to the full
rigours of the relevant Australian Standards on access and mobility as per BCA /Premises Standards D3.3(a)
and D3.11. Further, the lifts requirements of Premises Standards E3.6 and the referenced AS1735.12 1999 will
be achieved as per BCA /Premises Standards D3.3(b).
7.1 POTENTIAL OVERHEAD HAZARD
It is not yet determined how the escalators and any feature stair will be incorporated into the final design,
however, should an escalator or feature stairway create a head height hazard, this hazard will be addressed
by one of the methodologies outlined in AS1428.4.1 2009 Clause 2.6 and the associated figures.
8. PARTS OF A BUILDING REQUIRED TO BE ACCESSIBLE: HORIZONTAL
ACCESS
At this early stage of design, the documented doorways demonstrate attainment of the necessary clear open
width and door circulation space requirements. All passing and turning spaces appear to meet the
requirements as required by the BCA /Premises Standards D3.3(c), (d) and (e).
Comment
Ensure at design development that door widths and door circulation spaces at all doorways, required to be
accessible, meet all rigours of AS1428.1 2009.
9. HEARING AUGMENTATION (THEATRE)
9.1 HEARING AUGMENTATION (PROVISION)
Access Code D3.7 (1) and (2) requires that a hearing augmentation system must be provided where an inbuilt
amplification system, other than one used only for emergency warning, is installed in an auditorium/theatre,
conference room, meeting room, room for judicatory purposes, or a room in a Class 9b building.
Comment
Ensure at design development that there is provision for a hearing augmentation system within the theatre
should a B.I.S.A system be installed and the appropriate Braille and tactile signage in accordance with Access
Code D3.6(a)(ii) and Part D4 identify the space with a hearing augmentation system.

9.2 UNISEX ACCESSIBLE AND AMBULANT SANITARY FACILITIES
Access Code Clause F2.4 accessible sanitary facilities requires:
(a) accessible unisex sanitary compartments to be provided in accessible parts of the building in
accordance with Table F2.4 (a); and
(a) accessible unisex showers to be provided in accordance with Table F2.4 (b); and
(b) at each bank of toilets where there is one or more toilets in addition to an accessible unisex sanitary
compartment at that bank of toilets, a sanitary compartment suitable for a person with an ambulant
disability in accordance with AS 1428.1 2009 Clause 16 must be provided for use by males and
females; and
(c) an accessible unisex sanitary compartment must contain a closet pan, washbasin, shelf or bench top
and adequate means of disposal of sanitary towels; and
(d) the circulation spaces, fixtures and fittings of all accessible sanitary facilities provided in accordance
with Table F2.4 (a) and (b) must comply with the requirements of AS 1428.1 2009; and
(e) an accessible unisex sanitary facility must be located so that it can be entered without crossing an
area reserved for one sex only; and
(f) where two or more of each type of accessible unisex sanitary facility are provided, the number of
left and right handed mirror image facilities, must be provided as evenly as possible; and

Interpretation and comment
in accordance with the provision of accessible sanitary amenity Access Code Clause F2.4 and Tables F2.4(a)
and (b) and the intent of the DDA, it is the opinion of OHA that an accessible sanitary facility be incorporated
at the End of Trip facilities and the Theatre Dressing Rooms.
Of the unisex accessible facilities documented there appears to be an equal distribution of left and right hand
transfer options.
At the Design Development stage of the project, the circulation spaces, fixtures and fittings of all accessible
and ambulant sanitary facilities will be documented in accordance with the Premises Standards /BCA Table
F2.4 (a) and (b) comply with the requirements of AS1428.1 2009.
