I. INTRODUCTION
A. CONSTITUTIONAL RESTRAINTS ON CRIMINAL PROCEDUREThedevelopmentofnumerousconstitutionallimitationsuponthemannerinwhichacriminalsuspectmaybearrested,convicted,andpunishedhasrenderedmuchofcriminalprocedureaninquiryintoconstitutionallaw.
B. INCORPORATION OF BILL OF RIGHTS INTO DUE PROCESSThefirsteightamendmentstotheUnitedStatesConstitutionapplybytheirtermsonlytothefederalgovernment.However,theSupremeCourthasincorporatedmanyoftheserightsintothedueprocessrequirementbindingonthestatesbyvirtueoftheFourteenthAmendment.ThoseportionsoftheBillofRightsfundamentaltoourconceptoforderedlibertyhavebeensoincor-porated.[Duncanv.Louisiana,391U.S.145(1968)]

II. EXCLUSIONARY RULE
A. IN GENERALTheexclusionaryruleisajudge-madedoctrinethatprohibitstheintroduction,atacriminaltrial,ofevidenceobtainedinviolationofadefendantsFourth,Fifth,orSixthAmendmentrights.
1. RationaleThemainpurposeoftheexclusionaryruleistodeterthegovernment(primarilythepolice)fromviolatingapersonsconstitutionalrights:Ifthegovernmentcannotuseevidenceobtainedinviolationofapersonsrights,itwillbelesslikelytoactincontraventionofthoserights.Therulealsoservesasoneremedyfordeprivationofconstitutionalrights(otherremediesincludecivilsuits,injunctions,etc.).
2. Scope of the Rule
a. station.ThepolicereadDhisMiranda warningsthreetimesandpermittedDtoseetwofriends.Afterbeingatthestationforsixhours,Dconfessed.TheconfessionmustbeexcludedbecauseitisthedirectresultoftheunlawfularrestifDhadnotbeenarrestedillegally,hewouldnothavebeenincustodyandwouldnothaveconfessed.[Taylorv.Alabama,457U.S.687(1982)]
