Duringthecourseofthe20thcenturyGermanyexperiencedtwodifferentdictatorships,thetwelveyearsoffascistNaziGermany’s“ThirdReich”between1933and1945andthe40yearsofcommunistruleinEastGermanybetween1949and1989(thelatterprecededbySovietmilitaryoccupationofEasternGermanyandEastBerlinsince1945whenGermancommunistswereguidedinbuildingupdictatorialstructures).

Both periods of dictatorshipshadsomestructuralelementsincommonwhiletheyalsodisplayedobviouscontrasts.Bothdictatorshipsstartedandendedverydifferently,withNaziGermanyresortingtoaglobalwarofaggressionresultinginmillionsofwardeadandthegenocideofEuropeanJewry.RespectivecrimescommittedbythetwoGermandictatorshipsdifferedvastlyinscopeandgeographicalrange.

AfterthedemiseofNaziGermanyandtheSecondWorldWar’sendinginEurope,SovietmilitaryauthoritiesusedcertainNaziconcentrationcampsitesinEasternGermanybetween1945and1950fortheirten“specialinternmentcamps”todetainsomereal,andmanyalleged,national-socialists.About43,000ofthem,i.e.35percentofindividualsinterned,perishedduringconfinement.

HowGermanscametotermswiththosetwodictatorshipsexistingontheirsoilvariedsignificantly,giventhemajordifferencesinbothinternationalandnationalenvironmentsafter1945andfrom1989.MeanwhilebothexperiencesinredressinginjusticesofthepasthavebeguntoreferenceeachotherinpublicGermandiscourse.Theyhaveledtoaconvergenceinthesensethatobligationsexisttofacedictatorialpastsfromtheperspectivesofvictimsratherthanthoseheldbyperpetrators.Theprocessofhowtocometotermswithvariousinjusticesandcrimescommittedduringdictatorshipsalsofacilitatedascrutinyofthelatter’slegacies.Theywarrantasearchforlessonsapplicabletopost-dictatorialdemocraticsystemsandcorrespondingsocietalstructures.

TheGermanpopulationinareasthatbecamethecommunistGermanDemocraticRepublic(GDR)experiencedthedifferencesandsimilaritiesoftwosucceedingdictatorshipsfrom1933to1945and1945to1989.TheGDRwasestablishedon7October1949andimposedonthepopulationbyGermancommunistsorganizedintheSocialistUnityParty(SED)withthevitalassistanceoftheSovietUnionandwithoutpopularlegitimization.Afaçadeof“democratic”institutionswassetupwiththeSEDactuallypullingallthestringsbyvirtueofits

self-assignedabsoluteunfetteredpower.Overthecourseofyears,peoplelivinginthissocialiststatehadtoexperiencemultiplefeaturesofrepression.Opponentsoftheregime,ormembersofrivalpoliticalpartiesduringtheearlypostwaryears,wereatanytimesubjecttovariousformsofadministrativerepressionorarbitraryarrestsbasedonpartisandefinitionsofcriminallaw.ThejudicialsystemwasentirelysubordinatedtotheSED’srespectivepoliticalinterests.Overall250,000peoplewerearrestedbetween1945and1989forpoliticalreasons(between1961and1989about30,000ofthemwerereleasedtotheWestafterransomwaspaidtoGDRauthoritiesbytheWestGermangovernment).ThousandsweredeportedtoSiberiancampsbySovietauthoritiesafter1945andduringthe1950s.UntilAugust1961alone,morethanthreemillionpeoplefledtheGDRthroughthestillopenborderswithWestGermany:Suchconstituted

thelargestrefugeemovementinEuropeaftertheendofWorldWarII.Traumaticexperienceswerecreated,forinstance,bytheviolentSovietcrackdownonthemassiveEastGermanpopularrevoltinJune1953,the1956defeatoftheHungarianuprisingandsubsequentrepressivemeasuresintheGDR,theAugust1961constructionoftheintra-Berlinborderandthewalling-inandfencing-inof17millionpeopleintheGDRnowseparatedfromtheirkininWestGermany,the1968WarsawPactmilitaryinterventioninCzechoslovakia,orthe1981martiallawcrackdownontheSolidarnosclaborandpeasantunionmovementinneighboringPoland.AllthoseeventshadincommonthatattemptsbypeopleintheGDRandEasternEuropetoattaindemocraticrightsandfreedomsweremetbydictatorialregimeswithafullforceofrepressivemeasures.

ThecommunistregimeintheGDRremainedinpoweraslongasMoscowhadavestedinterestinandthepowertomaintainadivisionofGermanyandtheexistenceofaseparatesocialistGermanstate.By1989atthelatest,theUSSRhadimplicitlywithdrawnitswarrantyofarmedinterventiontomaintainthesurvivalofasocialistEastGermany.Inparalleldevelopments,arefugeewaveexitingtheGDRtoWestGermanythroughHungaryandCzechoslovakiaultimatelytoppledtheSEDregimeinconjunctionwithunrestinsidethe

GDR.Theremassiveandpersistentpeacefuldemonstrationsheldcountrywideinsmallandbigcitiestookplace.Allthiswasinspiredbythehugepath-breakingdemonstrationinthecityofLeipzigon9October1989,whichultimatelyforcedtheopeningof

theBerlinWallandofthecountry’ssealedborderswiththeWestby9November1989.A“peacefulrevolution”featuringtheslogan“Wearethepeople”graduallydismantledcommuniststatestructuresandestablishedfoundationsfortheemergenceofamulti-partydemocracy.Aftertheself-liberationofEastGermansthroughapoliticalrevolution,a

processofself-democratizationbegan.Freeelectionson18March1990resultedinanoverwhelmingmajorityforEastGermanpoliticalpartiesadvocatingrapidunificationwiththeWesternFederalRepublicofGermany(FRG).Bythenthesloganfromthebeginningoftherevolutionhadchangedto“Weareonepeople”.EnsuingnegotiationsbetweengovernmentrepresentativesfrombothGermanstatesthenculminatedinacurrency,economic,andsocialunionon1July1990andinacomprehensiveUnificationTreatysignedon31August1990.Afterextensivemultilateralandbilateraldeliberations,thefourvictoriousalliedpowersofWorldWarII(USSR,USA,GreatBritain,France)ratifiedon12September1990inMoscowwithbothGermanstatesinaso-called“2+4Treaty”upcomingGermanunificationandthestatusofunitedGermanyasamemberoftheNorthAtlanticTreatyOrganization(NATO)militaryalliance.SovietarmedforcesintheGDR,whichthatatheightoftheColdWarinEuropehadamountedto400,000men,weretoleavetheEasternpartofunitedGermanyby1994.

Backin1945,SovietmilitaryoccupationauthoritieshadestablishedonEastGermanterritorythefivestatesofBrandenburg,Mecklenburg-Vorpommern,Saxony,Saxony-AnhaltandThuringia.ThecityofBerlinwasdividedintofour

sectorswiththeSovietUnionadministeringthelargestofthemintheEasternpart.In1952theGDRhadthesefivestatesreplacedwith14districtsandaseparate15thentityforEastBerlin.WithGermanunificationon3October1990,however,theoriginalfiveEastGermanstatesfrom1945werere-

established.TogetherwiththereunitedcityofBerlin,nowfiguringasastateofitsown,theyjoinedtheexistingelevenWestGermanstatestomergeintooneFederalRepublicofGermany.In1991unitedBerlin

wasvotedthecapitalcitybytheGermanparliamentandultimatelybecametheseatofunitedGermany’sfederalgovernmentin1999.

HowtocometotermswiththecommunistGDRpastbecameamajorfeatureofpublicdiscourseinunitedGermanyalmostimmediatelyafterthefalloftheBerlinWallinNovember1989.FirststepsinthisregardinitiatedinEastGermanybymultiplecivicgroupsandlocalmedianowfreedfromcensorship(andintenselysupportedbyWestGermanmedia);nottheleast,however,mostinitiativeswerelaunchedbycourageous

individuals.ThoseactivitiesoccurredduringtheGDR’slastyearbetweenNovember1989andOctober1990–andthusbeforeGermany’sofficialunification.Importantdecisionsinthecontextofdemocratization,likeapplyingcriminallawtoperpetrators,compensatingthevictims,andopeningthefiles,originatedfromthelastGDRgovernment(whichalsohappenedtobetheonlyfreeanddemocraticone)aftertheMarch1990elections.

SubsequentlytakenupbythefederalparliamentofunitedGermanyandthefivenewstatesinitsEasternpart,broadpoliticalmajoritiesreachedconsensusaboutapublicdutytoaddress,andpossiblyredress,themanifoldissuesofinjusticeandrepressioncommittedduringGDRtimes.Comprehensiveexplorationandinformationaboutstructuresandmethodsofadictatorialpast,aswellasthecommemorationofactsofciviccourage,opposition,andresistance,wereseenasnecessarypreconditionsforlivinginahealthydemocracy.Since1990,allGermanfederalgovernmentsandparliamentshavebeenveryclearinexpressingtheneedforareappraisalofthecommunistdictatorship.Wide-rangingandintenseeffortsbyfederal,stateandlocalgovernments,themedia,

andcivicsocietydealtinmultiplefacetswiththescopeofissuesraisedbythedemiseofthecommunistGDR.Hardlyanyotherdemocracyduringthecourseofthe20thcenturytookmoreinitiativesandsteps,bothquantitativelyandqualitatively,tocometotermswiththelastinglegacyofinjusticefromapastdictatorshipthanunitedGermanydidsince1990inthecaseofcommunistEastGermany.

ResearchersworkingatUniversitiesandelsewherediscoveredavarietyofnewtopicsandpublishednewknowledgewhichenlightenedthepastrealityoftheEastGermanDictatorship.Morethan2.000researchprojectswereaccomplishedsince1990.Especiallythefieldofoppositionandresistanceagainsttheregimeaswellasrepressionandpoliticalpersecutioncameintothecentreofhistoricalinterest.

I. ThEPOST-COmmUnISTGERmAn EXPERIEnCE:SPECIAlFEATURES

WhencommunistregimesinCentralandEasternEuropegraduallylosttheirpoliticalpowerandwereoverthrowninthesecondhalfof1989bypeacefulrevolutions,auniquefeaturewasondisplayinEastGermanyduringthefirstdaysofDecember:DemocracyactivistsandconcernedcitizensspontaneouslyforcedtheirentranceintodistrictandcountyheadquartersofthefearedandhatedMinistryforStateSecurity(MfS,orStasi;establishedin1950).

1. SecuringandOpeningtheFileS

The Stasi,theclandestinearmoftheSEDwith95,000employeesandroughly180,000unofficialinformersin1989,hadspiedoneverysegmentoftheGDRpopulationforalmost40years.Allinall,nearly600,000unofficialinformersand250,000StasiemployeesmonitoredthepeopleduringtheexistenceoftheGDR.Thisconstitutedtheperhapshighestcountryratiobetweenintelligenceoperativesandapopulationanywhereintheworld.

ThescenarioofDecember1989unfoldedinmajorcitieslikeErfurt,Leipzig,Dresden,Magdeburg,Halle,andRostock,butalsoinmanyotherseatsofdistrictorcountygovernments:Activistsseizedthebuildingsandsealedandsecuredmillionsofremainingsurveillancefileswiththehelpofstateprosecutorsassistedbythepolice.ThemassiveStasiheadquartersinBerlin,however,wheremajorresistancewasexpected,remaineduntoucheduntil15January1990beforeitsharedafateidenticaltoStasicompoundsinotherEastGermancities.

ByearlyDecember1989,theStasididnotputupfightsforitspropertiesindistrictandcountyseatsaffected.Itcededunderpeacefulpressurewithoutresortingtoviolencesinceitslong-timepoliticalprincipalhadjustceaseditsownexistence:TheentirePolitburoandCentralCommitteeoftheSEDinBerlinhadresignedon4December1989,andthusdefactoterminatedtheexistenceofacommunistpartyinEastGermany(itspost-communistsuccessorpartiesweretomarkabreakfromMarxist-Leninistpatternsofthepast).WhilethefoundingmissionoftheStasiasthe“swordandshieldoftheparty”vanished,someregionalStasicommandersgaveinstructionstodestroyitsincriminatingfiles.SmokefromchimneysofStasibuildings,andtherapidcountrywidespreadofsuchnews,triggeredapopularmovementtoseizethebuildingsandstopthedestructionofrecords.ActivistEastGermancitizenssucceededinthisregardtolargeextent.TheythuslaidthegroundworkforaspecialfeatureofEastGermany’scomingtotermswiththecommunistpastbyprovidingnecessarytoolsandsourcesforcomprehensive

lustrationoftaintedindividuals.SecuringtheStasifilesestablishedamajorpillaroftransitionaljusticeinGermanytobeestablishedandimplementedduringthefollowingdecadeofthe1990s.

InthemonthstofollowthetakeoversofDecember1989andJanuary1990,Stasirecordsremainedundersealandwereguardedonsitebylocalgroupsofcivicactivists.The

freelyelectedGDRparliamenttookupon22July1990itsfirstreadingofadrafton“securingandopening”thefilesforvictimsofsurveillanceaswellasforresearchers.On24Augustdeputiespassednearlyunanimouslyalawprovidingforacomprehensive

lustrationofallEastGermanparliamentariansasafirststep.ArelocationandpotentialclosureplanfloatedbytheWestGermanMinistryofInteriortomovetheStasirecordsintothe

FederalArchivelocatedinWestGermanywasmetbyamassiveoutcryinEastGermany.Asit-ininBerlin’sformerStasiheadquarters,andasubsequenthungerstrikebyprominentactivists,eventuallyrenderedanyrelocationplansmoot.On18September1990aclausewasaddedtotheUnificationTreatybetweenthetwoGermanstates,accordingtowhichthefutureparliamentofunitedGermanywascommissionedtodraftalawbasedonprovisionsfromtheAugust1990modelpassedbytheEastGermanparliament.WithGermanUnificationdayon3October1990theStasirecordsthencameundersupervisionofaspecialcommissionerandhisstaffwhoturnedintoaFederalCommissionerin1991:ThiswasEastGermanJoachimGauck,aProtestantpastorfromRostockandactivistwhohadalsochairedthelastGDRparliament’scommitteeinchargeofdealingwiththeStasilegacy.Aftermuchlegalwrangling,precededbymediarevelationsfromStasifilescirculatinginpublic,inDecember1991theGermanparliamentultimatelypassedthefinaldraftoftheStasiRecordsLaw(or“StUG”,astheGermanacronym

goes).ItestablishedaFederalAgencyheadedbyaFederalCommissionerforStasirecords(“BStU”bytheGermanacronym)andregulatedindetailhowtoaccessandmakeuseofaltogether180kilometers(120miles)ofsavedandpreservedfilesassembledbytheformerGDRMinistryforStateSecurityoverthecourseofalmost40years.JoachimGauckheadedtheBStUuntil2000when,duetolegaltermlimitations,MarianneBirthlersucceededhimintheofficeofFederalCommissionertillMarch2011.RolandJahnisthethirdFederalCommissionerbynow.

TheDecember1991StUGcameintoeffecton1January1992andformallyestablishedtheBStUasafederalagency.Itsmaintasksstipulatedbythislawwerethefollowing:

• Individualsweregrantedtherightofaccessto,andcomplimentarycopiesof,anypersonalizedrecordstheStasimighthavecreatedandfiledonthem.Also,theyobtainedtherighttomakepublicanycontentoftheirpersonalfilesandtoreceive,uponrequest,namesofinformerswhohadspiedonthem.(Sofar,theBStUagencyhasreceivedmorethantwomillionindividualinquiriessince1991).

• TheagencyprovideddocumentationandinterpretationassistanceforthevettingofpresentandprospectiveemployeesofGermany’sfederalandstatecivilservice.

• Inordertofulfilltheneedforpubliclyavailableresearchresults,theStUGalsoregulatedoverallgenerousaccessrightsforjournalists,aswellasforacademicandindividualresearchers.

• TheBStUwastaskedtocontributetopubliceducationaboutStasimethods,structures,andactivities;itdidsothroughoutreach,publicevents,documentations,publications,andexhibits.

Incombination,thoseprovisionsstimulatedaverylivelydebateinthemedia,theinterestedpublic,andamongacademics.Allinall,since1991morethan6.5millionrequestsforaccesstoStasirecordswerefiled(includingthosebymediaandresearchers).1.7millionindividualsaskedtoseetheirpersonalStasifiles.

Followingthepath-breakingopeningofthesefilescreatedbytheGDRsecurityapparatus,recordsfromallcentral,regional,andlocalbranchesoftheGDRpartyandstatecomplexweresubsequentlyopenedandmadeaccessibletothepublic,toresearchers,andtothemedia.WiththesingleexceptionoftheEastGermanyMinistryofForeignAffairswherefilescameunderauthorityofunitedGermany’sForeignOffice,theotherwisecommon30-years-ruleforGermanarchivalrecordswaswaivedforallGDR-relatedfiles.Inessence,theybecameavailablefortheentirehistoricalperiodbetween1945and1990.The42kilometers(26miles)ofrecordsfromthevastformermulti-branchEastGermanstateapparatus

weretransferredtotheauthorityoftheGermanFederalArchive.TheyareopentothepublicintheircurrentlocationinBerlin-Lichterfelde.ThesamearchivalcompoundalsohoststhelikewiseaccessiblearchivesofthecommunistpartySEDanditsaffiliatedmassorganizations(TradeUnions,YouthAssociations,NationalFront).Since1991thosefilesareorganizedinaseparatefoundationembeddedintheFederal

Archive.Archivesoftheso-called“blocparties”alignedwiththeSEDduringGDRtimesweremovedtotheirWestGermanpatronpartiesin1990.TheretheybecameaccessiblesomewhatlateratthearchivesoftheChristian-DemocraticUnion(CDU)inSt.Augustin

nearBonnandtheFreeDemocraticParty(FDP)inGummersbacheastofCologne.BasedonthiswiderangeofopenedfilesanddocumentsofthecommunistdictatorshipintheGDR,since1990morethan16,000publicationsappeared,amongthemover6,000booksandacademicmonographs.

Thevastdocumentationrecordavailable,inparticularfromthecomparativelywell-organizedStasiarchives,wasafter3October1990alsousedasabasisforcomprehensivelustrationofmembersandapplicantsforcivilservice,aswellasforvariousaffiliatedsectorsofthisserviceinunitedGermanyonthefederal,state,andlocallevel.Scopeofscreeningsandindividualregulationsvariedwithregardtostates,professionalsectors,andrespectivelustration

commissions.However,overallmoreorlesscomparableruleswereappliedtovalidate,ordismiss,questsbyindividualstoremainin,respectivelyjoin,Germany’svastcivilservice.Backgroundchecksremainedineffectandmandatoryuntil31December2006.Afterthatdate,theybecameapplicableinlimitedcasesonly,andpertainingtohigher-rankingpositions.

DuringGDRtimes,theSEDexerteditsconstitutionallyguaranteedandself-declared“leadingrole”instateandsocietynotjustintheory.By1989,thecommunistpartyhad2.3millionmembers(outofanentirepopulationof16million).

Party membership was mandatory forbasicallyeveryleadingpositioninsectorslikepublicadministration,thestate-runeconomy,police,security,andthemilitary,thejudicialsystem,oreducationinschoolsandatuniversities.Afterthepeacefulrevolutionof1989,theSEDrenameditselfinPDS(“PartyofDemocraticSocialism”)anditsmembershipdroppedtoabout200,000bytheendof1990.TheGDRgraduallyceasedtoexist,followingthefreeEastGermanelectionof18March1990thatoverwhelminglyexpressedapopularwilltopursuerapidunificationandadoptionoftheWestGermanpoliticalandeconomicsystem.ThequestionnowloomedwhowouldformthenewEastGermanelitesinstateandsociety;andwhatrole,ifany,mightbeplayedbythemillionsofformerSEDmembers.

AsfarastheprocessofreplacementofcommunistelitesinformerEastGermanyisconcerned,theperiodsince1990wasanotherratheruniqueexperiencedisplayingvariousGermanspecifics.Withregardtoanexchangeofoldadministrativeelites,EastGermanshadoneparticularoptionthatsetthemapartfromothertransformingformerWarsaw

PactmemberstatesinEasternandCentralEurope:Beyondtheobvioussearchforpoliticallyuntaintedindigenouselites,thefivenewEastGermanstatesinunitedGermanyhadattheirdisposalresourcesoftrainedadministrativepersonnelfromWestGermanpartnerstates.Also,thereexistedacertainstockofemigratedformerEastGermansnowlivinginWestGermanywhowerewillingto“comeover”,orreturn,totheEasttotakeoverpositionsvacatedbyoldcommunistandideologicallyaffiliatedelites.WhereassomeEasternEuropeanstateshadaswellnumbersofemigrantslivinginethniccommunitiesinWesternEurope,theUnitedStates,andCanadawhoconsideredtoreturntotheirnowpost-communistcountriesofbirth,thosenumberspaledinquantitativetermstothelargeWestGerman-basedpoolofuntaintedpersonnelavailabletoEastGermany.Forthosereasons,nowhereinpreviouslysocialistcountriesofEasternandCentralEuropeelitechange,i.e.thereplacementofpoliticallycompromisedpersonnel,becameassweepingandprofoundasitdidintheformerGDR.Inbasicallyallmajorareasofthecivilserviceitwasfar-reaching,deep,andpermanent.

Overall,theelitechangeduringthe1990sinEastGermanyhadsignificantlymoretorelyonWesternimportsthanonindigenouspotential.From1990onwards,reformistpoliticalcirclesandcivicactivistsinEastGermanysetthepaceforpurgingoldelitesfromthesectorsofpublicadministrationandfromtheeducationalsystem(thelattertraditionallybeingapartofcivilserviceinGermany).Initially,theyhopedtodrawmostlyonindigenousresources:DuringcommunisttimescertainpartsofGDRacademicelitesnotaffiliatedwiththeSEDhadlargelystayedawayfrompolitics.They“hibernated”incomparativelynon-ideologicalacademicprofessionslikemedicine,thenaturalsciences,engineering,orintheChristianchurches.Afterthefallofcommunism,theywherenowexpectedtofigureasapotential“counter-elite”andtoserveasanindigenousreservoirforthereplacementofoldelites.Someofthemsubsequentlyindeedemergedinpoliticalofficeonstateandcountylevel.However,intheendonlyafractionofsuchindividualsactuallywantedtojointheremodeledsectorsofpublicadministrationinthefivenewEastGermanstates.The“counter-elite”optionfailedtoemergeasarealisticalternativewhenthemajorityoftargetedindividualsstayedwithintheiroldprofessions;thosehad

meanwhilebecomemoreattractiveandofferedperspectivesinbothpartsofunitedGermany.

ThusimportsfromWestGermanyturnedoutasthefallback

optionforelitechangeinEastGermany.Withunification,theWestGermanpolitical,economic,legalandadministrativesystemreplicatedandreproduceditselfinthenewlyformed

EastGermanstates.Thisentailedalarge-scaledismantlingofformerGDRinstitutionalstructureswhileatthesametimeadministrativebodiesandbureaucraciesbasedonWestGermanmodelswereestablished.ForEastGermans,formercommunistsoranti-communistsalike,thiswasan

entirelynewexperiencethatrequiredsubstantialadaptation.Withthatexperiencecametheurgentneedtolearnalmostovernightaboutlaws,regulations,andtheactualfunctioningoftheWestGermansystem.HencetheimportofWestGerman-basedtemporaryexpertsandnumerousadvisersforpolitical,administrative,andeducationalleadershippositionsacrossthepublicsectorwasinevitableandultimatelyindispensable.

AfterGermanunification,thosepersonnelimportsweretospearheadinthefiveEastGermanstatestheimplementationofallaspectsofthetransferredWestGermansystemformanyyearstocome.

TheWestGermanimportsencounteredamoreorlessblankslateandstruggledtofillvacanciesacrosstheboardinEasterntopadministrativepositions.SomeoldGDR-specificinstitutionsweredownsized,yetmanyofthemweredissolved.Numerousnewadministrativestructureshadtobebuiltfromscratch.ThefivenewstategovernmentsestablishedinEastGermanyaftertheWestGermanmodelhadnoequivalentintheGDRwheretheterritoryhadbeensubdividedinto15districts.Afterunification,publicadministrationinEastGermanyhadtoshiftgearsandspeedilyimplementWestGermanlawandregulationswithalltheirsubtleties.ThustherewasaconstantneedofimportingspecialistsfromtheWestforallhigherlevelsofcivilservice.SoonthisresultedinWestGermandominanceinalmostallhigherranksofEastGermanstate

hadtobefinanciallysubsidizedbyWesternpartners.ThusthelatterconsideredexportofadministrativepersonnelasanactivecontributiontooverseeanddirecttheinvestmentandspendingofmoneyintheEast.TheyalsohopedforaspeedyeconomicrecoveryoftheEastwiththehelpofWesternspecialists.Thoughthisrecoverytooksignificantlylongerthaninitiallyexpected,itultimatelyincreasedlivingstandardsintheformerGDRandledtopartialeconomicself-sufficiencyofEasternGermany;therebyinturngradually

decreasingtheamountofneededWesternpersonnelimports,financialassistance,andotherformsofaid.

Inpublicadministration,Westernimportsinitiallyoccupiedmanytoppositionsinnewlyformedstateadministrationstructures,albeitmuchlesssoincontinuingstructuresoncountyandlocallevels.Numericallythemainbodyofall

stateadministrationscon-sistedofpoliticallyuntaintedEasterners,yetmostlyinsubordinatepositions.ThejusticesystemandthecourtssawaheavyinfluxofWesternimportsintovarioustoppositions,againwithastrongnumericalEasternbaseinlowerechelons.Incontrast,policeforcesinEastGermanyweretogrowrapidlyafterunificationdue

toanincreaseincrimeandsafety-relatedneeds.DespitesomeWesternimportsinstalledattheverytop,manyformerGDRpolicepersonnelhadtoberetainedanditsnumbers

increasedfromindigenousresources.Whilethepolicewassometimesoverwhelmedafterunification,thepublicschoolsystemanditsbureaucracywereoverstaffedduetosinkingenrollment.Muchtaintedpersonnelwasthusdismissedbutotherswereretained,astheinterestofWesternimportstoworkinEastGermanschoolswascomparativelylow.UniversityfacultypositionsintheformerGDR,incontrast,wereattrac-tivetoWestGermanacademicswhopushedintovacanciescreatedbydismissalsofpoliticallyandotherwisecompromisedEastGermanprofessors.StructuresoftheGDReconomyweresubstantiallytransformed,withthehugeformerall-publicsectorbrokenupintoindividualpiecesandsoldtoWesterncompanies.YetmanyEastGermaneliteeconomicprofessionalsmadetheirwayevenundernewconditionsanddespiteWestGermanleadershipatthetop;theirnetworksandexpertiseweremuchindemand.OtherformerGDRsectorsallbutdisappeared:CentralstructuresofthevastGDRstateapparatusweredismantled,thelargeSEDpartyapparatusdisappeared.The95,000forceoftheStateSecuritywasdissolvedwithoutreplacement,the165,000GDRmilitarydemobilizedandincorporatedintotheWestGermanarmy(Bundeswehr)withultimately11,000menretained.

4. cOmmuniStinjuStice beFOrethecOurtS

During the following decadeofthe1990s,GermancourtsappliedGDRlawsineffectduringactualcommitmentofcrimesincommunisttimes,butalsocurrentjurisdictionofunitedGermanywhereapplicable,and,inthecaseofexecutedshoot-to-kill-ordersattheBerlinWallandtheintra-Germanborderbetween1961and1989,universalhumanrightslaw.IncontinuationoflegalprosecutorialeffortsinitiatedduringthelastyearoftheGDR,thejudiciaryinunitedGermanyactedfurtherupon“electoralfraud”,i.e.themanipulationofelectionresultsintimesofcommunistrule,aswellasuponissuesconcerning“abuseofprivileges”andcorruptionamongformerleadingGDRofficials.Afterunification,thecourtsofunitedGermanydefinedthecategorieslistedbelowasmanifestexpressionsof“communistinjustice”duringGDRtimes.Therewerethereforeconsideredassubjecttoprosecution,includingtheobligationtoinvestigateandactonpotential“severehumanrightsviolations”inanyofthefollowingcategories:

• Politicalinstructionsandmilitaryactionspertainingtoshoot-to-killordersagainstEastGermanrefugeesbetween1961and1989attheBerlinWall(sofar126confirmeddeadlyincidents)andtheintra-Germanborder(deathsarenumberingbetweenmanyhundredsupto1,000andarestillsubjecttoexactconfirmation);defendantswereformermembersofhighestGDRdecision-makingpoliticalbodies(SEDPolitburo,NationalDefenseCouncil),aswellasindividualborderguardswhoexecutedpoliticalguidelinesresultinginthedeathsofrefugees

Bytheendofthe1990s,Germanloweraswellashighercourtsestablishedalargelyconsistentsystempertainingtoapplicationsofpastandcontemporarylaw.Afterabout15yearsofprosecutorialefforts,trials,verdicts,andacquittals,themostrecentcourtdecisiononGDR-erainjusticewasissuedin2005.Giventhelowprobabilityofdiscoveringfurthercasesofcommunistinjusticeaftermorethanadecadeofintensivescrutiny,andGermanamnestylaws

allowingonlyforfuturepersecutionofcrimesofextremelyseverenature,Germanlegaleffortstoaddresscommunistinjusticehavebasicallycometoaconclusion.

Resultsoftheseeffortsallowforthefollowingassessments:

• InitialprosecutionduringthelastyearoftheGDRwasmostlyconcernedwithpartyleadercorruption,electoralfraud,andembezzlement.ItbeganinNovember1989andlasteduntilGermanunificationdayof3October1990.Chargeswerefiledin180casesandresultedintheinvestigationof124accusedindividuals.Atleast42ofthemwereheldundertemporaryarrest.Ultimately41caseswerebroughttotrial,andGDRcourtssentenced26individualsbeforeOctober1990.

• Incontinuingthisprocessforcasesstillunresolved,andthroughasubstantialexpansionofthescopeofinvestigationsasoutlinedabove,federalandstateauthoritiesinunitedGermanycentralizedtheprosecutioninBerlinwithaspeciallyassignedteamofprosecutorstoadjudicatestate-sponsoredcrimeduringGDRtimes.

• WithexactnumbersdifficulttodeterminegiventheinvolvementofvariousregionalcourtssystemsalloverGermany,theapproximateoverallestimateforlegalinvestigationsconductedamountstoroughly75,000casesinvolvingabout100,000individualsunderinitialsuspicion.Intheend,however,only1,021casesagainstaltogether1,737defendantswereactuallyslatedfortrial.14percent(143)ofthosecaseswerewithdrawnbytheprosecutionordismissedbythecourtsandsubsequentlyleftuntried.Allinall,chargeswerefiledandtriedincourtonlyincasesconcerningabout1,400individuals(1.4percent)outofthose100,000originallyunderinvestigation.

• Onlyabout54percent(about756inabsolutenumbers)ofdefendantschargedwereultimatelysentenced,24percent(about336)wereacquitted.Theremaining22percent(about308)werereleasedwhenproceedingsgotterminatedwithoutanysentencesissued.Onlyinsevenpercentofcasesprisonsentencesoftwoormoreyearswereissued.53percentofsentencesamountedtoonetotwoyearsofprisontimewhile47percentofthosewereverdictsoverlessthanoneyear.In92percentofallthose

casesprisonsentencesweresuspended.Defendantswereplacedonprobationandsubsequentlyreleased.

• Amajorcauseforthesenumberswasthehighaverageageofdefendants:Itamountedto58years,withonethirdoftheaccusedbeing64andolder.Manyofthoseweredeclaredunfittostandtrialorserveprisontimeforreasonsofhealth.

• About37percentofcasesbroughttotrialconcerned“perversionofjustice”inGDRtimesthrougharbitraryapplicationofexistinglaws,24percentconcernedtheuseofforceattheBerlinWallandtheintra-Germanborder,and14percentwerecrimescommittedbytheformerMinistryofStateSecurity.

• Thecomparativelyharshestsentences,inpartamountingtofiveyearsofprisontimeormore,wereissuedagainstformerWestGermancitizensconvictedofespionagefortheGDRaccordingtoWestGermanlaw,whichexplicitlysanctionsespionageagainsttheFederalRepublicofGermany.SentencesofformerGDRcitizenscommittingespionageagainsttheFRG,however,werecommutedsincetheydidnotfallunderthejurisdictionofpre-1990WestGermanlaw.

ThosepurefiguresseeminglyindicatedformanyobserversinGermanyanunderperformanceofthelegalsysteminprovidingjusticeafter40yearsofstate-sponsoredcriminalactsintheGDR.However,inmanycasesprosecutorialhandsweretiedbyrespectivestipulationsofthe1990UnificationTreatybetweenthetwoGermanstates.Accordingtothose,onlysuchcrimesweresupposedtobesubjecttolegalsanctionsthatwerecommittedbefore1990inviolationofthen-existingGDRlaws.

Still,suchdidnotapplytocasesofsevereviolationsofhumanrights,liketheuseofdeadlyforceagainstrefugeesattemptingtoleavetheGDRthroughtheBerlinWallortheheavilyfortifiedintra-Germanborder.AccordingtoGDRlawsandregulations,itwasillegaltoleavethecountrywithoutauthorization,andthereforelegaltohinderthosedefyingstateordersbyforce.Inthiscase,however,thecourtsofunitedGermanytookrecourseinsupersedinginternationalhumanrightslaw.Theycompletelyreversedthetermsof“legality”and“illegality”withregardtotheuseofforcealongtheintra-Germanborder.InupholdingprisonsentencesissuedagainstGDRofficialsfromtheSEDPolitburo,theNationalDefenseCouncil,andthehigherechelonsofmilitaryborderunitswho

repeatedlyadoptedandre-confirmedtheshoot-to-killorderintheirrespectivemeetings,theGermanFederalConstitutionalCourtemphasizedtherelevanceofuniversallyapplicableinternationallawanditssupersedingeffectsoveranynationallegalconstructionswhichseverelyviolatedhumanrights.

Notwithstandingtheseverityorlenienceofsentencesissued,thesymbolicandfactualimpactofbringingcasestocourt,andarrivingatimpartialverdictswithvariousoutcomes,madesubstantialcontributionstowardsexploringthehistoricaltruthaboutcommunistinjusticecommittedinthepast.ThelegalprocessinunitedGermanywascharacterizedby

comprehensivenessandthoroughprofessionalism.Itstoodincontinu-anceofaprocessoflegalreckoninginitiatedintheGDRsinceNovember1989;anditdemonstratedthroughoverallmeasuredresultsthatithardly

representedanyvindictivepost-unification“victors’justice”.Thepublicverdictontheseresultswasmixed,though,encap-sulatedinastatementbyBärbelBohley,amajorprotagonistoftheEastGermananti-communistdissidentmovement:“Wewantedjustice,andwegottheruleoflaw”.

“We wanted justice, and we got the rule of law”

CommunistinjusticeintheGDRcouldbecomeverypersonal:Overall,hundredsofthousandsofpeoplewereeitherarrested,sentenced,expropriated,deported,ordiscriminatedagainstandwrongedforpoliticalreasons.

5. rehabilitatiOn, cOmpenSatiOn, reStitutiOn

An unknown number of people werekilledordiedincampsorprisons.Accordingtoestimates,therewereabout250,000politicalprisonersintheGDRoverthecourseof40years,andsomewhatover105,000verifiablecaseswherepeoplesufferedprofessionaldiscriminationforpoliticalreasons.Sincethefirst1992IndemnificationLaw,andasof2005,about170,000individualswererehabilitated.Also,theGermanForeignMinistrynegotiatedwithauthoritiesinterritoriesoftheformerSovietUnioncancellationsofcourtdecisionsandrespectiverehabilitationsforsofarabout13,500Germanswhoweresentencedafter1945onSovietterritoryforpoliticalreasons.

One-timefinancialcompensationspaidtoindividualsforGDRprisontermsviolatingtheruleoflaw,aswellasforadenialofaccesstoeducationandprofessions,havesofarexceededtheoverallamountof1.0billionU.S.dollars.Compensationshadalreadysurpassedthatlevel,whenin2007anadditionallawofferedtheoptionofpermanentmonthlyfinancialcompensationtoacertainnumberofqualifyingformerprisoners.

AmajorareaofredressingpastinjusticeincommunistEastGermanyisrepresentedbycasesofindividualrehabilitationandcompensation.Thisfeatureinitiatedinearly1990alreadywhenfirstmeasureswereundertakenbytheGDR’slastnominalsocialist-ledgovernment.Backthenadecreewasissuedtorehabilitateconvictedorotherwisepenalizedformercommunistpartydissidentsandordinarymembers.Ideologicallychargedverdictsfromcommunisttimeswerenullifieddatingbacktotheaftermathofthe1956Hungarianuprising.ThisrathernarrowconcentrationonformercommunistswassupersededbymorecomprehensiveandinclusiveconceptsintroducedthroughaRehabilitationLawpassedon6September1990bythefreelyelectedGDRparliamentfourweeksbeforeGermanunification.Itremainedineffectuntil4November1992whenunitedGermany’sparliamentadoptedthefirstso-called“CommunistInjusticeIndemnificationLaw”.ItofficiallyrehabilitatedvictimssentencedonpoliticalprovisionsofGDRcriminallaw.AllEastGermancourtdecisionsbetween8May1945and2October1990that“violatedtheruleoflaw”werenullified.

orprofessionalcareers.Compen-sationwasofferedfrom1994toindemnifyallvalidatedclaimantsforcorrespondinglowerpaymentsafterretirement.One-timecompen-sationpaymentsofabout430U.S.dollarspermonthweregrantedto

thosewhoservedinprisonforpoliticalreasons.About100,000applicationsforthistypeofrehabilitationandcompensationwerefiled,androughlyhalfofthemgranted.Anothertypeofrehabilitationofferedbythe1994lawconcernedthenullifi-cationofGDRadministrativemeasuresleadingtohealthproblems,lossofassets,orpoliticaldiscriminationwithconsequencespersistingtothepresent.About25percentofroughly40,000motionsfiledinthisregardweregranted.Theburdenofproofforphysicalorpsychologicaldamagesandotherdetrimentssufferedwaslyingwiththevictimsofpersecution.

Followingpubliccontroversiesandamendmentsduringsubsequentyearsthatquestionedtheactualfinancialcommensurabilityofthe1994stipulations,theGermanparliamentpassedon23June2007athirdbilltoincreasecompensationsforvictimsofpoliticalpersecutionduringGDRtimes.Provisionsnowofferedapermanentmonthlypaymentof250Euro(about340U.S.dollars)tothoseformerpoliticalprisonerswhohadtoservejailtimesintheGDRofatleast6monthsandarecurrentlysufferingfromlowincome.

Anotherformofcompensationforpastinjusticeconsistedinmaterialrestitution.ItwasgrantedtoformerGDRcitizensincasesofforcedpropertylossorsale,anditwasappliedtoexpropriatedbusinessesaswellastoprivatehomeschangingownerships.ThespecialcaseofformerJewishpropertynationalizedduringGDRtimeswasexemptedfromstatuteoflimitationsin1991whentheparliamentofunitedGermangrantedtherighttofilerestitutionclaimsforthistypeofproperty.OnlymaterialrestitutionclaimsforSovietpropertyexpropriationexecutedduringtheperiodofmilitaryoccupationbetween1945and1949wereexemptedbyparliamentarylaw.Thismovebarelysurvivedvariouscourtchallenges,buton23March2005theEuropeanCourtfor

Theactualprocessofpropertyreturnwasinitiatedbyadecreeissuedbythelastnon-electedGDRgovernmentbeforeEastGermany’sfirstfreeelectionsof18March1990.Afewmonthslater,withafreelyelectedGDRgovernmentinplace,ajointWestGerman-EastGermansettlementon“openpropertyquestions”wassignedinJuly1990.Ultimately,alawcodifiedwithWestGermanlegalexpertiseon23September1990andrepresentingoneofthelastactsofGDRparliamentbeforeunification,setthestageformanyyearsofclaimsand

subsequentadministrativeandcourtbattlesoverpropertyreturns.Boththe1990settlementandlawstipulatedmaterialrestitutionbutdeniedfinancialcompensationforlossofproperty:“RestitutionoverrulesCompensation”savedstrainedgovernmentbudgetsalloverGermanyfromlarge-scalepayments,butitalsoopenedaplethoraoflegalclaimsfrompeoplewho,forciblyorvoluntarily,leftpropertybehindwhentheyemigratedorfledfromtheSovietOccupationZoneortheGDRbetween1945and1989.Asmostclaimswereabletoproveandvalidatetheexistenceofformerpropertyrights,alargenumberofcasesofmaterialrestitutionwereimplementedincomplexanddrawn-outprocessesstretchingovermanyyears.

Between1992and1998twoEnquete(inquiry)CommissionsestablishedbyparliamentarymandateintwosubsequentsessionperiodsoftheGermanfederalparliament(Bundestag)investigatedthehistoryoftheSEDdictatorshipanditseffectsonGermanunity.Thecommissioninsessionbetween1992and1994wasassignedtodealwith“ComingtoTermswithHistoryandConsequencesoftheSEDDictatorshipinGermany”.

Its successor commissionrunningfrom1995to1998wastaskedwithaddressing“OvercomingtheConsequencesoftheSEDDictatorshipwithintheProcessofGermanUnity”.Altogether,bothcommissionspublished34volumeswithmorethan30,000pagescontainingcompletetranscriptsofpublichearingsandnumerouscommissionedexpertanalysesonawiderangeofhistoricalandcurrentsubjects.

Onrecommendationbythesecondcommissionofinquiry,theGermanfederalparliamentenactedon5June1998alawontheestablishmentofafederal“FederalFoundationfortheReappraisaloftheSED-Dictatorship”(Bundesstiftung zur Aufarbeitung der SED-Diktatur).Thefoundationstarteditsworkinfallof1998,andthusapublic-fundedinstitutionalclearinghousewascreatedtoraisepublicawarenessandcontinuediscussionsaboutthesecondGermandictatorship.

ByitsmandatereceivedfromawidemajorityofpartiesrepresentedinGermanparliament,thefoundationstandsforanactiveandpluralisticdiscussionoftheSEDdictatorshipanditslastingeffectsonreunitedGermany.Itfunctionsasbothamediatorandintermediarybetweenacademicandprivateresearch,politics,themedia,andthepublicpertainingtothereappraisaloftheSEDdictatorship.Thefoundation’slibrarywithits45,000itemsanduniquearchivewiththeircollectionsofmaterialonrepressedliteratureandoppositionalactivitiesintheGDRprovidesdocumentarymaterialtoaidresearchers.Since1998thefoundationhassupportedmorethan2,000research,documentationandexhibitionprojectsinGermanyandvariouscountriesofCentralandEasternEurope,spendingaltogethermorethan26millionU.S.dollarsfortheseprojects.

It consists of members of the German parliamentrepresentingallitsfactions,membersappointedbyministriesoftheGermanfederalandtheBerlincitygovernment,aswellasoffiveindividualsnominatedbyfederalparliamentaryfactionswhoareespeciallycommittedtodealwithchallengesandquestionsofcomingtotermswiththeSEDdictatorship.TheChairmanoftheBoardisMarkusMeckel,vice-chairmanthememberofGermanparliamentHartmutKoschyk.TheBoardofTrusteesdecidesonallfundamentalquestionsconcerningthefoundation’sgeneralobjectivesandactivities.

TheBoardofDirectors(Stiftungsvorstand),workingonahonorarybasis,guidesthemoreconcretetasksofthefoundation.Itconsistsoffivemembers:RainerEppelmann(chairman),BerndFaulenbach(vice-chairman),AnnemarieFranke,GerdPoppe,andGerryKley.Theboardissupportedandadvisedbythreeadvisorycommitteesonacademic,societalreappraisal,andarchivalissues.Thosecommitteesconsistofaltogether32individuals.

TheOfficeoftheFoundationisdirectedbyDr.AnnaKaminskyandcurrentlyemploysastaffof22.Itisinchargeofallissuesandquestionsconcerningtheactivitiesofthefoundation,includingthefundingofprojects,allocationofscholarships,andtheorganizationofconferencesandotherevents.Thefoundation’sofficeservesasamediatorbetweenvariousorganizationsandinstitutionsinGermanycommittedtoresearch,documentandinvestigatethehistoryoftheSEDdictatorshipanditsconsequences;inthiscontexttheofficealsoprovidesinformationandadviceaboutprofessionaldevelopment.

It aims to provide testimonytoinjusticescommittedbytheSEDregimeandtorecognizevictims,tofurthertheanti-totalitarianconsensuswithinGermany,andtostrengthendemocracyandGermanunity.Thefoundationwasestablishedtoservethefollowingaims:

• topromoteandsupportprojectsdealingwithexploringGDRsociety,privatearchivesandvictim’sorganizations,academicresearch,andpoliticaleducation;

• tocontributetothemaintenance,collectionanddocumentationofmaterialswithregardtooppositiontotheSEDdictatorship;

• toprovidepsychologicalandlegalassistanceforvictimsofpoliticalpersecution;

• toadvanceinternationalcooperationonthereappraisalofdictatorshipsworldwide;

• tocontributetopublicdiscoursewithitsownpublicationsandevents;

• toawardprizesandscholarships.

Currentlythefoundationhasanannualbudgetofabout7.6millionU.S.dollarssuppliedbytheGermanFederalGovernmentonmandateoftheGermanparliament.Ithasanendowmentofabout120millionU.S.dollars,mostlyderivedfromassetsformerlyheldbytheEastGermanCommunistPartySEDandallocatedtothefoundationbydecisionoftheGermanparliament.
