Dear Maine Conservationist,

Maine people ushered in new, proconservation

leadership in the 2012 legislative elections while

Governor LePage remained in the Blaine House. This

dynamic led to mixed results or the protection o

Maines environment during the rst hal o the 126th

Legislative Session.

Over 80 bills were vetoed by Governor LePage, including

one that would have protected pregnant women and

children rom toxic chemicals and another that would

have allowed the state to prepare or the eects o

climate change.

There were other measures that became law without the

Governors signature, however, including a bill to restore

passage or alewives at two dams on the St. Croix River;

one to establish a recycling program or household paint

sold in Maine; and a ban on BPA in inant ormula and

baby ood.

Some important bills did not even make it to the

Governors desk. This was the unortunate situation or

a bill to protect Maine people and wildlie rom water

pollution like arsenic, lead and mercury that results rom

openpit sulde mining. The Senate ailed to pass An

Act To Amend the Maine Metallic Mineral Mining Act To

Protect Water Quality, despite bipartisan support and a

sizable victory in the House.

Alewives (LD 72)An Act To Open the St. Croix River to River Herring

Sponsored by Rep. Madonna SoctomahThe Legislature

authorized reopening

the St. Croix River to

alewives representing

a signicant victory or

wildlie habitat. Also

known as river herring,

alewives are a critical ood source or Maine lobster,

many sh species, and a variety o birds and mammals.

The sh passages were closed in 1995, restricting access

to the alewives native spawning grounds and causing

a dramatic population decline. The Marine Resources

Committee voted unanimously in avor o the bill,

setting the stage or easy passage in both the House

and Senate. Thanks to the timely passage o this bill,

alewives swam unrestricted up the river this year.

Wind-Power Siting(LD 385)An Act To Improve Wind Energy Development Permitting

Sponsored by Rep. Roberta Beavers

The Legislature directed the Department o

Environmental Protection DEP to increase

opportunities or public participation in deciding where

new wind projects can be built. The DEP must now also

evaluate the potential scenic and wildlie impacts o

wind power. Additionally, the bill protects the habitat

o Bicknells Thrush, a globally rare bird species ound at

very specic high elevations.

GMO Labeling(LD 718)An Act To Protect Maine Food Consumers Right To Know

about Genetically Engineered Food and Seed StockSponsored by Rep. Lance Harvell

The House and

Senate both

passed the GMO

labeling bill with

overwhelming

support, and

Governor LePage

has promised to

sign it into law

in January 2014. The law will require ood companies

to label products that have been produced using

Genetically Modied Organisms GMOs. LD 718 will

go into eect when 5 contiguous northeast states,

including Maine, pass GMO labeling laws. Connecticut

passed such a law this year. GMOs have signicant

environmental impacts on species diversity, unknown

impacts regarding toxic chemicals in the ood supply,

and have increased pesticide use. The GMO labeling

law will give important reedom o choice to ood

consumers in Maine and the northeast.

Climate Change (LD 825)Resolve, To Study Climate Change and Implementthe Recommendations o the Department o

Environmental Protection Report on Climate Change

Sponsored by Rep. William Noon

In 2009, the Legislature directed the DEP to build upon

the Universtiy o Maines climate impact assessment

by evaluating the options available to Maine people

and businesses or adapting to the environmental

eects o climate change. Under Governor LePages

Administration however, the DEP ceased its study

directed the DEP to resume the study and implement

recommendations made in response to its ndings. The

bill passed both bodies but was vetoed by Governor

LePage.

Healthy Kids (LD 1181)An Act To Further Strengthen the Protection o

Pregnant Women and Children rom Toxic Chemicals

Sponsored by Sen. Seth Goodall

Despite passage in the

House by a wide marginand initial unanimous

Senate passage, Governor

LePage vetoed the Healthy

Kids bill, and the Senate

ailed to override. LD 1181

would have required the

disclosure o BPA use in

ood packaging by ood

manuacturers with more

than a billion dollars in

annual sales. Disappointingly, the Senate did not debate

the bill.

Open-Pit Mining(LD 1302)An Act To Amend the Maine Metallic Mineral Mining

Act To Protect Water Quality

Sponsored by Rep. Jef McCabe

Openpit sulde mining is one o the most polluting

industries, releasing dangerous arsenic, lead, and

mercury into the surrounding watershed. Until last year

it was highly improbable that this type o mining would

ever occur in Maine, but a bill passed in 2012 weakened

the clean water protections that to apply these mines,

opening the

door or their

development

in the state.

LD 1302

would have

strengthened

water qualityprotections

and ensured that Maine taxpayers are not let with

cleanup costs once a mine is closed. The House passed

the bill by a large margin, but the Senate ailed to

pass it by just one vote. The LePage Administrations

Department o Environmental Protection recently

drated rules that will govern uture mining operations.

In 2014, the Legislature will have nal say over whether

these proposed rules are adopted.

Paint Recycling(LD 1308)An Act To Establish a Stewardship Program or

Architectural Paint

Sponsored by Sen. Thomas Saviello

The Legislature passed LD 1308, which establishes a

recycling program or architectural household paint

sold in Maine. Following the precedent set by Maines

bottle bill, this bill enables consumers to return their

unused paint to designated locations throughout the

state or recycling and proper disposal.

AlewivesCommittee chairs Sen. Johnson and Rep. Kumiega

did an excellent job running the Marine Resources

Committee, which voted unanimously in avor oopening the St. Croix to alewives LD 72. Tribal Rep.

Soctomah sponsored and championed the bill,

speaking on the foor and even persuading three

senators to change their votes to support it on nal

passage. Republican Reps. Parry and Weaver provided

leadership in Committee. Governor LePage let the bill

become law without his signature.

Open-Pit MiningAsst. House Majority Leader McCabe continued to

be an environmental champion this year by sponsoring

the bill to strengthen

water quality standards

in Maines mining law LD

1302. Sens. Johnson and

Gratwick, and Reps. Welsh,

Grant, Chapman, Harlow,

Kruger, and Chipman were

outspoken proponents o

improving the law. Republican

bill cosponsors Reps. Cotta, Dunphy, Espling, Maker,

Malaby, and Sanderson contributed strong support;

and Sen. Langley deserves credit or being the only

Senate Republican to support the bill.

DISAPPOINTMENTS: Despite easy passage in the House,

the Senate did not pass the bill. The Republican

caucus save Sen. Langley and Democratic Sens. Cain,

Dutremble, Patrick, Valentino, and Asst. Senate

Majority Leader Jackson voted against the bill.

Healthy KidsReps. Welsh, Grant, McGowan, Cooper and Sen.

Gratwickenergetically advocated or LD 1181, a BPA

disclosure bill, in the Environment and Natural Resources

Committee. Beyond the Committee, Reps. Devin,

Dorney, Gideon, Graham, and Tipping-Spitz were

staunch allies. House Speaker Eves prioritized the

passage o the bill, contributing important support.

In the Appropriations Committee, Sens. Cain, Flood,

and Hill deserve thanks or shepherding an amendment

to eliminate the scal impact. Commendation also goes

to Sen. Flood: the sole Republican senator to vote to

override the Governors veto.

DISAPPOINTMENTS: Sen. Saviello worked against the

bill in Committee and sided with the Administration

to oppose the bill. Lacking Sen. Saviellos support, the

Senate ailed to override Governor LePages veto.

GMO LabelingBill sponsors Rep. Harvell and Sen. Johnson provided

passionate and tenacious championship or GMO

labeling LD 718. Their eorts were bolstered by

Reps. Hickman,Jones, Kent, and Noon, memberso the Agriculture, Conservation and Forestry ACF

Committee. The our representatives who voted against

the nal bill on the House foor, Reps. Jones, Boland,

Chipman, and Kent, did so only because they thought

it did not go ar enough.

Departmental MergerRep. Kent was a hero in opposition to the merger o the

Departments o Agriculture and Conservation LD 837which takes resources rom conservation programs. He

gave an impassioned foor speech, provided leadership,

and asked probing questions in Committee. Asst. House

Majority Leader McCabe and Rep.Carey were valuable

allies, and Rep. Marean was instrumental in restoring

the Land or Maines Future director position which had

Outside o the Committee, Senate President Alond and

House Speaker Eves championed energy eciency policy.

Reps. Dorney and McGowan were also active voices

pressing or energy eciency and climate change

legislation. Rep. Noon sponsored and led the passage o

the Climate Adaptation bill LD 825.

Rep. Beavers championed a successul bill LD 385 that

addresses the nuances o location decisions or new wind

power projects. Rep. Welsh was a leader on other wind issues.

Energy, Utilities, and Technology Committee Chairs Sen.

Patrickand Rep. Herbig, along with Rep. Graham ably

attempted to restore the Maine Uniorm Building andEnergy code LD 977.

On the Appropriations Committee, Chair Sen. Rotundo,

and Reps. Carey and Keschl successully halted

attempts to take money rom the Regional Greenhouse

Gas Initiative and the Eciency Maine Trust. House

Minority Leader Fredette and Rep. Dunphy were also

instrumental in this eort.

Habitat and WildlieAsst. House Majority Leader McCabe championedprotection o brook trout by opposing a bill to allow

live bait shing in important

brook trout ponds LD 170. In

Committee, Rep. Kusiakvoted

courageously, casting the only

opposing vote among the

Committee members present.

Sens. Haskell, Saviello,

Cleveland, Lachowicz,Johnson, Tuttle,and SenateMajority Leader Goodall are lauded or voting to

preserve trout habitat.

Sen. Haskell, with assistance rom Reps. Shaw and

Davis, championed a bill protecting loons rom lead

poisoning LD 730.

Senate Majority Leader Goodall sponsored the

successul bill to protect sand dunes LD 1102.

Sen. Saviello helped deeat the vernal pool and

signicant wildlie rollback bills acing the Environmentand Natural Resources ENR Committee LD 674, 793. He

also led the charge on limiting motorized gold dredging

LD 1135 with signicant help rom bill sponsors Rep.

Blackand Sen. Boyle.

Sen. Boyle worked to prevent legislation that would

have gutted Shoreland Zoning and the Natural

Resources Protection Act LD 470.

Other Noteworthy ActionsSens. Saviello and Boyle were critical in the passage o

the paint recycling bill LD 1308.

Rep. Blackstood up to protect the Allagash Wilderness

Waterway LD 269. On the ACF Committee, he voted with

Reps. Jones and Noon against the tenmember majority

and delivered a powerul speech on the House foor.

Rep. Marean was a hero or

opposing the Eagle Lake Sporting

camp bill LD 493 which would

have sold public land or private

gain. Asst. House Majority

Leader McCabe also aided in the

bills deeat.

In the Transportation Committee, Sens. Mazurek, Powers,

and Peoples took the lead in deeating bills that threatened

Maines billboard ban. Sen. Mazurekalso played a key role

in creating more transparency and increasing evaluation

o EastWest Highway proposals. Asst. House MajorityLeader McCabe worked hard on the issue as well.

Rep. Priest assured that new regulatory takings bills,

similar to those proposed in previous sessions, were

soundly deeated by the Judiciary Committee.
