and answer the questions given below it. Certain words/phrases are given in bold to help you locate them whileanswering some of the questions.
Choosing not to make a choice has been accepted asa democratic right. The Supreme Court decision tointroduce a None of the Above (NOTA) option enablespeople to vote in a way that will have no effect on theoutcome. But will it have a fundamental effect on theaccountability and representativeness of the electoralsystem?
The SC decision is an extension of a technical clausein the Representation of People Act which allows for therecording of spoilt or unused ballot papers. The use ofElectronic Voting Machines has not previously allowedfor any choice other than a valid vote, and so the provisionof the NOTA button re-institutes what was recognised asa legitimate option. As such, it provides a recognition thatpeople might want to take part in the electoral process, butnot necessarily cast a vote for any of the candidates onoffer.
Dramatic claims about the advantages of a NOTAoption have been made. In his judgment, Chief Justice PSathasivam said that in a vibrant democracy, the votermust be given an opportunity to choose none of the above(NOTA) button, which will indeed compel the politicalparties to nominate a sound candidate. He stated that thesignificance of such a provision was massive, and wouldfoster the purity of the electoral process.
There is something surreal about debating the right tocast a vote for no candidate. Representative democracy isbased on the principle that the electorate make a collectivedecision, and that the public choose wisely amongst theavailable options. The idea that the provision of a neutraloption will significantly enhance the democratic processseems unlikely. The claim that NOTA will purify the politicalprocess seems based on an assumption that it will threatena corrupt cartel of political parties, who can put up criminaland corrupt candidates in the knowledge that their rivalsare bound to do the same. The Aam Aadmi Partys right-to-reject proposal is based on the view that voters are forcedto waste our vote on someone we know is unfit for thejob. However, most elections have many candidates, andthe common complaint has been that it was too easy tostand for election, with voters overwhelmed with choice.
The right-to-reject option provides for a more powerfulnegative option. In cases where NOTA is a more popularoption than any candidate in that constituency, the electionwould have to be contested again. This vote of noconfidence in the candidates on offer is a radical proposal,but raises the prospect of political deadlock and a vacuum
in the representative process. Far more constructive is thedecision of Arvind Kejriwal to join the democratic fray, andthrough AAP seek to provide a substantive alternative tovoters. Rather than a neutral protest, this is an opportunityto broaden the choices available to the electorate, and testthe strength of discontent with established parties in thearena of electoral competition.
A broader consideration is that NOTA will act as anindicator of democratic legitimacy. In the past, in one-partystates such as Poland and the Soviet Union, the NOTAoption provided a signal that there was widespreaddissatisfaction with the political options on offer. In stateswhere an election boycott has been a recourse, the NOTAbutton provides a way to actively cast a protest againstthe political process.
