    COMPLAINT

    Plaintiff Amethyst IP, LLC (Amethyst), for its Complaint against Defendant Samsung

    Opto-Electronics America, Inc. (Samsung OEA) hereby alleges as follows:

    The Parties

    1. Plaintiff Amethyst is a New York limited liability company with its principal

    place of business at 1225 Franklin Avenue, Suite 325, Garden City, New York 11530.

    2. On information and belief, Samsung OEA is a New Jersey corporation with a

    place of business at 100 Challenger Road, Suite 700, Ridgefield Park, NJ 07660. On information

    and belief, Samsung OEA operates under the fictitious name Samsung Techwin America.

    Nature of the Action

    3. This is a civil action for the infringement of United States Patent No. 7,425,901

    (the 901 patent) (attached as Exhibit A).

    Jurisdiction and Venue

    4. This Court has jurisdiction over the subject matter of this action pursuant to 28

    U.S.C. 1331 and 1338(a) because this action arises under the patent laws of the United States,

    including 35 U.S.C. 271 et seq.

    5. This Court has personal jurisdiction over Samsung OEA because, among other

    things, Samsung OEA has committed, aided, abetted, contributed to, and/or participated in the

    commission of patent infringement in this District and elsewhere that led to foreseeable harm and

    injury to Amethyst.

    6. Samsung OEA has established minimum contacts within the forum such that the

    exercise of jurisdiction over Samsung OEA will not offend traditional notions of fair play and

    substantial justice. Moreover, Samsung OEA has placed products that, when combined with

    other products, practice the claimed inventions of the 901 patent into the stream of commerce

    with the reasonable expectation and/or knowledge that purchasers and users of such products

    were located within this District. And Samsung OEA has sold, advertised, marketed, and

    distributed products in this District that, when combined with other products, practice the

    claimed inventions of the 901 patent.

    7. Venue is proper in this judicial district pursuant to 28 U.S.C. 1391 and

    1400(b).

    The 901 patent

    8. On September 16, 2008, the 901 patent, titled Baby Monitoring System With

    Recording Capability was duly and legally issued by the United States Patent and Trademark

    Office. Amethyst is the assignee of all rights, title, and interest in the 901 patent, and it

    possesses all rights to sue and recover for any current or past infringement of the 901 patent.

    Infringement of U.S. Patent No. 7,425,901

    9. Paragraphs 1-8 are incorporated by reference as if fully restated herein.

    10. Samsung OEA has infringed, and continues to infringe, the 901 patent.

    11. Samsung OEA indirectly infringed, and continues to indirectly infringe, the 901

    patent under 35 U.S.C. 271(b) or (c), either literally and/or under the doctrine of equivalents,

    by making, using, offering for sale, selling, and/or importing into the United States camera

    products as claimed in the 901 patent including at least the SecureVIEW Baby Monitor Model

    SEW-3035 (Camera Products), along with a MicroSD memory card (Memory Product, and

    together with the Camera Products, the 901 Infringing Products).

    12. On information and belief, Samsung OEA's customers, resellers and distributors

    directly infringe the 901 patent under 35 U.S.C. 271(a), either literally and/or under the

    doctrine of equivalents by making, using, selling, and/or offering for sale the 901 Infringing

    Products in the United States. Further, to the extent that Samsung OEA itself uses Camera

    Products with Memory Products in the United States, Samsung OEA directly infringes the 901

    patent under 35 U.S.C. 271(a), either literally and/or under the doctrine of equivalents.

    13. On information and belief, Samsung OEA actively, knowingly and intentionally

    (from at least the date of the service of this Complaint) induces infringement of the 901 patent

    under 35 U.S.C. 271(b) by making, using, offering for sale, and selling Camera Products, as

    well as by contracting with others to use, market, sell, and offer to sell Camera Products.

    14. On information and belief, Samsung OEA has also contributed to the

    infringement by others (e.g., Samsung OEA's customers and the users of 901 Infringing

    Products), and continues to contribute to infringement by others under 35 U.S.C. 271(c), by

    selling, offering to sell, or importing Camera Products into the United States, knowing (from at

    least the date of the service of this Complaint) that those systems constitute a material part of the

    inventions of 901 Infringing Products, knowing (from at least the date of the service of this

    Complaint) those systems to be especially made or adapted to infringe the 901 patent, and

    knowing (from at least the date of the service of this Complaint) that those systems are not staple

    articles or commodities of commerce suitable for substantial noninfringing use.

    15. By way of example, the Samsung OEA User Manual that ships with the SEW-

    3035 instructs customers to install a MicroSD card to enable the recording functionality of the

    SEW-3035. A copy of this User Manual is attached as Exhibit B.

    16. Amethyst has been and continues to be damaged by Samsung OEA's infringement

    of the 901 patent.

    Prayer For Relief

    Wherefore, Plaintiff Amethyst respectfully requests that this Court enter judgment

    against Samsung OEA as follows:

    a) adjudging that Samsung OEA has infringed, induced infringement of, and/or

    contributory infringed, literally or under the doctrine of equivalents, U.S. Patent No. 7,425,901;

    b) adjudging that Samsung OEA's infringement has been willful;

    c) awarding Amethyst the damages to which it is entitled under 35

    U.S.C. 284 for Samsung OEA's past infringement and any continuing or future infringement up

    until the date Samsung OEA is finally and permanently enjoined from further infringement,

    including both compensatory damages and enhanced/treble damages for willful infringement,

    and ordering a full accounting of same;

    d) finding that this case is exceptional under 35 U.S.C. 285;

    e) ordering injunctive relief under 35 U.S.C. 283;

    f) awarding Amethyst pre-judgment and post-judgment interest on its damages; and

    g) awarding Amethyst such other and further relief in law or equity that

    the Court deems just and proper.

    Amethyst hereby demands a trial by jury on all claims and issues so triable.

    To prevent overheating, keep the product and AC power adapters away from any directsunlight and heat sources such as radiators, heat registers, cooking devices (e.g., stovesand ovens) and other appliances that produce heat (e.g., amplifiers, televisions andstereos).

    Ensure that the product is well ventilated during use. Avoid contact with pillows andfurniture that may block ventilation.

    Use only the AC adapters provided with the product, as other adapters may damage theproduct. Plug the adapters only into standard household current (120 volts AC).Place the AC adapters avoiding pinch points otherwise you can damage the adapters.

    When an AC adapter is plugged into a power source, DO NOT touch the exposed end of

    the AC adapters cord.Do not use extension cords with the AC power adapters to avoid entanglement.

    Getting to know your Monitoring system

    Wireless Receiver

    After opening the box, fully charge the monitor before use. After initial charge, recharge as needed.

    Front Controls

    Navigation Controls / Button

    Viewing Mode: The following controls are used while watching live video from the camera:

    Press the [+] or [] keys to increase or decrease the volume.

    Press the [A] key to view cameras in automatic switching mode.

    Press the [M] key to manually switch between cameras.

    Menu Mode: Use the [+//A/M] key arrows to navigate in Menu Mode.Press the [ ] button to confirm the menu selection.

    Receiver AntennaReceives and sends signals from or to the camera.

    3.5 LCD Screen

    Displays video from the camera.

    Microphone

    Transmits audio to the camera when Talk Button ispressed down and held like a walkie talkie.

    Wireless Camera

    Front & Back Controls

    The camera can also be powered using 3 AA batteries (not included) installed in the base. If the camera is plugged in with the AC adapter, the batteries will not be used.

    The batteries are intended for short term, portable camera use.

    Remotely control Night Light ON or OFF is available only when the camera is paired to the receiver.

    The IR indicator will be activated in a low contrast scene and cause an increase of the temperature, which may affect the temperature sensor.

    Sound Alarm Trigger

    Adjust the sensitivity knob to set the sound alarm

    sensitivity.The receiver will beep to alert you when the sound is

    above a preset sound level.Adjust to increase or decrease the level of sensitivity.

    Camera ON/OFF Switch

    Turns the camera ON or OFF.

    Camera on and low battery indication

    Turn on the camera, the LED light will blink green onc

    Low battery, the LED will blink repeatedly.When the camera is turned on, the LED light wouldappear green. After 2 seconds, it goes out.

    Night vision sensor

    Detects light levels where the camera is placed.

    To Use The Battery Mode

    You can use the battery to power the camera if its distant from the power source or ifyou want to carry the camera.

    This camera has built-in IR LEDs, which provides the camera with the ability to view

    images in no/low light conditions. It is important to use the provided power adapter (and

    not the batteries) when using the camera for prolonged periods in low light conditions,

    as the built-in IR LEDs will deplete the battery more quickly than regular daytime use.

    Remove the battery cover from the base of the camera.

    Insert 3 AA batteries (not included) into the Battery Pack. Make sure to correctlyline up the Positive (+) and negative (-) terminals of the batteries.

    Replace the battery pack cover.When the battery level is low and requires recharging, the LED light will blinkintermittently.

    When using the system with only battery power and the charge is low, then the pictureand or sound may affected.

    How to InstallCaution if you use the system to watch a young child, do not place the camera where thechild can reach.

    Wireless Receiver

    Place the receiver in a place that will have clear reception with your camera(s).

    Pull out the stand.

    Do not pull up the stand lever with an excessive force. Otherwise, it may be broken.

    Wireless Camera

    Before you install the camera, carefully plan where and how it will be positioned, andwhere you will route the cable that connects the camera to the power adapter.Before starting permanent installation, verify its performance by observing the imageon the receiver when camera is positioned in the same location/position where it willbe permanently installed and the receiver is placed in the location where it will be usedmost of the time.

    Installation WarningsAim the camera(s) to best optimize the viewing area: Select a location for the camerathat provides a clear view of the area you want to monitor, which is free from dust, andis not in line-of-sight to a strong light source or direct sunlight.

    Avoid installing the camera where there are thick walls or obstructions between thecamera and the receiver.

    Carefully unpack the camera.

    If you are installing cameras that did not come with the system, please seepairing camera section of this manual for details on installation.

    Mount the camera to the wall.

    Mark the position of the screw holes on the wall,and drill holes and insert 2 screws, then firmlyattach the camera to the wall by placing thestand over the installed screws and pushing thebase downwards.

    The camera can also be placed on a flat surface,such as a table or shelf, and no mounting

    hardware is required.

    Adjust the viewing angle of the camera

    You can install additional cameras (maximum of 4 cameras).

    When adding cameras that were not included in the original box, you will need t

    the cameras with the receiver.

    For paring to add a camera, refer to Pairing. (Page 12)

    How it works in viewing mode

    If you want to view the childs scene (on the camera display) on a larger screenas TV or computer monitor, use the provided AV cable to connect the wireless with the TV.

    Wireless Receiver

    Signal Indicator

    The signal indicator shows the strength of the signal being received from thecamera. The number of bars in the signal indicator shows the strength of thesignal One or no bars indicate the signal is poor, and 4 bars indicate a strongsignal.

    Camera Number

    Indicates the number of camera that is displayed on the current screen. Pressthe [M] key on the receiver to switch between available cameras.

    To automatically switch between channels, press the [A] key (AUTO).

    Pairing

    You can register a wireless camera with the receiver using the registration menuwhere you can view the video of the selected wireless camera.Pairing The system comes with a camera that has already been paired with thereceiver unit.

    The pairing function assigns the camera to a channel on the wireless receiver.Up to 4 Cameras (each additional camera sold separately) may be paired, whicheach optional camera on its own channel.If additional cameras are paired, they must each be configured separately.

    It is highly recommended to pair the cameras to the receiver before permanentlymounting the cameras. See the pairing section on this manual for details.n
