Message from the Alumni Relations Director

Dr Tan Seow HonAssociate Professor of LawAssociate Dean, Student, Alumni & Staff AffairsDirector, Alumni Relations

A very happy new year to all our alumni! Hope that as the last year drew to a close, you had a good time of reflection and this message finds you still keeping any meaningful new year resolutions you made. Last semester was an eventful one with the change of deanery at the School of Law, the launch of the new premises of the SMU Pro Bono Centre, the BBQ reunion for all alumni on the roof terraces of the School in celebration of the School’s tenth anniversary, and the launch of an online law student publication, Lexicon. At the start of his new term, Dean Goh Yihan led town halls for alumni and for students, to gather feedback about matters such as school identity, student life, and the curriculum, as we continue to shape the future of our young school and our graduates. The town halls were in addition to a survey of our students that we conducted in relation to the curriculum. Indeed, we’d be having more town halls for alumni and students. We were very encouraged that so many of our alumni came back on a weekday evening after a hard day at work for the previous town hall, and hope that many of you can join us at the next town hall on March 1. Thanks also to many of you who signed up as mentors under the SMU Alumni Mentoring Programme. Our students will benefit much from your kind friendship. We hope that more of you will arise in this manner, and we look forward to organizing more events for alumni-

students interaction and guidance soon. As many of you know, we have four alumni groups for our LLB, JD, LLM, and international moots alumni. Each group was started at a different time as the school started the different degree programmes and as our international moots programme flourished under the able leadership of Assistant Professor Chen Siyuan. We will be consolidating these groups under a School of Law Alumni Chapter, with the groups remaining autonomous under the chapter. More, in our next newsletter! Wishing you all the very best for 2018!

9 & 10 november 2017 — sePs, ssOs and FrAnD – Fostering innovation in interconnectivity: Asian and Global Perspectives

Hosted at the School of Law on November 9-10, 2017, the conference probed the factual scenario, and concern areas, associated with the practice of standards setting in connection with standard essential patents (‘SEPs’) and standards setting organizations (‘SEPs’). The focus of the conference was on the Asian experiences with FRAND (Fair Reasonable and Non-Discriminatory) with SEPs, and to assess if Asian experiences

could contribute to the issues impinging upon the use of SEPs and innovation. Hence, apart from presenters from the Asian region, the conference also featured an eminent group of speakers from other countries such as the USA, the UK, and Germany, to enable a comparative evaluation of possible solutions for the interconnected world of smart phones, ICT, internet of things etc. The conference adopted a fact finding, and case study

method, to analyze and study the overarching subject area, through an amalgam of industry experts, legal academicians, judge and economists. The result of the conference will culminate in a book co-edited by Profs. Kung-Chung Liu (director of ARCIALA) and Reto Hiltyby (director pf the German max Planck Institute for Innovation and Competition) and co-published by the two institutions in 2018.

8 December 2017 - the Future of Asian trade Deals and iP

Hosted at the School of Law on December 8, 2017, as the first ever large-scale dialogue between IP academics and international economic law scholars, the primary objective of the conference was to analyze the current and ideal development of trade deals in the Asian region, and to examine the proposed IP provisions of the two most important trade

deals, namely the Regional Comprehensive Economic Partnership (‘RCEP’) and the Comprehensive and Progressive Trans-Pacific Partnership (‘CPTPP’). Related discussion areas include the issue related to the interplay between RCEP and CPTTP, investor-state dispute settlement (ISDS), the judicialization of ISDS in Singapore, and concerns raised

by compulsory licenses of IP as expropriation. The conference featured a diverse array of academicians from the greater Asian region. The result of the conference will culminate in a book to be edited by Prof. Kung-Chung Liu (director of ARCIALA) and published by the renown Hart publishing company in 2018.

18 & 19 December 2017 - innovation, economic Development and iP, in india and China

Hosted at Renmin University of China, Beijing on December 18-19, 2017 the conference was a joint collaboration between ARCIALA, Renmin University, Jindal Global University, India, and the Max Planck Institute for Innovation and Competition, Germany.

As the title of the conference suggests, the conference was to examine and discuss the three interrelated aspects of innovation, the state of economic development, and the intellectual

property frameworks, in India and China- two countries that in some ways make the perfect compare and contrast pair. The conference was structured in seven panels for the findings of seven specific study groups to be presented and discussed. These study groups were, ‘IP policy and codification and state innovation’, ‘film industry’, ‘pharmaceutical industry’, ‘automobile industry’, ‘plant varieties and food security’, ‘IT industry’, ‘peer production and sharing economy’. Each study group comprised a team

of experts from India, and China, representing both law and economics. The speakers from each study group shared their findings on the development of the concerned industry in their respective countries, including on the variegated issues and concerns that continue to plague the industry in their country. The result of the conference will be crystalized in a book to be edited by Prof. Kung-Chung Liu (director of ARCIALA) and published by the renown Springer as one of ARCIALA’s IP Series.

“I am absolutely delighted (and relieved!) at having completed my PhD over Michaelmas 2017. My supervisor Martin Dixon’s forbearance allowed me to utilise a cross-disciplinary approach, and my thesis cuts across planning and property law, as well as law and economics. I am especially grateful to my academic mentor Tang Hang Wu, past and present deans Yeo Tiong Min and Goh Yihan, as well

as the law school’s general office staff for supporting me in their various ways during my studies. Having benefited from the excellent pastoral environment in Cambridge that facilitated my thinking and writing, I hope to inspire this love of learning in my law and business school students in the coming years.”

“I’ve been having a fantastic time at HLS. It’s quite awe-inspiring to realise that the classrooms I inhabit now may have been the very same ones where Lon Fuller once taught jurisprudence and where countless US Supreme Court Justices first learnt the ropes of their trade. The entire institution is brimming with intellectual vibrancy and energy, and my classmates all seem to have fascinating backgrounds.

I’ve had the opportunity to take all sorts of interesting classes as well. In particular, I considered it a real privilege to have been able to take a class with Professor Robert P. George, one of the leading legal theorists in the country whose work I have always admired.”

occasional display of culinary skills (such as with treats from ‘Pearlie’s Kitchen’), these gatherings would hopefully provide academics who spend a lot of time on independent research with a welcome respite!

SMU School of Law graduates Wilbur Lim (LLB ’12) and Mark Lee (LLB ’12) started their law firm WMH Law Corporation, with the aim of marrying both the provision of quality legal service and putting greater emphasis on giving back to the community through pro bono or corporate social responsibility initiatives.

“At WMH, we feel that the disadvantaged very often get shunned (rightly or wrongly) by the community. Be that as it may, we firmly believe that everyone

deserves to have their day in Court,” said Mr Lee, Managing Director at WMH.

The firm joined the Criminal Legal Aid Scheme (CLAS) shortly after it commenced practice in November 2016. The Law Society’s CLAS is a programme which provides criminal legal assistance to those who are unable to afford a lawyer, and are facing charges in a Singapore court for non-death penalty offences. The firm is also participating in outreach

programmes such as Justice Without Borders, a not-for-profit organisation that supports victims of labour exploitation and human trafficking, as well as giving talks to the community to make legal advice accessible to the masses. In addition, Mr Lee and his team from WMH regularly volunteer at legal clinics organised by the Community Justice Centre in Singapore.

The LLM program naturally brings together law students and lawyers from around the world creating an international learning environment that is incredibly enriching for all of us. Our Alumni OverseAs

Greetings from a snowy New York City! Some six years after graduating from SMU, Ruth and I are students once again, this time at Columbia University. We’re pursuing our postgraduate degrees in law and public administration respectively. Student life this time around could not be more different, as we juggle between work, study and our spirited one-year old boy, Zachary. The Columbia experience has been very rewarding thus far. We have the privilege of learning from esteemed faculty and interacting with students from all over the world. Our prior work experiences are also very useful, as we view new ideas and concepts through more ‘experienced’ lenses.

While there is always so much to see, eat and do in the city itself, it has also been great fun trying to replicate the dishes that we quickly come to miss from home, and having friends over as our guinea pigs for our home-cooked food (and vice versa). It certainly helps that my wife Huey Hien is here to share in with these experiences (she has unlocked a previously hidden talent for cooking and baking). I enjoyed my time as an undergraduate at SMU and had missed the intellectual rigour of our seminars, and was excited that I now had another opportunity to be a student again. Of all the modules I am currently undertaking, I particularly enjoy my Unjust Enrichment classes, largely because it is still a relatively young and burgeoning area of law and the rigours of the discussions led by Professor Charles Mitchell.

These are exciting times in the UK, what with the shadow of BREXIT looming over all areas of the law – from constitutional law issues such as the limits to the executive prerogative in triggering Article 50, to conflicts of law problems that will arise following the UK’s departure from the European Union and the potential jettisoning of the entire Brussels I system. It has therefore been a privilege to explore these uncharted territories with some of the brightest legal minds in the world. It has also been a particular honour to be studying the works and thinking of Jeremy Bentham in UCL, the home of the Bentham project.

AlsA moot — After 5 rounds of competition, Jolyn Khoo, Darren Ng, R Saravanan, Claudia Tan, and Jonathan Tan have emerged as champions of the latest edition of the Asian Law Students’ Association Moot. This year’s moot was based on investment arbitration and saw around 30 teams participating, with the top half qualifying for the international rounds in Kuala Lumpur. This is SMU’s second win in this competition and brings a fitting end to SMU’s 2016/17 moot season — with 5 international championships won in 6 finals this season.

lawasia — After 9 rounds of competition, the Lawasia moot team comprising Andrew Chia, Claire Lim, and Wayne Yeo emerged as champions of the competition. The moot this year saw a total turnout of 37 teams, with 16 gathered in Tokyo for the international rounds. SMU qualified for the knockouts as one of the top seeds in a field that comprised universities with strong mooting traditions such as West Bengal, Jodhpur, and NUS. It then won all of its matches en route to its 7th championship final appearance in this moot (extending its tournament record) and 4th title (also extending its tournament record). SMU also won Best Memorials, matching the double it won last year, and also like last year, SMU won 1st-runner-up for Best Oralist (Wayne).

This win is the third for coach Nanthini Vijayakumar (LLB ’15), who had won the moot as a student in 2013 and as a coach in 2016. As was the case last year, she co-coached this year’s team with Qabir Sandhu (LLB ’15).

AG Cup — The Attorney-General’s Cup final was held at the SMU David Marshall Moot Court for the first time. The judges were Deputy Attorney-General Hri Kumar SC and Judicial Commissioners Aedit Abdullah and Hoo Sheau Peng. The spoils were divided, with SMU winning Best Finals Oralist (Audrey Choo, who partnered Theodore Toh) and Best Memorial (Dana Lim and Russell Hong) and NUS winning the cup.

Bar Day and Prof Appreciation Day

Students at Bar Day

Bar Day was held in conjunction with Prof Appreciation Day this year on 8 September 2017. Bar Day has traditionally been an annual event for the purpose of enabling students and faculty to bond with each other across all levels. Those who have helped out in summer events such as Law Camp, Graduation Night and Law Night were also presented prizes as a form of appreciation

during Bar Day.

Prof Appreciation Day is an annual event that bridges the gap between the student body and the faculty — students show their appreciation for their favourite professors. The categories of prizes that we had this year included the Funniest Professor, the Most Charismatic Professor, the Most Popular Professor, the

Most Entertaining Professor and the Most Caring Professor. Students were sent voting links in their email and prizes were awarded to the professors during Bar Day.

welfare Drives

The Bar kicked off our annual welfare drives with the Tan Kok Quan Partnership Welfare Drive, during which students were treated, amongst other things, to traditional ice cream from an

ice cream uncle. The second welfare drive was on I.S.A.B.E.L. Day, which commemorates the different schools in SMU. The Bar prepared nostalgic snacks, donuts, and stationery for law

students. Finally, at the Rajah and Tann Welfare Drive, students enjoyed a sumptuous buffet and door gifts.

Students were treated to a movie marathon which included Inception, Conjuring, Finding Dory, Me Before You, and 21 Jump Street during the 10th Anniversary Movie Night, the last

installation in our celebration of the School’s 10th Anniversary. The event also gave students the opportunity to relax before preparation for our finals.

the Bar’s mentorship Programme

The 10th Management Committee of the bar continued with the mentorship programme initiated by the 9th Management Committee. Freshmen were assigned mentors from the second

or third year of law school, who were advised to meet up monthly with their mentees and provide advice on matters such as bidding for courses, CCAs, or study tips. The initiative was well-received

this year, with an increase from 10 mentors and 30 mentees to 48 mentors and 88 mentees. The Bar hopes to explore developing the programme in future years.

events by the Pro-Acad team

The Pro-Acad team organised the annual Rajah & Tann Dialogue Session, a career-sharing event for the Singapore Police Force, as well as an event for the Asia Bar Review regarding legal practice in the States.

In addition, the Pro-Acad team also hosted Mr Justin Swinsick, Director of Graduate Admissions at Georgetown University Law Center, on a tour around the School during his visit to Singapore.
