Property Damage and Loss of RentThere is a choice of cover for your buildings, contents orrent – All Risks or Specified Events

All Risks includes:• Fire, Lightning, Explosion

• Aircraft

• Riot and Civil Commotion or Malicious Persons

• Earthquake

• Subterranean Fire

• Storm or Flood

• Escape of Water from any tank, apparatus or pipe

• Escape of oil from any fixed heating installation

• Sprinkler Leakage

• Impact by any road vehicle or animal

• Theft

• Accidental Damage

• Subsidence

Specified Events – you can select the specific cover yourequire from all of the above. Cover availability will dependon the territory.

Territorial LimitsCover will be restricted to Defined Territories as specified inthe policy documentation.

Property DamageExtensions automatically included:• Day One Reinstatement

An automatic increase of 30% will be added to theDeclared Value to allow for inflation during the periodof insurance. The Declared Value is the cost ofrebuilding or replacing the property on the first day ofthe period of insurance.

• Automatic ReinstatementSums insured will not be reduced by the amount of anyclaim unless we advise you otherwise. This extensionwill be subject to payment of an additional premium inthe event of a claim, and we may require you toimplement risk reduction measures.

• European Union & Public Authorities (and UndamagedPortions)Cover includes the cost of complying with EuropeanUnion & Public Authorities requirements. Including thecosts relating to undamaged portions of the buildingssubject to a 15% limit.

• Removal of DebrisCover includes the necessary and reasonable costs ofremoving debris following a loss, including the cost ofcleaning, clearing or repairing of drains, sewers gutters.

• Professional FeesCover includes the cost of architect’s, surveyor’s,managing agent’s, legal and consulting engineer’sprofessional fees incurred following a loss.

• Index LinkingThe sum insured in respect of property within the UKwill be adjusted to take into account inflation, and willbe automatically increased at each renewal date.

• Capital AdditionsAlterations, additions and improvements to existingpremises within the EU up to £5M for premisesoccupied as offices, retail or for residential purposes,£2M for all other premises.

• Newly Acquired BuildingsNewly acquired properties within the EU up to £5M forpremises occupied as offices, retail or for residentialpurposes, £1M for unoccupied premises and £2M for allother premises.

• Inadvertent Omission to insureProvides cover for properties within the EU which havebeen inadvertently left uninsured up to £5M forpremises occupied as offices, retail or for residentialpurposes, £1M for unoccupied premises and £2M for allother premises.

• Theft Damage to BuildingsCover for damage to occupied buildings within the EU bytheft. An excess, normally £500, will apply to this cover.

• Leased and Rented PremisesWhere a tenant or lessee or other occupier is obligated tomaintain insurance on a building by virtue of thewording of a lease and inadvertently fails to do so, thisextension indemnifies the property owner for suchproperty within the EU. Cover is provided up to a limit of£2M for premises occupied as offices, retail or forresidential purposes, up to £500,000 for unoccupiedpremises or those undergoing or awaiting refurbishmentor redevelopment, and up to £1M for all other premises.

• Value Added TaxCover extends to include for Value Added Tax (VAT)liability for rebuilding costs where VAT has not beenincluded in the sum insured and which you cannotrecover. You must ensure that, all reasonableprecautions have been taken to insure adequately forVAT. The extension also amends the basis of settlementso that the provisions of any underinsurance conditionswill not apply solely due to a failure to include VAT inthe sums insured.

• Privity of ContractLessees who sell buildings within the UK are stillobligated to ensure that they are insured by applicationof the law of privity arising under the Landlord andTenant (Covenant) Act 1995. Cover extends to includelegal liability to insure, repair or reinstate damage tothe buildings or premises where such properties are leftuninsured by their new owners, up to a limit of £2M inrespect of any one premises.

• Residential Property – Rent and AlternativeAccommodation The cost of providing alternative accommodation forresidential portions of the premises, and 24 months lossof rent. Cover is provided up to 20% of the sum insuredof the premises or portion of premises damaged.

• Removal of debris – TenantsCover extends to include irrecoverable costs inremoving debris of tenant’s contents following damageup to an amount of £5,000.

• Locks and KeysThe cost of replacing locks or keys following theft up toan amount of £5,000.

• Landscaped groundsDamage to landscaped grounds as a consequence ofdamage to the property insured.

• Metered SuppliesLoss of water, gas, electricity or other supply charges upto an amount of £50,000.

• Unauthorised use of SuppliesThe unauthorised use of electricity, gas, water or othermetered supplies is covered up to an amount of£50,000.

• Trace and AccessCosts incurred in tracing the source of damage to waterpipes and underground services belonging to theproperty up to an amount of £50,000.

• Tree felling and loppingThe cost of felling or lopping trees which are animmediate threat to life or damage to the property upto an amount of £10,000.

• Removal of wasps and bees nestsCost of removing wasp nests or bees nests up to anamount of £500.

• Contractors InterestWe agree to note the interest of any contractor or subcontractor subject to any contracts valued at £250,000or above being advised to us prior to thecommencement of work.

• Contract WorksCover for Buildings and Contents of any permanent ortemporary works undertaken as part of a Contractwhich you are responsible under the terms of theContact up to an amount of £250,000 any one Contract.

• Loss Minimisation and Prevention ExpenditureCover for costs and expenses incurred with our consentin preventing or reducing imminent damage whichwould have been insured, or reducing mitigating orotherwise alleviating damage during and after it hasoccurred. Cover is provided up to an amount of £5,000and is subject to an excess of 10% of the sum insured or£350 whichever is the greater.

• Contracting Purchaser’s InterestCover for buildings in the period between exchange ofcontract and completion.

• Fire Extinguishers and SprinklersCost of refilling, recharging or resetting risk protectionequipment up to £50,000.

• Sprinkler Installations Upgrading CostsCovers the increased costs of reinstating sprinklersystems within the UK to the latest regulations ifrequired by us, up to 20% of the sum insured of thepremises damaged.

• Further Investigation ExpensesCosts incurred with our consent when checking forfurther damage where there is a possibility of damagethat is not immediately apparent. Cover is provided upto an amount of £5,000 in respect of any one claim.

• Continuing Interest and Hire ChargesExtends cover following damage to include interest orcontinuing hire charges where the Insured are liableunder contract and these are not recoverable under theterms of a lease or similar agreement. Cover is subjectto a limit of £10,000 any one claim and in total in anyone period of insurance.

• Gardening EquipmentCover extends to include damage to Landlord’sgardening equipment at the premises, up to a limit of£10,000 any one claim.

• Fly Tipping Cover extends to include costs necessarily andreasonably incurred in clearing and removing anyproperty illegally deposited in, on or around thepremises. Cover is subject to a limit of £10,000 any oneclaim and £25,000 in total any one period of insurancefor all claims. An excess of £500 applies unless a higheramount is shown in the schedule.

• Exhibitions and Models Cover extends to include exhibition or display modelsand similar promotional equipment whilst being usedor stored within any premises insured which havesuffered damage. A limit of £25,000 applies to any oneclaim and in total in the period of insurance.

• Damage following TheftShould buildings not be insured under this Section, wewill pay the costs which you are responsible for torepair damage caused as a result of theft or attemptedtheft.

InformationExcessAn excess (the first part of your claim) will apply – pleaserefer to your policy documents for details.

Loss of RentDeclaration Linked Cover OptionYou have the option to select this alternative basis ofsettlement. You will be required to provide an estimatedsum insured at the inception of cover, and declarations ofthe actual rent received annually. Provided thatdeclarations are received as required, the Underinsurancecondition will not apply.

Territorial LimitsCover and Extensions to Cover will be restricted to DefinedTerritories as specified in the policy documentation.

Extensions automatically included:• Rent Reviews

Increases in rental income following a rent review isprovided, subject to a maximum of 200% of the totalsum insured for rent.

• Capital AdditionsAlterations, additions and improvements to existingpremises within the EU up to £3M for premisesoccupied as offices, retail or for residential purposes,£1M for all other premises, other than for unoccupiedpremises where a limit of £250,000 applies.

• Newly Acquired BuildingsNewly acquired buildings within the EU up to £3M forpremises occupied as offices, retail or for residentialpurposes, £250,000 for unoccupied premises and £1Mfor all other premises.

• Inadvertent Omission to insureProvides cover for where properties within the EU whichhave been inadvertently left uninsured up to £3M forpremises occupied as offices, retail or for residentialpurposes, £250,000 for unoccupied premises and £1Mfor all other premises.

• Automatic ReinstatementSums insured will not be reduced by the amount of anyclaim unless we advise you otherwise. Cover is subjectto payment of an additional premium in the event of aclaim, and we may require you to implement riskreduction measures.

• Professional Accountant’s & Legal FeesCover includes accountant’s fees incurred by you inproducing information specifically required by us in theevent of a claim. Cover also includes the reasonablecharges payable by you with our consent to yourlawyers for determining your contractual rights underany rent cessor clause or insurance break clausecontained in the lease.

• Re-letting costsWhere you lose an existing or prospective tenantfollowing insured damage, cover extends to include theadditional costs of re-letting the premises.

• Relocation of TenantsExtends cover where a tenant is relocated to emptypremises so that any resultant claim for rent will not bereduced provided that the buildings are insured underthe Property Damage Section of the policy.

• Service Charges and Other ChargesCover extends to include service charges and otherincome for the use of the services provided and for carparking facilities, and insurance premiums where thereis a cessor clause in the lease which enables the lesseeto cease paying premiums in the event of damage.

• Buildings Awaiting SaleExtends the basis of settlement where you havecontracted to sell your interest in the premises oraccepted an offer to purchase your interest in thepremises and the sale is cancelled or delayed inconsequence of damage. You may opt for the amountpayable by us to be in respect of loss of rent or loss ofinterest incurred on capital borrowed or investmentinterest lost to you on any balance of the sale proceedsplus additional expenditure incurred to avoid orminimise the loss payable and the additional legal feesand other expenditure incurred. Cover is subject to ourliability being limited in any one period of insurance to10% of the rent sum insured or £100,000 whichever isthe lower, unless we have agreed otherwise.

• Loss of Investment Income on Late Payment of RentIf our payment to you is made later than the date uponwhich you would normally have expected to receiverent from a lessee. In these circumstances we will pay afurther sum representing the investment interest lost.

• Rent Free PeriodStandard cover extends to reflect the existence of a rentfree period agreement. At your option the indemnityperiod may be increased to reflect the unexpired rentfree period, provided that you have made allowance forthe actual future rent in the sums insured.

• Denial of AccessLoss of income due to damage to a nearby propertywhich prevents tenants gaining access to the premises.

• Denial of Access Non DamageCover extends to include access to the premises or anyproperty or rights of way in the immediate vicinity ofthe premises being hindered or prevented as a result ofthe actions or advice of the Government, a LocalAuthority or other statutory body due to an emergencyarising which is likely to endanger life or property.Cover is subject to a number of exclusions andconditions – please refer to the policy wording fordetails. A limit of £50,000 applies and cover does notapply for the first four hours of interference with theuse of the premises. The Maximum Indemnity Periodfor this cover is 3 months.

• Supply UndertakingsCover extends to include damage to the land basedlocations which supply the premises with electricity,gas, water or telecommunications services. Damage tocables, pipes or pylons to the terminal connecting pointat the premises is also included, but this element ofcover will exclude damage to any overheadtransmission or distributing lines or their supportingstructures located over one mile from the premises.

• Failure of SupplyCover extends to include interruption of or interferenceresulting from the accidental failure of supply ofelectricity, gas, water, and telecommunications services.Cover is subject to a number of exclusions andconditions – please refer to the policy wording fordetails. Cover will exclude damage to any overheadtransmission or distributing lines or their supportingstructures located over one mile from the premises.Cover also does not apply for the first 4 hours ofinterference, increased to 12 hours fortelecommunications services, which is also limited to aMaximum Indemnity Period of 3 months. A limit of £1Mor 10% of the sum insured whichever is the less applies.

• Loss of Attraction - Leased premisesCover extends to include damage to buildings or otherproperty at any location in the immediate vicinity of thepremises which results in a fall in the number ofcustomers visiting the area and which in turn leads tothe lessee’s business being affected and the rentreceivable by you reduced. Cover excludes obstructionof roads, streets etc. by weather or climatic conditions.A limit of 10% of the sum insured or £500,000 whicheveris the less applies.

• Loss of Attraction - Unleased Premises Cover extends to include damage to buildings or otherproperty at any location in the immediate vicinity of thepremises which results in the termination and orrenegotiation of any agreements for lease and or otherloss of tenancy and or delay in completion or letting ofthe premises. Cover excludes obstruction of roads,streets etc. by weather or climatic conditions. A limit of£100,000 or 10% of the sum insured whichever is theless, and the Maximum Indemnity Period for this coveris 3 months.

• Managing Agents PremisesCover is provided if there is interruption or interferenceto the business as a result of property damage at thepremises of the managing agent. Limit 10% of the suminsured or £500,000 whichever is the less.

• Exhibition SitesCover extends to include any exhibition site within theEU where you are exhibiting goods or services. Coverexcludes exhibition sites under canvas or in the open,and a limit of £25,000 applies.

• Book DebtsCover is provided for outstanding debit balances thatcannot be collected because the records have beendamaged or destroyed at premises within the EU. Limit £25,000.

InformationProperty Damage & Loss of RentCover ExclusionsTo reflect the international scope of cover some specificexclusions apply to the Property Damage and Loss of rentSections, in addition to those normally found under astandard UK wording

• Damage to land, roads, pavements, piers, jetties,bridges, dams, dykes, culverts or excavations,underground mines, caverns, tunnels, offshore propertyoverhead transmission and distribution lines orsupporting structures other than on the Insured’spremises

• Damage to property in the Netherlands and/or Belgiumcaused by flood inundation from the ocean or sea or thefailure or overflowing of water retaining structures orsimilar works

• Damage to property caused by “sturmflut” Insuredsituate in Schleswig-Holstein, Niedersachsen,Mecklenburg-Vorpommern, Bremen and Hamburg, in Germany.

• Damage to property situate in France from a peril orevent as defined in the French Law Article No. 82-600 of13th July 1982 or by act of terrorism as defined inarticles L 421-1 and L 421-2 of the French Penal Code

• Damage to property situate in Spain resulting from aperil or event which has been declared a “CalamidadNacional” by the Spanish government or resulting fromdamage covered by the State compensation scheme“Consoricio de Compensation de Seguros”

• Damage to property in Norway or Sweden resultingfrom hydroelectric dam breakthrough

• Loss or damage covered by any voluntary orcompulsory government scheme, official obligatorypool or natural catastrophe insurance scheme, orsimilar pool or scheme

• Loss or damage caused by confiscation, requisition,nationalisation, seizure, detention or destruction byany government de jure or de facto or public municipallocal or customs authority or dispossession of anybuilding resulting from unlawful occupation

• Loss or damage arising in respect of tenants liability,neighbours liability or tenants claims against thelandlord in any country which is subject to theNapoleonic Civil Code

• Fines penalties or costs imposed at the order of anygovernment agency court or other authority inconnection with any environmental seepage pollutionor contamination

• Loss or damage to property arising from war, invasion,act of foreign enemy, hostilities, or warlike operations,civil war, mutiny, civil commotion assuming theproportions or amounting to a popular rising, militaryrising, insurrection, rebellion, revolution, military orusurped power, martial law or state of siege or anyaction taken in controlling preventing suppressing or inany way relating to such events

Terrorism Cover Covers under these sections exclude any loss resultingfrom an act of Terrorism.

Cover can be extended to provide Terrorism cover withinthe UK for an additional premium. For further informationor if you require such cover, please contact you insuranceadviser.

Property Owners Liability SectionProvides cover in respect of all sums which you becomelegally liable to pay as compensation to third parties foraccidental injury or damage.

Territorial Limits

Cover will be restricted to Defined Territories as specified inthe policy documentation.

Cover automatically includes:• Limit of Indemnity

A limit of £2M is provided as standard, higher limits ofindemnity are available on request.

• Data Protection ActSums which you become legally liable to pay ascompensation under the 1998 Act.

• Defective Premises Act 1972Legal liability arising out of any premises or landdisposed of by you.

• Consumer Protection and Food Safety Acts –Legal Defence CostsLegal costs and expenses in connection with thedefence of any criminal proceedings brought againstyou under: Consumer Protection Act 1987 and the FoodSafety Act 1990.

• Court Attendance CostsCovers attendance as a witness in connection with aclaim. Compensation for each day of attendance:Director/partner £500Employee £250

• Contractual LiabilityLiability arising from your contractual obligations.

• Legionellosis LiabilityCover is extended to include pollution orcontamination arising from Legionella within the EUsubject to a limit of £5M, or the amount stated in thepolicy schedule whichever is the lower.

• Corporate Manslaughter and Homicide Cover extends to include legal costs and expensesincurred with our consent and costs of the prosecutionawarded against you in connection with the defence ofany criminal proceedings brought under the CorporateManslaughter and Corporate Homicide Act 2007 inrespect of any fatal injury. Cover is limited to £5M orthe amount stated in the policy schedule which ever isthe lower.

• Obstructing VehiclesCover extends to include your liability arising from themovement of a mechanically propelled vehicle withinthe EU obstructing your business.

• Financial LossCover extends to include your legal liability for financialloss within the EU, subject to a maximum amount inany one period of insurance up to £50,000. Please notethat this is a claims made cover, and will be subject toan excess of 10% of the limit selected or £1,000 whichever is the higher amount in respect of each claim.

• Libel and SlanderCover extends to include your legal liability within theEU in respect of any act of libel or slander committed oruttered by you in respect of your advertising or in-houseand trade publication material prepared by you. Coveris subject to a maximum amount in any one period ofinsurance of £250,000. Please note that this is a claimsmade cover, and will be subject to an excess of 10% ofthe limit selected or £1,000 whichever is the higheramount in respect of each claim.

InformationProperty Owners LiabilityCover ExclusionsTo reflect the international scope of cover some specificexclusions apply to the Property Owners Liability Section, inaddition to those normally found under a standard UKwording

• Liability occurring outside of the UK caused by orarising from asbestos or material or productscontaining asbestos or any nuclear weapon or weapons material

• Liability occurring outside of the UK in respect of injurycaused by or arising from fungus, mould or mildew orsilica particles, dust or compounds

• Liability compulsorily insurable under employers’liability workers’ compensation or similar legislation orany sums which you shall be called upon to pay for anyworkers’ compensation, unemployment compensationor disability benefits

• Liability arising from war, invasion, act of foreignenemy, hostilities, civil war, rebellion, revolution,insurrection, military or usurped power,nationalisation, confiscation, requisition, seizure ordestruction by government or public authority

Terrorism Cover Cover for acts of Terrorism is restricted to the UK and islimited to £5M or the amount stated in the policy schedulewhich ever is the lower.

AsbestosCover for liability caused by or arising from exposure,inhalation, or fear of the consequences of such exposure or inhalation due to asbestos or the costs incurred inrepairing, removing, replacing, recalling, rectifying,reinstating or managing asbestos or the presence ofasbestos is excluded outside of the UK and is limited to £5M or the amount stated in the policy schedule which ever is the lower in respect of the UK.

Employers LiabilityProvides cover for damages, legal costs and expenses forwhich you are legally liable in respect of bodily injury ordisease to employees resident in the UK or EIRE.

Cover automatically includes:• Limit of Indemnity

A limit of £10M is provided as standard, higher limits ofindemnity are available on request.

• Health and Safety at Work – Legal Defence CostsCover is provided for legal defence costs arising out ofthe Health and Safety at Work Act 1974.

• Unsatisfied Court JudgementsCovers payment of court judgements obtained byemployees against third parties for injury sustained atwork, if the judgement remains unsatisfied.

• Court Attendance CostsCovers attendance as a witness in connection with aclaim. Compensation for each day of attendance:Director/partner £500Employee £250

• Corporate Manslaughter and Homicide Cover extends to include legal costs and expensesincurred with our consent and costs of the prosecutionawarded against you in connection with the defence ofany criminal proceedings brought under the Corporate Manslaughter and Corporate Homicide Act 2007 inrespect of any fatal injury. Cover is limited to £5m or theamount stated in the policy schedule whichever is thelower.

InformationTerrorism Cover – Employers LiabilityCover caused by acts of Terrorism is restricted to the UKand is limited to £5M.

Directors and Officers LiabilityDirectors and Officers Liability insurance provides financialprotection and therefore peace of mind for directors interms of their personal liability when managing theircompany in their capacity as a director.

Smaller sized businesses can be just as vulnerable toclaims as larger companies and as the directors of smallprivate companies are subject to similar duties as listedcompanies.

Under the 1985 and 1989 Companies Acts directors andofficers are exposed to over 200 areas of statutory liability.This means that they can face unlimited personal liabilityfor their actions and decisions on behalf of the company.Other legislation (e.g. Companies Act 2006) has furtherincreased such liabilities.

Directors and Officers Liability -Residents AssociationsResidents of a block of flats or residential property in theUnited Kingdom may have established a formal Residents’Association or Residents’ Management Company. This maybe to oversee the upkeep and maintenance of theirproperty, but in certain circumstances may also involvefinancial and legal matters concerning the property.

In doing so, the members of such an association orcompany may act in the capacity of a director, companysecretary, trustee, non executive director or other similar“officer” role.

Individuals in these positions accept responsibility fordirecting its affairs, ensuring that it remains solvent, wellrun and meets the aims for which it has been established.

In undertaking such roles, individuals are potentiallyplacing their personal assets at risk if an allegation is madewhere they have failed to use reasonable care and skill inexecuting their duties. Even if a legal action is successfullydefended it may still involve incurring significant legal fees.

Law Applicable, Jurisdiction & Policy LanguageUnless agreed otherwise we will apply English Law. Thelanguage of the policy and all communications with you willbe in English. In the event of any dispute under this policy,the exclusive jurisdiction of the courts of England & Walesshall apply and any arbitration shall be held in London.

Currency The premium, tax or similar charges payable under thepolicy and all claim payments, shall be paid or payable inthe UK in GBP Sterling (£). In respect of a claim whichoccurs outside of the UK conversion of the local currencywill be at the rate of exchange in the London ForeignExchange Market prevailing at the time.

Insurance Tax and ChargesYou are required to make available to us all information onrisks situate outside the UK relevant for the calculation ofany foreign insurance tax or similar charge. Should anycalculation be questioned by any tax authority and we areobliged to pay any additional tax or charge, you will berequired to reimburse us irrespective of the moment in timethat such payment has taken place.
