4-1 INTRODUCTION

This Part of the Contract describes AGL Macquarie’s requirements as to how the Contractor and its

workforce will conduct themselves when on AGL Macquarie’s premises. These requirements are to

be interpreted as the minimum accepted standard.

In this Part Legislative Requirement means any act, regulation, standard, code, requirement of any

person having authority over the Site or the Works or Services to be performed under the Contract.

Nominated representative (Nominated Representative) means the person nominated by AGL

Macquarie to carry out that role under these Standard Site Requirements..

Regardless of the nature of the work, AGL Macquarie, the Contractor and its workforce have

obligations to identify, assess, eliminate or control risks arising during the course of the Contract.

These risks may have work health and safety, environment or business implications for any or all of

the parties involved and must be eliminated or controlled in order to prevent undesirable

consequences.

The Contractor must implement risk management processes in accordance with including, and as

well as through, effective risk assessment, supervision, induction and training and consultation.

The Contractor must consult with AGL Macquarie and following that consultation must design,

document and implement a Site Management Plan setting out the systematic management

processes to be used to manage performance of the work or services on the Site. The Site

Management Plan must be comprehensive and specific to the site and must be at least equivalent

to or a higher standard than the requirements of the following standards:

AS/NZS 4801 Occupational Health and Safety Management systems - Requirements with

guidance for use

AS/NZS ISO 14001 Environmental Management Systems – Requirements with guidance for use

AS/NZS ISO 9001 Quality Management Systems – Requirements

These standards provide a framework for management of safety, environment and business

activities. AGL Macquarie does not require certification to these standards by the Contractor unless

it has been specifically required under Part 1 of the Contract

4-2 PROJECT MANAGEMENT

4-2.1 Contractors Representative

The Contractor must have in Australia, during the term of this Contract, a representative with full

power to deal expeditiously with all matters that may arise in connection with the Contract

4-2.2 Site Manager

The Contractor must have for the duration of the performance of services or work onsite a Site

Manager that has the power to deal expeditiously with all matters relating to the site. The

Contractor’s Representative must nominate for appointment a Site Manager who has the authority

to deal with and make decisions in relation to all matters arising in connection with the execution of

the Site Works. The Contractor must present in writing to the Nominated Representative, the

credentials, experience and competencies of the proposed Site Manager for review.

At the absolute discretion of the Nominated Representative, the proposed Site Manager may be

interviewed to assess suitability for the position. Final approval of the appointment of the site

manager must rest with AGL Macquarie.

The Site Manager must be readily contactable by the Nominated Representative at all hours during

the term of the Contract.

The Contractor must ensure that the Site Manager is responsible for compliance with and

implementation of:

(a) all the requirements of these Standard Site Requirements for the duration of the Contract, and

(b) such additional processes or controls as may be required under the Contract.

The Contractor must conduct and document regular audits as nominated to evidence to the

satisfaction of AGL Macquarie that the Site Manager is performing his obligations under this

provision.

4-2.3 Site Establishment

The Contractor must undertake the following steps when establishing onsite and prior to

commencement of work:

1. The Contractor may not proceed to establish site office facilities until the Site Manager is

approved by AGL Macquarie.

2. The Site Manager, in conjunction with the Nominated Representative, must prepare a Risk

Assessment for the contract works or services that encompasses all the known hazards

identified by both parties. The two parties must agree on the required controls for these

hazards which must include the agreed level of supervision to be provided in order to

effectively manage these controls.

3. The Risk Assessment must be used to develop a site and project specific draft Site

Management Plan that complies with the requirements of this Contract.

4. The draft Site Management plan must also include site specific plans that detail how all the

site required standard, policies and procedures will be adhered to. The following Site

Specific plans will include but are not limited to the following –

Site Safety Plan

Site Environment plan

Business Plan

5. The Site Manager must consult with the workforce on the draft Site Management Plan and

incorporate any changes arising from this consultation process. These changes must be

communicated to AGL Macquarie.

6. The draft Site Management Plan must be submitted by the Site Manager to the Nominated

Representative for approval. The Nominated Representative may in his absolute discretion

approve, disapprove or recommend amendment to the draft Site Management Plan.

7. If approved, a draft plan will be the Site Management Plan. The approval of any plan does

not relieve the Contractor of any of its obligations.

8. The Contractor must prepare Work Method Statements as required for the project

9. The Contractor must develop the induction and training system for the project.

10. The Site Manager must ensure that all the requirements of the Site Management Plan are

in place, all training, competency assessments and inductions are complete and that

adequate consultation has taken place before any work onsite is commenced.

4-3 SITE MANAGEMENT PLAN – POLICY, PLANNING AND THE MACQUAIRE

GENERATION GOLDEN RULES.

4-3.1 General

The Contractor must comply with the Site Management Plan and must ensure that its employees

and agents comply with the Site Management Plan.

The Site Management Plan must include the primary objectives for the contract works or services

and detail how these objectives must be achieved. The plan must be divided into the three key

plans:

Environment

Business.

The systems and controls established in the Site Management Plan must be specific, measurable,

and achievable, have assigned responsibilities and be time based, so as to permit easy verification

of activities through audit.

The Site Management Plan must be specific to the site, the activities and tasks to be performed

and the hazards identified and recorded. It must not include generic references from corporate

procedures or systems that are irrelevant to the work under the contract or procedures and

systems that do not meet the requirements of the standard to be adopted for the plan. It must

assign responsibilities consistent with the requirements of this Contract.

The Site Management Plan must include as a minimum the sections and requirements outlined in

this Contract.

The Contractor must produce a revised draft Site Management Plan for consultation and

consideration if for any reason the Site Management Plan fails to continuously comply with these

Standard Site Requirements including without limitation if:

There is a change to any Legislative Requirement

There is any incident involving a potential or actual breach of Work Health and Safety or

environmental obligations by any party in relation to the Work or Services at the Site

If revised draft Site Management Plan is required under this provision then:

1. The Site Manager, in conjunction with the Nominated Representative, must prepare a Risk

Assessment for the works or services that encompasses all the known hazards identified

by both parties. The two parties must agree on the required controls for these hazards

which must include the agreed level of supervision to be provided in order to effectively

manage these controls.

4-3.1.1 Policy

4-3.1.2 Policy Statement

The contractor must comply with all current AGL Macquarie policies including the following:

AGL Macquarie Golden rules –

1. Fitness for Work:

o I will not report for work under the influence of illegal drugs and/or alcohol.

2. Electrical Safety:

o I will ‘Test before Touch’ when working on all electrical circuits * (*Unless

approved otherwise)

3. Personal Protective Equipment:

o I will adhere to all PPE requirements.

4. Safe Driving:

o I will drive safely and obey road rules on site.

5. Isolations:

o I will always follow correct isolating procedures and never remove or work

through a danger tag *

(*Unless approved otherwise)

6. Safety Equipment:

o I will never tamper with, remove or bypass a safety device *

(* Unless approved otherwise)

7. Incident Reporting:

o I will report all Safety and Environment incidents.

8. Environment:

o I will ensure that all spills, once identified, are addressed immediately.

Any breach of the AGL Macquarie Golden rules may result in disciplinary action which may

include but is not limited to the following –

Working with the AGL Macquarie Contract administrator to identify and suggest

improvements,

A report developed and attached to the contract document file,

Possible temporary removal of site access for a period of time,

Permanent removal of site access,

In a serious intentional breach a meeting of Contractor and AGL Macquarie

management will be required to review the incident, the contractor’s response and

to discuss impacts on the contract.

AGL Macquarie Policy SAF001 Work Health Safety Policy

i. The contractor must establish policy statements that are specific to the project

and :

ii. are appropriate to the nature, scale and risks presented by the Site Works

iii. include a commitment to continuous improvement

iv. include a commitment to comply with applicable legislation

v. provide a framework for setting and reviewing the objectives of the Contract

vi. are documented, implemented and maintained

vii. are communicated to all persons involved with the Site Works

AGL Macquarie Procedure SAFS 002 Drug and Alcohol Testing

i. Comply with the requirements of the Drug and Alcohol Testing

regime as outlined in clause 4.14

4-3.2 Planning

4-3.2.1 Legal and Other Requirements

The management of safety must be at a minimum in accordance with the following documents:

The NSW Work Health and Safety Act 2011 and the associated Work Health and Safety

Regulation 2011.

The minimum standard that must apply to the safety management system for the Site

Works must be AS/NZ 4801 Occupational Health and Safety Management Systems –

specification with guidance for use.

Specific provisions of the Regulation, Australian Standards, Codes of Practice and Industry

Standards will apply to work activities. These requirements must be noted on the relevant

risk assessment, work method statement or work procedure.

The management of the Environment must be at a minimum in accordance with the following

documents:

The Protection of the Environment Operations Act 1997 NSW and the associated acts and

regulations. The contractor must comply with this act at all times.

The minimum standard that must apply to the environmental management system for the

Site Works must be ISO 14001 Environmental Management Systems – Requirements

with guidance for use.

The AGL Macquarie power stations operate under licenses that establish specific

operational limits and requirements for each site. The contractor must operate within the

requirements all relevant licenses at all times.

The management of Business activities must be at a minimum in accordance with the following

documents:

The Contractor must identify and state in the Site Management Plan the controlling

legislation for Industrial Relations and Welfare activities.

The controlling Standard for the provision of Quality to Site Works must be ISO 9001-

Quality Management Systems - requirements

The controlling document for security compliance will be the relevant Power Station

Standing Instruction at the site where the work will be carried out.

The controlling document for information technology compliance will be the AGL

Macquarie Corporate Standard IT-001 Information Technology. Where the IT systems

include control systems for plant the Contractor must follow the relevant change

management Power Station Standing Instruction

Other Legislative Requirements may be applicable to the Site Services and Works. The

Contractor must identify and document all such Legislative Requirements and their

relevance to the contract work or services on Site. The Contractor must have in place a

system to identify changes to any Legislative Requirements controlling and ensure that

any such changes are incorporated into the documents that are affected by the change

e.g. Work Method statements, Training modules etc.

4-3.2.2 Objectives and Targets

The primary objective for the execution of the contracted Site Services and Works is:

to identify all workplace hazards and implement effective controls to safely manage the risk

associated with those hazards

The primary objectives for the management of safety are:

To achieve zero harm

Eliminate as far as reasonably practicable safety impacts on others

Eliminate exposure to hazardous substances that exceed permissible exposure limits

Prevent unauthorised or uncontrolled fires

Achieve conformance with the AGL Macquarie Safety Rules

Achieve compliance with the AGL Macquarie Golden Rules

The primary objectives for the management of the environment are:

Eliminate any unauthorised or uncontrolled discharges to air, land or water

Remove as far as reasonably practicable possible exposures to a hazardous substance

Impliment and develop methods to eliminate as far as reasonably practicable unauthorised

or illegal disposal of waste materials onsite or offsite

Achieve compliance with the AGL Macquarie Golden Rules

Quality

Prevent plant forced outages or load reductions as a result of the Works

achieve compliance with technical and commercial specification

Eliminate exposure of AGL Macquarie to legal action or commercial loss.

Industrial Relations and Welfare

Achieve conformance with Industrial Agreement

Prevent work stoppages due to industrial issues other than industry-wide stoppages

Implement systems ensuring access to appropriate site amenities

Security

Prevent security incidents

prevent the security cards or passes being unaccounted

Prevent interference with security infrastructure

Information Technology

Eliminate unapproved access to the AGL Macquarie IT infrastructure

Eliminate affect to IT security systems

Prevent unapproved interruptions to part or all of the AGL Macquarie Local Area Network

Prevent unapproved changes to control or indication systems

The Contractor must further establish, implement and maintain documented objectives and targets

for each major task, process or activity associated with the contracted Site Works. The objectives

must be consistent with the Site Management Plan Policy and be achievable and measurable as

far as practicable.

When establishing objectives the Contractor must consider the identified risks established for the

Site Works, legal responsibilities, business requirements and the requirements of AGL Macquarie.

4-3.2.3 Risk Management

The contractor must establish, implement and maintain documented systems and procedures for

the identification and assessment of hazards and the control of all risks arising from activities,

products or services that will form part of the contract Site Works. The procedures must be based

on the principals of AS/NZS ISO 31000:2009.Risk Management – Principles and Guidelines

Under the risk management system established for the contract Site Works the Contractor and

AGL Macquarie must identify and document all hazards.

Each hazard must be risk assessed and the agreed hierarch of controls implimented to eliminate

were applicable or as reasonably practicable, managed the risk to reduce the risk to an acceptable

level.

4-3.2.4 Training and Competency

Training must be managed in accordance with the principals of ISO 9001. It must be competency

based and subject to a continual improvement loop.

All training to be carried out must be supported by a training needs analysis and a design

specification for the training module. The specification must detail the description of the training

module, the objectives of the module, the qualification required of the presenter, the style of training

delivery required (e.g. on the job, lecture or a combination theory and practical), the requirement for

competency assessment and the method of review of effectiveness of the completed training.

Assistance in this area is available in the Australian Standard Handbook HB 249 Managing and

Delivering Technical Training.

Approved training modules must be prepared by persons or organisations qualified and/or

accredited to do so. They must be supported by Module Plans, Session Plans and Course Notes

that clearly define and demonstrate how the course objectives will be met.

A training record management system must be maintained by the Contractor for all staff employed

under the contract and must put in place a document control system to cross reference the training

needs analysis, with the risk assessment and training records.

4-3.2.5 Consultation

The contractor must detail the workplace consultation procedures to be used under the Contract.

The contractor must have in place documented and effective consultation systems with all

subcontractors and suppliers.

All consultation procedures must be detailed in the Site Management Plan and must be consistent

with the WorkCover NSW Work Health and Safety, Consultation, Cooperation and Coordination

Code of Practice.

AGL Macquarie has developed and implemented the Contractor Consultative group. This group

has been identified as the primary means of consultation between AGL Macquarie and contractors

engaged onsite. In addition to this group AGL Macquarie will continue to communicate via email,

administration notes, safety alerts, Contract Administrator and all other approved methods of

consultation.

The Contractor Consultative group meeting will be held on the first Thursday of each Month unless

advised otherwise. For those contractors un-able to attend but are actively working onsite or have

an active contract must supply an apology to their respective AGL Macquarie representative.

Minutes of the meeting will be distributed to all active site contractors.

4-3.2.6 Resources

AGL Macquarie and the Contractor must review the Site Management Plan taking into account the

hazards identified, the risks they pose after controls are implemented and the scope and breadth of

the contract. The two parties must agree on the level of supervision and resources that will be

required on the Site Works to meet the objectives and requirements of the plan.

4-3.2.7 Responsibilities

The Contractor must define in the Site Management Plan the accountability and responsibility of all

persons involved in the site safety, environment or business management under the contract. The

minimum responsibilities of the key parties involved in the contract must be as set out below.

4-4 SITE MANAGEMENT PLAN - IMPLEMENTATION AND VERIFICATION

4-4.1 Resources

The Contractor must provide sufficient number of suitable personnel throughout the execution of

the work at Site to supervise efficiently all work under the Contract. Supervisory personnel must

have had thorough experience in the erection, construction, commissioning, operation and

maintenance of plant, buildings, structures and services comparable with that being supplied,

constructed, maintained or rehabilitated under the Contract. These supervisors must be proven

technically, industrially and administratively competent to the satisfaction of the Nominated

Representative.

4-4.2 Responsibilities

For the Contractors information the following responsibilities apply:

4-4.2.1 AGL Macquarie

AGL Macquarie is responsible, as far as reasonably practicable:

for the overall management of the site .

to provide safe isolations for work under the AGL Macquarie Safety Rules

to ensure any premise controlled by AGL Macquarie is safe and without risks to health, the environment or infrastructure

to ensure all people on its premises are not exposed to risks to their health and safety arising from AGL Macquarie’s activities

to ensure information is provided to the Contractor about hazards and measures taken to control hazards on AGL Macquarie’s premises.

To regularly consult with all persons on its premises regarding safety policies, procedures and emerging issues

4-4.2.2 Contractor and Subcontractors

Contractor and Subcontractors have a duty to:

ensure the health safety and welfare at work of all its employees and those of its subcontractors

ensure any premises controlled by them are safe and without risks to health and safety

ensure any plant or equipment provided for use by their employees is safe and without risk to health and safety, the environment or existing infrastructure when properly used

ensure that systems of work and the working environment of their employees are without risks to health, environment or infrastructure

providing such information, instruction, training and supervision as may be necessary to ensure their employees’ health and safety at work and the protection of the environment or infrastructure

provide adequate facilities for the welfare of their employees at work

ensure all people on AGL Macquarie’s premises are not exposed to risks to their health and safety arising from the Contractor’s activities

ensure any plant or substance designed, manufactured or supplied is approved for use, safe and without risk to health and safety, the environment or infrastructure when properly used

provide adequate information about any supplied plant or substance to ensure its safe use by persons to whom it is supplied.

4-4.2.3 Employees

Each employee of AGL Macquarie, of the Contractor and of any subcontractor has a duty to:

Take reasonable care for his or her own health and safety, and

Take reasonable care that his or her acts or omissions do not adversely affect the health

and safety of other persons, and

Comply, so far as the worker is reasonably able, with any reasonable instruction that is

given by the person conducting the business or undertaking to allow the person to comply

with the Work Health and Safety Act 2011, and

Co-operate with any reasonable policy or procedure of the person conducting the business

or undertaking relating to health or safety at the workplace that has been notified to

workers.

The following specific responsibilities apply 4-4.2.4 Nominated Representative

The Nominated Representative must

be the main point of contact for the Contractor for the duration of the Site Works and must

discharge the powers and responsibilities nominated in the contract.

convene regular meetings to discuss the progress of the Contract. These meetings must

review the Objectives and Site Management Plan for the Contract.

ensure that the requirements of the Site Management Plan are being implemented.

4-4.2.5 Contractor’s Site Manager

The Site Manager must

ensure the Contract Site Management Plan will be submitted to the Nominated

Representative prior to the Site Works commencing.

ensure that all the requirements of the Site Management Plan are in place, all training,

competency assessments and inductions are complete and that adequate consultation

has taken place before the Site Works commence. The Site Manager must provide to the

Nominated Representative written evidence of same before the Site Works commence.

ensure all the requirements of the Site Management Plan are continuously implemented

verify through audits, inspections and consultation that the systems are effectively

controlling the identified risks and achieving the objectives of the project.

Ensure that the training program is effective, maintained and that records are kept up to

date for all employees

Constantly review the effectiveness of the supervision provided and to make adjustments

to meet changing needs of the project

Update the Site Management Plan immediately where required by events such as a near

miss, incident or change of legislation or standard.

Continually improve site procedures to meet the objectives in line with the principals set

out in the standards listed in Clause 4.1

4-4.3 Control of Risks

The identification of hazards, assessment of risk posed by those hazards, and implementation of

control measures, must be a central concept in the Contractor’s workplace management. This must

be a continual process that involves the workforce.

The Risk Assessment must become the checklist for all task related assessments, operating

procedures, job safety analysis and work method statements. All affected staff must be involved in

the preparation of work procedures through the consultation process. Where further hazards and

controls are identified through the consultation process the Risk Assessment must be updated and

reissued to the Nominated Representative and all staff.

All Contractor’s staff employed under the contract including supervisors and specialist staff must be

trained in the system, advised of the purpose of the Risk Register, involved in the risk management

process and consulted where changes to the systems are proposed. All personnel retained to

undertake work under the Contract must be, at the expense of the Contractor and to the

satisfaction of AGL Macquarie, prior to commencing work:

Evidence of these requirements must be provided to AGL Macquarie from the Contractor, as and

when requested

Documents must be compiled by competent persons to record the outcomes of the risk

assessments and these must be readily available to all personnel involved in the Site Works.

4-4.4 Progressive Consultation

Where the Site Works are part of a larger project such as a unit outage, special provisions for the

coordination of the Site Works must be put in place by AGL Macquarie. The Contractor must attend

all coordination meetings.

Regular progress meetings must be held between AGL Macquarie and the Contractor to review the

progress of the Site Works. All key areas must be discussed at these meetings with safety being

the first item on the agenda. The frequency of the meetings must be in accordance with the

requirements of the Site Management Plan.

Consultation must take place at a minimum with all affected parties whenever there is a proposed

change to the Site Management Plan, any work procedure or a change to the conditions of the site.

4-4.5 Implementing Induction, Training and Competency

All personnel must be inducted to the Contract Site Management Plan in all key areas. This

induction must be carried out before personnel begin work onsite. Further mandatory inductions are

detailed under the key areas of the Contract.

The Contractor must ensure that training required for tasks is carried out to the appropriate

standard or specification and that the personnel has achieved the required level of competency.

Where the personnel are hired with a pre-existing qualification that will be used in the Site Works

the Site Manager must assess the competency of such personnel to ensure they are suitably

qualified to undertake the relevant work. Such testing must be at the expense of the Contractor and

to the satisfaction of AGL Macquarie.

Where a competency is identified as a requirement for a task under the Risk Management System,

the competency must be attained by each member of personnel before they commence work on

the tasks identified as requiring that competency.

The Contractor must ensure that complete records are kept onsite of all training, qualifications and

competency assessments held by employees working onsite.

4-4.6 Sub-contractors

The Contractor must remove from site and terminate any engagement of a subcontractor who fails

to abide by and adhere to the Site c Management Plan.

The Contractor is to ensure that all subcontractors have in place a management plan and

supporting systems that are consistent with and equivalent to the Site Management Plan. The

Contractor must carry out routine audits of the subcontractors to ensure that the relevant

subcontract management plan is being continuously implemented. Evidence of audits and

compliance with the Site Management Plan by subcontractors will be provided to AGL Macquarie

as requested.

4-4.7 Audit

The Contractor must carry out a self-audit of the systems required under the Site Management

Plan to ensure that they are being implemented effectively at a frequency agreed to between AGL

Macquarie and the Contractor at site establishment.

Any incident or uncontrolled event represents a failure to control an identifiable risk and therefore

requires immediate investigation. The contractor must have in place a system for the reporting of

near miss incidents, actual incidents and non-compliance that is consistent across the three main

areas of safety, environment and business. The system must be included in the Site Management

Plan.

Investigations must be carried out into all incidents using a structured approach that identifies the

root cause of the incident .The root cause must be related back to a recognised hazard in the risk

register or requirement of the Site Specific Management Plan. Copies of all investigation reports,

root cause analyses and material collated to produce the investigation report including, but not

limited to, statements, photographs, expert reports and copies of notifications to the relevant

statutory authority must be provided by the Contractor to AGL Macquarie. The Contractor must

ensure co-operation of its personnel, employees and any subcontractors engaged with any request

by AGL Macquarie to participate in an investigation of an incident, accident, dangerous occurrence

or ‘near miss’, including providing statements by involved and affected personnel, employees and

subcontractors to AGL Macquarie

An audit of compliance to the Site Specific Management Plan by the Nominated Representative or

safety and environment representative may be conducted at any time. The Contractor will co-

operate with any such request. The audit may involve a formal assessment of the Contractor’s

management systems that are or should be in place, and will check that the requirements of the

Site Management Plan and legislative requirements are being implemented continuously. Any

defects found must be remedied by the Contractor as soon as possible and at the Contractor’s

expense.

4-4.8 Records and Notices

The contractor must provide copies, before issue for implementation, of all risk management

documentation prepared for the Contract e.g. Work Method Statements, Job Safety and

Environment Statements for AGL Macquarie’s records to AGL Macquarie before and during the

Contract, as requested by AGL Macquarie

The contractor must provide copies of all self-audits within 5 working days of completion of the audit

including all non-conformances.

The Contractor must promptly report all safety and environmental incidents actual or near miss that

occurs during the course of the contract by the contractor or its Subcontractors complete with report

in accordance with the relevant Power Station Standing Instruction.

The Contractor must supply and deliver to AGL Macquarie, a copy of all notices served in

complying with Acts, Regulations, Codes or Standards and the requirements of Statutory

Authorities. These notices must include both those served upon the Contractor and those issued

by the Contractor.

The contractor must provide weekly returns on labour force, incident management and other

prescribed matters to AGL Macquarie.

4-5 WORK HEALTH AND SAFETY – SPECIFIC REQUIREMENTS

4-5.1 Implementation and Operation

4-5.1.1 Induction Training & Competency

Irrespective of the work to be performed, all staff that requires access to AGL Macquarie’s premises

must have successfully completed an induction training program specific to the Site and the tasks.

The following inductions are mandatory for all contracts involving onsite work:

Site Specific Induction (this course must be conducted by a Trainer who has been

approved by AGL Macquarie to deliver an induction course appropriate to the AGL

Macquarie premises).

Induction to Safety Management Plan (Internal)

Induction to Work Procedures , JSAs and Work Method Statements (Toolbox Meetings)

AGL Macquarie sites are not “construction sites” as defined under the Work Health and Safety Act

2011. Notwithstanding where contract work or services is considered by AGL Macquarie to be

“construction work” in line with the definition provided under the WH&S Regulation 2011, Chapter

6 then a “ “ General Construction Induction will be required for all staff employed under the contract.

All inductions must be recorded. Site specific inductions must be valid for a period of 2 years after

which staff must be re-inducted. If staff have been employed on a full time basis over the period

since induction and are aware of all changes to the site procedures that have occurred during the

period then the contractor may apply to AGL Macquarie to have the validity extended by one year.

Approval of such extension must be at the sole discretion of the Nominated Representative.

Prior to an employee commencing any work on Site, the Contractor must provide proof to AGL

Macquarie that the employee has successfully completed the appropriate inductions and or

training.

4-5.1.2 Safety Risk Management

Task Risk Assessments

Detailed risk assessments must be documented where required by AGL Macquarie and as per

legislative requirements. These risk assessments must take into account the hazards listed in the

“risk register” and implement the agreed control measures for these hazards.

Safe Work Method Statements

Safe Work Method Statements must be prepared in accordance with the definition provided under

the WH&S Regulation 2011, Clause 299 for all work that is recognised to be high-risk, and are

mandatory for:

All tasks where the contract value exceeds $250,000

All tasks involving fault finding or testing of live low voltage electrical apparatus or work

adjacent to energised low voltage electrical equipment;

All tasks involving the use of hazardous chemicals or asbestos;

All tasks involving spray painting or abrasive blasting or electroplating

work where there is risk of injury from falling ;

work involving excavation where there is a risk of injury

work involving demolition;

Hazardous lifting and material handling tasks

work on or near roadways or railway lines;

work involving the use of explosives, including explosive tools;

work in areas where there is movement of mobile plant;

work adjacent to fuel oil pipe lines, or high pressure steam mains;

work over or adjacent to water that poses a risk of drowning or diving work;

hot cutting and welding work; and

Each Safe Work Method Statement must be detailed and comprehensive, and make provision for

environment protection where relevant. The Contractor must ensure these Safe Work Method

statements are communicated to, readily available to, and used by all involved in the work.

The Safe Work Method Statements must outline the steps in the work, hazards present at each

step, and measures required to control the hazards. They should be compiled in consultation with

employees who conduct the work, be in plain English, and readily available to all employees

involved in the work.

A copy of each Safe Work Method Statement must be provided to the Nominated Representative

prior to the start of work.

4-5.1.3 Emergency Preparedness

The Contractor is responsible for providing first aid services to its employees and those of its

subcontractors, including coordinating with AGL Macquarie, transport for injured persons to hospital

or other appropriate destination as and when required.

A AGL Macquarie emergency plan has been established for each site. The Contractor must ensure

the requirements of the relevant plan are integrated into the Site Management Plan.

All potential emergency situations must be identified and emergency procedures documented for

preventing and mitigating associated illness and injury.

The Contractor must review and if necessary revise its emergency preparedness and response

procedures, in particular, after the occurrence of incidents or emergency situations.

4-5.1.4 Regular Safety Inspections

Regular workplace inspections are to be made by the Contractor to ensure conditions and

practices on the Site are consistent with the requirements outlined in the Site Management Plant,

the risk assessments, and the safe work method statements. Depending on the duration and

complexity of the works, the Contractor must conduct inspections which may be daily, but must not

be greater than weekly.

4-5.1.5 Access to Plant

The Contractor must comply with the requirements of AGL Macquarie’s “AGL Macquarie Safety

Rules” while carrying out work under the Contract at Site. An uncontrolled copy of the rules will, if

required, be issued to the Contractor. AGL Macquarie may require the Contractor to provide one or

more supervisors to be trained in the Rules and to enable the work.

4-5.1.6 High Voltage Safety

Where, during the work under the Contract, sections of the Works are required to be energised at

high-voltage or are located in a high-voltage switchyard, AGL Macquarie may require the

Contractor to have at the particular location of the work:

At least one employee who is “certificated” for “AGL Macquarie Safety Rules”. The limit of

the qualification must be in accordance with the proposed duties.

At least one employee who is trained in rescue and artificial respiration in the case of

electrical shock.

A Register of all high voltage enclosures in the work area under the Contractor’s control must be

included in the Safety Management Plan

4-5.1.7 Confined Spaces

Any work in a defined confined space on Site is subject to the “AGL Macquarie Safety Rules”, for

which a Confined Space Entry Permit to Work must be obtained before work commences.

A Register of all confined spaces in the work area under the Contractor’s control must be included

in the Safety Management Plan

AGL Macquarie have developed confined space risk assessments and Confined space control

measures. These documents are available to contractors as referencing information and guide

only, These documents identify the known hazards associated with the confined space only and

detail the minimum hazard controls required to manage the risks associated within that space.

Contractors and sub-contractors must develop their own Confined space risk assessment, control

measures and rescue plan, based on the work to be conducted or introduced, ensuring that the

minimum AGL Macquarie confined space controls measures be implemented in conjunction with

any other hazard controls identified or implemented that relates to the work conducted in the

confined space..

A Register of all confined space work areas under the Contractor’s control must be included in the

Site Management Plan

4-5.1.8 Hot Work

Any hot work in defined high risk areas on Site is subject to the “AGL Macquarie Safety Rules”, for

which a Hot Work Permit to Work must be obtained before work commences.

Irrespective of whether the hot work is to be performed in a high risk area, all hot work must be

carried out under the control of a person who is responsible for the safe execution of all operations

and has the authority to enforce the requirements of Australian Standard 1674.1 – Safety in

Welding and allied Processes – Fire Precautions. Detailed procedures for all hot work must be

used.

The Contractor must ensure its supervisors, employees and subcontractors, who may be required

to carry out or be involved with hot work, are trained in the use of fire fighting equipment.

A Register of all high risk hot work areas in the work area under the Contractor’s control must be

included in the Site Management Plan

During Total Fire ban periods all hot work is to be suspended or ceased for the period of time that

the Total Fire ban is in effect. Where hot work is required to maintain plant operation for supply of

essential services AGL Macquarie has received an exemption to conduct such work ensuring strict

guidelines are followed and implemented. Any contractor required to conduct hot work during a

Total Fire ban period must obtain approval to do so through their respective AGL Macquarie

representative.

4-5.1.9 Fire Protection

The Contractor must be responsible for the fire protection of its own buildings, plant and equipment.

The method of complying with this requirement must be detailed in the Site Management Plan.

The Contractor must provide additional, appropriate and adequate fire fighting equipment in areas

where the Contractor is working. As a minimum, the fire fighting equipment necessary to comply

with Australian Standard AS2444, “Portable fire extinguishers and fire blankets – selection and

location” is required for its contracted Site Works or Services. Particular attention is to be given

when hot cutting or welding work is being carried out.

The Contractor must maintain and regularly service its fire fighting equipment in accordance with

Australian Standard “Maintenance of Fire Protection Systems and Equipment (AS1851) and must

recharge its extinguishers after use regardless of how they were discharged. The method of

complying with these requirements must be detailed in the Site Management Plan.

The Contractor may use AGL Macquarie’s fire fighting equipment if the circumstances call for their

use. However, the Contractor must immediately inform AGL Macquarie of the use of any

equipment so that systems can be recharged as required.

As part of its fire prevention measures, the Contractor must ensure that all its flammable materials,

particularly liquids and gases, are stored on Site in accordance with the requirements of the

Dangerous Goods Regulation.

A Register of all fire extinguishers and their location must be included in the Safety Management

Plan

4-5.1.10 Hazardous Chemicals

All chemicals and Hazardous substances introduced to any AGL Macquarie site must be approved

in writing by a AGL Macquarie environmental representative prior to arrival onsite.

In conformance with Chapter 7 of the WH&S Regulation 2011, the Contractor must maintain a

register of all chemicals in use and their hazard level. Current Safety Data sheets for the hazardous

chemicals listed in its register must be available and valid; all containers must be clearly labelled. A

risk assessment must be completed for every hazardous material.

The storage of all chemicals and Hazardous substances must be in accordance with site policy and

must be addressed in the Draft Site Management Plan.

4-5.1.11 Asbestos

Asbestos bearing material may be present in the work area under the Contractor’s control. AGL

Macquarie will provide a register of all locations on the site where asbestos bearing material is

known to be present. A Register of all known asbestos bearing material in the work area under the

Contractor’s control must be included in the Site Management Plan.

All work with known asbestos bearing materials must be conducted in accordance with the

requirements of Chapter 8 of the WH & S Regulation 2011

All work on known or suspected asbestos bearing material must be reported to AGL Macquarie

administrators to ensure the correct organisational procedures are followed and adhered to.

4-5.1.12 Additional Safety Registers

The following safety registers must be included as a minimum as a part of or referenced to in the

Site Management Plan. All registers must be prepared in accordance with the relevant Australian

Standard (where applicable) but as a minimum will include description, location, inspection

frequency and inspection details for each item:

First Aid Kits

Register of injuries

Corrective action register

Electrical Equipment

Lifting and Rigging Equipment

Work at Heights, Harnesses and Fall Restraint Equipment

Rescue Equipment (eg confined space rescue equipment)

Safety Test Equipment (eg Prove Dead Testers, Safety Earths or Bonds etc)

General Safety Equipment (signs, barriers etc)

4-5.1.13 Personal Protective Equipment

The Contractor must ensure that personal protective equipment as determined by the risk

assessments is worn by its employees while carrying out the work on Site.

All Personal Protective Equipment must be of a quality that complies with the relevant Australian

Standard and employees must be trained in its proper use and maintenance.

Unless otherwise directed or specified, the Contractor’s employees must wear as a minimum

requirement, a long-sleeved shirt and long trousers or combination overalls, together with safety

glasses, safety footwear and safety helmet. All contractor employees must have in their possession

or on their person whilst onsite, appropriate safety gloves at all times. The clothing is to be

industrial-grade work apparel in good condition identified with the company logo.

AGL Macquarie sites require high visibility clothing to be worn at all times. The clothing must be to

the relevant Australian Standard and the approval of AGL Macquarie.

Standards approved hearing protection must be worn at all times in designated hazardous noise

areas.

4-6 ENVIRONMENT – SPECIFIC REQUIREMENTS

4-6.1 Implementation and Operation

4-6.1.1 Environmental Management Plan

The Site Management Plan must include an Environmental Management Plan for all work or services undertaken on site, showing all information of specific actions, responsibilities, dates of implementation and monitoring processes.

The Contractor must, and must ensure that its employees, and agents, comply with the Environmental Management Plan as approved by AGL Macquarie and including such amendments as AGL Macquarie reasonably requires.

4-6.1.2 Content of Environmental Management Plans

The Environmental Management Plan should be prepared in accordance with AGL Macquarie’s “Contractor Environmental Management Plan (CEMP) Guidelines and Assessment Checklist”

The Environmental Management Plan must include, as a minimum the following items:

(a) Statutory obligations;

(b) Site induction;

(c) Staff training in environmental matters;

(d) Environmental emergency procedures;

(e) Storage of environmentally hazardous materials;

(f) Incident reporting procedures;

(g) Pollution prevention procedures;

(h) Pollution containment procedures; and

(i) Risk assessment covering intended activities.

4-6.2 ENVIRONMENTAL PROTECTION

4-6.2.1 Environmental Compliance

The Contractor must ensure that the Contractor, its staff, servants and agents :

(a) are environmentally conscious and minimise any adverse impact on the environment attributable to their activities;

(b) have all appropriate permits, approvals and licences and verify this by providing copies of such to AGL Macquarie;

(c) comply with the requirements of the New South Wales Office of Environment and Heritage, Environmental Protection Authority and all other applicable legal and legislative requirements;

(d) comply with the requirements of any relevant development consent, construction approval, Environmental Impact Statement and/or Determining Authorities Assessment Report;

(e) take all precautions necessary to prevent the discharge of any pollution (including water pollution, air pollution, noise pollution and land pollution as defined in Protection of the Environment Operations Act 1997 (NSW)); and

(f) ensure all liquids, gases and materials stored on Site are contained and stored in accordance with the requirements of The Work Health and Safety Act 2011 and the Work Health and Safety Regulation 2011

4-6.2.2 Facilities, Plant and Equipment

The Contractor must ensure that:

(a) all facilities erected on the Site by the Contractor, its employees, servants and/or agents are designed and operated to prevent the emission of any pollution into the atmosphere including smoke, dust, cement dust and other objectionable matter;

(b) plant and equipment is maintained in a manner which does not cause pollution, including contamination of soil; and

(c) washing down of machines and plant is only carried out on a paved concrete area, the drainage from which must be provided with approved oil separation traps before discharge into any waterway. The Contractor is responsible for regular removal of deleterious matter from such traps and its disposal by approved methods. All oil and fuel spilt or leaking from any item of plant or equipment must be cleaned up immediately if necessary by excavation of impregnated soil and its removal to approved disposal areas. If any waterway becomes contaminated by oils or similar materials as a result of the Contractor’s failure to comply with the requirements of this clause, the Contractor must, at no cost to AGL Macquarie, comply with all directions given by AGL Macquarie and any relevant Authority to clean-up the contaminated areas and to prevent any further pollution.

4-6.2.3 Precautions to be taken by Contractor

The Contractor must take all proper precautions and must ensure that its staff, servants, and

agents take all proper precautions to:

(a) minimise any nuisance (including dust) arising from the work being carried out, in accordance with Protection of the Environment Operations Act (POEO) 1999, Sections 124 – 126 and 128. (a) Such precautions may include but must not be limited to spraying the roads with water or other

suitable liquids, the removal of mud from the wheels and bodies of hauling equipment before they enter the public roads, and the removal of mud split by construction equipment on public roads; and

(b) prevent the erosion of soil from any lands used or occupied by the Contractor or from the bed or banks of any stream or lake.

4-6.2.4 Removal of Waste

(a) All waste generated by the Contractor’s activities is the responsibility of the Contractor to remove unless otherwise agreed. All waste disposal must be in accordance with the Protection of the Environment Operations Act 1997 (NSW).

(b) The Contractor must not (and must ensure its employees, servants and agents do not) deposit excavated or eroded materials in any stream or lake or reservoir.

4-6.2.5 Clearing of vegetation

The Contractor must not (and must ensure that its staff, servants and agents do not) destroy, remove or clear trees, timber and scrub to an extent greater than is necessary for the execution of the work or services under the Contract as determined by AGL Macquarie or any relevant Authority. Excavation and vegetation clearing must be carried out with consideration for Aboriginal heritage items or areas and in consultation with the AGL Macquarie Environment Officers.

4-6.2.6 Remedial Work to be Undertaken

If, in the opinion of AGL Macquarie, the Contractor’s operations cause erosion hazards, the Contractor must at no cost to AGL Macquarie, obtain the advice of the Department of Infrastructure, Planning and Natural Resources after prior advice has been sought from AGL Macquarie and effect such remedial measures as recommended by AGL Macquarie or that Department.

4-6.2.7 Environmental Emergencies

The Contract must ensure that in the event of an environmental incident:

(a) AGL Macquarie is immediately advised; and

(b) adequate facilities and equipment are readily available to contain, remove and decontaminate affected areas in the case of an accidental spill or discharge of a pollutant.

4-7 BUSINESS – SPECIFIC REQUIREMENTS

4-7.1 Implementation and Operation

4-7.1.1 Business Management Plan

The Site Management Plan must include a Business Management Plan for all work or services

undertaken on site, showing all information of specific actions and responsibilities. The business

Management Plan must include the requirements listed below:

4-7.1.2 Quality

General

The Contractor is responsible for all works and costs associated with the delivery of goods to site ,

including transport costs, demurrage charges, incurred in the delivery, unloading, receipt, handling

and storage at Site of all materials forming part of the Works.

The Contractor is responsible for the disposal of all packing or waste material.

Material Storage

The Contractor must arrange for the covered storage, maintenance and/or protection of all

materials against corrosion and mechanical damage during storage and erection. Equipment

stored must be placed on timber or other approved material so that it is not in contact with the

ground. All dunnage must be provided by the Contractor. AGL Macquarie’s covered storage

space is limited and its use is not guaranteed. All methods of storing and protecting items of plant

must be to the approval of the AGL Macquarie Representative.

Materials must be handled and stored in a manner that will ensure reasonable access for

inspection and checking of these materials.

The Contractor must from time to time as requested by the AGL Macquarie Representative remove

and replace selected sections of the protection provided for materials to permit inspection. Where

any protection is found to be damaged or inadequate, all foreign matter and corrosive products

present must be removed, the internal surfaces cleaned to the satisfaction of the Nominated

Representative, and adequate protection re-established by the Contractor.

Hours of Work

The Contractor’s site labour arrangements proposal must observe and take into account the

following requirements:

(i) Shift work may be allowed; and

(ii) Overtime may be worked.

Items (i) and (ii) above are subject to prior notice to and approval by the Nominated Representative.

The Contractor must work as necessary if the Contractor is obliged under the terms of the Contract

to work additional time to regain program, expedite outage work, or for any other reason covered

by the Contract.

Erection and Checking of Works

Where AGL Macquarie requires, the Contractor must prepare a comprehensive quality plan that

details how the works or services will be controlled to meet the performance standards.

The Contractor must submit to the Nominated Representative for approval, all proposed

construction, erection and commissioning programmes and procedures and particulars of any

proposed Temporary Works.

The Contractor must make the Works available at all times for inspection by the Nominated

Representative. Temporary access and landings must be provided for this purpose and must be to

the satisfaction of the Nominated Representative.

AGL Macquarie will provide major centre lines and datum levels only.

Protection of Adjacent Plant

The Contractor must take all precautions necessary to avoid interfering with the normal operations

of the power station and the work of other contractors. When required by the Nominated

Representative, the Contractor must partition off from operating plant, all areas in which work under

the Contract is proceeding.

The Contractor must remove the partitions when directed to do so by the Nominated

Representative.

The Contractor must provide, to the approval of the Nominated Representative, temporary

protection for all equipment, including that equipment provided by others, installed in the areas in

which work under the Contract is proceeding. After erection, adequate protection must be provided

around all items of plant where necessary to ensure that at the Date of Practical Completion, the

Works are in a condition satisfactory to the Nominated Representative. Particular attention is

drawn to the protection of alloy steels from ferritic contamination, and the protection of electrical

insulators from paint-spray.

Protective coverings must be removed and replaced by the Contractor as necessary for testing and

commissioning.

During the fixing of thermal insulation and during painting, the Contractor must protect the adjacent

plant, buildings and floors from damage caused by splashing or falling plaster, over-spray, etc. The

plant must be covered with dust-sheets or other coverings to the satisfaction of the Nominated

Representative. Boarding must be used on the floors for the mixing of materials.

Where the erection of building cladding and weather proofing by the Contractor is delayed , the

Contractor must provide temporary weather protection to all plant (including the plant provided by

others) left unprotected due to this delay. This protection must be provided to the satisfaction of the

Nominated Representative at no additional cost to AGL Macquarie.

Scaffolding and planking must not be supported on plant. Scaffolding erected on grid mesh floors

must be supported on feet capable of adequately distributing the loads and protecting the flooring.

Access to Plant and Equipment

The Contractor must abide by established procedures for access to operating plant and equipment,

and should be mindful that access to certain areas is restricted and controlled. Delays in gaining

access in these areas can occur.

When it is necessary for equipment to be taken out of service to enable work under the Contract to

proceed, outages will be arranged by AGL Macquarie. These outages must occur when, and for

such periods as conditions permit.

The Contractor must plan the work to give sufficient notice to AGL Macquarie of outages required

for work, especially that near high- voltage equipment.

The Contractor requires a written authority from AGL Macquarie to use plant owned by AGL

Macquarie.

Setting to Work

Unless specified elsewhere in the Contract, the Contractor must not start-up the plant supplied

under the Contract, but must request AGL Macquarie to do so once the plant is in a fit condition for

service. The Contractor must carry out all adjustments necessary to ensure the correct operation

of the plant when used with AGL Macquarie’s associated equipment, including simulation of

abnormal conditions, in the presence and in co-ordination with the Nominated Representative’s

staff. Before the plant is started, the Contractor must be satisfied as to the correctness of all

electrical and mechanical connections to the plant supplied under the Contract.

Immediately after delivery to Site and on erection of each item of plant provided with an anti-

condensation heater, the Contractor must temporarily connect the heater to a suitable electricity

supply. The connections must be retained until the permanent cabling has been connected or until

the plant is placed in commercial operation, whichever is the earlier.

If, in the opinion of the Nominated Representative or the Contractor, it is considered necessary for

any electrical plant supplied under the Contract to be dried out, it must be dried out by the

Contractor to the satisfaction of the Nominated Representative at no cost to AGL Macquarie.

Immediately prior to initial running or at such other times as mutually agreed, plant supplied under

the Contract, such as gearboxes, pumps, fans, etc., must have their covers removed for inspection

and cleaning. Seal, glands and bearings must be inspected and re-greased by the Contractor if the

Nominated Representative so requests. All plant with routine lubrication facilities must be freshly

lubricated prior to running.

Plant must not be placed in service without adequate labelling and identification. If permanent

labels are not installed, the Contractor must supply and fit temporary labels, at no cost to AGL

Macquarie.

From the time each item of plant supplied under the Contract is placed in service to the completion

of the Defects Liability Period of that item of plant, the Contractor must carry out regular checking of

all packing and joints on each item, if checking is required to reduce leakage or the possibility of

damage to the plant, failure of the packing or joint. This will particularly apply to pipe joints and the

glands of valves, pumps and similar equipment. Until all joints have been satisfactorily proved in

service, the Contractor must, unless otherwise approved by the Nominated Representative, leave

the joint(s) exposed in such a manner that bolted flanges can be checked and tightened if

necessary during and after initial thermal cycling of the plant.

Where the nature of the Works is such that no staff will normally be required to be present at the

Site during the Defects Liability Period, the Contractor must visit the Site when requested by the

Nominated Representative for the purpose of checking and/or adjustment of packing, joints, relays

and similar equipment.

Vehicles and Equipment

Only equipment approved by the Nominated Representative must be brought onto Site.

Equipment, which will cause excessive damage to surfaces or to other construction works, must

not be used.

All vehicles are to be registered in accordance with NSW Roads and Maritime Services

requirements and are to be maintained in a safe condition. The method and means of keeping

these in good condition must be included in the Site Management Plan.

All contract and subcontractor on-site vehicle access is the subject of AGL Macquarie approval.

Approved contract and subcontractor on-site working vehicles, including mobile plant equipment,

must be clearly identified by company logo or insignia and, fully comply with all other provisions for

on- site operations.

Visiting business vehicles are required to park off-site in AGL Macquarie’s designated car parks. A

Site Manager (or representative) may request temporary on-site working or business vehicle

access in writing to AGL Macquarie. Drivers of such vehicles, whether they are approved for

personal access to site or not, are required to stop at security on the first day of an approved

temporary on-site access period and register their vehicle with security.

All vehicles approved for on-site access may be subjected to vehicle searches. Drivers of vehicles

must be able to account for vehicle’s contents if requested. Under heightened security alert

conditions vehicles may not be permitted entry to site.

Use of Vehicles

All drivers of vehicles registered with NSW Roads and Maritime Services on Site must possess a

current driver’s licence that is recognised by the NSW Roads and Maritime Services.

Site parking notices and speed limits must be strictly observed. Offenders may be refused further

access to AGL Macquarie’s property.

Rubber tyred vehicles must be used on AGL Macquarie’s paved roads and areas, and, if it is

necessary for tracked vehicles to travel on or across such roads, they must do so in a manner

approved by the Nominated Representative.

Damage caused by the Contractor to AGL Macquarie’s roads must be promptly repaired by the

Contractor to the satisfaction of the Nominated Representative, at no cost to AGL Macquarie.

The Contractor must ensure, by reference to the Nominated Representative, that appropriate

safety clearances are maintained by vehicles and mobile plant entering switchyard or passing

under distribution and transmission lines.

Where it is necessary for the Contractor to install temporary underground services that pass under

roads, the crossing, must be carried out in an approved manner. Roads must not be opened up

without prior written permission of the Nominated Representative. The Contractor is required to

provide adequate warning signs and alternative access if its work interferes with safety or normal

access.

Crossing of trenches, conduits, light-weight chequer-plate areas, roadside kerbs and the like, by

vehicles and plant requires approval from the Nominated Representative. Protection of the

crossing may be required and must be provided by the Contractor.

Electrical Supplies

AGL Macquarie will provide free of charge a three-phase, four-wire, 415/240V (nominal) 50 Hz

supply of electricity at a fixed point on power station sites. AGL Macquarie does not guarantee that

this supply will not be interrupted nor will AGL Macquarie be responsible for any damage or loss of

production to the Contractor’s plant resulting from interruptions to the power supply, single-phasing

or voltage variation.

Any electrical installation by the Contractor to facilitate the works or services must be carried out in

accordance with Legislative Requirements and to AGL Macquarie’s requirements.

Residual Current Devices are required on all 240 and 415 volt outlets.

Periodically AGL Macquarie will require the Contractor to demonstrate that the circuits and

equipment are in a safe condition. Any defective equipment is to be disconnected until the defects

are remedied.

Permanent power outlets in the power station may be available on the basis that AGL Macquarie

has priority for use at all times

4-7.1.3 Industrial Relations and Welfare

Industrial Relations

The Contractor must comply with the provisions of the appropriate industrial relations legislation

during the course of the Contract.

As a major electrical power generator, AGL Macquarie has a duty to maintain reliability of

production. The Contractor must ensure that its industrial arrangement and any future negotiated

industrial arrangements or agreements will not jeopardise or restrict AGL Macquarie’s ability to

operate and maintain the power station as a whole, as and when required.

The Contractor must liaise with and keep AGL Macquarie informed during the course of any

negotiations with unions and/or employees. During the course of the Contract, the Contractor or its

Site Manager must promptly inform the Nominated Representative of any potential or actual

industrial problems or any proposed changes to the industrial arrangements or agreements.

If requested by AGL Macquarie, the Contractor must provide AGL Macquarie with a copy of any

current, new or amended industrial arrangement or agreement relating to the work under the

Contract at Site.

Site Office

The Contractor must include in the business Management Plan the agreed provisions for a site

office and telephone service. The Site Office and telephone service must be provided by the

Contractor. This office must be adequately staffed to enable the representative to be conveniently

contacted.

Site Accommodation

The Contractor must provide all sanitary and other accommodation for the personnel employed by

the Contractor and its subcontractors. Each building or structure must have its exact location

approved by AGL Macquarie, such as its site office, store, workshop, amenities, change room,

sanitary accommodation, hot water heaters, etc.

Site accommodation and amenities must be of a standard that complies with the requirements of

the Chapter 3 of the Work Health and Safety Regulation 2011 Adequate facilities must be

provided before any work at Site commences. All site buildings and containers must be identified

with the company name, and must be maintained in a safe and healthy condition.

AGL Macquarie will provide connection points within 30 metres of the approved site location for

electricity (240 V single phase), water and sullage. The Contractor must make all connections to

these services, however continuity of service is not guaranteed. Telephone services are the sole

responsibility of the Contractor. The Contractor must provide all drainage and surface preparation

required in the area allocated for the facilities. The Contractor is responsible for the maintenance of

the allocated area, road access and other installed services.

No residential accommodation is permitted on AGL Macquarie’s property. The provision of any

accommodation away from Site is the responsibility of the Contractor.

The Contractor must remove within 14 days after the Date of Practical Completion where

applicable, or the end of the term of the Contract where applicable all site offices, temporary

structures, sheds and workshops including all services, appliances and associated structures.

Sanitary And Sullage

AGL Macquarie maintains limited toilet facilities that may be used by the Contractor. If additional

facilities are necessary for whatever reason, then the Contractor must provide its own

prefabricated, transportable toilet units or arrange for joint usage with other contractors. Toilets

must only be installed in approved areas. The Contractor may connect to Site sewerage systems

at convenient locations. All connections are subject to approval by AGL Macquarie.

Individual septic tank installations require a council permit and approval by AGL Macquarie. Self-

contained transportable toilets of the chemical treatment type may be approved by AGL Macquarie

where no reticulation system is available.

Sullage water must not be discharged directly or indirectly into watercourses, rivers, lakes, etc. The

Contractor must dispose of sullage in an environmentally friendly manner approved by AGL

Macquarie.

The Contractor must ensure that its subcontractors make satisfactory sanitary arrangements. The

method of complying with these requirements must be detailed in the Site Management Plan.

Telephone And Mail

AGL Macquarie’s mail and telephone facilities are not available to the Contractor, except in cases

of extreme emergency.

Canteen

Where a food kiosk or canteen exists on Site, and if possible, a service will be provided to the

Contractor. AGL Macquarie makes no guarantees regarding the operation of the canteen.

4-7.1.4 Security

General

AGL Macquarie’s Power Station sites are under extensive security control measures. These

measures range from, but are not limited to, pedestrian turnstiles, vehicle access gates, recorded

close circuit television (CCTV) and man-proof perimeter chain mesh fencing. On-site Security staff

and their vehicles are clearly identifiable.

Each contract and subcontractor employee requires prior approval from AGL Macquarie before

entering site. Access to the inner perimeter of the Power Station will be approved on the basis of a

pre-determined period and also be the subject of compliance with all safety provisions under the

contract. A photographic Security Identification Card (Security ID Card) will be issued to a contract

or subcontractor employee for the duration of the on-site access but only after separate identity

verification can be provided.

A Security ID Card issued to a contract or subcontractor employee, remains the principle

responsibility of the Contractor. A Security ID Card, which is lost or cannot be returned after the

expiration of an approved access period, will incur the standing lost card charge prevailing at the

time.

Contract and subcontractor employees are required to wear their Security ID Card in a prominent

place. Where it is unsafe to do so, a Security ID Card must be readily presentable should an

authorised officer of AGL Macquarie request to sight the card.

Site access for business or working visitors for short durations may be granted. A Site Manager (or

representative) may request short term site access for such persons in writing to AGL Macquarie.

If approved, the person’s safety and whereabouts remains the responsibility of the Contractor for

the duration of that person/s visit.

People under 12 years of age are not permitted on site.

White Level Inspections

AGL Macquarie’s Power Station sites operate under a White Level Inspection policy. Under the

provisions of this policy, each contract and subcontractor employee is required to maintain a

general awareness for unusual or suspicious articles in and around their workplace. In addition,

each employee is to undertake an inspection of their workshop, office and change and meal room,

at the commencement of each day, for articles that are unusual, suspicious, hidden, not typically in

that area or cannot be accounted for. If an article is considered suspicious, employees are not to

handle the article and are to report their findings to a Supervisor, Security Guard or AGL Macquarie

officer immediately.

Removal of Material and Equipment

Neither the Contractor nor its subcontractors may remove materials or equipment from AGL

Macquarie’s premises unless accompanied by a signed docket (‘Removal from Site Form’ or ‘Pass

Note for AGL Macquarie Property’) which must be presented to AGL Macquarie’s security staff

when the removal takes place. The Contractor must give adequate notice for the removal of all

items owned by AGL Macquarie so that AGL Macquarie must have adequate time to arrange

insurance, notifications and clearances.

AGL Macquarie will accept no responsibility for the loss of, or damage to the tools, equipment,

clothing etc. of the Contractor, its subcontractors or their employees.

4-7.1.5 Information Technology

Local Area Network

Access to AGL Macquarie’s local area network is strictly controlled. Where the Contractor requires

access to AGL Macquarie’s LAN they must complete a separate application on the appropriate

form for each staff member requiring an account and forward it to AGL Macquarie for approval.

Approval to use the LAN must be at the sole discretion of AGL Macquarie and the Contractors

must abide by the requirements of the Corporate Policy at all times. Failure to do so will result in

immediate termination of the account.

Control and Indication Equipment

Access to AGL Macquarie’s control and indication equipment is strictly controlled. Where the work

onsite involves replacement, use or modification of plant control or indication equipment the

Contractor must nominate to AGL Macquarie for approval those staff members that will require

access to C&I equipment and provide a comprehensive resume for each staff member outlining

their background, experience and qualifications. Where required the Contractor must also provide

detail of what hardware, software or firmware will be affected by the work. Approval to access plant

C&I equipment will be at the sole discretion of AGL Macquarie.

Where modification to the control and indication equipment is required the relevant change

management system as nominated by AGL Macquarie must be followed. Online modifications will

require a comprehensive procedure that effectively controls the risks associated with plant

operation.

Information Technology Security

AGL Macquarie’s IT systems are integrated to allow staff to interrogate remote C&I systems and

the internet. Sophisticated security systems are in place to prevent unauthorised access or

corruption of data or logic. The Contractor must comply with all the requirements of AGL Macquarie

when installing, modifying or accessing IT equipment to ensure that the existing security systems

are maintained and are not compromised by the connection of equipment outside the limits of the

security system.
