According to TSSAA guidelines, Board of Education approval is required to allow non-faculty volunteer coaches to participate in the school athletic programs.

6. VISITORS 7. SPOTLIGHT ON EDUCATION

School Counselors Rutherford County Schools currently has 81 professional school counselors to serve approximately 36,700 students in 42 schools. School Counselors participate in professional development initiatives to help meet the ever-changing academic, career and social/emotional needs of our students. Counselors focus on national standards, state counseling guidelines and district school improvement plans within the framework of the Comprehensive School Counseling Program to stay abreast of specific tools and strategies to enhance student success.

8. APPROVAL OF GRANTS/PROGRAMS/APPLICATIONS/CONTRACTS (TAB 2)

A. General Mills Champions for Healthy Kids Grant

Recommend Approval --- motion to approve a grant proposal by LaVergne Lake Elementary (LLE) School and the Office of Coordinated School Health for a General Mills Champions for Healthy Kids Grant. The Champions for Healthy Kids Grant is a $10,000 grant aimed at improving the nutrition and physical fitness of children, especially those living in high needs areas. These funds would be used to increase the physical activity of LaVergne Lake students by providing Take 10! training and materials for all LLE classroom teachers. Take 10! is an elementary program that provides age-appropriate lesson plans that integrate physical activity within the curriculum. The funds would also

be used to purchase two portable salad bars for the school cafeteria as well as materials for two nutrition based events: 1.Dole Nutrition Adventure Day and 2. Family Health Night. The Dole Nutrition Adventure Day introduces students to the health benefits of fruits and vegetables in a fun-filled event. The Family Health Night would include a health fair for parents as well as information and recipes to help families have Family Meal Nights, even on a tight budget.

B. Contract with Staff Development for Educators for High School Training

Rutherford County high schools will be implementing a seven-period modified block calendar beginning in the 2010-2011 school year. We are planning a series of training opportunities for teachers on effective use of the longer class period to enhance instruction. Rick Wormeli is a nationally recognized trainer on this topic.

Recommend Approval --- motion to approve a contract with Staff Development for Educators in the amount of $7,591.00 for the honorarium and all related travel expenses for Rick Wormeli’s in-service training on Effective Use of Block Schedules in Grades 9-12 on April 24, 2009.

9. APPLICATION FOR APPROVAL OF SPECIAL COURSES

The Instruction Department is requesting permission to make an application to offer credit for special courses under the following guidelines:

Rule 0520-1-3-.05-2a: Local school systems may offer special courses not listed in 0520-1-3-.06 on an experimental basis. The Commissioner of Education must approve each course in advance each year. After three years the course may become permanent part of the local school program upon approval by the State Board of Education.

11. FACILITIES (TAB 4)

AT&T Easement at Central Middle School AT&T has submitted a Request for Easement adjacent to North University Street on the Central Middle School Campus. The area of the easement is 180 square feet (10’ x 18’). A new AT&T switch cabinet is proposed in the location to enhance the phone service in the East Main Street area.

Recommend Approval --- motion to approve a 10’ x 18’ utility easement for AT&T on the Central Middle School campus as presented.

12. FINANCIAL MATTERS (TAB 5)

Budget Amendments

A. This $65,700 donation from the Jennings Jones Foundation will be used to build a stronger Virtual Enterprises International™ network in Tennessee by providing professional development opportunities to enable participating vocational teachers to develop expertise that will assist them in facilitating student learning. Funding also provides training in recruiting and working with business partners.

Recommend Approval --- motion to amend $65,700.00 in funds received from the Jennings and Rebecca Jones Foundation for the Virtual Enterprise program and the related expenditures as presented.

B. This $25,000 donation from the Jennings and Rebecca Jones Foundation will

fund the 2009 Rutherford County Reading Conference. The 3-day summer conference will provide training for 65 teachers in grades 6-8.

Recommend Approval --- motion to amend $25,000.00 in funds received from the Jennings and Rebecca Jones Foundation for the 2009 Rutherford County Reading Conference and the related expenditures as presented.

C. This amendment re-allocates $3,250 in the approved 2008-2009 State of

Tennessee Adult Education Grant - Staff Development funds from other non-personnel funds. Professional development expenditures are budgeted and reported separately from other Adult Education personnel and non-personnel expenditures.

D. Bus Cameras

This amendment reallocates $237,985 from Contracts with Owners, 72710-315, to Transportation Equipment, 72710-729, for 128 three-camera systems with GPS for school buses based on Bid #1802.

The funding is from two sources:

• $90,486 remaining of the $230,565 budgeted fuel price adjustments • $147,499 should be available from bus contracts.

(One route is not being filled and others started later in the school year.)

Recommend Approval --- motion to amend $237,985 from Contracts with Owners, 72710-315, to Transportation Equipment, 72710-729, for bus camera systems as presented.

13. OUT OF COUNTY TRANSFER STUDENT (TAB 6)

Recommend Approval --- motion to approve the admission of an out of county transfer student from Desoto County, Mississippi. The student’s placement shall be at Daniel McKee Alternative School. The student’s admission shall also be subject to compliance with all other applicable admission requirements.

14. 2009 BUS CONTRACT

The Director of Schools is making preliminary plans for drafting the new bus contract and would like direction from the Board regarding the manner in which staff should proceed with this process.

A. Nissan Check Presentation and BEP Review Julie Cockrell and Julia Lawless, representing Nissan, presented a fake check in the amount of $75,000.00 to BEP for the use of school mini-grants for this semester and next.

Lee Rennick reported on the Chamber of Commerce BEP Foundation.

B. Dr. Linda Gilbert and Kathy Ferrell, representing the Franklin Heights’

Coalition, expressed thanks to the Board and Adult Education for the General Equivalency Diploma (GED) program being offered onsite at Franklin Heights.

7. PRESENTATION BY GCA SERVICES GROUP, INC.

GCA Services Group, Inc. gave a presentation regarding outsourcing of custodial services and possible cost savings for the Rutherford County Schools. The GCA representatives included Craig Colquilt, Dave Helton, Andy Kuhms, Doug Roth, and Kip Puryear. The Chairman stated that the Board will review the information.

8. FOLLOW UP STATUS OF PREVIOUS BOARD ACTION ITEMS

Mr. Clardy gave a status update on the following projects: • Christiana Elementary School Classroom Addition is complete and has been

released to the school. The Engineering/Construction Department is awaiting the final closeout documents and as-builts for the renovations before issuing final payment and closing out the job.

• Eagleville Gymnasium HVAC Renovation is 100% complete and in operation.

Engineering/Construction Department is awaiting the final closeout documents and owners manuals before issuing final payment and closing out the job.

• Kittrell Elementary School Re-roof is 100% complete. The roof has been

inspected and the items that were listed on the punch list have been addressed. Final payment is in progress.

• Homer Pittard Campus School

Interior piping and ductwork are progressing well. The 4-pipe loop water system is in progress on the ground floor and the second floor. The ground floor is approximately 98% complete and the second floor is about 95% complete. The fresh air ductwork on the second floor is in progress and approximately 95% complete. The roof top units are ready to be installed.

The additional concrete work and the structural steel supports are in place. This work will be accomplished on a weekend. Fan coil units for the classrooms are on site and installation is going well. The fire sprinkler piping is in progress on all three floors. The new electrical system is installed on the ground floor, the first floor and the second floor. The electrical contractor has begun changing over power on the ground floor. As this takes place the old system will be removed.

The new exterior lobby and elevator block work is complete to the second floor slab. The new entrance ramp, for the elevator lobby, foundations and walls has been poured and gravel backfill is complete. Over the Christmas holiday a lot of progress was made with interior demo and build back. The south stairwell wood handrail system was removed and the new steel system was installed and painted. Over Spring break the other stairwell will be reworked.

• Brown’s Chapel Elementary School

Biscan Construction is making good progress. The contractor had a number of crews working during the holidays. With the weather the way it has been, the subcontractors are working any dry and warm day. Roof truss installation is progressing well. At this time the trusses are set on A, F, B and a portion of the main corridor. Decking has been completed on F, and is in progress on A. The roofing contractor was able to begin work the first week of January. They have insulation and ice and water shield started on the west side of F. The interior plumbing and electrical in wall rough-in is progressing along with the interior masonry. As trusses are installed overhead piping is beginning. The geothermal well fields on the north side of the kitchen have been completed, but the lateral line connections are still in progress. The final geothermal field, well drilling is in progress. The Sewer drip system bids were received on January 8, 2009.

• Buchanan Area Middle School

The topographic survey has been completed and Barge-Cauthen has begun design for the grading and roadways. Construction and Engineering met with MTEMC on December 30, 2008 to begin design coordination with them. The paperwork has been submitted to the City of Murfreesboro to request annexation of the property into the city limits. This is necessary to get approval to connect the proposed sewer system to the city sewer system. Survey work is taking place on the Jones Foundation Property to gather information to help design the sewer line across their property. Preliminary drawings will be ready to be sent to TDOT in the next few weeks.

• DeJarnette Lane Area Middle School

The topographic work for this property has been completed. Barge-Cauthen has begun design work and have a couple of different layouts drawn. The Engineering and Construction staff, along with Barge-Cauthen, had a meeting on December 8, 2008 with the city of Murfreesboro’s Planning, Storm water, Public works, Electrical and Water and Sewer Departments. The purpose of the meetings was to get a layout approval and begin to work toward the requirements of the City of Murfreesboro.

• Siegel High School Repurified Water Irrigation Project

The project is now designed and will go out for bid. Bids will be received in the Board Room on February 17, 2009 at 2:00 P.M.

9. APPROVAL OF GRANTS/PROGRAMS/APPLICATIONS/CONTRACTS

A. Tennessee Theater Performance of the Arts – “Pinocchio”

The focus is to expose Stewartsboro Elementary School students to classical performances that enhance learning by correlating the arts with literature.

Motion made by Mr. Wise, seconded by Mr. Dorris Jernigan, to approve Stewartsboro Elementary School to have The Tennessee Theater Company perform a presentation of the arts called “Pinocchio” for all students in grades K-5 on Thursday, April 23, 2009 at 9:30 A.M. The total cost for the presentation is $1,500.00 with $1,000.00 subsidy from the Tennessee Arts’ Commission and the Community Foundation of Middle Tennessee. Stewartsboro Elementary School’s Title I Student Presentation allocation will pay $500.00.

Vote: All Yes

B. Contract with Dr. Becky Thomasson

Motion made by Mr. Wise, seconded by Mr. Kelley, to approve Smyrna Elementary School’s contract with Dr. Becky Thomasson to provide staff development to the faculty of Smyrna Elementary on January 29- 30, 2009. The staff development will directly relate to the school’s AYP (Adequate Yearly Progress) data as well as other assessments in order to provide the teachers with prescriptive instruction that will help students not meeting AYP. Smyrna Elementary School’s Title I staff development allocation will pay for 100% of the cost. Dr. Becky Thomasson’s fee is $2,000.00 per day plus travel expenses. Vote: All Yes

C. Rutherford County Schools’ Tools for Success Conference for 2009

The Instruction Department is seeking approval for the 2009 Rutherford County Tools for Success Teacher Training Conference on July 28-29, 2009. Modeled after the successful Differentiated Instruction Conference next year’s conference will be closely linked to instructional methodology to meet the revised state curriculum standards along with a noticeable increase in rigor built into those standards. We are anticipating up to 1,100 educators to attend the conference.

Motion made by Mr. Dorris Jernigan, seconded by Mr. Wise, to approve a contract for $165,893.00 with Staff Development for Educators for the Rutherford County Schools’ Tools for Success Conference on July 28-29, 2009, to be paid for with Title II funds. Vote: All Yes

D. Contract with aha! Process Inc.

Oakland High School and Riverdale High School are jointly requesting approval of a contract with aha! Process Inc. for March 4, 2009 training on Improving the Math Achievement of Under-Resourced Learner Secondary Students. Rutherford County has a history of using aha! Process Inc. as a teacher training resource when concentrating on instructional challenges associated with students in poverty. Motion made by Mr. Dorris Jernigan, seconded by Mr. Kelley, to approve a contract with aha! Process Inc. for teacher training on March 4, 2009 on Improving the Math Achievement of Under-Resourced Learner Secondary Students to be paid for with Title II funds in the amount of $1,600.00 for the contract plus travel expenses for a total not to exceed $2,600.00.

Vote: All Yes 10. FINANCIAL MATTERS

A. Rockvale Property Note Receivable

This amendment transfers $1,569,000.00 from the General Purpose School (GPS) Fund Balance in order to pay off the $1,569,000.00 note receivable on the General Purpose School accounts that was issued to purchase 84 acres of the Brown Property.

The county cannot use borrowed funds to purchase land that will not be needed for a school. If the land is not sold, it must be paid for with school funds within three years after purchase.

Motion made by Mr. Blair, seconded by Mr. Wise, to amend $1,569,000.00 from the General Purpose School Fund Balance to Transfers in order to pay off the note receivable issued for the Brown Property.

B. Building Program - Campus School Amendment

This cleanup amendment for the Homer Pittard Campus School Renovation moves existing Campus School repair funds in the amount of $178,783.00 from the 2005 Elementary Repairs and $869.00 from the 2005 Secondary Repairs to the main Campus School Renovation Budget so that the old repair projects can be closed out. (Because of the major project, these repairs were deferred and folded in to the main project.) The amendment also reallocates funds in the main renovation project to the appropriate line items where the expenditures will be charged. No new funds are being used in the project.

Motion made by Mr. Dorris Jernigan, seconded by Mr. Wise, to approve amending $178,783.00 from the 2005 Elementary Repairs and $869.00 from the 2005 Secondary Repairs to the main Campus School Renovation Budget and to amend the line items within the main Campus School Renovation Budget as presented.

Vote: All Yes C. John Colemon Renovation

The May 2008 Facilities Plan showed the McFadden Renovation as a fiscal 2009 project. Since then we have discussed proceeding with the John Colemon Renovation and deferring the McFadden Renovation until fiscal 2010 so that the renovation can address any changes needed by the change in grade structure to a K-5 school. The fall 2008 version of the facility plan listed the John Colemon Renovation instead of the McFadden Renovation. An amendment changing the renovation to John Colemon is needed for the major capital repair fund because the Commission approved the May version.

Motion made by Mr. Wise, seconded by Mr. Blair, to change the $650,000.00 2009 McFadden Renovation Project to the John Colemon Renovation Project in the Major Capital Projects Fund.

Vote: All Yes 11. APPROVAL OF NEW POLICY MANUAL

Motion made by Mr. Blair, seconded by Mr. Wise, to approve the new Rutherford County Board of Education policy manual on second reading as amended and recommended by the policy committee.

Congratulations to Mr. Wayne Blair Dr. Mark Byrnes, Board Chairman, congratulated Mr. Wayne Blair, Board Member, who has been appointed to serve a one-year term as an at-large member to the Tennessee School Boards Association Board of Directors. Oakland and Siegel High School Rezoning Mr. Gill announced that a press release has been issued regarding Oakland High School graduation rate. The statement said that he has received data showing Oakland High School did not meet the state benchmarks for its graduation rate for the 2007-2008 school year. This means the system may have to offer school choice for Oakland parents beginning next school year. However, the system has not been notified officially by the state that school choice will be mandated next year for Oakland, but we are anticipating the likelihood based on the data in-hand. The state is not expected to notify the district officially of any potential corrective action until July. The graduation benchmarks are part of the state’s implementation of the No Child Left Behind Act.

The Director of Schools said that he did not think that Oakland High School deserves corrective action because it is a good school and has made significant progress with its graduation rate.

However, with this uncertainty of what is happening with Oakland High School and potentially offering school choice, he recommends that the rezoning of Siegel and Oakland High Schools be delayed for one year.

Mr. Wise stated that rezoning will happen at some point.

Motion made by Mr. Dorris Jernigan, seconded by Mr. Kelley, to accept the Director of Schools recommendation to delay the Oakland High School and Siegel High School rezoning for one year.

After discussion, Mr. Dorris Jernigan and Mr. Kelley withdrew their motion and second.

Board Members Present Dr. Mark Byrnes, Chairman Terry Hodge, Vice Chairman Wayne Blair Donald Jernigan Dorris Jernigan Grant Kelley Richard E. Wise Harry Gill, Jr., Director of Schools The Board Chairman called the meeting to order at 5:00 P.M., January 20, 2009. The purpose of the meeting was to establish zone lines for the Brown’s Chapel Elementary School. Shane Morgan presented the proposed zone lines for Brown’s Chapel Elementary School. Motion made by Mr. Wise, seconded by Mr. Hodge, to approve zone lines for Brown’s Chapel Elementary School with the bounds of which are defined by Study Areas 1, 2, 3, 4A, and 4B. The bounds of the total area defined by state route 840 and Manson Pike to the south, Asbury Road to the east, Florence Road and Old Nashville Highway to the north, and Baker Road to the west. VOTE: All Yes RIVERDALE AND BLACKMAN HIGH SCHOOLS’ REZONING DISCUSSION Dr. Byrnes proposed that the Board explore Riverdale High School and Blackman High School rezoning by sending a survey to the parents of Riverdale High School that are in the proposal to be rezoned to Blackman High School. The survey would ask if anyone is interested in volunteering to go to Blackman High School from Riverdale High School. This is open to Riverdale High School parents only and is not a guarantee of acceptance. Transportation would not be provided. The results of the survey would be used to gauge interest from parents to aid the Board in making a decision on the rezoning proposals.

THE HIRING PARTY AGREES:

To pay a total of $7,591.00 which includes the Speaker's honorarium and all related travel expenses. If

the Hiring Party significantly modifies this training in any manner, both parties agree that the terms of

this agreement will be renegotiated.

To sign and return a copy of this agreement with a 15% deposit of $1,138.65 payable with a purchase

order, check, credit card, or money order. If you are unable to make a deposit at this time, please

provide a purchase order number for the full contracted amount.

To pay the balance of the fee no later than 30 days after the engagement or a finance charge may be

applied. All payments must be made payable to SDE, Inc., (Federal ID 31-1330847).

To make duplicates for all participants from a master set of handouts provided by the presenter.

To provide the following: an overhead projector or LCD projector, an 8-foot screen, 3 tables up front for

the Speaker, and a wireless lapel microphone (if room is large). If unable to provide this A.V.

equipment, the Hiring Party must discuss options directly with the Speaker.

Video recording during the training is not permitted.

All future professional development with Rick Wormeli will be contracted through SDE Inc.

Initial

This agreement, dated Thursday, January 8, 2009, is by and between Rutherford County School System and SDE. The parties agree that

Rick Wormeli will conduct a presentation on the topic of Block Scheduling, for grades 9-12, in Murfreesboro, TN, on the date(s) of

4/24/2009-4/24/2009 for a maximum of six instructional hours per day.

PROFESSIONAL DEVELOPMENT AGREEMENT

CANCELLATION POLICY:

If the Hiring Party cancels this training, they must call SDE at (877) 388-2054. If the Hiring Party cancels the engagement, this may

result in the loss of your deposit and you may incur travel related expenses. However, if the Hiring Party reschedules the training for a

future date, SDE will apply any paid monies towards that contract.

In the unlikely event that the Speaker scheduled for this training must cancel, SDE will provide an alternate speaker that we consider

having equal or greater presenting ability and authority on the necessary topic(s). If an appropriate alternate is not available and SDE

must cancel the training due to the Speaker's cancellation, we agree to provide this training at no charge to the Hiring Party on a later

date that is mutually agreeable to SDE and the Hiring Party.

If SDE must cancel the training due to an Act of God or other circumstance completely beyond our control, the Hiring Party will be

notified immediately and their paid deposit will be fully refunded. At the Hiring Party's request, SDE will make every effort to

reschedule the training for a future date(s) convenient for the Hiring Party.

DATE: January 20, 2009 TO: Harry Gill FROM: Angel McCloud RE: Transfer student under discipline The Board has been requested to admit a transfer student under discipline from another school system. The student previously attended an alternative school in Desoto County, Mississippi. The student was placed at the alternative school for repeated behavior infractions and was to attend at the alternative school for a minimum of six weeks. According to policy 6.318 the Board must approve all admissions when a student comes from another school system while under suspension or expulsion. I recommend that the student be admitted and placed at his zoned alternative school (Daniel McKee) subject to her compliance with all other applicable admission requirements.
