ELECTION OF COMMITTEE REPRESENTATIVES In accordance with Section 5.10 of the Local Government Act 1995, a Councillor is entitled to be a member on any committee of their choice, even though that may exceed the quorum. Additionally, the Chairman is entitled to be a member on any committee of their choice, even though that may exceed the quorum. The Chief Executive Officer is entitled to be on (or appoint a representative to) any committee having employee representation. In respect of the Deputy Councillors, Council protocol appoints the Councillors who are not members to the committee as Deputy Delegates to enable their attendance and participation in committee meetings to ensure quorums.

9.3.1 DELEGATE TO THE MUNICIPAL WASTE ADVISORY COUNCIL

SUMMARY It is proposed a delegate to the Municipal Waste Advisory Council be appointed.

BACKGROUND The Municipal Waste Advisory Council (MWAC) is a standing committee of the Western Australian Local Government Association (WALGA) with delegated authority on municipal waste issues. MWAC is formed with representation from regional councils and local government authorities. This makes MWAC a unique forum through which all the major Local Government waste management organisations cooperate. MWAC seeks to represent the entire Local Government waste management arena, including both the metropolitan and non-metropolitan areas. An Officer Advisory Group (OAG) meets prior to each MWAC meeting to provide operational comments on reports.

DETAIL MWAC meetings commence at 4pm and are usually held at the WALGA premises in ONE70, LV1, 170 Railway Parade, West Leederville WA 6007. The next meeting will be held on 11 December 2019. 9.3.2 AUDIT AND RISK MANAGEMENT COMMITTEE MEMBERSHIP

SUMMARY An Audit and Risk Management Committee is required to be established with a minimum of three members in accordance with Section 7.1A (1) of the Local Government Act 1995. WMRC has recently (OCM October 2019) broadened the committee’s scope to include risk management. Please refer to Attachment 9.3B for the committee’s Terms of Reference

BACKGROUND Section 7.1A (1) of the Local Government Act 1995 states:

A local government is to establish an audit committee of 3 or more persons to exercise the powers and discharge the duties conferred on it.

The Audit and Risk Management Committee will be required to meet at least three times in the year:

• In February of each year to consider the Compliance Audit Report • In June of each year to consider the draft Budget. • In December of each year to consider the draft Annual Report. • Appointments continue until ordinary local government elections in October 2021.

DETAIL Whilst the Audit and Risk Management Committee must comprise a minimum of three council members, if more Councillors nominate than are required to sit on the committee, then this alleviates the problem of having to fulfil a quorum. The Chairman has the right to sit on any committee if the council is advised accordingly. In addition, any Councillor is entitled to attend any committee meeting as an observer.

SUMMARY Several changes to the WMRC’s Fees and Charges are proposed to further reduce costs to Member Councils, allow the WMRC to better attract waste from other sources and to promote National Recycling Week.

BACKGROUND With the introduction of the Pre-booked Bulk Waste Verge Collection Service, some additional Fees and Charges are required in order to extend the availability of this service to Non-Member Councils. The services were designed to be easily extended to nearby local governments; both the Town of Cambridge and the City of Fremantle have shown interest in the service.

In line with WMRC’s active pursuit of reduced rates for Member Councils, it is proposed that the disposal rate for Member Council Bulk Waste collected through the Pre-booked Collections be significantly reduced.

As per last year’s successful initiative to promote National Recycling week, it is proposed that Fees and Charges for the receival of Mattresses and Bases be waived during National Recycling week.

The SMRC has called for Tenders for the disposal of residual waste from the cities of Melville and Fremantle and the Town of East Fremantle. The existing discount structure can be improved to assist in attracting business from larger volume customers.

DETAIL Pre-booked Bulk Waste Verge Collection Service – Non-member Councils With the introduction of the Pre-booked Bulk Waste Verge Collection Service, some additional Fees and Charges are required in order to extend the availability of this service to Non-Member Councils. The services were designed to be easily extended to nearby local governments; officers from both the Town of Cambridge and the City of Fremantle have shown interest in the service.

Member Councils will benefit from Non-member Councils taking up the service in two ways: firstly, the attractive discount structure will take effect, reducing costs to Member Councils who use the Service. Secondly, provision of this service to Non-member Councils will generate additional income which can be used to offset costs to Members or to provide additional services.

Two additions to the Fees and Charges are proposed: A Cover charge for the provision of the Pre-booked Collections Service to Non-member Councils. The Member Council charge for this service

is set at 7% over the collection cost. It is proposed that the equivalent charge for Non-Member Councils be set at 12%. This charge will cover the cost of designing and printing the appropriate communication and education materials. Staff time will be required to manage the communications rollout, and to manage the collection service contract on behalf of Member Councils.

To make this service more attractive to Non-member Councils, it is suggested that the disposal rate for Non-member Council Bulk Waste collected through the Pre-booked Collections be significantly reduced. This would currently be chargeable under the Non-member Council Bulk Waste rate of $200 per tonne (ex. GST). It is suggested this be reduced with the introduction of a new charge: Non-member Council Bulk Waste (Pre-booked Collections) set at $135 per tonne (ex GST).

Member Council Bulk Waste (Pre-booked Collections) In line with WMRC’s active pursuit of reduced rates for Member Councils, it is proposed that the disposal rate for Member Council Bulk Waste collected through the Pre-booked Collections be significantly reduced.

This would currently be chargeable under the Member Council Bulk Waste rate of $155 per tonne (ex. GST). It is suggested this be significantly reduced with the introduction of a new charge: Member Council Bulk Waste (Pre-booked Collections) set at $125 per tonne (ex GST). This reduction is achievable because this rate does not need to cover the costs of handling at the WMRC transfer station and haulage, but only disposal at the processing site.

National Recycling Week – Mattress Fee Waiver As per last year’s successful initiative to promote National Recycling week, it is proposed that Fees and Charges for the receival of Mattresses and Bases be waived during National Recycling week.

Last year this doubled the number of mattresses received in the week; if it has the same effect this year, we expect this to add an extra 10-20 mattresses which represent a foregone income of $250-$500.

The offer does also support increased resident awareness of the services at the West Metro Recycling Centre.

SMRC Request for Tender Response

The SMRC has called for Tenders for the disposal of residual waste from the cities of Melville and Fremantle and the Town of East Fremantle. Disposal of such waste streams is one of the services WMRC provides as part of its core business.

The existing discount structure can be improved to assist in attracting business from larger volume customers. It is suggested that two new tiers of discounts to the rates for Bulk and General Waste be adopted, as per Attachment 101.A. The discounted rates under these tiers would be a further 5% for volumes between 2,400 and 3,999 tonnes per year, a further 5% for volumes between 4,000 and 9,999 tonnes per year and a further 5% for volumes over 10,000 tonnes per year. To enable WMRC to competitively tender for such arrangements, it is suggested Council adopt a price for the Non-member Council General Waste until 30 June 2022, being the current charge plus CPI. If any changes are made to the Landfill Levy during that time period, this charge will be raised by an equivalent amount.

Given the tight timeframes for the SMRC Tender Submission, which closed on 1 November 2019, a Tender Offer was submitted on this basis, noting that this offer was subject to confirmation by WMRC. If this is not confirmed, the Fees and Charges as at 1 November 2019 will apply.

Conditions for discounts are proposed: Discounts available by prior arrangement for account customers only. Discounts are calculated on a financial year basis. Once a customer passes a discount threshold, the discount will apply to all tonnes received from that customer in a financial year. Discounts are not applicable for WMRC Member Councils or for WMRC's Pre-booked Bulk Service.

STATUTORY ENVIRONMENT

Section 6.16 of the Local Government Act 1995 permits the imposition of fees and charges when adopting the annual budget or during the financial year via an Absolute Majority decision of Council.

Financial Implications

The fee changes to commercial services will allow WMRC to meet its budgeted objectives for attracting additional commercial waste. They will not negatively impact on WMRC’s finances.

Strategic Implications This is designed to contribute to the following key strategies:

1. Achieve a comprehensive, cost effective waste management service across the region 2. Increase the number of Councils, businesses and people using our services 3. Divert waste from landfill making materials and energy recovery available 4. Promote and facilitate waste avoidance and responsible waste management in the

OPENING HOURS DURING THE CHRISTMAS PERIOD Responsible Officer: Manager Operations

SUMMARY Each year, Council approves the trading hours of the WMRC for the upcoming calendar year or any changes to previously approved trading hours.

BACKGROUND

The West Metro Recycling Centre is historically closed on Christmas Day and New Year’s Day and opens between 7.30am and 1.00pm on public holidays. This is included on all promotional material for the facility.

For the past five years, the WMRC Administration Office has been closed during the Christmas and New Year period, although staff may work on days not identified as a public holiday.

DETAIL It is proposed that the WMRC Administration Office be closed from 4.00pm Tuesday 24 December 2019 and remain closed each day thereafter until reopening on Thursday, 2 January 2020. As most enquiries during this period will relate to waste disposal it is proposed that the Recycling Hotline number be forwarded to the West Metro Recycling Centre during that time so that clients and/or the public will not be unduly inconvenienced by this arrangement.

WMRC Officers would be required to make appropriate leave arrangements during this period. Public holidays will be observed on:

• Wednesday, 25 December 2019 (Christmas Day) • Thursday 26 December 2019 (Boxing Day) • Wednesday, 1 January 2020 (New Year’s Day)

It is proposed the West Metro Recycling Centre be opened on the following days and times over the Christmas and New Year period:

3 DECISION ITEMS

3.1 MWAC Structure and Funding***

MUNICIPAL WASTE ADVISORY COUNCIL MOTION (CR PRICE / CR COOK) That the Municipal Waste Advisory Council:

1. Endorse Scenario 1 for MWAC Structure subject to the increase of State Council representation to 3 – one metropolitan and one non-metropolitan and one other member.

2. Endorse Scenario 1 for MWAC Structure and Funding which is to expand the Council’s membership to include: a. Regional Subsidiaries b. Beneficial Enterprises c. Regional Centres (Cities) d. Metropolitan Local Governments, with significant waste infrastructure (landfill/transfer station),

not currently member of Regional Council e. Voluntary Regional Organisations of Councils (VROC).

3. Agree that a differential base rate for MWAC membership be applied to Local Government entities in the Metropolitan ($5,000) and Non-Metropolitan areas ($2,000) in acknowledgement of the travel and associated costs for MWAC members in the Non-Metropolitan area.

In Brief

MWAC has considered various options for the restructure of the Council and were supportive of expanding the membership base.

This option would ensure that MWAC can continue to represent all Local Government entities with an interest in waste management.

Relevance to Strategic / Business Plan: This item relates to MWAC’s ability to represent the sector. Background The majority of MWAC’s current funding is from Regional Councils, WALGA and the Waste Authority (through the Household Hazardous Waste Program). Regional Councils and WALGA contribute the same amount – with the Regional Council contributing on the basis of population (and a minimum contribution). If Local Governments withdraw from Regional Councils this impacts the cost distribution for the remaining members. Comment MWAC exists to ensure all Local Government entities with an interest in waste are represented and have the opportunity to provide input into the sector’s advocacy and policy development. The proposed new structure and approach, in line with this purpose, is to expand MWAC’s Membership to include all Local Government organisations with a material interest in waste management. MWAC considered this issue at the August meeting. The Officers Advisory Group discussed the potential for the base level contribution to MWAC (currently $5,000 – plus a portion of funding related to population) to be a barrier for non-metropolitan Local Government entities. This issue has previously been raised by OAG members as there are substantial costs associated with travel and accommodation to attend meetings. Therefore the Officers have recommended that a differential base level contribution be applied to MWAC, with metropolitan Local Government entities paying $5,000 base level contribution and non-metropolitan Local Government entities paying $2,000. This was in recognition of the additional costs for participation for Local Government entities in the non-metropolitan area. Discussion at the Municipal Waste Advisory Council The group is supportive of a differential base level contribution to ensure a broad representation of metropolitan and non-metropolitan Local Government entities from across the state. Subsequent to further consideration of

Scenario 1 MWAC agreed to increase of State Council representation from one to three members (one metropolitan, one non-metropolitan and one other member) thereby increasing the MWAC membership from 20 to 22. Concern was raised as to when the proposed funding model would be adopted as some members have been invoiced for the 2019/2020 financial year. The Executive Manager highlighted that the new funding potential proposed in Scenario 1, where some members would see a decrease in their contribution, is contingent on the level of uptake. Furthermore, a significant amount of work will need to be undertaken to establish a new membership basis. A review of the MWAC structure was largely driven by changes in the Local Government Act and instigation of Regional Subsidiaries, therefore it would be judicious to await these reforms taking place in the first instance. The group will be updated with progress at the penultimate meeting of the current financial year where it is anticipated a decision can be made as to whether to proceed with the proposed funding model.

3.2 Submission on Local Government Waste Plans***

MUNICIPAL WASTE ADVISORY COUNCIL MOTION (CR PRICE / CR COOK) That the Municipal Waste Advisory Council endorse the Submission on DWER Local Government Waste Plan Resource Kit. In Brief

The Local Government Waste Plans are a requirement of the Waste Avoidance and Resource Recovery Strategy and present an opportunity to align Local Government outcomes.

It is important to ensure that in the Plans implementation the administrative burden on Local Government is minimized.

Relevance to Strategic / Business Plan:

Key Results Area 2: Advocacy. o Strategy 2.2: Making comment on relevant policy, programs, legislation and regulation. o KPI 5: Respond to all relevant State/Federal waste specific policy, programs, legislation and

regulation. Background The Department of Water and Environmental Regulation have released a Resource Kit – comprised of a Guidance Document and Template – for Local Government Waste Plans. MWAC staff provided DWER with some initial feedback on the Waste Plans prior to the release of the Draft requesting a more streamlined approach to the structure of the Plans. This feedback has only had limited incorporation. Submissions on the draft Waste Plan Resource Kit are due by 26 September. Comment MWAC discussed the draft MWAC Submission on the Waste Plans at the August meeting and the feedback from the Council was incorporated into the Submission. The draft Submission was also circulated to Local Governments for any comment. At the Officers Advisory Group meeting it was raised that the Department had also developed a Waste Plan Template for Regional Councils. Concern was expressed regarding what the Plan would include, as Regional Councils operations vary greatly and many waste related activities are carried out by the Regional Councils individual Local Government members. Additional commentary was included in the draft Submission regarding the Regional Council Waste Plan concept. Discussion at the Municipal Waste Advisory Council This item was passed with minimal discussion.

3.3 Submission on Waste Authority Data Strategy***

MUNICIPAL WASTE ADVISORY COUNCIL MOTION (CR PRICE / CR COOK) That the Municipal Waste Advisory Council endorse the Submission on Waste Authority Data Strategy. In Brief

The Waste Authority released a draft Data Strategy for comment. MWAC considered a draft Submission at the Councils August meeting. The Submission is now presented for endorsement.

regulation. Background MWAC has an existing Policy Statement on Waste Management Data and Information Management and this has been used to guide the development of the draft Submission. The Submission on the draft Strategy was due 6 September. Comment MWAC considered the draft Submission at the August MWAC meeting and no amendments were made. Discussion at the Municipal Waste Advisory Council This item was passed with minimal discussion.

3.4 Submission on Auditor General Report on Local Government Performance***

MUNICIPAL WASTE ADVISORY COUNCIL MOTION (CR PRICE / CR COOK) That the Municipal Waste Advisory Council endorse the Submission to the Office of the Auditor General on Local Government Waste Management. In Brief

The Office of the Auditor General announced an inquiry into Local Government waste management service delivery in June 2019, focusing on auditing specific Local Governments.

A brief Submission to the inquiry has been developed, identifying the constraints on Local Government in delivering services and the range of factors which influence service delivery.

Relevance to Strategic / Business Plan:

Key Results Area 2: Advocacy. o Strategy 2.2: Making comment on relevant policy, programs, legislation and regulation. o KPI 5: Respond to all relevant State/Federal waste specific policy, programs, legislation and

regulation. Background The Auditor General identified that the revised Waste Avoidance and Resource Recovery Strategy 2030 was published in February 2019 and outlines 3 key objectives and targets to ‘avoid’ waste generation, ‘recover’ resources and values from waste, and ‘protect’ the environment. The Auditor General considers that Local Governments have a key role to help the State progress best practice waste management approaches and encourage community participation.

The objective of the audit is to determine whether Local Governments plan and deliver effective waste management services to their communities.

The Auditor General identified the following lines of inquiry:

Are waste services planned to minimise waste and meet community expectations? Do local government entities deliver effective waste services? Does the State Government provide adequate support for local waste planning and service delivery?

Tabling of the Audit is anticipated in the first quarter of 2020.

Comment The Auditor General is focusing on auditing specific Local Governments – metropolitan and non-metropolitan and Regional Councils in relation to these objectives. The draft Submission that has been developed draws on previous Submissions and identifies the constraints on the Local Government sector in relation to service delivery and the relatively recent direction being provided by the State Government. The Officers Advisory Group discussed the relevance of the questions in the review to Regional Councils – particularly as one Regional Council had been included in the Audit. Commentary has consequently been included in the draft Submission identifying the variety of operations, approaches, Constitutions / establishment agreements which govern Regional Council operations. Discussion at the Municipal Waste Advisory Council The draft Submission references the general competency powers of Local Governments under the Local Government Act in response to the Auditor General’s lines of inquiry. Once initial findings are made public, it is expected that Local Governments who participated will be afforded a right of reply which will be incorporated into the final report.

4 DISCUSSION ITEMS

4.1 Climate Change Issues Paper

In Brief

The State Government has released a Climate Change Issues Paper which seeks to inform the development of a State Climate Change Policy. The Paper includes waste reduction as one of the 11 areas for action.

For Discussion

Key issues for inclusion in the WALGA Submission on the Climate Change Issues Paper. Background WALGA will be developing a comprehensive submission on the Climate Change Issues Paper, referencing the recently reviewed WALGA Climate Change Policy. There is an opportunity to provide waste specific input into the Submission. Officers discussed the matter and identified the following issues:

Importance of having a clear objective for the Policy, to ensure its implementation can be measured

Identification of initiatives that have occurred to date and their net results

Connection of emissions reductions and correct waste separation behaviour by the community

Use of recycled material, rather than raw materials as a key strategy with quantifiable benefits

Use of the Federal methodologies for net greenhouse gas reduction measurement

Linking the waste hierarchy and circular economy into the paper

Minimising waste generation and optimising resource recovery.

Discussion at the Municipal Waste Advisory Council The State Government has committed to releasing a State Climate Change Policy in 2020 and it has not been made clear as to what the consultation phase will involve, if any. Local Governments are strongly encouraged to provide feedback individually or via the WALGA Submission in order to inform the creation of a Climate Change Policy for WA. Given the Issues Paper lacks detail, it was suggested that one line of inquiry could be to address issues pertaining to the Waste Levy and how it will be allocated to fulfil the objectives and targets of the Waste Avoidance and Resource Recovery Strategy 2030 and accompanying Action Plan.

5 INFORMATION ITEMS

5.1 Senate Inquiry into the Product Stewardship Amendment Bill

On 12 September 2019, the Senate referred the Product Stewardship Amendment (Packaging and Plastics) Bill 2019 to the Environment and Communications Legislation Committee for inquiry and report by Thursday of the first sitting week in May 2020.

Information regarding the bill can be found at the committee's website under 'Current Inquiries'. WALGA has been invited to develop a Submission for the Inquiry. Submissions are due by 21 November. A draft Submission will be developed in October/November and circulated for comment to the OAG and MWAC.

5.2 CDS Progress

The Scheme Coordinator has hosted a number of workshops across the State on how to set up a refund point.

The MWAC Executive Officer has presented to 2 Zone meetings and another grouping of Local Governments on the Scheme, opportunities and issues.

WALGA has been in discussion with Department of Planning and Department of Water and Environmental Regulation regarding the need to ensure that CDS infrastructure is expedited through the Planning process.

Discussion at the Municipal Waste Advisory Council Concern was raised over the lack of information available for Local Governments interested in becoming a Refund Point Operator. A considerable amount of detail required by the Scheme Coordinator for the tender process has been difficult, in some cases unrealistic, for interested parties to respond to without knowledge of what the network will be. It was also noted that the Scheme Coordinator will only provide software for IT equipment. Without any funding assistance, it would be almost impossible for community groups and isolated facilities to be involved in the CDS as a Refund Point Operator.

5.3 National Waste Policy – Action Plan

Following the COAG announcement regarding the development of a timeline for export bans for certain materials, the National Waste Policy Action Plan has been revised by the Federal Department of Environment. WALGA has provided comment into the development of the Action Plan via the Australian Local Government Association and focused on the need for a phased approach to any future export bans – including infrastructure and market development.

5.4 Waste Authority Business Plan 2019/20 Released

The Waste Authority Business Plan for the current financial year has now been released. The previous year’s Business Plan has also been released. An analysis of the Plans will be undertaken for the December MWAC meeting.

5.5 Meet the Waste Authority Breakfast

WALGA is hosting a meet the Waste Authority Breakfast on Wednesday 30 October at the Joondalup Resort. This will provide attendees with the opportunity to meet the new Waste Authority and discuss key issues in an informal setting. To register visit the WALGA Website.

5.6 Expressions of Interest – Bin Tagging & Household Hazardous Waste

WALGA received funding from the Community and Industry Engagement Grants to implement Bin Tagging with at least 5 Local Governments in the 19/20 financial year. The EoI to be part of the Program is out now and due 1 November 2019.

The Household Hazardous Waste Program is now seeking expressions of interest to host Temporary Collection Events and for new HHW Permanent facilities, the EoI’s for these are due 22 November 2019.

6.1 Working Groups/Committee Reports

1. Metropolitan Regional Council Working Group

Delegates/Nominees: Mr Tim Youé, Working Group Chair This Group met with the WALGA CEO and Chair of the Waste Authority on Monday 23 September.

2. Reducing Illegal Dumping Working Group Delegates/Nominees: n/a This Working Group has not met since the previous MWAC meeting.

3. Vergeside Collection Working Group Delegates/Nominees: n/a This Working Group has not met since the previous MWAC meeting.

4. State Government Container Deposit Scheme Advisory Group Representative: MWAC Executive Officer / Mr Tim Youé This Group met on 29 August to discuss the Regulations which will govern the Scheme’s implementation.

5. Container Deposit Scheme Policy Forum Representative: MWAC Chair The Policy Forum met on Monday 2 September to discuss the development of the Scheme and key issues to date.

6. Waste Reform Advisory Group Representative: MWAC Chair, MWAC Executive Officer and CEO of SMRC This Working Group has not met since the previous MWAC meeting.

7. State / Local Government Waste Partnership Agreement Working Group Representative: MWAC Chair, OAG Chair, Stefan Frodsham (WMRC) and Morné Hattingh (Karratha) This Working Group has not met since the previous MWAC meeting.

Audit and Risk Committee Terms of Reference

Establishment

The Audit and Risk Committee is established by the WMRC under section 7.1A(1) of the Local Government Act 1995.

Objective

The primary objective of the Audit and Risk Committee is to guide and assist the WMRC in carrying out its financial management and auditing functions; and report to Council on the organisation's progress of such matters.

Areas of responsibility

The Audit and Risk Committee is to:

• develop each year an Annual and a three year Strategic Audit Plan;

• review internal and external audit reports and ensure their recommendations areimplemented;

• recommend the appointment to council of an internal auditor, if circumstanceswarrant;

• oversee the implementation of any actions in accordance with regulation 16(f) of theLocal Government (Audit) Regulations 1996.

• guide and assist the WMRC in carrying out its functions:o under Part 6 – Financial Management, of the Local Government Act 1995;o in relation to audits conducted under Part 7 – Audit, of the Local Government

Act 1995; ando relating to other audits and other matters related to financial management.

• review the CEO’s report into the appropriateness and effectiveness of a localgovernment’s systems and procedures in relation to risk management, internalcontrol and legislative compliance, given to it by the CEO under regulation 17 of theLocal Government (Audit) Regulations 1996;

• develop a risk identification program and a strategy to address risk;

• once a year report on risk within the WMRC and satisfy itself that theappropriate controls and processes are in place and are adequate for dealing withthose risks;

Membership

Membership of the Audit and Risk Committee is comprised of three (3) members of Council.

Council at its discretion may appoint one representative of the community with local government experience and/or formal auditing or accounting or company director experience.

Meetings

The Committee meets as required and at least three times per year. Special meetings can be initiated by any committee member or an internal auditor.

Delegated Authority

There are no powers delegated to this Committee.

Reporting

Recommendations from this Committee will be referred to Council for consideration.

Term

Appointment is for two years; and members are eligible for re-appointment.
