Audit Update Baker Tilly conducted their preliminary audit fieldwork during the week of January 11-15. As a result of their initial assessment of federally funded grant programs, they determined that they will be focusing this year’s Single Audit testing on KDOT’s IDOT projects and the Community Development Block Program. (Last year they focused on the Workforce Development program.) The auditors will return for the month of March for their final audit fieldwork. FY2015 General Fund Revenue Variance Comments As of January 25, 2016, total General Fund revenue is about $3.2 million more than budgeted. The following is a recap of some of the major General Fund revenue variances in descending order. Circuit Clerk General Circuit Division Fees (376,697) Downward trend Sheriff Chancery Foreclosure Fees (471,000) Decline in foreclosures Total General Fund Revenue Variance 3,248,218 FY15 General Fund Expenditure Variance Comments As of January 25, 2016, total General Fund expenditures are about $1.9 million less than budgeted and all General Fund departments have a positive variance except for Judiciary & Courts which has a negative $4,406 variance and the Sheriff’s Office which has a negative $25,632. Budget adjustments have been submitted to address both of these budget overages. Expenses will continue to be accrued through the month of February, so the total overall positive expenditure variance is expected to be reduced. FY15 Special Revenue Fund Variance Comments All Special Revenue Funds have a positive expenditure variance except for the following:

• Grand Victoria Casino Elgin has a negative 1.4% variance due to a $150,000 payment to the Forest Preserve that was budgeted for FY14 but was not paid until FY15.

• Regional Office of Education has a negative 0.1% variance due to an outstanding portion of annual payroll expense for which we are expected to be reimbursed by the ROE.

• Children’s Waiting Room is 34.8% over budget due to greater than anticipated cost to operate by the Kane County Bar Association. There is sufficient cash-on-hand to cover this overage.

• Coroner’s Administration Fund is projected to be 31% over its operating budget of $57,900 ($84,900 total budget less $27,000 capital budget) as a result of the Coroner transferring $18,600 of expense from the Coroner’s General Fund department. A budget adjustment has been submitted to address this overage.

• Probation Victim Services has a negative 5% variance due to greater than budgeted expense incurred. However there is sufficient cash-on-hand to fund the overage.

• Community Development Block Program is 7.5% over the expense budget. However, since this is an expense reimbursement program, the additional expense will be covered by additional revenue once the year-end accruals are posted.

• The Health Insurance Fund currently indicates a favorable expense variance of 3%. However, there is still expense relating to claims incurred in FY15 but not yet processed that will be accrued as part of year-end based on an actuarial analysis. The current projection indicates a possible overage of about $500,000, which will be funded by the health insurance reserve.

Financial Reports for County Board Office, Grand Victoria Casino Elgin and Farmland Preservation The greater than expected revenue in the County Board Office General Fund and Farmland Preservation Fund are the result of Riverboat transfers that occur at the beginning of the year. Similarly, the greater than

expected expense in the Riverboat Fund is the result of transfers for internal Riverboat grants that occur at the beginning of the year. County Revenue Streams Suspended by State of Illinois The following is an updated list of revenue streams that are impacted by the State of Illinois budget impasse. Salary reimbursements for the Supervisor of Assessments, State’s Attorney and Public Defender remain outstanding. In addition, we’ve learned that the annual salary reimbursement from IDOT for the County Engineer salary has not yet been received, and will not be issued until the IDOT budget is approved. We have also become aware of two significant grants that are partially State funded for which payments have ceased: the State’s Attorney’s Office Title IV grant and the Kane County Health Department’s Local Health Protection grant. Trade-in Value: $($21,150 unit 25/$21,150 unit 38/$20,150 unit 47/$20,150 unit 48) These plow trucks will replace 2 current plow trucks (units 25 &38). Normal replacement of this type of vehicle is every 13 to 15 years. Replacement is based on age, mileage, dependability and maintenance cost. The 2nd lowest acceptable bid was from Trans Chicago Truck Group (Freightliner). They were $97 higher (per truck) than Rush Enterprises (international), lowest bid. Recommendation by fleet maintenance staff is they prefer the Freightliner chassis. We have both International and Freightliner plow trucks, the Freightliner has a little better track record for dependability and lower repair costs. This is our justification for spending $97 more per truck. Please refer to bid tab. These vehicles are included in the FY2016 Transportation Budget. Staff requests committee approval.

Due to changes in plow routes from making adjustments for correct levels of service during and around snow events, and overall better equipped plow trucks being able to do more with less, units 47 and 48, which meet the County requirements for replacement, are no longer needed, so they will not be replaced. Any immediate known future expansion of KDOT roadways, like Long Meadow, is already figured into this adjustment. Road expansion beyond that will be our justification to add these trucks back into the fleet if necessary. This is part of an ongoing adjustment of equipment, training and testing over the last 8 years or so, which we believe we have about completed.

This resolution seeks to authorize a contract extension (per resolution # 13-26) for a period of twelve months with WM Curbside, LLC to continue to provide curbside household hazardous waste services to residents of Burlington, Dundee, Elgin, Hampshire, Rutland, and Plato Townships, and the Mill Creek SSA. The total cost of the contract is not to exceed $30,000 pre year. A total of $25,000 is contributed annually to the County towards this program from the Villages of Carpentersville, South Elgin, and West Dundee, and the Mill Creek SSA. The end cost to the County therefore is approximately $5,000 per year.

APPROVING THE FY16 CONTRACT EXTENSION WITH WM CURBSIDE, LLC FOR HOUSEHOLD HAZARDOUS WASTE SERVICES

WHEREAS, the Kane County Solid Waste Management Plan, adopted by the Kane County Board in 1992, and most recently updated in 2015, continues to support County programs that divert household hazardous wastes (HHW) from the landfills; and

WHEREAS, the County has a current contract with WM Curbside, LLC (per resolution #13-

26) to provide more convenient service for proper handling of HHW to residents of Burlington, Dundee, Elgin, Hampshire, Rutland, and Plato Townships, and the Mill Creek SSA; and

WHEREAS, Curbside has provided satisfactory service to County residents since 2000 and

the current contract has a "mutual option to extend for two (2) additional one (1) year renewal periods", this being the first one (1) year renewal; and

WHEREAS, the 2016 budget for the Enterprise Surcharge Fund (650) includes $40,000

funding for HHW programs, and a total of $25,000 is contributed annually to the County towards this program from the Villages of Carpentersville, South Elgin, and West Dundee, and the Mill Creek SSA, from funds collected via waste hauler contracts; and

WHEREAS, the Division of Environmental and Water Resources in cooperation with the

Purchasing Department have reviewed this contract and recommended its extension, with mutual consent of WM Curbside, for a period of twelve months ; and

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman is

hereby authorized to extend the contract with WM Curbside, LLC to continue to provide household hazardous waste services for FY 2016 to residents of the said northern six townships and the Mill Creek SSA, invoiced on a per use basis, in an amount not to exceed Thirty Thousand Dollars ($30,000). A copy of said contract shall be kept on file with the Kane County Auditor.

APPROVING THE FY16 RIDER ON THE CONTRACT FOR ELECTRONICS RECYCLING SERVICES WITH EWORKS ELECTRONICS SERVICES

WHEREAS, the Illinois Electronic Products Recycling and Reuse Act (PA 97-0287) and the amendments expanding the act (SB2106), bans the landfill disposal of used electronics; and

WHEREAS, beginning in January 2012, all manufacturers of electronic products must register with the Illinois EPA and meet an annual recycling goal, and therefore fund the recycling of electronics under the above legislation; and

WHEREAS, electronics manufacturer's weight-based goals are set far too low in the law (compared to what programs are actually collecting) and so goals are being met before the end of each given year, at which point the manufacturers cease to fund the recycling of electronics and all costs are shifted to the recyclers and then to the collectors (in this case, the County); and

WHEREAS, the instability of the electronics recycling industry is due to larger state-wide legislative flaws affecting all Illinois counties, and revenue earned under the original contract is no longer an option; and

WHEREAS, eWorks, the current service provider under contract until 1/14/17 provides assurance of a cost-free program for a portion of 2016, based on a set weight of electronics that eWorks has pledged to recycle for their partner manufacturers that they are pledging to Kane County at this time; and

WHEREAS, it is uncertain when Kane County collection programs will exhaust the allotted pounds, and the cost of the program thereafter is as yet unknown, and this Rider serves to outline terms of contract through the duration of the cost-free program; and

WHEREAS, in advance of reaching the limit of the cost-free program, staff will negotiate the most cost-effective program going forward, for the recycling of used electronic equipment for the County's public recycling program; and

NOW, THEREFORE, BE IT RESOLVED that the Chairman is authorized to approve the Rider specified in the title of this resolution for the contract year starting 1/15/16 and ending 1/14/17 or until further amendments are made prior to the transition to a for-cost program.

INTERGOVERNMENTAL AGREEMENT BETWEEN KANE COUNTY AND SAINT CHARLES TOWNSHIP

WHEREAS, Saint Charles Township desires assistance to meet short term obligations and

requests to enter into an intergovernmental agreement with Kane County; and

WHEREAS, Kane County has sufficient funds to assist Saint Charles Township subject to

the following terms and conditions:

Kane County will provide via electronic transfer $250,000 to Saint Charles Township on or

before March 1, 2016.

Kane County will provide via electronic transfer $150,000 to Saint Charles Township

Cemetery District on or before March 1, 2016.

Saint Charles Township and the Saint Charles Township Cemetery District shall allow Kane

County to be reimbursed from property tax collections by payment from the Kane County Collector

until the funds are recovered based on the following schedule:

1. From the First Property Tax Distribution after June 1, 2016

2. From the First Property Tax Distribution after September 1, 2016

AUTHORIZATION FOR INTERGOVERNMENTAL AGREEMENT WITH THE SUPREME COURT OF ILLINOIS FOR LEASE OF SPACE IN THE 3RD STREET COURTHOUSE

WHEREAS, the Illinois Supreme Court requests to utilize certain space in the Third Street Courthouse for purpose of establishing offices and hearing rooms for the Kane County Mandatory Arbitration Program and there is sufficient available space in the Third Street Courthouse to accommodate the Illinois Supreme Court’s desire to continue to lease space; and

WHEREAS the County of Kane has the authority to lease space to the Illinois Supreme

Court pursuant to code 50 ILCS 605/3.1 and this lease would serve a public purpose and benefit; and

WHEREAS, the initial term lease agreement was from January, 2011 through December,

2013, with a one year lease extension in January 2014 through December 2014; and

WHEREAS, the Illinois Supreme Court desires a three (3) year lease agreement with the

County of Kane for the use of rooms 210, 211,212 and 214 from January 1, 2015 to December 31,

2018, for a an annual base rent of Thirty thousand five hundred twenty six dollars and ninety two

cents ($30,526.92) per year paid in monthly installments of Two thousand five hundred forty three

dollars and ninety one cents ($2,543.91); and

WHEREAS, lessee shall have the right to renew the lease for a further term of three (3) years or

any such portion, per County of Kane approval.

NOW, THEREFORE, BE IT RESOLVED, by the Kane County Board that the Chairman

thereof is hereby authorized to enter into the intergovernmental agreement with the Illinois Supreme

Court for lease of space at the Third Street Courthouse.

WHEREAS, the Kane County Drug Rehabilitation Court had received a grant from the Substance Abuse and Mental Health Services Administration (SAMHSA) for Three Hundred Twenty Five Thousand Dollars ($325,000) for year one of the grant, to enhance programming for non-violent offenders with substance dependence and co-occurring (substance dependence accompanied by a mental health diagnosis) with issues by providing supplementary services; and

WHEREAS, the grant funding was approved through Kane County Resolution 15-22; and WHEREAS, at the end of the 2015 Federal Fiscal Year, on September 30, 2015, there was

a surplus of unexpended funds in the amount of One Hundred Nineteen Thousand Six Hundred Sixty Four Dollars and Seventy Nine Cents ($119,664.79) which SAMHSA has approved the rollover of funds into Kane County’s current fiscal year; and

WHEREAS, the corresponding expense budgets should be increased in the amounts of,

WHEREAS, the Kane County Board approved Ordinance #15-52 on February 10, 2015, which removed the Fiscal Year 2015 budget for the Sheriff’s Office Adult Prisoner Board & Care line item since the US Marshals Service contract had been terminated and there was no longer a need to house detainees outside of the county facility in order to maximize space for housing federal detainees inside the County facility; and

WHEREAS, expense continued to be incurred for occasionally housing detainees outside of

the county facility for reasons other than maximizing space for federal detainees; and WHEREAS, $28,600 of the Adult Prisoner Board & Care expense was unable to be

absorbed by savings on other line items within the Sheriff’s Office budget. NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Fiscal Year

2015 budget be amended as follows:

WHEREAS, X-Ray Scanners are essential to providing adequate security at the Judicial

Center, Kane Branch Court, Geneva Court House and Juvenile Justice Center ; and

WHEREAS, the Sheriff has determined that three (3) of the X-Ray Scanners need to be replaced in order to continue providing adequate security and to avoid disruption of services; and

WHEREAS, the funding for the replacement of these three (3) X-Ray scanners is available

in the Fiscal Year 2016 Capital Budget (Fund 500) on a line item originally intended for the purchase of Digital Surveillance Cameras for which another source of funding has been identified and utilized; and

WHEREAS, a competitive evaluation was conducted as required by the Kane County

Purchasing Ordinance through the solicitation of quotes; and WHEREAS, quote #2556 received from Event Metal Detectors, LLC totaling $71,250

(including delivery, setup and training) has been determined to best fit the Sheriff’s requirements for adequate courthouse security; and

WHEREAS, this purchase has already been approved in accordance with the emergency

purchase provision of the Kane County Procurement Code to expedite the ordering and installation of the three (3) replacement X-Ray scanners to ensure public safety and to avoid a disruption of service caused by failure of the remaining scanners.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the County Board

hereby ratifies the emergency purchase of three (3) X-Ray Scanners from Event Metal Detectors, LLC for a price of $71,250, including delivery and training, to be paid from Fund 500, and hereby authorizes the County Board Chairman to enter into and execute on behalf of the County of Kane a purchase contract for such equipment in accordance with the terms described herein. WHEREAS, Kane County administers annual allocations of federal workforce development funding provided by the Illinois Department of Commerce and Economic Opportunity for the local workforce development area which includes Kane, Kendall and DeKalb Counties; and

WHEREAS, said funding had been authorized under the Workforce Investment Act (WIA), which was recently superseded by the Workforce Innovation and Opportunity Act (WIOA); and

WHEREAS, under WIOA, all local workforce development areas are required to prepare and adopt a four-year plan for the delivery of workforce services; and

WHEREAS, the plan must conform to draft regulations and policies recently released by the U.S. Department of Labor; and

WHEREAS, the local Workforce Development Board, which oversees the workforce development program, has authorized Kane County to procure the services of a consultant to gather relevant data and information and prepare the plan; and

WHEREAS, the Kane County Purchasing Department has conducted a competitive Request for Proposals (RFP) process for the local workforce development planning services sought by the Workforce Development Board; and

WHEREAS, four proposals were received and the local Workforce Development Board’s Executive Committee and WIOA Transition Committee met jointly as an evaluation panel to review the proposals; and

WHEREAS, the evaluation panel selected Public Consulting Group, Inc. of Boston MA, and the Workforce Development Board’s Executive Committee authorized the county to award a contract to the firm in an amount not to exceed $97,084, with the provision that the county negotiate certain reductions to the final scope and contract amount.

WHEREAS, the Office of the States Attorneys Appellate Prosecutor was created to provide services to State’s Attorneys in Judicial Districts containing less than 3,000,000 inhabitants; and WHEREAS, the powers and duties of the Office of the States Attorneys Appellate Prosecutor are defined and enumerated in the “State’s Attorneys Appellate Prosecutor’s Act”, 725 ILCS 210/1 et seq., as amended; and WHEREAS, the Illinois General Assembly appropriates monies for the ordinary and contingent expenses of the Office of the States Attorneys Appellate Prosecutor, one-third from the States Attorneys Appellate Prosecutor’s County Fund and two-thirds from the General Revenue Fund, provided that such funding receives county approval and support from within the respective Judicial Districts eligible to apply; and WHEREAS, the Office of the State’s Attorneys Appellate Prosecutor shall administer the operation of the appellate offices so as to insure that all participating State’s Attorneys continue to have the final authority in preparing, filing, and arguing all appellate briefs and any trial assistance; and WHEREAS, the Office of the State’s Attorneys Appellate Prosecutor and the Illinois General Assembly have reviewed and approved a budget for Fiscal Year 2016, which funds will provide for the continued operation of the Office of the State’s Attorneys Appellate Prosecutor. NOW, THEREFORE, BE IT RESOLVED that the Kane County Board, does hereby support the continued operation of the Office of the State’s Attorneys Appellate Prosecutor and designates the Office of the State’s Attorneys Appellate Prosecutor as its agent to administer the operation of the appellate offices and process said appellate court cases for this County BE IT FURTHER RESOLVED that the attorneys employed by the State’s Attorneys Appellate Prosecutor are hereby authorized to act as Assistant State’s Attorneys on behalf of the Kane County State’s Attorney in the appeal of all cases, when requested to do so by the State’s Attorney and with the advice and consent of the State’s Attorney prepare, file and argue appellate briefs for those cases and, also, as may be requested by the State’s Attorney, to assist in the prosecution of cases under the Illinois Controlled Substances Act, the Cannabis Control Act, the Drug Asset Forfeiture Procedure Act, the Narcotics Profit Forfeiture Act and the Methamphetamine Control and Community Protection Act. Such attorneys are further authorized to assist the State’s Attorney in the State’s Attorney’s duties under the Illinois Public Labor Relations Act, including negotiations, as well as the trial and appeal of tax objections. BE IT FURTHER RESOLVED that the attorneys employed by the Office of the State’s Attorneys Appellate Prosecutor may also assist State’s Attorneys in the discharge of their duties in the prosecution and trial of other cases, and may act as Special Prosecutor if duly appointed to do so by a court having jurisdiction.

WHEREAS, the County of Kane is authorized by law, pursuant to Illinois Compiled Statutes, 605 ILCS 5/5-801 et seq. (2012) to acquire by negotiated purchase or eminent domain

proceedings, real property for highway purposes; and WHEREAS, the County of Kane has jurisdiction over part of Longmeadow Parkway

(proposed Kane County Highway No. 86), within the boundaries of the County of Kane; and WHEREAS, the County of Kane deems it necessary and appropriate to construct and

improve Longmeadow Parkway; and WHEREAS, Longmeadow Parkway and the planned improvements therefor, has been

surveyed, laid out and projected over certain lands situated in Kane County, Illinois. It is deemed by the County of Kane that certain parcels of land and, in particular, the parcels described herein in Exhibit “A” (copy of which is on file with the County Clerk of Kane County and which is incorporated herein and made a part hereof), which are located within the limits of Kane County should be acquired by negotiated purchase and, negotiation failing, by eminent domain proceedings for highway purposes.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board:

1. That it is hereby determined by the County Board of Kane County that the real property described herein in Exhibit “A” be used, occupied and improved for highway purposes in a manner necessary and convenient for public use.

2. That it is further hereby determined it is necessary and proper that the County of

Kane acquire title to or other appropriate interest in and possession of these parcels because said real property is necessary and required by the County of Kane for highway purposes and, more specifically, the improvement of Longmeadow Parkway.

3. That the Chairman of the Kane County Board or his duly authorized representative are hereby authorized, empowered and directed to negotiate for and on behalf of the County of Kane with any and all owners of the property described herein or with any other individual possessing an interest therein for the purchase thereof upon such terms and conditions as shall be approved by the Transportation Committee of the Kane County Board and/or the County Board of Kane County.

The National Bridge Inspection Standards (NBIS) establish the requirements for structure inspection procedures, frequency of inspections, qualifications of personnel, inspection reports and related matters. Appropriately qualified personnel inspect structures and the findings are submitted to IDOT for inclusion in the state and national databases. Bridges found to be deficient are monitored. Some structures may require a reduction of loads, and ultimately, prompt programming of funds towards a rehabilitation or replacement improvement. To complete this work, staff has utilized the Kane County QBS process and selected Hampton, Lenzini and Renwick, Inc. (HLR) as the preferred consultant for this work. At the County’s discretion, dependent on HLR’s performance, HLR may also conduct the 2017 and 2018 work. This work includes in-depth structure inspections, load ratings, and various on-call services. to ensure the structural integrity of in-service bridges and is mandated by the Federal Surface Transportation Assistance Act of 1978; and

WHEREAS, in order to accomplish the Project, it is necessary to retain the services of a

professional engineering firm to provide bridge inspection engineering services therefor; and WHEREAS, Hampton, Lenizini and Renwick, Inc., 380 Shepard Drive, Elgin, IL 60123 has

APPROVING AMENDMENT NO. 1 TO PHASE II ENGINEERING SERVICES AGREEMENT WITH CHRISTOPHER B. BURKE ENGINEERING, LTD. FOR 2013 HIGHWAY SAFETY

IMPROVEMENT PROJECT, KANE COUNTY SECTION NO. 12-00424-00-SP

WHEREAS, pursuant to Resolution No. 13-95, the County of Kane appropriated Two Hundred Forty Nine Thousand Nine Hundred Ninety Six and 87/100 Dollars ($249,996.87), (hereinafter the “appropriation”) for and entered into a Phase II Engineering Services Agreement (hereinafter the “Agreement”) with Christopher B. Burke Engineering, Ltd. for the 2013 Highway Safety Improvement Project, (hereinafter the “Project”); and

WHEREAS, additional engineering services not anticipated in the original scope of work set forth in the Agreement are required for the successful completion of the Project; and

WHEREAS, in order to address the need for additional engineering services, the County desires to enter into Amendment No. 1 to the Agreement (a copy of which is on file in the office of the Kane County Clerk) increasing the amount paid for the unanticipated engineering services by $123,011.08; and

WHEREAS, it is in the County’s best interest to extend the upper limit of the appropriation for the Agreement an additional $123,011.08 from $249,996.87 to $373,007.95.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that Amendment No. 1 to the Agreement is hereby approved and the Chairman thereof is authorized to execute Amendment No. 1 to the Agreement with Christopher B. Burke Engineering, Ltd., Inc. for the Project.

BE IT FURTHER RESOLVED by the Kane County Board that there is hereby appropriated the additional sum of One Hundred Twenty Three Thousand Eleven and 08/100 Dollars ($123,011.08) from the Transportation Capital Fund #540, Line Item #50140 (Engineering) for a total appropriation for the Agreement as amended not to exceed Three Hundred Seventy Three Thousand Seven and 95/100 ($373,007.95) with approximately ninety percent (90%) of the total appropriation to be reimbursed to the County from federal funds.

Summary:

The Intergovernmental Agreement with the Village of Algonquin details the Longmeadow Parkway Bridge Corridor project within the Village of Algonquin land use authority and planning jurisdiction from Huntley Road to IL Route 31. The agreement outlines improvements, maintenance responsibilities, access locations, and the jurisdictional transfer of Longmeadow Parkway from Randall Road to approximately 200 feet east of White Chapel. Engineering is nearing completion and remaining right-of-way is being acquired by the County. Right-of-way preparation on portions of the corridor is currently underway and staff anticipates initiating construction of Stage A-1 (west of Randall Road) this Spring. The second stage of construction from Randall Road east to east of White Chapel Lane is anticipated to be let mid-2016.

APPROVING AN INTERGOVERNMENTAL AGREEMENT BETWEEN VILLAGE OF ALGONQUIN AND THE COUNTY OF KANE REGARDING LONGMEADOW PARKWAY

WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and the Illinois Compiled Statutes (5 ILCS 220/1, et seq.) authorizes the County of Kane (hereinafter the “County”) and the

Village of Algonquin (hereinafter the “Village”) to cooperate in the performance of their respective duties and responsibilities by contract and other agreements; and

WHEREAS, it is deemed necessary in order to facilitate the free flow of traffic and to ensure

the safety of the motoring, bicycling and walking public to improve Longmeadow Parkway from Huntley Road to Illinois State Route 31; and

WHEREAS, the Village and the County desire to make the improvements in that the same

will be of immediate benefit to the residents of the Village and the County and the improvements will be long lasting and permanent in nature; and

WHEREAS, the Village and the County, in order to facilitate and assure the proper flow of

traffic on Longmeadow Parkway for now and in the future, and to permit reasonable development of lands adjacent thereto, wish to limit direct access for properties adjoin and adjacent to Longmeadow Parkway; and

WHEREAS, the Village and the County have determined that limitations on direct access to

Longmeadow Parkway are necessary for proper transportation and land use planning; and WHEREAS, the Village and the County believe it appropriate to enter into an

intergovernmental agreement (a copy of which is on file with the County Clerk's Office) to achieve the goals of the Village and the County and to provide for maintenance of Longmeadow Parkway.

NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the County of Kane

enter into an intergovernmental Agreement for Longmeadow Parkway with the Village of Algonquin and that the Kane County Board Chairman is hereby authorized to execute an intergovernmental agreement and any related documents therefor.

The Village of Algonquin and Kane County have jointly planned for the construction of the

Longmeadow Parkway Bridge Corridor project which requires the jurisdictional transfer of

Longmeadow Parkway from Randall Road to approximately 200 feet east of White Chapel

Lane. Engineering is nearing completion for the project and the remaining right-of-way is being

APPROVING A LOCAL AGENCY AGREEMENT FOR THE JURISDICTIONAL TRANSFER OF LONGMEADOW PARKWAY FROM THE VILLAGE OF ALGONQUIN TO THE COUNTY

OF KANE

WHEREAS, the Illinois Constitution of 1970, Article VII, Section 10 and the Illinois Compiled Statutes (5 ILCS 220/1 et seq.), authorizes the County of Kane (County) and the Village of Algonquin (Village) to cooperate in the performance of their respective duties and responsibilities by contract and other agreements; and

WHEREAS, the Village has jurisdiction over part of Longmeadow Parkway (MUN 749)and

desires to transfer jurisdiction thereof to the County of Kane as part of the County Highway System from the east edge of pavement of Kane County Highway No. 34 (Randall Road), (FAP 336) easterly to 200 feet east of White Chapel Lane (MUN 747) at the corporate boundary of Algonquin, in its entirety under the terms and conditions as set forth in the jurisdictional transfer agreement (a copy of which is on file with the Kane County Clerk).

NOW, THEREFORE BE IT RESOLVED, by the Kane County Board that any and all

jurisdiction for that part of Longmeadow Parkway from east edge of pavement of Randall Road (FAP 336) easterly to 200 feet east of White Chapel Lane (MUN 747) at the corporate boundary of Algonquin be transferred in its entirety to and accepted by the County of Kane upon approval of the Illinois Department of Transportation and that the County Board Chairman is authorized to execute any agreement and documents to accomplish the same. Said jurisdictional transfer shall be effective upon the execution of the Local Agency Agreement for Jurisdictional Transfer by the County of Kane, Village of Algonquin and Illinois Department of Transportation.

BE IT FURTHER RESOLVED, that the above location, with Illinois Department of

Transportation approval, be deleted from the municipal street system of the Village of Algonquin and that said route be identified as County Highway No. 86, (Longmeadow Parkway) easterly to the municipal boundary of the Village east of White Chapel Road, in its entirety.

BE IT ALSO RESOLVED that the County Clerk is hereby directed to transmit three certif ied

copies of this Resolution to the State through its Regional Engineer’s Office in Schaumburg, Illinois.
