Re: Request from HeIloWorld Inc. for Personal Property Tax Exemption Under P.A. 328

Dear Sirs and Mesdames:

City staff is in receipt of a request from HelloWorId Inc. for tax abatement pursuant to Public Act 328 of 1998. Abatements under P.A. 328 reduce property taxes by the full millage rate (including state and local levies) for new personal property. The local community and the business negotiate the length of abatement (number of years) for the new personal property tax. The law does not contain a maximum or minimum number of years.

As part of the City's ongoing economic development initiatives, City staff is in receipt of a request from Hello W orId for the City of Southfield to partner with them, in the form of personal property abatement, to facilitate the relocation of new corporate headquarters from the City of Pleasant Ridge to Southfield.

HelloWorId is a digital marketing solutions company working with the world's leading brands across all industry verticals. The company offers a powerful combination of native platform technology and marketing strategy to brands looking to accelerate growth and deepen customer impact. HelloWorId creates brand-consumer interactions through promotional campaigns to spark interest, loyalty programs to retain and reward, and mobile messaging to continue the conversation. HelloWorld is one of the largest independent digital solution providers, with offices in Detroit, New York, Chicago, Los Angeles, Nashville, Phoenix and Seattle. HelloWorId's technology is behind local, national and global campaigns for clients such as Coca-Cola, Microsoft, the Gap and Procter & Gamble.

Pending establishment of an Industrial Development District for Southfield Town Center and approval of personal property tax exemption for a period of ten years, Hello World proposes to occupy and improve 43,500 square feet of currently vacant space in the Southfield Town Center, 3000 Town Center floors 19 -21. In addition to significant investment in the real property, the proposal includes the investment of approximately $6,475,000 investment of which, $6 million of the investment will be in information technology, furniture and fixtures, with the balance in leasehold improvements. Hello World will relocate over 300 employees from the City of Pleasant Ridge to their new Southfield facility, and hire an additional 50 new full time positions. They continue to hire young talent and will work with the Southfield Michigan Works to create opportunities for Southfield residents to access these positions.

As the City considers partnering with HelloWorid to facilitate their move, we will be held harmless regarding our personal property tax collection. The State of Michigan has established a new base from which the City of Southfield will be reimbursed for taxes. This level was determined based upon fiscal year 2012.

The City's City Administrator, Fred Zorn, Business Development Manager Rochelle Freeman and City Assessor, Mike Racklyeft along with representatives from HelloWorld, will present the company's tax abatement request.

RE: Woodland and Tree Preservation Discussion

Dear Sirs and Mesdames:

The Woodland and Tree Preservation ordinance was enacted 23 years ago in 1991 as the result of unwarranted tree removal activities in the City. The ordinance established pennitting guidelines for residential and commercial properties for tree removal and in some instances, tree replacements are required. Pursuant to the Council President's recent request, the Planning Department would like the 0ppOliunity at your June 1, 2015 Committee-of-the-Whole Meeting to discuss some potential revisions to the ordinance and is seeking Council's direction and additional input on any revisions they would like to see.

Tree Ordinance Revisions for Study Session

Ordinance 1324 enacted 08/12/1991

We recommend the following revisions to Ordinance 1324:

1. Non Residential Land Use - If tree removal is not part of a site plan and tree removal exceeds 10% of

the total number of trees on the property over eight (8") inches D.B.H. per calendar year, Per Ordinance

1324 Sec. 1. 5.56(1.}{a-dU8.}{a}{b)(d-f). We recommend a Tree Permit Application and a fee of $300.00

2. Residential Land Use- If tree removals exceed 10%, of the total number of trees on the property over

eight (8") inches D.B.H. per calendar year, Per Ordinance 1324 Sec. 1. 5.56{1.)(a-dU8.)(a)(b)(d-f). We

recommend a Tree Permit Application and a fee of $50.00

3. Residential New Construction - We recommend a Tree Permit Application Fee of $75.00 per lot or

unit. Per Ordinance 1324 Sec. 1. 5.56{1.)(a-d},{8.}{a)(b)(d-f).

4. All tree removal should include stump grinding and lawn restoration.

5. Per Ordinance 1324 Sec. 1. 5.56{6.} (b). The removal or transplanting of a pear (pyrus), apple (malus),

cherry (prunus), peach (prunus) or plum (prunus) tree. We recommend that these tree species be

evaluated by the Planning or Forestry department to determine if they are orchard style fruit trees or

ornamental landscape trees. Ornamental style fruit trees will need a tree removal permit if combined

trunks exceed 8" caliper. Orchard style fruit trees do not need a permit for removal.

6. Since the Tree Ordinance has been in effect, we have used the tree replacement fee of $300.00. We

recommend a new fee of $325.00 per tree when applicant is required to bond for replacement trees or

to donate to the Tree Trust Fund. Per Ordinance 1324(8)(f)(iii}.

7. We recommend that Common Buckthorn (Rhamnus cathartica) be classified as a noxious weed and

invasive tree. No permit required for removal of this species.

8. If a tree has multiple trunks, then its total D.B.H. (diameter at breast height) shall be computed by

adding D.B.H. in inches of each of the trunks.

Re: Update on Southfield Neighborhood Stabilization Program Grants NSP-l and NSP-3

Dear Sirs and Mesdames:

As the NSP-l and NSP-3 programs are winding down, staff would like to provide the City Council with a program update.

The Southfield Growth Corporation is the managing entity for the Southfield Neighborhood Stabilization Program Grants (NSP-l, B-08-MN-26-0011; NSP-3, B-II-MN-26-0011). The grants have been in place since 2009 and 2011 respectively and provide funding to minimize blight, preserve green space and the ability to acquire/rehabilitate and resell residential properties. As part of the NSP-l grant guidelines, a permitted activity is demolition of uninhabitable single family dwellings located adjacent to parks. Four (4) properties meet these criteria. Prior to the demolition of these properties, there was significant blight and a threat to public health and safety.

At the June 15, 2015 Regular Council Meeting, the Administration will request that the City agree to take ownership of the four (4) parcels.

RE: Group Child Care Facilities Discussion

Dear Sirs and Mesdames:

In 2011, the City Council amended the Zoning Ordinance to allow for Group Child Care Homes in the Single Family Residential Zoning District as a Special Use subject to Planning Commission recommendation and City Council approval. Since its adoption, staff has processed five (5) requests for Group Child Care Homes and Council has approved three (3), two (2) of which have been in basements.

With the concern over this type of use in basements and the safety of both children and caregivers, staff has been asked to come before your Honorable Body at your June 1,2015 Committee-of-the-Whole meeting to seek Council's direction on a potential zoning ordinance amendment related to Group Child Care in basements. If it's Council desire, staff can then review this matter and come back to Council at a future C.O.W. meeting to discuss our findings and any potential text amendment.

The petitioner will make a presentation on his proposal and then Planning staff and the petitioner would be happy to answer any questions the Council may have prior to this item being heard at the Public Hearing scheduled for June 15,2015.
