Chip Carson, Chair NFPA Correlating Committee on Safety to Life (SAF-AAC) Peter Willse, Chair NFPA Correlating Committee on Building Code (BLD-AAC)

Re: Report to the Correlating Committee Task Group on Security-Related Criteria

Dear Mr. Chairs:

The Task Group on Security was asked to evaluate the scopes of NFPA 101 and NFPA 5000 as they pertain to security and recommend any needed revisions. The Task Group met by conference call on November 26, 2018 and in person with conference call-in on December 4, 2018. Following is a summary of the discussions and recommendations.

The Task Group started by discussing 6 questions. The responses are summarized in blue under each question.

1. Is safety as a matter of security from violence appropriate for inclusion in NFPA 101 and/or 5000?Is it appropriate for this to be addressed by 5000 but not 101? The Task Group is generallysupportive of inclusion of security-related criteria in both NFPA 101 and NFPA 5000, with somecaveats.a. The Task Group noted that the nature of the threat can be difficult to quantify and

“security” is so broad a topic that is encompasses much more than just active shooterscenarios, including, perhaps, cannabis-related issues, other types of work place violence, and other types of weapons that firearms.

b. The Task Group suggested relying on NFPA 730 Guide for Premises Security and 731Standard for the Installation of Electronic Premises Security Systems, as well as NFPA 3000Standard for an Active Shooter/Hostile Event Response (ASHER) Program.

c. The Task Group expressed some concern that the technical committees lack the technicalexpertise to address the need for and technology related to specific security solutions.

d. The general feeling was that some general scoping was appropriate but specifics shouldbe determined based on the use of NFPA 730, not prescriptively included in NFPA 101 and5000.

2. Is NFPA 101 1.1.8 adequate to address security issues or is broader language, such as that foundin NFPA 5000 1.1.1 appropriate? [Note that the annex language in 101 1.1.8 talks about thefeatures for protection from fire being useful in other circumstances, specifically mentioningcrowd safety, but stops short of endorsing protection from circumstances that have no relationto fire whatsoever. On the other hand, physical violence is NOT listed in 1.1.9, which notes somespecific areas NFPA 101 is not intended to address.] The Task Group expressed support for amodification to NFPA 101 1.1.8 to broaden the scope.

a. The Task Group noted that there are already some provisions in the Code which do notappear to be covered by the current language (such as locking against entry in Day CareOccupancies).

b. One Task Group member suggested adding a separate paragraph rather than modifyingSection 1.1.8.

c. NFPA staff noted in a follow-up email that there are no Public Inputs for Section 1.1.8 soany changes would need to wait for a subsequent edition of NFPA 101.

3. NFPA 101 4.2.4 addresses Physical Violence Mitigation by merely stating it should not compromisecompliance with other requirements of the Code. Should this be expanded to specifically includefeatures to achieve physical violence mitigation in the scope? The Task Group agreed with thisapproach.

4. NFPA 5000 4.1.7 has similar but different language regarding Security Features. Should directionbe given to harmonize the language in 101 4.2.4 and 5000 4.1.7? The Task Group agreed with thisbut noted that “security” may be too broad a word and “violence” is too narrow. “Occupantsafety due to intentional threats to life safety” was suggested, though there was not an effort toparse words at this point so this was only a suggestion for further consideration.

5. In NFPA 101 and 5000, the Committee Scope for the Technical Committee on Fundamentalsaddresses protection “from fire, earthquake, flood, wind, and other circumstances…” These areall natural phenomena. Should consideration be given to asking the Standards Council to revisethe scope to include man-made circumstances such as security? [Note that issues such as injuryfrom falls have been added to the scope in Chapter 1 but not the Committee Scope. In theCommittee Scope, these fall under “other circumstances” in the Committee Scopes, though onlythe scope for Fundamentals lists natural phenomena in addition to fire.] The Task Group did notdirectly address this question, as they felt the Committee scope was not under the purview of theCorrelating Committee. This should be a question for whoever has authority to set the Committeescopes.

6. Is it even up to the Correlating Committee to make a recommendation regarding the scope of thedocument or is the existing scope so clearly not intended to cover non-fire issues such as physicalviolence mitigation that this direction needs to come from the Standards Council? The Task Groupgenerally agreed that the appropriate approach would be to suggest scope changes and copy theStandards Council so the Standards Council would have the opportunity to decide whether anyaction on their part is needed.

Subsequent to the conference call on November 26th, Howard Hopper drafted some proposed revisions to the scope in NFPA 101 and 5000.

NFPA 101 1.1.8 Occupant Security. The Code also addresses considerations that provide for occupant security from intentional harm perpetrated by others.

1.1.9 1.1.8* Considerations Not Related to Fire. The Code also addresses other considerations that, while important in fire conditions, provide an ongoing benefit in other conditions of use, including non-fire emergencies.

4.2.4 Physical Violence Mitigation. Where buildings are designed to mitigate physical violence against occupants, such measures Security Features. Where buildings include security features to protect occupants or contents, such features shall not compromise compliance with other requirements of this Code. <This wording now matches NFPA 5000, Section 4.1.7>

9.13 Security Systems and Equipment. <New section, renumber remaining sections, 9.13.1 covers all security systems and equipment (assuming school locks are “equipment”. 9.13.2 recognizes that NFPA 731 is being expanded to cover premise security systems, not just electronic systems)> 9.13.1 General. Where required by another section of this Code, security systems and equipment shall be designed, installed, inspected, tested, and maintained in accordance with the manufacturer’s instructions and this section. 9.13.2 Security Systems. Where required by another section of this Code, premise security systems shall be designed, installed, inspected, tested, and maintained in accordance with NFPA 730.

NFPA 5000 Chapter 55 Fire Protection and Life Safety Systems and Equipment <This section already covers CO detection, which is not a fire protection system, name change fits with security reference> 55.12 Security Systems and Equipment. <New section , renumber remaining sections, same wording as proposed for NFPA 101 > 55.12.1 General. Where required by another section of this Code, security systems and equipment shall be designed, installed, inspected, tested, and maintained in accordance with the manufacturer’s instructions and this section. 55.12.2 Security Systems. Where required by another section of this Code, premise security systems shall be designed, installed, inspected, tested, and maintained in accordance with NFPA 730.

NFPA staff responded by noting changes to NFPA 101 1.1.8 and 9.13 would have to wait until the next edition of the Code, as no Public Inputs had been submitted for these sections. The Task Group members made several comments to the text.

1. The reference to NFPA 730 was questioned, as this is not a mandatory document, but rathera guide. Reference to NFPA 731, which is a standard, was suggested.

2. Another Task Group member noted that security should not be mandated and that referenceto a guide might be appropriate, suggesting it might be an if/then approach where if onechooses to address security, one should follow NFPA 730.

3. It was also noted that NFPA 731 is does not capture the overall intent of security issues andan Annex reference to NFPA 730 in both NFPA 101 and 5000 should be considered.

4. NFPA Staff noted that FR-6643 revises 4.2.4 in NFPA 101 to bring it very close to language inNFPA 5000 and that NFPA 5000 might further revise the text based on the proposed newChapter 56 Security. It was suggested that a First Correlating Revision might recommend toNFPA 5000 Technical Committee on Fundamentals that they consider revising Chapter 4 toalign its objectives with Chapter 56.

5. One Task Group member reminded the Group that this needs to work for all occupancies, notjust Educational Occupancies, and that some might be outside the scope of NFPA 101.

At its meeting on December 4th, the Task Group discussed possible changes to Chapters 1 (in NFPA 101) and 4 (in both NFPA 101 and 5000). It was agreed that changes to Chapter 1 can be made at this stage by means of a First Correlating Revision. Beyond that, the focus of the discussion was on clarifying the scope by suggesting to the technical committees what elements they should consider rather than telling them what to do.

The Task Group recommends the Correlating Committee take the following action:

Page 14: AGENDA NFPA 5000 Correlating Committee on Building Code … · 2019-11-07 · AGENDA . NFPA 5000 Correlating Committee on Building Code (BLD-AAC) NFPA 101 and NFPA 5000 A2020 Second

1. Direct the Technical Committee on Fundamentals to coordinate the language in NFPA 101 4.2.4 and NFPA 5000 4.1.7, keeping in mind that there may be security issues that are appropriate for inclusion in a building code but that might not be appropriate for inclusion in a life safety code.

2. Direct the Technical Committee on Fundamentals to consider whether an Annex note pointing users of the Code to NFPA 730 and 731 for further information on addressing security issues may be appropriate. Tie to 101 section 4.2.4 and NFPA 5000 section 4.1.7.

3. Issue a First Correlating Revision that revises NFPA 101 1.1.8 with language similar to the following: 1.1.8 Occupant Security. The Code also addresses considerations that provide for occupant security from intentional harm perpetrated by others. Reason: This change recognizes that existing provisions in the code, such as locking requirements in day care and educational occupancies, are designed to provide security for occupants from intentional harm perpetrated by others, such as active shooters. It is appropriate to recognize this in the scope of the Code.

4. Change CI-8219 (which changes NFPA 4.1.7 to address the new proposed Chapter 56 Security) to a First Correlating Revision.

5. Direct the NFPA 5000 technical committees to look at the proposed new Chapter 56 and direct the NFPA 101 and 5000 technical committees to look at the revised scoping language in Chapter 4 regarding security issues when considering potential changes to the chapters under their purview.

6. Suggest to the Standards Council that they consider revising the Committee Scopes to align them with the scoping provisions in Chapters 1 and 4 of NFPA 101 and 5000.

7. FCR: A.1.1.8 Life safety in buildings includes more than safety from fire. Although fire

safety has been the long-standing focus of NFPA 101, its widely known title, Life Safety

Code, and its technical requirements respond to a wider range of concerns, including, for

example, crowd safety and providing life safety when security features are provided.

Code requirements that contribute to the safe movement of people during fire

emergencies might also assist in responding to many other hazards that require decisions

about where people can be safely located. 8.

The Task Group looks forward to answering any questions the Correlating Committee may have. Sincerely,

John A. Rickard, AIA, PE

The Correlating Committee (CC) actions that follow are subject to and within the limitations of the Regulations Governing the Development of NFPA Standards (the Regs) at 3.4 and 4.4.11.

Second Correlating Revision (SCR): Used to delete or modify SRs, generate the equivalent of a new SR, or revise the TC action on a public comment. All SCRs must include a Correlating Committee Statement (CCS) to support the change. A SR from the TC that is modified by an SCR converts to a committee comment (see Regs at 4.4.11.2). SCRs are balloted and appear in the second draft report if they pass ballot. SCRs that do not pass ballot are not published (see Regs at 4.4.11.5.1).

Excerpts from the Regs follow (see the Regs for complete details at http://www.nfpa.org/codes-and-standards/resources/regulations-and-policies):

4.4.11 Correlating Committee Review and Action on Public Comments and the Second Draft.

4.4.11.1 Review and Permitted Actions. Where Technical Committee activities are managed and coordinated by a Correlating Committee, the Correlating Committee shall review the Public Comments and the Second Draft as balloted by the Technical Committees under its responsibility and take appropriate action within the limits of its authority and responsibilities, as set forth in 3.4.2 and 3.4.3, by creating Correlating Revisions and revising actions on Comments as set forth in 4.4.11.2 and 4.4.11.3.

4.4.11.2 Correlating Revisions. The Correlating Committee may, within the limits of its authority, revise the Second Draft by creating Second Correlating Revisions, with associated Correlating Statements, that delete or modify Second Revisions or other text in the Second Draft. To the extent that a Second Correlating Revision modifies or deletes a Second Revision or any portion of the Second Revision, the original text of the Second Revision or affected portion thereof shall be redesignated as a Committee Comment and shall be published in the Comment section of the Second Draft Report along with a note indicating that the text contained in the Committee Comment has been modified or deleted from the Second Draft as a result of a Second Correlating Revision.

4.4.11.2.1 Size and Content of Second Correlating Revisions.

(a) An individual Revision can contain multiple changes to the Standard text, provided that the changesare contained within a contiguous portion of the Standard that is no smaller than an individualnumbered or lettered section or no larger than a chapter.

(b) Exception for Global Revisions. Where the Correlating Committee wishes to revise a term or phrase throughout an NFPA Standard so as to achieve editorial consistency or correlation, the Committee may do so through a Global Revision.

4.4.11.3 Change in Actions on Comments. Where a Second Correlating Revision is inconsistent with the Technical Committee’s Committee Action on any Comment, the Action shall be changed to make it consistent with the Second Correlating Revision, and a note shall be provided with the new Action indicating that it has been changed at the direction of the Correlating Committee to be consistent with a Second Correlating Revision.

…..

4.4.11.5 Correlating Committee Ballot on Second Draft.

4.4.11.5.1 Balloting on Second Correlating Revisions.

(a) Any proposed Second Correlating Revisions to the Second Draft shall be submitted to a Ballot of the Correlating Committee. Approval of Second Correlating Revisions shall be established by a three-fourths affirmative vote of the Correlating Committee. Negative votes or abstentions on specific Second Correlating Revisions shall include the reasons for such votes.

(b) Only proposed Second Correlating Revisions that are approved by the Correlating Committee Ballot shall become Second Correlating Revisions and shall be published in the Second Draft Report. Second Correlating Revisions that fail Ballot shall not be published.

(c) For approved Second Correlating Revisions, a ballot statement as indicated in 3.3.4.3(d) shall be published with their associated Second Correlating Revisions in the Second Draft Report.

(d) Treatment of Global Revisions. Global Revisions are balloted in the same manner as other Revisions, and a Global Revision that passes Ballot is applied, as directed, throughout the Standard, independently of the results of balloting on other Revisions.

4.4.11.5.2 Ballot on the Report as a Whole. In addition to the Ballot on each of its individual Second Correlating Revisions (see 4.4.11.3.1), there shall be a Ballot of the Correlating Committee on the Second Draft. The results of the Ballot for the further processing of the NFPA Standard are as follows:

(a) Forward the NFPA Standard to the NFPA Technical Meeting. The proposed NFPA Standard shall be forwarded for consideration to the NFPA Membership unless the Correlating Committee, by a three-fourths negative vote on the Ballot (demonstrably based on considerations within its authority and responsibility as set forth in 3.4.2 and 3.4.3), directs the return of the NFPA Standard to the Technical Committee for further study. If the NFPA Standard is forwarded for consideration to the NFPA Membership, the results of the Ballot, including the reasons for negative votes, shall be included in the Technical Committee Report.

(b) Return of the NFPA Standard. If the Correlating Committee directs the return of the NFPA Standard to the Technical Committee for further study, the NFPA Standard is not forwarded to the NFPA Membership, the Second Draft Report is not published, and a notice that the Correlating Committee has directed the return of the NFPA Standard to the Technical Committee for further study shall be published in place of the Second Draft Report.

October 30, 2019  Peter Willse, Chair NFPA Correlating Committee on Building Code (BLD‐AAC) Chip Carson, Chair NFPA Correlating Committee on Safety to Life (SAF‐AAC)  Re:  Correlating Committee Task Group on Technical Committee Scope for NFPA 5000 and 101   Report on Recommendations  Dear Messrs. Willse and Carson:  At the December, 2018 Correlating Committee meeting, a task group was formed by BLD‐AAC to address potential issues with the Committee Scope for the technical committees responsible for NFPA 5000.  NFPA 5000 has several  technical committees  that address  issues  (such as building construction and building systems) that are appropriate for a building code but that are not included in NFPA 101.  Nevertheless, NFPA 101 does include some provisions that are not strictly related to safety from fire.  Therefore, the task group, which I chaired, included the NFPA 101 committee scopes in our review.  Following are our recommendations, with some comments regarding issues we discussed.  The committee scope for the Technical Committee on Fundamentals is identical for NFPA 101 and 5000 and  includes  language regarding earthquake,  flood and wind.   This  language did not exist  in  the 2000 edition of NFPA 101 and appears  to have been  inadvertently added  to NFPA 101 at some point.   Our recommendation is to remove this language from the TC on Fundamentals Committee Scope in NFPA 101.  The resulting scope would be:  This  Committee  shall  have  primary  responsibility  for  documents  on  the  basic  goals,  objectives, performance  requirements,  and  definitions  for  protection  of  human  life  and  property  from  fire, earthquake,  flood, wind,  and  other  circumstances  capable  of  producing  similar  consequences,  on  the nonemergency and emergency movement of people, and on high‐rise buildings.  The  committee  scopes  for  the  occupancy  chapters  appear  to  be  identical  for  NFPA  101  and  5000.  Although the text within the occupancy chapters is similar for NFPA 101 and 5000, standpipes, which are a  feature  to  assist  firefighting,  are  included  in  NFPA  5000  occupancy  chapters  but  not  NFPA  101.  Nevertheless, we do not  recommend  any  changes  to  the  TC  scopes  for  the  occupancy  chapters  in response to this difference.  The committee scopes for the occupancy chapters refer to “protection of human life and property from fire  and  other  circumstances  capable  of  producing  similar  consequences.”    The  scopes  also  refer  to “emergency movement of people.”  The TC’s for Fundamentals and Assembly Occupancies (and only those TC’s) at  some point added  “nonemergency and” prior  to  this  language.   We do not  recommend any changes to the TC scopes for the occupancy chapters regarding this  issue but would like to note this discrepancy.  Both NFPA 101 and 5000 include language regarding grab bars in some occupancies, including residential and mercantile.  This is supported by the general language regarding purpose in NFPA 5000 and by a new

section  titled “Injuries  from Falls”  in NFPA 101 Chapter 1.   The Task Group believes the scope of  the occupancy chapters  is broad enough to include this and that this  is covered by “other circumstances capable of producing similar consequences.”    Issues  related  to  terrorism  and  hostile  intruders  (which  is  in  the  NFPA  5000  chapter  on  assembly occupancies), classroom locking (in the educational and day‐care occupancies chapter), and safety during building use and security features (both in the fundamentals chapter) were discussed and the consensus was of the Task Group that these primarily have an effect on emergency egress and therefore are covered by the existing scopes in both NFPA 101 and 5000. We do not recommend any changes to the TC scopes regarding these issues.  The Task Group members  look  forward to answering any questions you or  the Correlating Committee members may have.  Sincerely,
