Subject: Question raised by Sh. Satinder Singh, Councillor, Municipal Corporation, Chandigarh regarding Uppal Housing Project, Pocket No. 2 & 3, Commercial Property belonging to MCC at Manimajra
Sh. Satinder Singh, Councillor, Ward No. 18 has submitted the question to be
included in the forthcoming meeting of General House regarding Uppal Housing Project, Pocket
no. 2 and 3, Commercial property belonging to MCC at Manimajra.
In this connection, it is submitted that he original record file is lying with Vigilance
Cell, U.T., Chandigarh. However, the reply has been prepared based on the information
available with the office in annotated form as under:

Yes, the Municipal Corporation, Chandigarh in its
55th (adjourned) house meeting held on 23.8.2002
vide supplementary agenda item no. 2, resolved
that “the plot measuring 6.9 acre in pocket no. 2 &3
Manimajra, U.T., Chandigarh earmarked for Group
Housing Scheme shall be disposed of by way of
open auction to the private builders of reputed for
the construction of multi storied group houses
subject to the condition that equal or larger piece of
land shall be earmarked for the construction of
houses for the employee of the Municipal
Corporation, Chandigarh including deputationists
who have served for at least 3 years as a welfare
measure and modalities shall be discussed with
representatives of the employees. It was further
resolved that adequate no. of houses meant for
economical weaker section (EWS) of the society
shall be constructed by the private builder which
shall be allotted to eligible persons working
house/shops and not residing in Jhugis. It was also
resolved that the said site shall be disposed of by
way of open auction by giving due publicity in local
and National newspapers by the Commissioner,
municipal Corporation, Chandigarh ”.

Consequent to the resolution passed by the General
House of the Corporation in its 55th (adjourned)
meeting held on 23.8.2002, the Additional

Commissioner, MCC vide letter Memo No.
CMC/Estate/SAE-I/2002/15150, dated 29.11.2002
wrote to the Home Secretary-cum-Secretary Local
Govt., Chandigarh Administration, wherein it has
been mentioned that the Municipal Corporation in its
55th (adjourned) meeting held on 23.8.2002 vide
Supplementary Agenda Item no. 2 has passed the
following resolution unanimously:-
“In partial modification of the resolution passed
by the Municipal Corporation, Chandigarh in its 46th
adjourned meeting held on 21.6.2001 vide
supplementary agenda item no.5, it is resolved that
the plot measuring 6.9 acre in pocket no. 2 &3
Manimajra, U.T., Chandigarh earmarked for Group
Housing Scheme shall be disposed of by way of
open auction to the private builders of reputed for

19.12.2002 to take up the matter with the Chief
Architect & Secretary, Deptt. of Architecture, U.T.,
Chandigarh to prepare and supply copy of Architect

As per the copy of the Advertisement available in
the file (Copy enclosed at Annexure “2”, it was
mentioned in the advertisement that the detailed
terms & conditions mentioned in the brochure.
It was mentioned in the brochure that
“Adequate accommodation shall be provided for
domestic servants and other service population of
economically weaker sections (E.W.S.). The
number of such dwelling unit for domestic servants
shall not be less than 15% of the main dwelling
units and the carpets area of such unit shall not be
less than 200 square feet”.

The clause of 15 percent houses for Economic
Weaker Section (EWS) was not specifically
mentioned in the Allotment letter, but it has been
mentioned in clause 12 of the allotment letter that
“the building on the site shall be constructed strictly
in accordance with the approved/sanctioned plans,
which must confirm to the Punjab Capital
(Development & Regulation) Building Rules, 1952
and the provision of Frame control Architect Control
and the Zoning plan (whichever is applicable).
And it was also mentioned in clause 27 of the
allotment letter that “the conditions as mentioned in
the zoning plan, obtainable from Chief Architect,
Chandigarh Administration on payment of land shall
be considered as part of the terms & conditions of
this allotment letter”.(copy of allotment letter is
enclosed at Annexure “3”).

On the basis of Inspection report, a Show cause
notice was issued to Uppal Housing Pvt Ltd vide
No. MC/Estate/ 2011/5773, dated 14.9.2011 by the
Secretary, (exercising the power of Estate Officer
under Capital of Punjab (D&R) Act, 1952), Municipal
Corporation, Chandigarh (Copy enclosed at
Annexure “5”). The said notice was dropped vide
orders dated 15.12.2011.

The said point pertains to Chief Architect,
Chandigarh Administration & SDO(B), U.T.,
Chandigarh. However, a copy of occupation
certificate issued by the SDO(B), Estate Office,
U.T., Chandigarh on dated 31.5.2010 is enclosed at
Annexure “6”.
H What is fate of the said revised
Zoning Plan submitted by the
Uppal Pvt Limited? Kindly
supply the detail of the same?
The said point pertains to Chief Architect and
SDO(B), U.T., Chandigarh.
However, the Chief Architect had sought
NOC regarding proposed independent EWS Block
from this Corporation being allotting agency. It was
informed by the Municipal Corporation vide letter
dated 30.9.2015 to the Chief Architect that “the
matter has been considered at the level of
Commissioner, MCC and it has been decided that
no change should be allowed in original terms and
conditions of the allotment letter”.
Thereafter, the Chief Architect-cum-
Chairman, Deptt. of Urban Planning, Chandigarh
Administration vide letter dated 17.11.2015 has
intimated that “the revised building Plan for the
independent block of EWS of Uppal Group Housing
Scheme, Pocket no. 2 &3, Manimajra has not been
considered for approved by their office, in view of
the decision of this office vide memo as referred
above i.e. no change should be allowed in original
terms and conditions of the allotment letter. Further,
they have informed that EWS houses may be
retained as per earlier approved/sanctioned building
plans”. (Copy enclosed at Annexure “7”)

Subject: Amendment in Service Regulation of Sub Divisional Engineer (Horticulture)
The Municipal Corporation, Chandigarh notified its own Service Regulation of
Engineering Wing on 17.8.2012.
The following are the notified Service Regulations for filling up the post of Sub
Divisional Engineer (Hort.) by promotion.
By Promotion(50%)
Sectional Officer (Hort.)/Horticulture Inspector with 12 years regular service in the grade (including service any, rendered in the grade of Sectional officer (Hort) (Selection Grade and possessing B.Sc. (Agriculture)/B.Sc. (Botany)/B.Sc. (Hort.) of a recognized university or equivalent.
Or
Sectional officer (Horticulture) with 10 years regular service in the grade including regular service, if any, as Horticulture Supervisor and possessing Certificate in Garden Training course in Horticulture or Agriculture from a recognized university, Institute or equivalent, provided atleast 8 years regular service should be Sectional Officer (Hort.)
In the above Service Regulation, the minimum regular service required for the
degree holder for promotion to the post of SDE(Hort.) is given 12 years & 10 years for non
degree holders whereas the qualification of degree holders Junior Engineer(Hort.) for promotion
to the post of SDE(Hort.) should not be more than non degree holders. Therefore, the Service
Regulation of SDE (Hort.) are required to be amended (Annexure-I).
The matter is placed before the General House to reconsider the Service
Regulation for the post of Sub Divisional Engineer (Horticulture). After that the same will be sent
to Chandigarh Administration for amendment.

Subject: Amendment required in the Policy/ guidelines approved for the management
of Community Centres/ Janj Ghar by the General House in its 189th meeting
held on 30.01.2013 for smooth functioning.
The following points/amendments are required to be considered and decided by the
General House of MC Chandigarh:
a) During the gap period between the expiration of tenure of Executive Committee and re-
constitution of Executive Committee of the respective Community Centres, the
Commissioner, MCC may authorise to any officer/official of the MCC to exercise the power of
the Executive Committee.
b) The day to day expenditure for maintaining the Community Centre like purchasing of broom,
phenol, repair/change of water tap / bulb/ tube light etc. upto maximum of Rs. 5,000/- per
month may be done by the Executive Committee from the joint account by following the GFR.
c) All the expenditure made from the joint account of the respective Community Centres shall be
placed before the Executive Committee every quarter.
d) Election for the executive Committee in the villages /rehabilitation colonies under the jurisdiction of MC, Chandigarh:- The election to the post of President, Vice President, Secretary, 3 members of Executive
Committee shall be conducted by the MCC on the recommendation received from
Chairperson and official Executive members. There shall be minimum 25 member of the
Community Centres are required for conducting the elections of Executive Committee of
respective Community Centre.
e) Proposal for constitution of executive committee for all other community centres where there is no executive committee.

Tenure of the Executive Committee:-
The above said Executive Committee will remain in existence till an Executive committee is

Financial power:-
The area Executive Engineer of Road Wing may authorise to any officer/official of the MCC to
exercise the power of the Executive Committee.
NOTE:
This executive committee will work as per the approved guide lines of the General house.
f) Functioning of Gym in Community centres:-
i) Maintenance and operation of gym is a technical issue with health concern. Initiative should be
taken to get gym installed, operated and maintained by private parties on the commercial basis.
The Commissioner, Municipal Corporation, Chandigarh may be authorised to explore such
opportunities and take appropriate action.
ii) In Community centres where gym is maintained and operated by private parties, the members
of the Community Centre should be allowed to use the gym at concession rates.
The above points/amendments are placed before the General House for its consideration
and approval.

Subject: Hiring of Tractor Trolleys.
An agenda regarding hiring of 20 No. of Tractor Trolleys was placed in
the 231st meeting of General House of the Municipal Corporation Chandigarh held
on 30.05.2016.
The house considered and resolved as under:-
“The House considered & approved the extension with majority for
hiring of 20 Tractor Trolleys already deployed for lifting solid
waste in Municipal Area of Chandigarh for 03 months from
1.5.2016 to 31.07.2016 on the existing terms and conditions from
the existing contractors.
It was further decided that a new e-tender be floated meanwhile.”
The Ministry of Urban Development is implementing Swachh Bharat
Mission. Last time Chandigarh was declared as the 2nd Best City. This time our
endeavour is to be the 1st Best City. Frequent requests are received from the
Councillors and general public stating that the process of lifting of garbage in the
city is slow and sometimes the horticulture waste during the season of falling of
leaves and after a thunder storm takes days before it is lifted. In this regard,
various discussions and meetings have been held with the field staff. The field staff
has told that the no. of Trolleys (MOH office and hired) are less and in some cases,
the Trolleys are covering two or more Sectors. A trolley takes 03 rounds daily and

is thus not able to completely clear the whole area assigned to it in a single day. As
a result of this, garbage accumulated.
Thus, the filed staff including Health Supervisors, Chief Sanitary
Inspectors and Sanitary Inspectors were told to give the fresh requirement by which
they will be able to clear the whole area under them daily. They have given a new
requirement of 34 No. of Tractor Trolleys.
It was decided that new tender be floated on the basis of weight of
garbage transported and the minimum no. of trips for each Tractor Trolleys will be

E-tenders are hereby invited on behalf of the Commissioner, Municipal Corporation, Chandigarh from the firms/individuals/suppliers for hiring of 34 Nos. of Tractor Trolleys for lifting of Dry Leaves/Horticulture Waste/Solid Waste from municipal limits of U.T., Chandigarh for a period of One Year, which can be extended on yearly basis maximum upto Three Years keeping in view of the performance of the firms/individuals/suppliers with mutual consent.
Tender along with terms and conditions are available at website https://etenders.chd.nic.in w.e.f. _________. The tender shall be uploaded and received on https://etenders.chd.nic.in only up to _________ till 05:00 p.m. The tender will be opened on _________ at 11:00 a.m. and pre-bid meeting will be held on _______________ in the Committee Room of Municipal Corporation Chandigarh at _________.
Important instructions:-

7. The bidders are required to upload all the documents as prescribed in check-list as mentioned at

8. Price Bid shall be quoted by the bidder through e-tendering as per BOQ pattern.
9. The Bidders shall have to submit the Price Bids on-line in Electronic Format Digital Signatures for

ANNEXURE – E
General Terms & Conditions
1. The rates quoted will be valid for a period of One Year from the date of acceptance of the tender and no increase will be allowed during the period of contract.
2. The tractors and trolleys should be registered with concerned registration authority and insured for 3rd party during the period of contract. The bidder/contractor/supplier will be fully liable for any liability during the period of contract.
3. The 34 nos. of Tractor Trolleys are required to be supplied along with P.O.L./repairs/maintenance etc. as well as Labour consisting of one Driver with minimum of 05 nos. of labourers and sanitation material i.e. Pally, Panja, Kassi etc. are required to be provided to each tractor trolley by the firm/contractor for the removal of dry leaves/horticulture waste/solid waste from the municipal limits of Chandigarh during the period of contract. Every driver must have mobile phone No. in working condition during duty hours.
4. Technical Eligibility Criteria:-
i). The bidder has to upload the experience and past performance on similar nature of contracts/works for last
two years of minimum 50% of the required work for the supply of tractor trolleys with Labour.
ii). The bidder is also required to upload an undertaking to the effect that the agency/firm is
capable and has sufficient resources and labour to supply 34 Nos. tractor trolleys with labour.
iii). If the rates quoted by the firms/bidders are found to be at par, then the contract will be allotted in
equal share.
5. The number of tractor trolleys can be increased or decreased on the basis of requirement from time to time. If the contractor fails to supply increase demand of the trolleys by the Municipal Corporation within 48 hours, he will be penalized @ Rs.7500/- per day from the date of issue of the letter.
6. The firm/contractor is required to quote their rates for the supply of tractor trolley as per condition no. 3 in per Kg format from the area as per detail given at Annexure-F i.e. sector/village/colony etc. within the municipal limits of Chandigarh and to dump MSW garbage/ Dry Leaves/Horticulture Waste etc. at the ear-marked Dumping Ground/Garbage Processing Plant as the case may be.
7. The payment of the transportation of the garbage will be entertained as per weight measured at the weigh bridge installed at Dumping ground. Only driver will be allowed to sit on the vehicle while weighing. The firm will submit photocopy of weigh slips duly attested along with the bill.
8. If any tractor trolley is found carrying any material with the intention to increase the weight and the same is not required to be dumped at dumping ground, the trip of the tractor trolley will not be entertained and double the amount of the weight received at dumping ground will be deducted from the contractor bill and if any tractor trolley is found using this malpractice 5 times, the contract of the firm will be cancelled and security amount of the firm will be forfeited.
9. Each Tractor Trolley is required to be fully filled and should be covered with sheet i.e. Tarpaulim/Plastic etc. covering the complete length & width of trolleys, so that the waste is not visible to the naked eyes and does not litter the city streets during the movement of tractor trolleys.

10. The firm/contractor approved for supplying the tractor trolleys are required to comply with the Municipal Solid Waste (Management & Handling) Rules, 2000 and will be liable for any action due to breach any of the conditions stipulated thereof.
11. The tractor trolleys are required to report to concerned area Sanitary Inspectors/Chief Sanitary Inspector at the designated place at 7:00 a.m. during summer and 7:30 a.m. during winter. The tractor trolleys are required to perform the duty for a period of 8 hours and making minimum of 3 trips per day from the area earmarked to the dumping site in Chandigarh and 2 trips per day if deployed in the area of Manimajra, U.T., Chandigarh. Any tractor trolley fails to make requisite number of trips, it will be penalized for double the amount to be paid for its MSW received in previous trip.
12. The tractor trolleys are required to get the trip/weight entered in the Dumping Ground/Garbage Processing Plant failing which the trip shall not be counted.
13. Earnest Money (E.M.D.) amounting to Rs. 3.50 lacs in the shape of Demand Draft issued from any commercial bank in favour of the Medical Officer of Health, Municipal Corporation, Chandigarh payable at Chandigarh should be physically delivered to the office of MOH on the stipulated date and time and scanned copy of EMD be uploaded in the etender documents. Tenders without physical earnest money (in original) in advance before the close of e-tender will be rejected summarily.
14. Consequent upon the allotment of work, the supplier shall submit Performance Security (Security Money) on Model Bank Guarantee format as per Annexure-G valid for the entire period of contract+60 days after completion of all contractual obligations including Warranty Obligations equivalent to 5% of the total cost of the contract allotted in the shape of requisite format issued by any commercial bank/scheduled bank in favour of the Medical Officer of Health, Municipal Corporation, Chandigarh within 15 days from the date of allotment.
The successful bidder shall be required to execute an agreement with the office on the format approved and
supplied by the department on stamp papers of appropriate value at his/their own cost within 15 days of
allotment.
The successful bidder shall also submit an Indemnity Bond for Indemnify the office against all the liabilities
and losses.
15. The firm/contractor to whom the supply order is placed is required to make 100% availability of Tractor Trolleys within 10 days of allotment. The firms/contractor are required to keep one Tractor Trolley spare in order to meet any breakdown/exigency/emergency at their level. In case the firm fails to supply the requisite no. of tractor trolleys within stipulated period of supply order, the contract of the firm can be cancelled and its EMD can be forfeiture. The firm can be blacklisted.
16. In case of continuous breach for non-supply of tractor trolleys with labour etc. for a period of more than 07 days, the contract will be terminated and security amount will be forfeited. The firm/contractor will be blacklisted thereafter for a period of minimum 03 years.
17. The tractor trolleys are required to be given a coat of “Green Colour” and to be painted on both sides of trolleys “ON CONTRACT WITH M.C.C.”

18. Any liability arising out of the tractor trolley/manpower etc. under the provisions of any Act i.e. Motor Vehicle Act, Labour Act, EPF, ESIC or any other Act as applicable will be the sole liability of the firm/contractor.
19. The Force Majeure means an event beyond the control of the supplier and not involving the supplier’s fault or negligence and which is not foreseeable. Such events may include, but are not restricted to, acts of the purchaser either in its sovereign or contractual capacity, wars or revolutions, hostility, acts of public enemy, civil commotion, sabotage, fires, floods, explosions, epidemics, quarantine restrictions, strikes, lockouts, and freight embargoes. If there is delay in performance or other failures by the supplier to perform its obligation under its contract due to event of a Force Majeure, the supplier shall not be held responsible for such delays/ failures. If a Force Majeure situation arises, the supplier shall promptly notify the purchaser in writing of such conditions.
20. Corrigendum/Addendum to this tender, if any will be uploaded on the website mentioned above.
21. The Commissioner, Municipal Corporation, Chandigarh reserves the right to reject any or all the applications/tenders without assigning any reason. Over all lowest bid will be criteria for finalization of tender.
22. The Commissioner, Municipal Corporation, Chandigarh reserves the right to verify the particulars furnished by the applicant independently. If any information furnished by the applicant is found incorrect at a later stage; the firm/contractor/supplier shall be liable to be debarred/blacklisted for future tendering under the provision of “policy on blacklisting-2009” notified vide no. 1927-F and PO(3)-2009/1170 dated 27.02.2009 by the department of Finance, Chandigarh Administration.
23. The Courts at Chandigarh alone shall have the jurisdiction for the purpose of this agreement.
24. In the event of any dispute and difference arising out of or in any way touching on concerning this contract, the matter whatsoever shall be referred to the sole Arbitrator i.e. Commissioner, Municipal Corporation, Chandigarh or any other officer authorized by him, whose decision shall be binding on both the parties. The Arbitration and Conciliation Act, 1996 shall apply to the arbitration proceedings. The venue of arbitration shall be only at Chandigarh, U.T. (India). The contractor shall not object that the Arbitrator i.e. Commissioner, Municipal Corporation, Chandigarh or any other officer authorized by him may have dealt with the subject matter earlier in his official capacity.
The expression “Commissioner, Municipal Corporation, Chandigarh shall mean and include an
acting/officiating Commissioner, Municipal Corporation, Chandigarh.”
Subject as aforesaid, the Arbitration and Conciliation Act, 1996 and the rules framed there under and
any modification thereof for the time being in force shall be deemed to apply to the Arbitrator
proceedings under this clause.
