D. Staff Announcements i. The Mental Health Services Act Update is available for public comment and will culminate in a public hearing at the May Commission meeting. ii.The May Is Mental Health Month celebration will be Thursday, May 29 from 4 – 7 pm at 2640 Martin Luther King, Jr Way.

3. Response to NAACP Town Hall Report

Commissioners will submit written recommendations for the response to the Commission Secretary by May 8 for consideration at the May Commission meeting.

4. Commission Applicant Interview Guidelines This item is tabled until the Commission can look at the City Attorney’s opinion on the statement proposed last month.

6. Report from Mental Health Division – Steven Grolnic-McClurg Mr. Grolnic-McClurg reported on the progress in developing mental health division recommendations for improving services to persons in mental health crises. He provided information about Mental Health First Aid and indicated that Berkeley will be sending staff to be trained as trainers so that they can train the community.

7. Taser Subcommittee Report Two members of the public commented on the use of Tasers. M/S/C (Marasovic, Michel) The Mental Health Commission strongly urges the City of Berkeley not adopt the use of Tasers because of their likelihood to cause serious bodily injury or death to vulnerable persons. The Taser Subcommittee shall draft a report to Council. Ayes: Davis, Grossman, Heda, Kealoha-Blake, Marasovic, Michel, Posey; Noes: Dixon; Abstentions: None; Absent: Adams, Arreguin.

To: Honorable Mayor and Members of the City Council From: Councilmembers Laurie Capitelli, Gordon Wozniak, Darryl Moore Subject: Requesting a Report on the Possible Use of Tasers by BPD RECOMMENDATION Request that the City Manager research and report back to the City Council regarding the history, potential benefits, impacts and possible unintended consequences of allowing Berkeley police to carry and use tasers. Include in the report information regarding other jurisdictions’ “best practices” and protocols, an analysis of changes in technologies, and the feasibility of doing a pilot program. The City Manager should also consult with the Police Review Commission. FINANCIAL IMPLICATIONS Unknown staff time to research and write report. BACKGROUND Currently, every jurisdiction in the inner Bay Area except Berkeley, Alameda and San Francisco allows sworn police officers to carry tasers. The Berkeley Police Association is on record as supporting tasers as an important tool in law enforcement and they are in support of allowing Berkeley Police officers to carry them. Historically in Berkeley there has been significant opposition to allowing the use of tasers. Amongst the concerns, critics worry that police will use tasers in circumstances other than to avoid the use of lethal force. Before making any decision regarding the use of tasers by Berkeley police, the City Council should be well informed. Topics addressed in the staff report should include:

A report on changes in taser technology over the past decade; Regulations and experiences in jurisdictions that do allow tasers; An analysis of possible cost savings related to injuries, workers comp and early

retirement; A list of serious or minor injuries to citizens or officers that might have been

avoided by using tasers; A comparison between Berkeley and a selection of other local jurisdictions

I recall now that i was going to draft a general recommendation. Here you go:

The Community Mental Health Commission has reviewed the proposals of the NAACP Town Hall

meeting. We welcome this expresssion of the concerns of the African American Community and

regard the issues raised for the Mental Health system in Berkeley as extremely important. In

reviewing funding proposals for the Mental health Services Act we will be attuned to the need

for increased services directed toward low income residents in South and West Berkeley. We

are currently involved in a review of the mental health crisis response system. These

discussions include the feasibility of expanding mobile crisis hours. We will encourage

Berkley Mental Health to set enhanced diversity as a top priority in staff hiring.

• �Develop accountability standards for place-based Health Equity Work in the African American community – for mental health outcomes?

violence = trauma, trauma=mental health issue!!! • �Increase resources in order to eradicate violence; especially as it affects youth –

innovations program, education around MHSA funding • �Create a Mental Health and Public Health oversight advisory committee comprised of

African Americans, Low-income individuals and people from marginalized communities – sounds like the mental health commission if we were doing our job!!!

• Mental Health and Health Commissions need to provide more Oversight to Mental and Public Health Divisions. – I definitely would like to see more transparency before decisions are made around budgets with the Commission and the MHSA Advisory committee. Now that we are into our three year planning process maybe this will happen

At the March 27, 2014 Regular Mental Health Commission the following guideline was

proposed for interviewing commission applicants:

“Commission applicants may be asked their positions on policy matters, laws or administrative regulations, current pending or proposed, state, federal or municipal. Commission applicants may also be asked other positions on policy. Staff was requested to check the legality of the statement before the Commission votes on the statement.”
