RECOMMENDATION: That Council suspend standing orders pursuant to Regulation 20 of Local Government (Procedures at Meetings) Regulations 2013 to carry out Community Grants cheque presentations for Round 1 2016/2017.

3: ADJOURNED ITEMS: 3.1 Cr. Gore – Camping, Lake Bonney At the May 2016 Ordinary Meeting of Council Cr. Gore put forward the following Motion with Notice;

The area around Lake Bonney has traditionally been a 'free camping' zone. But of recent years vehicles have degraded the area and rubbish removal has become a major and expensive issue for Council especially at Easter time. CEO Comment: Council was awarded joint management of the surrounds of Lake Bonney/Barmera with the First People’s of the River Murray under the Native Title declaration; a requirement is the development of a management plan for the lake. The Barmerara Meru Committee will consider maps of the surrounds of the lake to identify areas for camping and exclusion zones at its next meeting. These recommendations will require approval by both the River Murray and Mallee Aboriginal Corporation on behalf of the First People’s and Council. A plan prior to that may be considered as culturally and administratively inappropriate. MOTION: That Council be presented with a plan that includes 'paid camping' provisions encompassing the area surrounding Lake Bonney.

Cr Gore/ Cr Kassebaum At the meeting, a formal motion was resolved for the motion to lie on the table and is brought back to this meeting for consideration.

3.2 Signage Policy Council’s current signage policy was considered at the meeting of Strategic Governance Meeting held on

November 8th 2016 with the outcome being a request from Elected Members for a further staff review of the policy, particularly in relation to real estate signage. The policy was presented at the meeting of Council held on November 22nd 2016 with the item remaining on the table for further review and presentation. MES/MP Comment: The policy has been reviewed and further edits made to improve the clarity of wording and explanations provided to the reader. RECOMMENDATION: That the signage policy be adopted by council.

Purpose Council is responsible for the issuing of approvals and permits for various forms of signage and these are generally assessed under the Development Act 1993 and Local Government Act 1999. It has come to council’s attention that some forms of signage are not covered that would be of benefit to the community in particular to allow for out of town areas to promote their locations. Signs of this nature are typically located adjacent the Sturt Highway which is the responsibility of the Department of Planning, Transport and Infrastructure (DPTI). The signage policy aims to provide consistency with the requirements of the DPTI and offer a uniform approach to signage within our district. Principles The Policy aims to provide an orderly and environmentally friendly approach to placement of roadside signs in public places and also to minimisze any threat to public safety from the placement of such signage.

Tourism/town entry/community signs: Tourist signage requested by local businesses shall be undertaken in accordance with the “Road Sign Guidelines: Guide to visitor and services road signs in South Australia” produced by Tourism SA when located in areas under the direction of TSA.DPTI Safety and Service Division Town entrance signs for the smaller townships of Cobdogla, Loveday, Overland Corner, Glossop, Winkie and Monash shall be erected in the most appropriate site adjacent the Highway. For the towns of Glossop, Monash and Overland Corner there shall be one single sided sign at each end of the entrance of the town, whilst e the other towns of Cobdogla, Loveday and, Winkie and Monash shall have a double sided single sign at the most appropriate site adjacent the Sturt Highway, to provide direction to the towns. There should be a uniform approach for these structures located on council land. Signage should be appropriately located to avoid interference with existing infrastructure, road users and pedestrians. These signs should be located at appropriate points to provide clear direction and information to residents and visitors to places of interest. Council may authorise local businesses to utilise space on the smaller township signs and as well as other directional signs, to provide advertising space. This advertising will be provided at the expense of the business that wishes to utilise any sign erected by council. Signage is to be undertaken in coordination with the Department of Planning, Transport and Infrastructure where necessary in locations endorsed by council and in consultation with the Berri and Barmera Town Beautification Committees. Additional signage shall only be undertaken with the agreement of council. Community signs shall be consolidated to appropriate locations so as to avoid proliferation of signage along the roads. These locations should include existing and new visitor information sites for permanently fixed signs. Temporary community signs shall be erected only with the relevant permits under the Local Government Act 1999 and in accordance with the following requirements:

Located only within the nominated areas;

Not sited so as to interfere with traffic or pedestrian movements;

Not interfere with any infrastructure above or below ground;

Be erected no longer than 6 weeks prior to an event and be removed within 1 week after the event; and

Must not move, flash or be illuminated. Real Estate signs: Real Estate signs within townships are adequately governed by the provisions of the Development Act and Regulations. In areas outside townships it is deemed acceptable practice to allow for directional signage located on Council land which is in addition to compliant signage on the subject property for sale. Location directional related Real Estate signs on Council land outside township areas shall be limited to the following circumstances:, when associated with the out of town areas:

Limit of one sign per property for sale or auction;

Have a maximum height of 1 metre above ground level;

Have an advertising area not exceeding a dimension of 400mm x 400mm;

Be double sided to avoid the need for dual signage;

Contain only the name of the agent that is responsible for the subject property, details of whether the subject property is for sale, auction or lease and a directional arrow on the advertising display;

Not be located within 10 metres of an intersection;

Not include any illumination;

Be maintained in good condition;

Be stable when in position;

Must not interfere with any infrastructure above or below ground;

Be removed a maximum of 2 weeks after the property is disposed of;

Be subject to an annual fee of $5 per sign per annum from council.

1. Introduction

Section 12(4) of the Local Government Act 1999 (the Act) requires Council to undertake a review of all

aspects of its composition and the division (or potential division) of the Council area into wards, at

least once in every period prescribed by the Minister for Local Government (generally eight years).

The review must be conducted and completed during the period April 2016 - April 2017.

The current review commenced in March 2016 and has progressed to the point where the first of two

prescribed public consultation stages has been completed. Council must now determine (“in

principle”) what changes, if any, it proposes to bring into effect in respect to its future size,

composition and structure.

2. Public Consultation

Public consultation commenced on Thursday, 20th

October, 2016 with the publishing of a public notice

in the Government Gazette, and this was followed by the publishing of a notice in the “Murray

Pioneer” newspaper on Friday, 21st October, 2016. In addition, the public consultation process

included promotion of the review (and the posting of the various relevant documents) on the Council

website and social media; and provision of the Representation Options Paper and associated

documents at the council offices.

At the expiration of the public consultation period (i.e. close of business on Friday 2nd

December,

2016) Council had received no submissions.

3. Future Composition and Structure Council has now reached the stage of the prescribed review process where it must identify what

changes (if any) it proposes to make to its current composition and/or structure. More specifically,

Council is required to make “in principle” decisions in respect to all of the following issues and present

details of its preferred future structure and composition to the community (for consideration and

comment) during the second of the prescribed consultation periods.

3.1 Mayor/Chairperson

The principal member of Council has always been a mayor elected by the community.

The following arguments for and against the two alternatives are provided to assist members in their

deliberations.

3.1.1 Mayor

A mayor is elected by the community.

The election of the mayor affords all eligible members of the community the opportunity to

express faith in a candidate and the result of the vote provides the elected Council with an

identifiable principal member who is accountable to the community.

A mayor is elected for a four year term and therefore provides stability and continuity to Council.

An elected mayor cannot be removed from office unless where legislative breaches are proven.

An elected mayor does not have a deliberative vote on a matter before council, but has, in the

event of a tied vote, a casting vote.

The office of mayor (elected) is additional to the number of councillors and, as such, comes at an

additional cost to Council (i.e. members allowances, administrative costs and alike).

As an election (or supplementary election) for the office of mayor must be conducted across the

whole of the Council area, a significant cost can be incurred by Council on every occasion the office

is contested.

At present all bar sixteen regional Councils have an elected mayor, as do all of the metropolitan

councils.

Candidates for the office of mayor cannot also stand for election as a councillor and, as such, the

experience and expertise of unsuccessful mayoral candidates will be lost to council.

3.1.2 Chairperson

A chairperson is selected by and from amongst the elected members.

The office of chairperson provides flexibility and opportunity for a number of elected members to

gain experience as the principal member during the four year term of the Council; and to bring

their particular skill set and opinions to the position, albeit for what could be a limited period of

time.

The term of a chairperson is decided by Council (1 - 4 years).

Council decides the title of a chairperson (e.g. mayor), pursuant to Section 51(1)(b) of the Act.

Sixteen regional councils currently have a chairperson, fourteen of which bear the title of mayor.

A chairperson has a deliberative vote at a council meeting, but does not have a casting vote.

The selection of a chairperson is not reliant upon an election. Should a chairperson not be able to

complete a full term of office a replacement can be selected from the existing elected members

and costs will only be incurred by Council when it seeks to fill the vacant position of councillor

(which is limited to the specific ward if a ward structure is in place).

It should be noted that:

any proposal to have a chairperson rather than an elected mayor cannot proceed unless or until a

poll has been conducted in accordance with the requirements of Section 12 (11a-d) of the Local

Government Act;

a poll must be conducted by Electoral Commission SA at Council’s expense;

a poll can occur either as part of the current review (which requires the review to be suspended

until the poll has been held and the outcome thereof is known) or at the time of the next Local

Government election (i.e. November 2018);

the result of a poll is binding and requires no ratification by Council; and

where a poll receives majority support, the proposal presented therein comes into effect at the

next Local Government election.

3.2 Structure

3.2.1 Wards/No Wards

Berri Barmera Council has never been divided into wards.

The key arguments supporting the retention of the “no wards” structure include:

the electors have the opportunity to vote for all of the vacant positions on Council;

the most supported candidates from across the Council area will likely be elected;

the elected members should be free of parochial local/ward attitudes;

the lines of communication between Council and the community should be enhanced, given that

members of the community will be able to consult with any and/or all members of Council, rather

than be obliged to consult with their specific ward councillors;

under the current proportional representation method of voting the “no ward” structure still

affords opportunities for the smaller “communities of interest” within the Council area to be

directly represented on Council (subject to voter turnout); and

the “no ward” structure automatically absorbs fluctuations in elector numbers (i.e. the quota

tolerance limits do not apply).

At present thirty-two regional councils and two metropolitan councils (i.e. the Towns of Walkerville

and Gawler) have no wards. In addition, the Southern Mallee District Council has recently resolved to

abolish wards, although this proposal has not yet been certified by the Electoral Commissioner.

The main arguments supporting the introduction of ward structure include:

wards guarantee some form and level of direct representation to existing communities of interest

and/or parts of the Council area;

ward councillors can focus on local issues;

under the “no wards” structure Council has to conduct elections and supplementary elections

across the whole of the Council area (at a significant expense); and

under the “no wards” structure the more popular or known councillors may receive more enquiries

from the public (i.e. inequitable workloads).

Should it be the preference of the elected members to introduce a ward structure, Council will not

only have to identify an appropriate ward structure but will also have to determine the need for area

councillors in addition to ward councillors; the level of representation within the wards; and

appropriate ward names.

3.2.2 Ward Structures

Council has previously considered a number of potential future ward structure options, and the

Representation Options Paper contained three ward structures to demonstrate how the Council area

could be divided under a Council structure which comprised seven and/or eight ward councillors.

Should Council opt to introduce a ward structure, the elected members will have to identify their

preferred ward structure. This could be one of any of the ward structure options previously presented

to Council or a newly developed structure based on the specific needs of Council in respect to

councillor numbers and levels of ward representation.

Any alternative ward structure option should:

provide an equitable balance of electors between wards which can be maintained, within the

specified quota tolerance limits over the extended period between reviews;

allow for likely fluctuations in elector numbers, primarily as a consequence of future population

growth/decline and/or residential development; and

exhibit an elector ratio which is similar to those exhibited by other councils of a comparable size

and type (i.e. avoids over-representation).

In addition, Council will need to take into account:

the character and topography of the area;

the likely impacts of wards and ward boundaries upon existing “communities of interest”; and

the preferred level of ward representation and the total number of elected members.

3.2.3 Area Councillors (in addition to ward councillors)

Section 52 of the Act indicates that councillors can be elected as a representative of a ward, or

alternatively, to represent the Council area as a whole (whether or not the council area is divided into

wards).

This matter only needs to be addressed if Council decides to introduce a ward structure.

As indicated in the Representation Options Paper, ward councillors generally consider themselves to

represent not only their ward, but the Council area as a whole. This being the case, the need for area

councillors in addition to ward councillors is questionable, an assertion which is seemingly supported

by the fact that only the City of Adelaide has a ward structure which incorporates two levels of

representation. Further, it is noted that under such an arrangement area councillors hold no greater

status than a ward councillor; have no greater responsibilities than a ward councillor; and need not

comply with any extraordinary or additional eligibility requirements.

In addition, any contested election (and/or supplementary election) for area councillors must be

conducted across the whole of the Council area, at a significant cost to Council.

For these and the other reasons previously presented to Council, it is considered that area councillors

(in addition to ward councillors) are unwarranted and unnecessary, and represent a costly additional

tier of representation.

3.2.4 Ward Identification

Again, this matter only need be addressed if Council opts to introduce a ward structure.

As indicated in the Representation Options Paper, wards can be identified using numbers, alphabetical

letters, direction or geographical references (e.g. north, south, east, west, central); place names; and/or

names of European and/or Aboriginal heritage/cultural significance.

It is suggested that the allocation of place names may be the most appropriate and palatable means

of ward identification, however, experience suggests that reaching consensus over the selection of

appropriate ward names (if required) may prove to be a difficult exercise.

3.3 Composition

Sections 26 and 33 of the Local Government Act 1999 specify: “the need to ensure adequate and fair

representation while at the same time avoiding over-representation in comparison to other councils of a

similar size and type (at least in the longer term)”.

The following table indicates that, when compared to the elector arrangements of other regional

councils of a similar size (in terms of elector numbers), the number of elected members on Council

and the resultant elector ratio are generally comparable.

Whilst the elector ratio of Council is reasonable when compared to those exhibited by the cited

councils in Table 1, there are councils within South Australia which function with fewer elected

members and/or higher elector ratios. This being the case, the review affords the opportunity to at

least consider alternative arrangements including a smaller number of elected members.

When considering a reduction in the number of councillors, care must be taken to ensure that:

sufficient elected members are available to manage the affairs of Council;

the elected member’s workloads do not become excessive;

there is an appropriate level of elector representation;

a diversity in member's skill sets, experience and backgrounds is maintained; and

adequate lines of communication will exist between a growing community and Council.

In addition, members should take into account the fact that:

all indicators suggest that the population (and therefore elector numbers) within the Council area

may decrease in the foreseeable future;

a reduction in the number of elected members will result in some cost savings to Council (e.g.

elected member's allowances alone are $12,800 per annum per councillor) which could be available

for redirection to community projects and/or programs;

fewer members may expedite debate and the decision making process in Council; and

enhanced communication and information technology should have served to reduce any

difficulties previously experienced by elected members in respect to their day to day tasks and

communication with both Council and the community.

A reduction in the number of elected members will serve to increase the elector ratio from the current

1:918 to 1:1,049 (seven councillors) or 1:1,224 (six councillors). It should be noted that only three

small regional councils within South Australia comprise six councillors; and the eight councils which

currently comprise seven councillors have elector numbers ranging from only 726 to 3,745.

On the other hand, any thought of increasing the number of elected members will be difficult to

justify, both from a cost point of view and compliance with the requirements of Sections 26 and 33 of

the Act (in terms of avoiding over-representation by comparison with other councils of a similar size

and type).

4. Review Process

The next stage of the review process, as specified under Section 12(8a) of the Act, involves Council

preparing a “Representation Review Report” which will:

provide information regarding the initial public consultation undertaken and Council’s response to

the issues arising from the submissions received;

set out the proposal that Council considers should be carried into effect; and

present evidence of how the proposal relates to the provisions of Sections 26 and 33 of the Act.

Once completed, the report has to be presented to the community for consideration and comment, in

accordance with the provisions of Section 12(9) and (10) of the Act. This second public consultation

stage must:

extend for a minimum period of three (3) weeks;

provide copies of the report for public inspection; and

afford all interested persons the opportunity to make a written submission to Council.

Any person who makes a written submission must be given the opportunity to address Council, either

in person or by way of a representative, in support of his/her submission.

Upon completion of the second public consultation, and after due consideration of all submissions

received in response thereto, Council will be in a position to make final decisions regarding its future

composition and structure. The final stage of the review process is the presentation of a formal report

to the Electoral Commissioner, for consideration and certification.

5. Recommendations

It is recommended that the Berri Barmera Council resolve as follows.

1. To formally note that no submissions were received during or as a consequence of the first public

consultation undertaken by Council

2. To agree ‘in principle’ to the following.

2.1 The principal member of Council continue to be a mayor elected by the community.

2.2 The Council area not be divided into wards (i.e. the existing “no wards” structure be retained).

2.3 The future elected body of Council comprise the mayor and eight (8) area councillors (i.e. the

status quo).

3. Based on recommendation 2, a draft Representation Review Report be prepared (for consideration

by Council) pursuant to the provisions of Section 12(8a) of the Local Government Act 1999.

4.2 Murray Darling Association update (item 7.2)

Due to the resignation of Cr Kevin Myers there is not a Chairperson for MDA-Region 5. Russell Peate, Mid Murray Council CEO is the current host providing secretarial and administration support. The formal appointment of a Chairperson is expected to be made at the next AGM.

Deputy Chairperson Cr Mark Ward has requested to provide a presentation to the February RLGF, when he will have more detailed information regarding the MDA National Conference. Date of conference yet to be confirmed.

5. Deputations 5.1 Ulysses Club

Mayor Martinson welcomed Graeme Rule, Co-Director of the 2018 Ulysses Club AGM and event to the meeting at 2.55 pm. Mr Rule provided an update and proposed itinerary for the 2018 Ulysses Club AGM and event to be based in the Riverland in May 2018.

Event host committee consisting of 90 members has commenced planning for the event. Up to 3000 bikes expected to participate

Local facilities and amenities to be used. AGM to be held at the Chaffey Theatre Renmark, and the National Committee meeting to be held at the Barmera Recreation Centre

Grand Parade planned to commence at Barmera and finish at Renmark, with a Civic Welcome and display of bikes. Brief discussion on venue, with consideration to be given to staging the welcome and display at the Renmark Oval

A lot of preparation and planning yet to be done, including preferred routes, traffic management plans, relevant approvals ie Council, Police and DPTI

Special mention made of the BBC staff attendance at the recent National event to promote the Riverland AGM. Requested similar attendance and promotion at the 2017 AGM

Sponsorship partners encouraged and welcomed. Information night planned with local groups, organisations and peak bodies to be invited

Karyn Burton to follow up status with David Beaton. Peter Bond advised funding via MRLGA may be available for this project.

6.9 Boating Industry Association of SA (DCLW) Peter Ackland to confirm BIASA Strategic Plan consultation process to ensure review and feedback from the Riverland Councils can be considered.

Discussion regarding impact due to high river/black water of sufficient potable water for properties that are connected to CIT water. Noted that it is the responsibility of the property owner to ensure alternative supply of potable water ie rainwater tanks or filtering system given that Irrigation Trust supply services are not marketed as potable supplies.

Subject Detail: Correspondence has been received from the Murray Darling Association Inc calling for local

government to have a seat at the table when state and federal governments meet to consider amendments to the Basin Plan, ensuring genuine Basin wide community consultation and local representation. The Water Act 2007 requires that any changes proposes by the Authority to the Basin Plan undergo a minimum eight week public consultation. Members of the Murray Darling LG Association are encouraged to work with their Regions to develop a response to the proposed amendments. On Wednesday 7 December 2016, the Premier, Mr Jay Weatherill held a meeting in Renmark to discuss the implementation of the Basin Plan and to advise that the matter has been included on the agenda at the Council of Australian Governments meeting on 9 December 2016. Premier Weatherill stressed the need for South Australia to fight for the assurance that the Basin Plan is implemented in its entirety and to challenge the Federal Minister for Agriculture and Water Resources Barnaby Joyce’s recent statements that the 450GL of additional water recovery targeted for the environment may be forgone. The matter was discussed at the Riverland Local Government Forum on 7 December 2016 and was agreed that a joint statement from Councils be made to the Federal Government that the Murray Darling Basin Plan must remain unchanged The media release and Northern Basin Review information are attached for Members information.

RECOMMENDATION: 1. That the Berri Barmera Council supports the implementation of the Murray Darling

LOCAL GOVERNMENT KEY TO BASIN PLAN SUCCESS

Yet another political stoush between state and federal ministers over the Basin Plan has once more thrown

rural and regional communities across the Murray Darling Basin into economic uncertainty and political

instability. It has also highlighted the need for all levels of government, including local government, to work

together to deliver optimum benefits for all Basin communities as the adjustment and review mechanisms set

into the Basin Plan as worked through.

With the Federal Minister for Agriculture and Water Resources Barnaby Joyce last week opening the

possibility for the 450GL of additional water recovery targeted for the environment to be foregone, and

language from South Australian Water Minister Ian Hunter descending into what could best be described as

‘unhelpful’, the Murray Darling Association is calling for local government to have a seat at the table at

Ministerial level to ensure that decisions are made that include local government and community

perspectives.

“Local government, represented by the MDA has backed a united approach to the implementation of the

Basin Plan that optimises triple bottom line outcomes for our local communities from the outset,” MDA

National President Cr David Thurley said from Albury today. “It is important that local government and the

communities we represent are at the table. There doesn’t need to be ‘winner and losers’ under the Plan, but a

constructive approach to a healthy Basin community does need for everyone to give a little, and to work

together.”

Following the release of the Northern Basin Review, the MDBA has also announced its revised water

recovery target. The Authority is proposing that the target be reduced from 390GLs to 320GL for the

Northern Basin, calling for feedback from communities before the Basin governments decide on the

amendments in February 2017.

The reduction aims to minimise social and economic impacts in northern basin communities and delivers

almost equivalent environmental outcomes by taking a more targeted approach to water recovery, an

objective members of the MDA have long been advocating for.

Speaking at a GMID Water Leadership Forum in Tatura last week, MDBA Chairman Phillip Glyde

confirmed that if approved, the reduction will amend the Basin Plan recovery target from 2750GL to

2680GL, noting also that a 70GL reduction in the north translates to less than a 4GL reduction at the SA

border, and only 3GL over the barrages, having a minimal impact on environmental flows.

“As we consider this review, and any adjustments to the Basin Plan, it is important that the Basin

governments and communities work together to understand the real benefits and impacts,” MDA’s Chief

Executive Emma Bradbury said. “This is not the time for our state and federal counterparts to dig in, and

start using terms like ‘not negotiable’. All levels of government must work together in a non-partisan way to

implement the Basin Plan if we are to maintain a healthy natural environment, halt any adverse social and

economic impacts, and restore confidence to our agricultural sector. Our Basin communities are calling for

leadership, certainty and a fair hearing.”

Ms Bradbury will be meeting with member councils across more than 20 local government areas in the

northern Basin next week to hear their feedback on the proposed amendments, and will travel to South

Australia for similar talks early in the new year.

MDA National Vice President Cr Barry Featherston, a South Australian Irrigator and councillor with

Alexandrina Council added “Local communities realized that the Basin Plan was not perfect, but agreed to it

being implemented so long as there was a review process. The MDA, as local governments peak

representative body on Basin issues is the level of government that can listen to the community and deliver

balanced opinions and local knowledge to our state and federal counterparts on the effects of the

implementation.”

Cr Featherston today called on the Weatheral Government in South Australia to observe the same principles

in delivering the Plan as they undertook with the nuclear waste debate, by listening to the community before

locking South Australia into a set path.

“Local government, through the MDA can help that process - our regional businesses and irrigators right

across the Basin deserve to be heard. We get that at local government level, and the community expect our

state and federal governments to do the same. What local communities want and need is for all levels of

government to work together, and for their state and federal leaders to listen to their concerns rather than

brawling publicly with each other.”

The MDA will continue to work for local government to be formally included in state and federal

discussions on the ongoing adjustments to and implementation of the Basin Plan.

This snapshot provides an insight into the proposed Basin Plan amendments. There are two more snapshots available, covering the themes of groundwater and practical amendments.

The Murray–Darling Basin Plan aims to safeguard one of Australia’s key national assets, the Murray–Darling Basin. The Murray–Darling Basin Authority (MDBA) is the agency responsible for establishing the Basin Plan in consultation with state and Commonwealth governments, industries and communities. The MDBA has a role in implementing and monitoring the Basin Plan and reviewing it in light of experience.

At the time the Basin Plan was established, the MDBA recognised more work in the north was needed to improve understanding of the hydrology, environment and socio-economic implications of the Basin Plan settings. A commitment was made, supported by all basin governments, to undertake a review and assess whether Basin Plan settings in the north are appropriate.

Snapshot• The Basin Plan seeks to deliver vibrant

communities, productive industries and healthy rivers. It does this by establishing a framework for consistent and integrated water management across the Murray–Darling Basin. The Basin Plan sets the amount of water which can be taken in future from the basin’s surface water and groundwater resources (sustainable diversion limits – SDL).

• A review of the northern basin water recovery target has been completed by the Murray–Darling Basin Authority (MDBA). The need to review the target was identified in 2012 when the Basin Plan was passed in recognition that knowledge of some northern areas was not as well developed as others. The three year review involved substantial new research into socio-economic, hydrology and environmental aspects of the northern basin. It also included consultation with northern basin communities.

• An 11 member Northern Basin Advisory Committee was established comprising of people from places in the northern basin with industry, community, Aboriginal and environmental expertise. This group, along with substantial feedback from people within communities, has been invaluable during the review and has advised on the research and helped ground truth the findings. The Northern Basin Advisory Committee also identified the opportunity to implement a range of actions (such as the protection of environmental flows and temporary trade) as a means of reducing economic impacts but delivering environmental outcomes.

• The Basin Plan current recovery target for the northern basin is 390 gigalitres (GL) of water. This target is made up of 247 GL within local catchments and 143 GL to be found from across the northern basin, called shared reductions.

• Based on research and feedback from communities, the MDBA is proposing the water recovery target be reduced from 390 GLs to 320 GLs, provided there are commitments from Australia, Queensland and New South Wales governments to implement a range of measures aimed at improving water management in the north.

• This reduction minimises socio-economic impacts in northern basin communities and delivers almost equivalent environmental outcomes by taking a more targeted approach to water recovery.

• The socio-economic research shows how communities have already been affected by water recovery in the north. The proposed change should reduce further impacts in many northern basin communities but some communities will feel further effects, especially in the Lower–Balonne. The MDBA recommends governments consider priority assistance for communities to help them adjust to the proposed changes, especially Dirranbandi and Warren.

• The MDBA further recommends governments and communities find ways to improve access to waterways for Aboriginal people and improve engagement in water planning and management.

• The proposed amendments to the Basin Plan are open for public comment from 22 November 2016 to 10 February 2017. Members of the public are encouraged to learn about the proposal and make a submission.

Proposed changes to the Basin PlanThe MDBA proposes changing the total water recovery in the northern basin from 390 GL to 320 GL on the basis governments commit to implementing certain measures aimed at improving water management. This means more water will be available for industries and communities.

It is also proposed to change the way water is recovered by reducing the shared reduction amount and increasing local reduction targets in some areas. For some catchments this will see water recovery targets increase, while others will remain the same.

Why the shared reduction target has changedThe northern basin is a connected system, with some catchments more connected than others. Local recovery in any catchment can provide benefits for the catchments below it, and the overall health of the system. The shared reduction is the volume required in addition to the local reduction in each catchment to meet environmental outcomes at the bottom of the system in the Barwon–Darling.

The new environmental science and hydrological modelling shows Barwon–Darling environmental outcomes are best achieved by recovering water within the catchment itself, which is why the Authority has proposed to increase the local recovery target in the Barwon–Darling to 32 GL. This volume recognises both recovery-to-date, and the negative social and economic effects of a larger water recovery amount.

Well-connected tributaries also contribute to flows in the Barwon–Darling, specifically the contributions of the Macquarie and the Border Rivers to baseflows, and in wet years the contributions of the Condamine–Balonne and the Namoi to peak flows.

To further improve environmental outcomes in the Barwon–Darling, targeted recovery combined with management and protection of environmental flows, would make the most of recovered water.

On this basis, the Authority is proposing that the shared reduction be reduced from 143 GLs to 41 GLs.

For the environmental science aspects of the review we looked in more detail at three areas, the Lower-Balonne, Narran Lakes and the Barwon–Darling.

These areas were selected because of their high ecological value and they act to represent the needs of the broader area. A key assumption is — if the needs of these downstream areas are met, there will be benefits for upstream regions as water flows through the system.

Any decisions to sell water that has been over-recovered will be a decision for the Commonwealth

Environmental Water Office and the relevant basin state governments, if the proposed amendments are adopted.

Implications for the southern basin Northern Basin Review modelling shows that, as a long-term average, around 45% of water recovered from the northern basin reaches Menindee Lakes. However, this value is dependent on both the location and type of water entitlement recovered and the pattern in which it is used.

Compared to the existing water recovery target of 390 GLs, the proposed 320 GLs option represents a more efficient pattern of water recovery and use. A more targeted recovery strategy includes recovery of water from tributaries with connections that allow for different flows to be restored in the Barwon–Darling system.

The reduction in the water recovery of 70 GLs results in 7 GLs less flows reaching Menindee Lakes. This translates to a 4 GLs reduction in flows to South Australia, and a 3 GLs reduction in barrage flow, compared to the benchmark. The Authority did not consider this reduction to have a material impact on achieving Basin Plan outcomes.

Further, the SDL adjustment mechanism is operating in the southern-connected basin to determine whether there will be a change to the recovery volume in the south. The outcomes of the Northern Basin Review will not alter the way the mechanism operates, but will be used to establish a new modelling benchmark from which adjustments are calculated.

The MDBA’s decision-making process The Water Act 2007 and the Basin Plan require the basin’s water resources to be managed in a way that considers outcomes for all water users. In forming the proposed amendment the MDBA was tasked with making what is referred to as a triple-bottom line decision, considering the needs of industries, communities and the environment.

A three-year research program was undertaken to better understand these needs. A considerable volume of new information was developed that added to the existing stock of knowledge. Over this time the MDBA closely reviewed the extensive results across the economic, social and environmental areas.

Assessing this research and coming to a recommendation are the six member Authority, who draw on a breadth of expertise and experience in water, economics, the environment, natural resource management and agriculture. These members have weighed up the research, feedback from communities, industries and key representative groups as well as the implications for the economic, social and environmental outcomes (see Triple Bottom Line report).

Communities (Social)The MDBA has listened to people and has a good understanding of how communities respond to water recovery. The research covered how 21 northern basin communities respond to water recovery and its effects.

The MDBA has used what we’ve heard, together with our detailed analysis of economies and the environment to understand what supports communities. We held almost 30 community meetings across 2016 to share our research, ground truth our findings and to gain a holistic approach to concerns in the north.

The MDBA also identified a number of measures that could address some of the serious concerns of Aboriginal people and their connection to country and rivers. The measures have emerged through our discussions and work with the Northern Basin Aboriginal Nations and consist of a number of initiatives, including increased access to waterways and improving engagement of Aboriginal people in water planning.

Industries (Economy)This recommendation offers better social and economic outcomes for irrigation communities compared with the current Basin Plan settings. For many irrigation communities no further water needs to be recovered. Communities told us that other things would help the health of the river as well as recovering water. The use of other measures, together with water recovery, will keep further impacts to a minimum.

The recommendation means different things for different communities. Ultimately, the reduction in water recovery needed means that in most of the studied 21 northern basin communities the economic effects are relatively small. In many cases, the effects are much smaller than those caused by other contributing factors. However, we recognise that any job losses in regional Australia has an impact on its communities.

EnvironmentEven under the current Basin Plan settings we can’t return the northern basin rivers to full health.

We can’t do quite as much with less water. Under 320 GL recovery, the environmental outcomes are slightly reduced compared to the current target in the Basin Plan.

We all need to be smarter with how we manage water. This is why our recommended approach includes other measures in addition to water recovery to help achieve river health with less water.

What we have learnt through this process is that different river flows at different times can achieve better results for the environment. It’s about maximising these flows.

The information we have will guide future water recovery strategy, both in terms of what we recover, where and how.

The Water Act 2007 requires that any changes the MDBA proposes to the Basin Plan requires a minimum eight week public consultation. The MDBA invites submissions from interested parties to provide feedback or to support the proposed changes to the Basin Plan.

13.6 Rates Relief – Extreme Storm Response regional action OFFICER: Acting CEO REF:

REPORT:

Subject Detail: Many primary producers were affected by the recent severe storm event on 11 November 2016

with many of them being in the Berri Barmera Council district. PIRSA have completed an assessment report and have submitted the data to the State Government to consider what assistance may be offered to the region. The intention is to make application to the Commonwealth Government for assistance as a Category C natural disaster event.

Representatives of PIRSA have advised the data contained within the report is not for publication, however have advised the financial losses experienced by local growers is in the $millions with the impact of financial losses not necessarily being felt immediately but for many more months to come. Mapping of the storm scar indicates many of the affected properties fall within our Council district, particularly Barmera, Monash, Glossop and some areas of Berri.

Discussion was held at the Riverland Local Government Forum on 7 December 2016 with the 3 Riverland Councils agreeing that a unified process of rate support being offered to growers affected by the storm would be responsive.

To ensure the administrative aspects of applying rate relief are consistent across all 3 Councils the suggestion put forward that each Council offer its ratepayers the option to apply to Council to defer payment of rates (i.e. enter into a payment agreement plan) and to exclude those ratepayers from incurring any late payment penalties. In addition, to ensure only eligible ratepayers apply for this relief they will be directed to seek the assistance from the Rural Financial Counselling Service associated with the storm recovery hotline who can verify to Council their eligibility.

RECOMMENDATION: That Council offer eligible primary production ratepayers who have been affected by the

severe storm event of 11 November 2016 rate relief by making application to Council.

14.2 Australia Day Citizen Awards OFFICER: MCD REF: Australia Day

REPORT: The following recipients were proposed as Australia Day 2017 Award winners at the selection

committee meeting, members consisting of Mayor Hunt, Cr Centofanti, Cr Fuller, Cr Lynch and Cr Scott held on Monday 28th November. Citizen of the Year Joy Mules of Barmera is an active member of the local community and a passionate fund raiser. Joy has participated in raising funds for various charities including Royal Flying Doctors, Riverland Cancer Council and Woodville Spastic Centre where she raised over $100,000. Through her sporting connection, having been a member of the Barmera Tennis Club since 1958, Joy has been awarded Life Membership. With a love of music, Joy has entertained residents in her local church, at sing-a-longs at Hawdon House and has also a member of the Riverland Musical Society. Young Citizen Award Kelsey Wade is a proactive Glossop High School student who is heavily involved in environmental, leadership and sporting activities of her school. As a prefect, member of River Murray Youth Council and Formal committee member Kelsey has undertaken her duties with passion and community focus. Her achievements include Service Award, Environmental Achievement Award, Academic Excellence Award, Subject Excellence Award, Lake Bonney Masonic Lodge 106 Scholarship. Participating in the 40hour famine for the past 4 years and coordinator of Step UP! for Down Syndrome, a cause close to her heart. Event of the Year Bruno Bay Spectacular has been organised over the past 10 years, consistently achieving attendances of above 1500 people. The event brings the community together, by being family friendly and encouraging broader community involvement. The event consists of local musicians, fireworks, amusement rides, side show alley local businesses stalls (Pete’s Pizza, Mario coffee van, Ice cream, popcorn, henna), and committee food and drink fundraising stalls. The funds raised over the year have gone a long way; making donations to Make A Wish Foundation, Cobdogla Football Club, Cobdogla Tennis Club and the Cobdogla Steam Friends. They have also erected shade over the playground at the Cobdogla oval and shade sails at the Bruno Bay Boat ramp. The volunteers also beautify the boat ramp, by having working bees to keep it tidy and clean. Building a Better Community Award This year’s recommendation for building a better community award is Step UP! for Down Syndrome Riverland. Step UP! for Down Syndrome Riverland was launched in May 2016 and was set up by local residents to bring awareness to and improve the lives of people living with Down Syndrome.

The volunteers involved in this program have co-ordinated events, “hit the pavement” and set up a fundraising page to raise funds to support local Riverland families with Down Syndrome children. Since its inception, a strong number of local businesses, organisation and media outlets have assisted in providing support to this project.

14.3 Request to support 2017 SA Bowls Senior Event OFFICER: MCD – A Haigh REF: Major Event Support

REPORT:

The Berri Bowling Club, with the assistance of the Berri Barmera Council, now has an extremely high quality bowling facility that will provide expanded opportunities to deliver and secure high quality events. Our Council has been approached by Bowls SA to secure one of their premier Senior Supa Series events to showcase both the Berri and Barmera facilities. Details of the event and the anticipated return to our community are contained in the attached proposal. The five day event is likely to draw 400-700 participants and visitors which will have an anticipated economic return to our community that will similar to that achieved by the Tennis Futures event conducted by the Berri View Lawn Tennis Club. Bowls SA suggests that based on Tourism Research Australia’s figures, the average sports tourist spends $249 per day, which when considered for an event of 400 competitors over 5 days, with an accompanying partner rate of 0.8:1 (provided by Bowls SA), the return to our district could be expected to be close to $900,000. The event is large enough that it will require being conducted across both the Barmera and Berri Bowling Facilities and potentially developing into Monash in the future. Although the overall proposal targets Council as the principle host, it is suggested that a partnership consortium, similar to that created to support the Tennis Futures event be secured. This may include the clubs, War Memorial Community Centre and accommodation sponsors. This will ensure that the Bowls SA host fees are achieved and provide broader community ownership of the event for a period on 3 years. The securing of high quality events, to showcase Councils investment into community facilities is a targeted objective within Councils Events Strategy and Corporate Plan. Council’s current budget provision for similar events come for its “Support for Major Events” allocation. Although this request would be included for allocated in the 2017/2018 budget, it is worth noting that at this stage the current commitments associated with this budget line still remain under the amount allocated for years budget.

RECOMMENDATION: That Council provides $2500, over the next 3 financial years, towards the hosting fee for securing the Bowls SA 2017 Supa Seniors event in the Berri Barmera District.

Please find below the salient points relating to the Bowls SA, Senior Supa Series Event, plus one day of Practice and Volunteer recognition day, which will be carried out at the Berri Bowling Club and Barmera Bowling Club, in May, 2017 and on dates to be confirmed in 2018 and 2019. It is anticipated that in excess of 400 competitors and officials; and their accompanying partners will attend the Senior Supa Series event from throughout South Australia and potentially other states. It is also expected there will be over 100 people attend the Volunteer day during the event. Bowls SA commitments:

BOWLS SA will use all reasonable endeavors to have participants and accompanying partners book accommodation through the Visitor Information Center (VIC) through means including, but not limited to; encouraging them to use a link to the VIC site which is to be set up on Bowls SA’s website, emailing competitors of the need to book all accommodation through VIC, educating competitors and their accompanying partners of the fact that the VIC can place them in the most appropriate accommodation which suits their needs; and any other reasonable means.

Facilitate a mass hand out of any promotional material that Council is interested in distributing to competitors at the event. This information may promote restaurants, tourist locations, shopping centre promotions etc.

Provide Council with logo recognition on all official event documentation and on any local media alerts.

Conduct a joint media release between Council, BOWLS SA and the host club(s) announcing the event is coming to the Riverland Region.

Provide Council with a brief post event acquittal highlighting total number of competitors, where competitors came from, and provide feedback on how long each stayed in the region.

Invite the Mayor and/or other Councilors to compete in the event as a special guest (2 spots) and be part of the official welcome and/or presentation of trophies.

In the spirit of the agreement, other reasonable requests will be considered. Council’s commitment:

• Provide a “hosting fee” of $10,000 plus GST for the Riverland

Seniors Supa Series event for 2017, 2018 and 2019. • In the spirit of the agreement, other reasonable requests will be

About Bowls SA

Bowls SA is the State Sporting Organisation for lawn bowls in South Australia. The governance of Bowls SA is well structured to facilitate the needs of our partners and Member Clubs. This governance structure enables Bowls SA to operate as a single entity through, and by which, bowls can be conducted, promoted and administered. Bowls SA is affiliated with World Bowls and Bowls Australia and consists of eight country regions and four metropolitan regions. Within the country region are 170 member clubs while the metropolitan clubs consist of 50 member clubs.

Bowls SA has a history of hosting World, National and State accredited events that support communities both financially and socially through areas such as tourism and participation. Bowls SA offers our partners the opportunity to interact with the bowling community through event and/or programme sponsorship. This allows representatives to interact face to face with bowls participants and offers the opportunity to increase exposure of products and services.

Our events provide the opportunity for promotional material and signage to be displayed and distributed to event participants and spectators at the host venue(s). Additional benefits also include the ability to interact with all attendees at the event notwithstanding the opportunity to present award winners.

Bowls is a versatile sport played by people of all ages, with a range of competitions available from social bowls all the way through to the elite level of the sport. Bowls SA has developed and trademarked a social program known as Night Owls, which is proudly South Australian and is all about enjoying the game in a relaxed and fun environment with friends. Many clubs throughout South Australia offer Night Owls over Summer and the warmer months. Whether entering as a team of four or joining with other players at the Club – it’s a fun way to enjoy the sport with theme nights, drink specials, BBQ's and more. Brand and Marketing

Brand consistency plays a critical role in establishing the presence of lawn bowls in South Australia, both on and offline. To provide consumers with a clear depiction of the brand, Bowls SA delivers cohesive content that is useful for all stakeholders involved and our aim is to stay relevant and bring fresh new stories and ideas.

Bowls SA commits to regularly bringing stories and up to date news to the bowling community. This includes pre, during and post thought about content that can be included in Bowls SA communications.

Bowls SA provides members and supporters of lawn bowls to receive timely and accurate information about the sport from grass roots (community) to elite through print, digital and social mediums providing our partners with greater and more regular opportunities to reinforce and promote their brand.

Bowls SA runs a Supa Series flagship event for Seniors (over the age of 60) that attracts participants and visitors from both intrastate and interstate. The competition provides a pathway for athletes to represent South Australia on the National stage. Seniors events are well supported by the Bowls community and are designed to tap into the demographic that is eager and in a position to travel and play, with social interaction as a major attraction to this tournament. Bowls SA prides itself on recognising valued volunteers and as a component of conducting this event in partnership with local council endeavours to acknowledge contributions made to the bowling community.

The Seniors Supa Series is well advertised and promoted through several types of media outlets including local and regional papers, as well as in all Bowls SA mediums such as The Bowler e-Magazine, website, Facebook and Twitter.

Subject Detail: Capital Projects

- The replacement of the pine posts with bollards (as per Pioneer Park) within and around Glassey Park is being continued by Contractor. - New Road sealing on Telfer, Coates and Curren Roads and Pommy Avenue are being undertaken by Contractors commencing 7 December. - Contractors have been engaged for Kerbing renewals and Lakefront path paving with work to commence in the new year. - Battams Road / Old Sturt Highway intersection upgrade has been linemarked. This now completes this project. General Projects - Ongoing weed spraying throughout the district when weather permits. - Stormwater drainage diversion on Old Sturt Highway near Plants Plus and adjoining residents is currently being undertaken - Clean up from the recent storm on 11.11.16 has been a high priority for all staff which has meant some jobs have been put on hold. Rural areas have not been started yet which have a lot of fallen trees. - Stormwater drain cleaner and camera will be here next week to look at problem areas. - Some minor stormwater mitigation works have been undertaken. - Number 2 oval mainline relocation and automation has been completed. - Due to the high river BBQ,s at martins bend , Berri Boat Ramp and Bruno Bay have been removed. Berri Boat Ramp pump has also been removed and serviced due to the high river. Community Events Once again it’s that time of the year when staff are extra busy organising road closures, bins and cleaning up after events. Some of these are: Remembrance Day – Barmera, Special School Prom, Berri Merri Xmas, Glossop High School Prom, Barmera Pageant, Murray Man Triathlon and Berri Rowing Club Regatta.
