AFFIDAVITI, Danica D. Duran, 25 years old, single, a resident of Brgy. Junob, Dumaguete City, Negros Oriental, after having been duly sworn to in accordance with law, do hereby depose and say:1. That I am the witness of the case of Murder against one Jess Potejos; 2. That on 29 March 2015, as I was walking to the sari-sari store just a block away from my house to buy coffee; 3. That I saw two persons on the other block;4. That I recognized the other person as Stephen Legaspi, my schoolmate and neigbor;5. That I recognized the other person as Jess Pontejos, my other neighbour;6. That after a while, I heard a gunshot and saw Stephen fell on the ground, and Jess ran away;7. That I immediately ran towards Stephen and saw that he was shot on his chest;8. That I immediately shout for help;9. That the sister of Stephen and some other Baranggay tanods came to see what happened;10.
