Matthew Massman, the Commissioner of the Minnesota Department of Administra-tion, recently issued an advisory opinion about a draft investigation report, finding that the draft was public data. The circum-stances are important.
A complaint was made about a city employee. The employer completed an investigation of the complaint and drafted an investigation report. Before the draft could be finalized, the employee resigned. No dis-cipline was pending or proposed at the time of the resignation.
The media requested “data related to the complaint against” the employee. The employee, through her attorney, objected to release of the draft investigation report. The city sought an opinion from the commis-
sioner about what data to release in response to the media’s request.
Massman found the draft investigation report was government data on an individual that met the definition of personnel data. The commissioner applied M.S. 13.43, Subd. 2(e) and (f), and found that the complaint against the employee was still pending against her when she resigned despite a com-pleted investigation. Accordingly, the “data relating to [the] ... complaint” were public, including the investigation draft report.
