The petition was, however, dismissed by the Hon'ble High Court at Srinagar vide its judgement dated 12-04-2017; and Whereas, two more candidates namely Dr. Shahnawaz Hassan and Dr. Shabana Balqees filed OWP No. 420/2017 and OWP No. 421/2017 respectively at Jammu, who challenged their being declared ineligible under SRO 8 of 2005 and the Hon'ble High Court has directed to keep seats reserved for the petitioners, which shall not confer any right etc/reserved till disposal of the petition respectively; and Whereas, the writ petition titled Dr. Shahnawaz Ahmad Choudhary & Ors Vs State & Ors at Jammu was disposed off by the Hon'ble High Court vide its judgement dated 26-04-2017, which allowed the petition filed by the petitioners to the extent as provided in the said order; and Whereas, judgement of the Single Bench in the said case was assailed by the BOPEE before the Hon'ble Division Bench vide LPA No. 85/2017 and the Hon'ble Division Bench of the High Court at Jammu was pleased to stay the operation and effect of the impugned judgement dated 26- 04-2017 vide its order dated 03-05-2017; and Whereas, some other petitions titled Dr. Mushtaq Ahmad Dar & Ors Vs State of J&K. & Ors (OWP No. 449/2017), Dr. Ayjaz Ahmad Bhat & Ors Vs State & Ors (SWP No. 644/2017) and SWP No. 678/2017 were filed by the candidates claiming benefit under rural service in terms of rule 15(f ) of SRO 294, which are also pending before the Hon'ble High Court; and Whereas, the BOPEE has filed the response/reply in all the petitions in a time bound manner; and Whereas, the Board while reviewing the schedule of admissions observed that it has notified the counselling schedule as per MCI schedule vide its Public Notice No. 01/BOPEE of 2017 dated 25-02-2017, which schedule has the stamp and seal of the Hon'ble Supreme Court of India in the case titled Ashish Ranjan & Ors Vs Union of India & Ors. vide its order dated 18-01- 2016. The admission schedule cannot be extended beyond 31st May of the year, under any circumstances, as approved by the Hon'ble Supreme Court; and Whereas, although the Board has completed in house assignments in a time frame for declaration of the result, yet, in view of the litigations, the Board has not been able to notify the first list and is short by 24 days with just 23 days available during which the Board has to complete different rounds of counselling for completion of the process including first round of allotment, upgradation round and physical round for which the candidates have to be given reasonable time to complete the formalities and if the list is not notified all the seats in the medical colleges/institutions may remain unfilled for 2017, causing immense loss to the colleges/institutions and the health care at large; and Whereas, in order to comply with the admission schedule of MCI, which has seal and stamp of the Hon'ble Supreme Court in the case titled Ashish Ranjan & Ors Vs Union of India & Ors for completion of the admission process by 31st May, 2017 and in light of the stay granted by the Hon'ble Division Bench in the case titled Dr. Shahnawaz Ahmad Choudhary & Ors Vs State & Ors, in LPA No. 85/2017 filed by the Board and to ensure that 448 seats in the medical colleges do not remain vacant, and patient care and the medical colleges do not suffer, as a consequence thereof, it has been decided to release the selection list of the candidates for admission to MD/MS/PG Diploma Courses, 2017, which shall be subject to the outcome of the writ petitions pending before the Hon'ble High Court or any other direction as may be given by the Hon'ble High Court in this regard from time to time. It has also been decided to squeeze the counselling schedule with a view to ensuring that the process is completed within the time frame and all rounds of counselling are completed so that no seat remains unfilled in the medical colleges/institutions; Now, therefore, after considering the preferences of the candidates for various seats/colleges and on the basis of the merit/ rank of the candidates as notified vide Notification No. 037-BOPEE of 2017 dated 08-05-2017 read with reservation rules and other orders on the subject, and subject to the outcome of the writ petitions pending before the Hon'ble Courts, the Board has provisionally selected the candidates for admission to the MD/MS/PG Diploma Courses, list whereof is annexed as Annexure "A" in respect of MD/MS/PG Diploma candidates. The admission list is purely provisional and in case of any information submitted by the candidates is proved to be false at any stage, the admission shall be liable to be cancelled along with the penalty as may be imposed by the Board in terms of SRO 158 (rule 12), which reads as under:- "If at any stage it is detected by the Competent Authority or the Principal of the Medical College concerned that any candidate has secured admission to a Post graduate Degree or Diploma Course by fraud, concealment of facts or mis-statement, the admission of the candidate shall stand cancelled and such a candidate shall also stand debarred from seeking admission to any Post graduate Degree and Diploma Course in future and shall also be liable to criminal proceedings." The candidates selected for admission for the courses/colleges shall report to the colleges/institutions selected and produce the other documents as may be required by the Colleges/Institutions along with the following:- i) Matriculation Certificate ii) MBBS Degree certificate iii) Internship completion certificate (before 31 st March, 2017) iv) MBBS Marks cards v) NEET Result card (wherever applicable) vi) State Subject Certificate vii) MCI/State Medical Registration Certificate(should be in possession have obtained within one month from the date of admission, failing which the admission of the candidate shall be cancelled). viii) Category certificate (wherever applicable) ix) Candidates passed MBBS Degree outside country to enclose MCI clearance/recognition certificate. x) NOC for seeking admission in PG/PG Diploma Courses from the competent authority in case of in-service candidates. xi) Proof of Identity by way of Adhaar Card, Driving License, Passport or any other verification document of identity as may be accepted by the Institute. The candidates shall also submit an affidavit to the colleges/institutions as per Annexure "B" to this Notification broadly with effect to the following:- 1. The information furnished by the candidate is correct and nothing has been concealed; 2. In case any information proved to be wrong/false, the candidate shall be personally responsible for the consequences including the cancellation of his/her admission and the penalty as may be imposed upon him/her by the Board/ Institution concerned in terms of SRO 158 of 1995 read with SRO 168 of 2014; 3. The candidate is not pursuing any MD/MS/PG Diploma & MDS Course in any institution of the State and if pursuing outside, has obtained NOC from the concerned University/Institution. 4. The candidate has not taken admission in the medical colleges/institutions in the State during 2016 and has not resigned/left the course midway. 5. The candidate has completed rotatory internship by or before 31-03-2017 and in case the same has not been completed by the said date, the candidate shall not be eligible for admission. 6. The candidate has not taken admission in any institute of the country for PG Course during admission 2017. The candidates shall:- i) Report to the colleges/institutions, immediately and within a period of four days from the issuance of Notification, so that the requisite formalities are completed by such candidates i.e. latest by 12th May, 2017; ii) Have to join the college/institution compulsorily and any candidate not joining the college/course against the seat so allotted shall not be eligible for subsequent rounds of admission against the unfilled vacancies those may become available due to non-joining etc in accordance with the conditions contained in the Information Brochure. Further, such candidates who stake a claim for betterment of the seat shall also have to join the Institute/course first and then stake a claim for upgradation in terms of Notice No.008/BOPEE of 2017 dated 08-03-2017, which shall be considered in accordance with merit-cum-preferences of the candidates and the conditions contained in the said notifications/notices; iii.) Submit a Status Retention Form as per proforma "G" given in the Information Brochure and in accordance with the conditions contained therein. The last date of submission of the Status Retention Form shall be 13-05-2017 by the college/institute and a copy retained by the candidate in terms of conditions of Information Brochure; iv). Be eligible to stake a claim for betterment of the seat against the left over/unfilled seats in accordance with the conditions notified in the Information Brochure read with notice dated 08-03-2017. The date of staking claim shall be w.e.f. 14th to 16th May, 2017. The upgradation round shall be completed between 18-20th May, 2017; v) As per the details in Information Brochure be eligible for final round of physical counselling against the unfilled/left over seats between 22nd-27th May, 2017 in accordance with the terms and conditions contained in Information Brochure; vi) Have to pass a biometric test by or before 31st May, 2017 or on any other date fixed by the Board, in the Board Offices at Srinagar/Jammu to ascertain that only the genuine candidates who had appeared in the NEET examination are granted admission and there is no proxy candidate seeking admission. For this purpose the NBE shall be providing kiosk for authentication of the candidates. The colleges/institutes shall:- i) Keep the admission counters open for the candidates even during off days/holidays; ii) Ensure that the candidates allotted the college/institute have completed the internship by or before 31-03-2017, and obtain necessary proof from the candidate(s) in this regard. Under no circumstances shall a candidate be allowed admission if he/she has completed internship after 31-03-2017 or fails to produce a proof in this regard; iii) Submit the details of the candidates who have not joined/vacant seats latest by 13th May, 2017 to enable the Board to fill vacant seats by way of upgradation followed by physical round of counselling, if required for the left over seats. The upgradation round shall take place between 18th to 20th May, 2017 and the physical round from 22nd May to 27th May, 2017. The institution shall keep the Board informed of the number of candidates joining on day-to-day basis. The selection of candidates for the above admissions shall, apart from the conditions contained hereinabove be regulated by such conditions not mentioned hereinabove but notified from time to time by the Board through notices/notifications, Information Brochure etc and shall form part of this Notification and those contained in terms of MCI Regulations/State rules as notified from time to time. The list has been drawn on the basis of updated merit list notified vide Notification No. 037-BOPEE of 2017 dated 08-05-2017. 25-02-2017 read with other Notifications issued from time to time on the subject and Notification No. 037-BOPEE of 2017 dated 08-05-2017.

Notification No. 038-BOPEE of 2017 Dated 08-05-2017Whereas, consequent upon conduct of NEET PG Examination, 2017 and declaration of result thereof by the National Board of Examinations on 13-01-2017, in respect of MD/MS/PG Diploma Courses, the BOPEE had initiated the process of admission of the eligible candidates by way of verification of documents etc issuance of Provisional State Merit List, determination of eligibility through various Notifications/Public Notices issued from time to time and issuance of final merit list vide Notification No. 037-BOPEE of 2017 dated 08-05-2017; andWhereas, the candidates were given an opportunity to fill up the Online Preference Forms w.e.f. 14-03-2017 to 20-03-2017, which process was also duly extended along with additional time given to the candidates on different occasions as a consequence of increase in the number of seats in the medical colleges/institutions during the admission year 2017; andWhereas, some writ petitions have been filed, inter alia, by some candidates titled Dr. Shahnawaz Ahmad Choudhary & Ors. Vs State (OWP No. 577/2017), Dr. Mohammad Obeid Haqaq & Ors Vs State and Ors (SWP No. 458/2017), Dr. Gulshan Younis & Ors Vs Union of India & Ors (SWP No. 265/2017), Dr. Mohammad Adil Sangeen Vs Union of India (WP No. 296/2017) and Dr. Zia-Ul- Islam & Ors Vs State & Ors (WP No. 272/2017), wherein they had claimed benefit for having worked in difficult areas in terms of regulation 9(IV) of MCI regulations and 10% be granted under rule 15(f ) of SRO 294 of 2005 for serving in rural areas; andWhereas, Dr. Mujtaba Waris & Ors through OWP No. 302/2017 read with OWP No. 367/2017 before the Hon'ble High Court at Srinagar, had challenged the Notification of the BOPEE declaring them ineligible for pursuing Post Graduation/having left the Course midway under SRO 8 of 2005 read with conditions contained in Information Brochure. The petition was, however, dismissed by the Hon'ble High Court at Srinagar vide its judgement dated 12-04-2017; andWhereas, two more candidates namely Dr. Shahnawaz Hassan and Dr. Shabana Balqees filed OWP No. 420/2017 and OWP No. 421/2017 respectively at Jammu, who challenged their being declared ineligible under SRO 8 of 2005 and the Hon'ble High Court has directed to keep seats reserved for the petitioners, which shall not confer any right etc/reserved till disposal of the petition respectively; andWhereas, the writ petition titled Dr. Shahnawaz Ahmad Choudhary & Ors Vs State & Ors at Jammu was disposed off by the Hon'ble High Court vide its judgement dated 26-04-2017, which allowed the petition filed by the petitioners to the extent as provided in the said order; andWhereas, judgement of the Single Bench in the said case was assailed by the BOPEE before the Hon'ble Division Bench vide LPA No. 85/2017 and the Hon'ble Division Bench of the High Court at Jammu was pleased to stay the operation and effect of the impugned judgement dated 26- 04-2017 vide its order dated 03-05-2017; andWhereas, some other petitions titled Dr. Mushtaq Ahmad Dar & Ors Vs State of J&K. & Ors (OWP No. 449/2017), Dr. Ayjaz Ahmad Bhat & Ors Vs State & Ors (SWP No. 644/2017) and SWP No. 678/2017 were filed by the candidates claiming benefit under rural service in terms of rule 15(f ) of SRO 294, which are also pending before the Hon'ble High Court; andWhereas, the BOPEE has filed the response/reply in all the petitions in a time bound manner; andWhereas, the Board while reviewing the schedule of admissions observed that it has notified the counselling schedule as per MCI schedule vide its Public Notice No. 01/BOPEE of 2017 dated 25-02-2017, which schedule has the stamp and seal of the Hon'ble Supreme Court of India in the case titled Ashish Ranjan & Ors Vs Union of India & Ors. vide its order dated 18-01-2016. The admission schedule cannot be extended beyond 31st May of the year, under any circumstances, as approved by the Hon'ble Supreme Court; andWhereas, although the Board has completed in house assignments in a time frame for declaration of the result, yet, in view of the litigations, the Board has not been able to notify the first list and is short by 24 days with just 23 days available during which the Board has to complete different rounds of counselling for completion of the process including first round of allotment, upgradation round and physical round for which the candidates have to be given reasonable time to complete the formalities and if the list is not notified all the seats in the medical colleges/institutions may remain unfilled for 2017, causing immense loss to the colleges/institutions and the health care at large; andWhereas, in order to comply with the admission schedule of MCI, which has seal and stamp of the Hon'ble Supreme Court in the case titled Ashish Ranjan & Ors Vs Union of India & Ors for completion of the admission process by 31st May, 2017 and in light of the stay granted by the Hon'ble Division Bench in the case titled Dr. Shahnawaz Ahmad Choudhary & Ors Vs State & Ors, in LPA No. 85/2017 filed by the Board and to ensure that 448 seats in the medical colleges do not remain vacant, and patient care and the medical colleges do not suffer, as a consequence thereof, it has been decided to release the selection list of the candidates for admission to MD/MS/PG Diploma Courses, 2017, which shall be subject to the outcome of the writ petitions pending before the Hon'ble High Court or any other direction as may be given by the Hon'ble High Court in this regard from time to time. It has also been decided to squeeze the counselling schedule with a view to ensuring that the process is completed within the time frame and all rounds of counselling are completed so that no seat remains unfilled in the medical colleges/institutions;Now, therefore, after considering the preferences of the candidates for various seats/colleges and on the basis of the merit/rank of the candidates as notified vide Notification No. 037-BOPEE of 2017 dated 08-05-2017 read with reservation rules and other orders on the subject, and subject to the outcome of the writ petitions pending before the Hon'ble Courts, the Board has provisionally selected the candidates for admission to the MD/MS/PG Diploma Courses, list whereof is annexed as Annexure "A" in respect of MD/MS/PG Diploma candidates. The admission list is purely provisional and in case of any information submitted by the candidates is proved to be false at any stage, the admission shall be liable to be cancelled along with the penalty as may be imposed by the Board in terms of SRO 158 (rule 12), which reads as under:-

"If at any stage it is detected by the Competent Authority or the Principal of the Medical College concerned that any candidate has secured admission to a Post graduate Degree or Diploma Course by fraud, concealment of facts or mis-statement, the admission of the candidate shall stand cancelled and such a candidate shall also stand debarred from seeking admission to any Post graduate Degree and Diploma Course in future and shall also be liable to criminal proceedings."

The candidates selected for admission for the courses/colleges shall report to the colleges/institutions selected and produce the other documents as may be required by the Colleges/Institutions along with the following:-i) Matriculation Certificateii) MBBS Degree certificateiii) Internship completion certificate (before 31st March, 2017)iv) MBBS Marks cardsv) NEET Result card (wherever applicable)vi) State Subject Certificatevii) MCI/State Medical Registration Certificate(should be in possession have obtained within one month from

the date of admission, failing which the admission of the candidate shall be cancelled).viii) Category certificate (wherever applicable)ix) Candidates passed MBBS Degree outside country to enclose MCI clearance/recognition certificate.x) NOC for seeking admission in PG/PG Diploma Courses from the competent authority in case of in-service

candidates.xi) Proof of Identity by way of Adhaar Card, Driving License, Passport or any other verification document of

identity as may be accepted by the Institute.The candidates shall also submit an affidavit to the colleges/institutions as per Annexure "B" to this Notification broadly with effect to the following:-1. The information furnished by the candidate is correct and nothing has been concealed;2. In case any information proved to be wrong/false, the candidate shall be personally responsible for the consequences

including the cancellation of his/her admission and the penalty as may be imposed upon him/her by the Board/Institution concerned in terms of SRO 158 of 1995 read with SRO 168 of 2014;

3. The candidate is not pursuing any MD/MS/PG Diploma & MDS Course in any institution of the State and if pursuing outside, has obtained NOC from the concerned University/Institution.

4. The candidate has not taken admission in the medical colleges/institutions in the State during 2016 and has not resigned/left the course midway.

5. The candidate has completed rotatory internship by or before 31-03-2017 and in case the same has not been completed by the said date, the candidate shall not be eligible for admission.

6. The candidate has not taken admission in any institute of the country for PG Course during admission 2017.The candidates shall:-i) Report to the colleges/institutions, immediately and within a period of four days from the issuance of Notification,

so that the requisite formalities are completed by such candidates i.e. latest by 12th May, 2017;ii) Have to join the college/institution compulsorily and any candidate not joining the college/course against the

seat so allotted shall not be eligible for subsequent rounds of admission against the unfilled vacancies those may become available due to non-joining etc in accordance with the conditions contained in the Information Brochure. Further, such candidates who stake a claim for betterment of the seat shall also have to join the Institute/course first and then stake a claim for upgradation in terms of Notice No.008/BOPEE of 2017 dated 08-03-2017, which shall be considered in accordance with merit-cum-preferences of the candidates and the conditions contained in the said notifications/notices;

iii.) Submit a Status Retention Form as per proforma "G" given in the Information Brochure and in accordance with the conditions contained therein. The last date of submission of the Status Retention Form shall be 13-05-2017 by the college/institute and a copy retained by the candidate in terms of conditions of Information Brochure;

iv). Be eligible to stake a claim for betterment of the seat against the left over/unfilled seats in accordance with the conditions notified in the Information Brochure read with notice dated 08-03-2017. The date of staking claim shall be w.e.f. 14th to 16th May, 2017. The upgradation round shall be completed between 18-20th May, 2017;

v) As per the details in Information Brochure be eligible for final round of physical counselling against the unfilled/left over seats between 22nd-27th May, 2017 in accordance with the terms and conditions contained in Information Brochure;

vi) Have to pass a biometric test by or before 31st May, 2017 or on any other date fixed by the Board, in the Board Offices at Srinagar/Jammu to ascertain that only the genuine candidates who had appeared in the NEET examination are granted admission and there is no proxy candidate seeking admission. For this purpose the NBE shall be providing kiosk for authentication of the candidates.

The colleges/institutes shall:-i) Keep the admission counters open for the candidates even during off days/holidays;ii) Ensure that the candidates allotted the college/institute have completed the internship by or before 31-03-2017,

and obtain necessary proof from the candidate(s) in this regard. Under no circumstances shall a candidate be allowed admission if he/she has completed internship after 31-03-2017 or fails to produce a proof in this regard;

iii) Submit the details of the candidates who have not joined/vacant seats latest by 13th May, 2017 to enable the Board to fill vacant seats by way of upgradation followed by physical round of counselling, if required for the left over seats. The upgradation round shall take place between 18th to 20th May, 2017 and the physical round from 22nd May to 27th May, 2017. The institution shall keep the Board informed of the number of candidates joining on day-to-day basis.

The selection of candidates for the above admissions shall, apart from the conditions contained hereinabove be regulated by such conditions not mentioned hereinabove but notified from time to time by the Board through notices/notifications, Information Brochure etc and shall form part of this Notification and those contained in terms of MCI Regulations/State rules as notified from time to time. The list has been drawn on the basis of updated merit list notified vide Notification No. 037-BOPEE of 2017 dated 08-05-2017.This issues without prejudice and subject to the outcome of the LPA No. 85/2017 titled BOPEE through Commissioner/Secretary to Government, Health & Medical Education Department Vs Dr. Shahnawaz Ahmad Choudhary & Ors. pending before the Hon'ble Division Bench of J&K High Court at Jammu and other cases pending before the Hon'ble High Court and shall be subject to such orders as may be passed by the Hon'ble Courts from time to time, before the completion of the process up to 27th May, 2017 as per MCI schedule, or if extended otherwise by the Competent Authority/Supreme Court of India.Note:- The five seats under Hindu Minority Quota and two seats under NRI Quota in ASCOMS will be filled up separately from amongst the eligible candidates on the basis of merit- cum-preference in accordance with the Public Notice No. 22-BOPEE of 2017 dated 20-04-2017 on the subject for which a date shall be notified separately.
