Pathey Trust’s Activity Report

April 2015 to March, 2016 Back ground: Pathey……. Food for thought on Struggle Journey for Social Justice About Pathey:- Pathey was registered in year 1993 and has pursued the pioneering work of Budget analysis, Goveranace and Advocacy work to further the cause of vulnerable and deprived sections of the society, to ensure Social Justice and Development and to create a debate over the financial allocations for the weaker sections of society and its impact over the development process. Pathey has been analysing the state, district, tehsil and national budget. Pathey analysis is focused upon the issues of Adivasis, Dalits, women, children, people with disability, NT-DNT, workers of unorganized sector, and other backwards classes. Pathey also works for capacity building of elected members and members of civil society organization for budget literacy. Pathey help by providing budgetary information to the members of civil society for strengthening their advocacy work. It organizes the training programmes for the elected representatives at (Panchayat level) to make them aware on financial allocation and spending, so that the village level elected representative can make budget for their villages and also ensure benefits of schemes to their village citizens from various schemes. One of the objectives of Pathey is to be a resource center for elected members, civil society, issue based organizations and networks, journalists, and academicians for providing information on budget, policy analysis, governance related issues for wider discussions and application of resources for change. Vision To ensure social justice and development, and to foster debates over financial allocations of the government for the poor and marginalized communities through, Empowerment, Capacity building, Budget Research and Advocacy process for transparent, accountable governance.

Mission Creating multiple centers for Demystifying state budgets to facilitate understanding of public finance from the perspective of vulnerable section of society like (Adivasis, Dalits, women and children and disadvantageous communities.) and facilitate advocacy process for right based policy by sharing research knowledge, capacity building of people for seeking accountable governance. Strategy Pathey is Budget analysis and Research based advocacy and educational organization engaging at various levels with stake holders like elected representatives, policy makers, civil society groups, voluntary organizations, academicians, communities and media through dissemination, education and capacity building. The interventions are focused around empowerment, social justice, and good governance for the vulnerable section of society. Background: Last year was full with changes be it political at national and state level as well. The state witnessed several social movements for their respective demands for reservation, Justice and assertiveness, which led the change of leadership in the government. The state was pre-occupied with in addressing the people’s aspiration. At organization level, we also face many challenging times, in declining financial support has hampered our overall work. We face financial crunch and could not continue the team members after the October, 2016. We were left with only two persons to continue the Pathey Trust work, even; we had to shift our office at other place. Despite being very lean and thin team, we put hard efforts to continue with our core activities, though at smaller scale and also made efforts to mobilize the resources; in the October, 2016, we submitted the charter of demands to the some departments to address the demands by policy intervention and earmarking higher allocation. During the budget session for 2016-17 in February and March of 2016, we engaged with legislatures and media people over the budget discussion by providing the budget briefs to them, one day before the discussion. instead of writing on all departments, we preferred to write only for social sectors’ department and Irrigation and water supply department. We focused issues like education, Health care, Nutrition, Special Component plans for Tribal and Dalit. Labour, women and children and others (The list is given below).

The following is brief report of activities pursued by Pathey Trust during last year (April, 2015 to March, 2016). 1. Strengthening People’s Capacity for Participation in Budgetary Processes:

The budget analysis is one of the critical tools for civil society organizations and other public-cause advocates as its use is productive and impactful. As a tool it can move through issues relating to different sectors, and it can be a powerful instrument for social activists involved in mobilizing people, therefore building capacity of social activists is very important.

1.1 Capacity building of members of civil society: In order to build capacity of social activists, we organized capacity building workshops with grass root level organizations focused upon issues of schedule tribes, schedule castes, and backward communities. The basic aim of conducting training for capacity building of members of civil society is to orient the members towards budgetary part of the state government for the issues, they have been working, build up their capacity to understand financial numbers and correlate these numbers with policy, and development programmes. The Capacity building and training programmes consist of theoretical aspects of budget making with definitions, codes in expenditures and revenue side of the state, hierarchy of codes (Major Heads to Object Heads), Plan and Non-Plan expenditure, Revenue and Capital expenditure, loans and advances, Charged and Voted expenditure. All terms are correlated with previous and present year’s numbers and data. The expenditures are correlated with prevailing socio-economic conditions of the state. During the last year, Pathey Trust organized four training programmes for members of civil society, activists and development practitioners and other for orientation and understanding the budgetary processes at sub –national (State). The training programmes were held with different social thematic like understating TSP(Tribal Sub Plan), SCSP(Special Component Plan for Schedule Castes) and Budget at Panchayati level.

Pathey also provides tailored made services for conducting the capacity building on budget analysis, advocacy and research on thematic and sectoral for specific purposes with professional capacity. During the last year, we conducted trainings and research study.

1. Pathey was approached by Sanket, Bhopal to conduct the budget analysis refreshing course for their staff for two days in Bhopal. The workshop was attended by SANKET staff and some members of civil society and media based in Bhopal.

2. JANVIKAS’ National Peace Group approached Pathey to conduct a basic orientation course for their Street Theatre Performers and enable them to understand the budget and its impact on citizens, so that the group could prepare script to perform in the street before the general audience to sensitize people on budget and governance issues. The group prepared the script on “Khel Paiso Ka” and performed at various places.

3. Kutch based SETU KMVS approached Pathey to conduct the orientation and capacity building workshop on understanding the Municipality Budget, urban governance and Participatory Budget for the elected members of Rapar Municipality. Pathey Team conducted the workshop in last week of December.

4. Pathey assisted SAATH organisation’s team members based in Surat for SMC (Surat Municipal Corporation’s budget for poor people for accessing the basic amenities.

1.2 Training Programme for Budget Analysis Cadres: Last year Pathey Trust initiated an innovative programme of creating budget analysis cadres. The capacity building programme with eight modules spread over eight months with intense training inputs and practices with assignments for building the pool of trained budget analysts. The training module consist of understating the budget and policy in public fiancé framework at various levels like thematic, sectoral, Panchayat and Urban Local Body level, understating the budget analysis, research and advocacy for policy influence. Total twelve

participants from various civil society organizations were selected for the eight modules budget analysis training, the copy of training module is annexed (I). The selected participants were provided training on concept of development and public finance, politics for development, budget formulation process at National and Sub-national level. De-mystification of Budget; Methods of Budget analysis and linking with ground level implementation of budgetary programmes, Budget Analysis and Advocacy, Budget Tracking and others. The participants also interacted with Legislatures. Each training module was conducted with presentations on technical aspect of budget, lecture by expert resource persons, participatory discussion (as all the trainees were working in organizations for more than five years had understanding of ground realities and issues.) The participants were also given assignments after every module to consolidate their learning and acquire the skills for budget data entry and analysis, correlating with issues and prepare the advocacy material. 1.3 Participatory Budgeting and Planning Process with Local Self-Government Bodies:

The Panchayati Raj Institutions are one of the most important and basic institution of governance in a democratic system, Panchaayati Raj is a system of governance in which gram panchayats are the basic units of administration. The Fourteenth Finance Commission has recommended direct fund flow to the Panchayats, thus empowering Panchayat to preparing their own development plans.

During the last year, Pathey conducted motivational training workshops for the Gram Panchayat’s members and citizens to participate in the decision making process for the development of village infrastructure, which is inclusive and caters the needs of village people in the each Panchayat ward. The vulnerable and marginalized section of village were sensitized towards village development process by focusing on basic amenities in each wards of the Gram Panchayat like drinking water, sanitation facilities, street light, pucca roads in each ward and others. The meeting were held in each Panchayat ward for seeking basic amenities from various development schemes run by the National and State level. The exercise was done in eight villages in Himmatnagar taluka of Sabarkantha district and Vyara taluka of Tapti district.

Training at Panchayat level decision makers and citizens:

The training workshops at Panchayat level were conducted for decesion makers, citizens and social workers for understanding the process of Panchayat Budget and goveranance at Panchayat level. The objectives of training of Panchayat representatives was to sensitize the panchayat representatives and gram sabha members about their local goveranace, roles and responsibilities of elected members and also to make orientation towards generating revenues from various sources like local taxaions, grants taluka, district, MGNREGS, Finance Commission, MLA/MPLAD grants and local donations. In these meetings, the participants, particularly gram sabha members are also provided information about RTI(Right to Information), welfare schemes for schedule tribes and schedule castes, RTE (Right to Education), education for girl child. The participants were motivated to monitor the services at ICDS centres, Mid day Meal, as their children access these services.

We also conducted meeting with village people separately and find out the development works, which should be given priority. The state government had announced meeting of Gramsabaha from 1st July to 15th July -2015. In these Gramsabha meetings, the village people passed the resolutions at ward level for demanding the grant for development works addressing their basic needs and amenities, the resolutions were subsequently submitted to the Gram Panchyat for incorporating in the development plans of Gram Panchayat, so that the Taluka Development Office approves the budget for such development works.

2. Efforts for Greater Transparency at the State and District Level.

The availbilty of Budget documents in public domain helps in creating Transparency in system, as people can access the budget documents and information. The budget document at state level are available at the state’s website but the budget documents at district and Urbal local bodies are not available in public domain. Pathey Trust took up the matter with District Panchyat and Urban Local bodies for uploading their respective budget document on the website. Some of the district Panchyat and Municipal corporation addressed the issue. We have to make more efforts for ensuring all the District Panchayat and Local bodies upload the budget documents on the websites.

3. Research and Budget Analysis:

Budget analysis and research is a continuous process oriented laborious work, the budget analysis and research work requires constant updating the budgetary figures. During the first two months of last year (2015-16, April and May), we entered the budgetary data from 32 budget books for all the departments for year 2014-15 and 2015-16. The up-dating of data helps in creation of data base for research analysis work for preparing reports, trainings, advocacy and sharing with issue based groups. We also started budget research on state government’s investment for children, particularly focusing on Gujarat state’s macro-economic status and Education, Health Care, nutrition and investment for the Tribal children. Earch studies will be completed in the next year. Besides, we also did study health budget in Gujarat in collaboration with JSA (Jan Suwasthiya Gujarat) for improving the budgetary outlay for health care, improving the human resources in medical care and access to free medicines. Pathey also prepare the training module for elected members of Rapar Municipality in Kutch district along with budget analysis of Rapar Municipality.

Budget Analysis and Research for Health Right Campaign:

Pathey Trust is engaged in budget analysis, advocacy, and capacity building work; along with Gujarat JSA Network members working on Health and maternal and child care issues has jointly working for Campaign for Health Rights with focus Access to health Care services by enhancing budgetary allocation for Filling the gap in Human Resources of Health and Health Care Infrastructure and also Access to Free Medicine. Pathey has engaged at three levels, 1-Research and Analysis of Health Budget, Health Infrastructure, and Health Indicators, 2- Capacity Building of JSA Members around Budget analysis, tracking of expenditure for Health care, and 3-Advocacy and Engaging with legislatures, policy makers, National body (NHRC) around the campaign issues. A policy paper on Health Financing and present status of Health care infrastructure, Indicators and outcomes was prepared. The paper has been published in Newsletter format for awareness generation among the community members, CSOs, academicians, media people and policy makers. For strengthening the Campaign process, Pathey conducted training workshops for the members of JSA focus around understanding the Health Care Budget and trends of public provisioning for health care services from different departments in Gujarat like SCP (Special Component Plan for Schedule Castes), TSP (Tribal Sub Plan), NHM (National Health Mission) and some centrally sponsored programmes. During the 1st year of campaign focus around understanding the budgetary trends for health care and Health indicators and Monitoring of health budget expenditure. For Capacity building of JSA members, five training sessions were held at various places for understanding the Health Budget for advocacy and monitoring. Besides, Pathey Trust also helped JSA in preparing the advocacy material for the joint press conference by JSA and NHRC (National Human Right Commission) held in Ahmadabad on 19th October, 2015. Engagement with elected members and media:

During the budget session, we prepared budget brief on Budget of Health and Family welfare and Highlighted the Shortage of Human Resources in the government Health care system particularly in the rural areas of Gujarat. We distributed the budget write up among the elected members (MLAs) and the media people, who cover the assembly session. The media highlighted shortage of health care human resources particularly the specialist at CHC (Community Health Centers), higher rate of IMR (Infant Mortality Rate, MMR (Maternal Mortality Rate), No of people served by Government doctor etc. please find below the press coverage given to Pathey’s budget write up on Health and Family welfare. Kindly see (annexure on Health issues) the Media coverage given to Pathey Write ups on Health budget and issues during the Budget session Gender Responsive Budget: Pathey Trust with the support of UN Women and NFI (National Foundation for India) prepared the Gujarat Gender Budget Statement 2012-13 in 2013. The report on Gujarat Gender Budget Statement was prepare mainly to advocate with the state government to present the State’s Gender Responsive Budget, subsequently, the state government presented the Gender Budget in 2014 and has institutionalized the presentation of GBS along with state’s general budget and budget is laid down in the assembly. The State’s GBS has many shortcomings due to lack of orientation among the

officials, who in the process of preparing the GBS due to lack of training, visualizations, besides, the GBS also lacks the technical terminology, which could really help in verification of the tracking of actual budget outlay and expenditure from the department’s budget documents. In order to advocate such issues, Pathey Trust with support of UN Women conducted awareness generating

workshops with the members of civil society working with women issues, so that these women groups also do advocacy for improving the GBS and state government also departments also get engaged in preparing Gender Responsiveness of the government’s programmes and schemes meant to address Gender issues. Two workshops were organized with civil society groups in Vadodara and Ahmedabad. As the government officials in Gender Cell, are the responsible stake holders, as they are in the process of preparation of schemes and programmes for Gender Responsive Budget. In order to make orientation of government officials, a workshop was conducted in collaboration of GRC (Gender Resource Center), Department of Women and Child Development on 1st October, 2015 in Ahmedabad. The workshop was attended by around 100 officials, from various departments appointed in Gender Cell. The workshop was inaugurated by the Minister of State, Department of Women and Child, Secretary, of the department and others. The UN Women’ senior officials also attended and conducted the orientation workshop. Under the “ Building Partnership for Gender Responsive Budget”, a roadmap was also prepared with the consultation of civil society members for Gujarat GRB Road Map: for preparing Gender Responsive Budget, which will be shared with state government and concerned officials engaged in GRB process; Besides, we also analyzed the Gender Budget statement for critique and generated awareness among the civil society members for revision and evaluation of Gujarat Nari Gaurav Niti’s impact on women empowerment. As new challenges for women, have emerged, therefore, such issues should also be addressed by policy frame works and budgetary mechanism.

Publication and Dissemination of Budget Literature:

Pathey has been creating awareness about budgetary performance and its impact on the society in general and vulnerable section of society in particular. Besides, during the state’s budget session, department wise budget briefs are produced focussing upon the expenditure performnace of department corelating with social development indicators for wider informed discussion. The literature produced with research and budget analysis is uploaded on Pathey Website at www.pathey.in

Pathey Samachar (Budget Newsletter):

In last year Pathey has published four issues of Newsletter entitled “Pathey Samachar”, providing information on various topics related to budget, policy, social and economic development of state, budget expenditure for education, Health care, Gender Budget, Infant Mortality Rate, 14th Finance Commission’s recommendations for State’s share in Devolution, status of agricultural land among the farm land holders. The Budget Newsletter also carried information about Pathey’s activities like, advocacy workshop, trainings and other activities. The Newsletters are distributed among the members of civil society, academicians, government officials and journalists. Many of analytical reports reproduced by the print media. Pathey also had a publication on “Beginer’s Guide to Budget Study”, the guide provides definitions of budget terminelogy in simple language and also budgtery processes. This is 2nd edition of the publication,

Pathey’s Urban Governance Activities for capacity building: Pathey Trust has intitiated budget analysis of Urban Local Bodies particularly for Ahmedabad Municipal Corporation. As Gujarat is getting rapidly urbanizing state with 43% of population in urban centers, where their basic needs are to be served by the local urban body. Pathey Urban Governance Initiative revolves around research and budget analysis of urban bodies, advcacy, networking and capacity building of community based organisation around expenditure for provisioning the basic civic amenities and social services like nutrition, education and health care. During the last year, Pathey Trust made presentation for the “Consultation on Participatory and Inclusive Urban Governance” jointly sponsored by HDRC, Cept University, Janvikas and Pathey Budget Center. budget at macro level and un-spent amount under the essential services, mainly accessed by the slum dwellers, poor and citizens in the poorer areas, as Pathey’s study on AMC budget analysis reveals that, the Corporation failed to utilize the earmarked budget items meant for providing services like

nutrition, hospital infrastructre developent, slum upgradation, RAY(Rajiv Awas Yojna) for providing basic services to people in slums, primary education and others.

Capacity Building of Elected members of Rapar Municipality : KMVS(Kutch Mahila Vikas Sanghthan) sponsorred “Urban Setu” invited Pathey Trust to conduct the orientation and training session for two days for the elected members of Rapar Municipality at Rapar town of Kutch District in last week of December, 2015. Pathey prepared a training module having legal provision of functioing of Municipality, 74th Amendment and other related laws. The workshop was attended by all the elected members and the officials involved in the budget formulation and executing. The participants were made aware with legal provisions of 74th amendment act, Gujarat Municipality Act, functions and duties of Municipality in providing the various services. The participants were also motivated for organising the Ward Sabha for assessing the aspiration of people’s development and amenities needs and participatory budget. Pathey Trust has also assisted urban community based organizations in understanding the City budget for basic services. In last year, Pathey provided training inputs to SAATH organization with budget analysis of Surat Municipal Corporation Budget for the Surat based civil society members and community members. Pathey also conducted the training workshop for HDRC’s (Human Development and Research Centre) urban community programme. The Budget analysis of AMC (Ahmedabad Municipal Corporation) budget for 2016-17 was shared with the community members for demanding the basic services from AMC.

Issues and Challenges of Minorities in Gujarat:

Pathey made presentation on the subject of “Issues and Challenges of Minorities in Gujarat, focusing on budgetary provisions for the minority communities on 26th December, 2015. The workshop was organized by National Peace Group and Jan Vikas.

4. Strengthening People’s Participation in Budgetary Processes:

Engagement with Legislatures and Media:

Creating awareness and having informed discussion on the performances of Budget allocation and utilization through budget analysis is Pathey Trust’s core activity; As the Budget and documents are presented in the technical codes, which citizens can hardly de-codify and understand, it is very essential that the citizens must understand the performances budget utilization, as it (Budget) has great impact on the their lives and destiny. Pathey Trust has been spreading Research and Analysis at multiple levels by engaging the various stake holders by proving the budget analysis information, training and capacity building, advocacy for governance and accountability. The elected members are the most legitimate actors for discussing and debating the budget and its implication on the various sections of society, therefore, we have been engaging with all the elected members of the assembly by providing the brief analytical write up on department’s budget and its performances with previous year’s data. These budget brief write up also compare the outcomes of various states for advocacy purpose. We also proactively engage with the media for disseminating the budget analysis findings to the larger audience by providing and feeding the budget analysis findings to media people in the simple language. The budget brief are distributed among the legislatures and media people one day before the actual discussion in the assembly, so that the legislatures can use the Pathey’s write up as reference in the discussion. During the budget session held in February and March, 2016), We could prepare 21 budgets brief for the selected departments as shown in the table below (As We did not have financial and Human resources, there are only 2 persons working November onwards due to financial constraints). The Budget briefs on Department’s expenditure and performances were very well received by the media and gave good coverage, using Pathey’s data and publish reports on various themes; these reporting are mainly focused upon the performances, indicators, and under utilization of budgetary allocation for social development, vulnerable section of society, and others. The write up also helps in advocacy efforts as well. Pathey gave comments on non-utilization of plan budget; less expenditure on social sector budget, which appeared in the paper next day, the detailed is annexed at the end. The comments on plan implementation for social expenditure, as the state under spending of the budget outlay for social services, also received media attention.

The analysis of budget at macro level in a brief format so that any lay person could better understand the fiscal positions of state at macro level. The budget brief covered financial aspects like revenue resources from various sources of state and expenditure of state for various services. The analysis included comparison of data with previous years for giving trends in larger perspective.

Pathey prepared write up with socio-economic development indicators along with comparison with other states to illustrate the actual progress made by the state vis a vis other states of country, for example IMR (infant mortality rate), payment of minimum wages to casual workers, implementation of FRA (Forest Right Act) and others. The main objective of incorporating such data is to present the status of particular issue at national comparative perspectives so that elected members have idea and more information to debate upon and in the process, very vital issues of development get discussed by the people’s representative and media also write about such discussed issues. As we did not have financial grants and human resources to prepare the budget briefs for all the departments, therefore, we chose to focus upon and prepared budget briefs only social sector departments and distributed limited copies of budget brief among the legislatures. Of course, all the media people were distributed paper copies of budget briefs for wider dissemination. Some Achievements:

• Patheya’s consistent efforts have motivated many civil society organizations to look at the government’s budget and build perspective in their advocacy with the issues as well. There are several organizations and groups, who have approached Pathey to orient the staff members the budget analysis work for monitoring and tracking the status of social justice.

• During the state assembly’s budget session, Pathey has been able to articulate the write ups giving emphasis on marginal sections, unorganized sectors workers, women, children, Adivasis and Dalits, Pathey has also provided comparative development indicators to highlight the delivery of governance for the critical social development sector like status of education and health.

• The journalists covering assembly session have also used Pathey’s write ups as reference material for their newspaper reporting, which has helped the

wider dissemination. The media reporting on budget has also further disseminated budget analysis work deeper. The research articles or budget related case study published in Pathey’s Newsletter “Pathey Samachar” has been receiving good response. Many of the articles are reprinted in the newsletters of other organizations; many of the articles are printed in the newspapers with acknowledgement, which shows the relevance.

• The Government has institutionalized the presentation of Gender Budget Statement, Pathey had prepared Gender Budget statement in 2012-13 and shared with the government departments, subsequently, the state government has presented the Gujarat Gender Budget Statement.

Future Challenges:

There are several challenges, that organization is faced with, some of the challenges are Grant related, as financial resources are not available. The organization will have to search for new resources. The Financial support for pursuing for budget analysis work is shirking and in last three years, the financial support has been very irregular, which has impact on pursuing the research, training, and publication work. We had core support up to October, 2015 and despite our efforts, we could not mobilize the grants. From October 2015 to September, 2016, only two persons have been working.

• Mobilizing funds for budget work is also a challenge. • The General atmosphere in the present situation is not helpful to budget

work, though the budget work and analysis findings are sought for. • The technology is changing very rapidly and the budget work being time

consuming and laborious, therefore, keeping pace with rapidly changing technology is also big challenge.

• Non-availability of information (Budget related) is also barrier. As the demand for micro level budget information is increasing, so access to information is also challenge.

• In absence of resource, there is serious problem of nurturing the human resource for budget work.

Way Forward

In Last five years, Pathey Trust (Pathey Budget Center) has travelled the journey as an independent organization and has established its identity. It has explored many new themes and also partnered with national, local and issue based coalitions and networks, which was not the case earlier.

Pathey Budget Center will carry forward the state level budget and policy analysis work for demanding governance, accountability and participation for disadvantageous and poor people.

Pathey has deepened budget work in urban local bodies and but will have to pitch for inclusive and participatory planning in urban bodies.

Pathey will engage with government departments for issuing Gender Responsive Budget at state level and also at PRI (Panchayati Raj Institutions) and ULB (Urban Local Bodies)

Pathey will strengthen its research and advocacy work and sharing with various organizations, networks and others.
