Activity report

EMPL main achievements during the 8th legislature (2014-2019)

Introduction by the Chair

The Committee on Employment and Social Affairs (EMPL) is responsible for employment and social policy, workers’ rights, health and safety at work, the European Social Fund, vocational training, the free movement of workers and pensioners, social dialogue, discrimination at the workplace, and relations with the four agencies working within its remit[footnoteRef:1]. During the eight legislative term, the Committee had 55 full and 55 substitute members representing the Chamber’s eight political groups. Over the five past years, the Committee has been engaged in an important number of legislative and non-legislative activities with the aim to put employment and social policy at the centre of EU policy making and to modernise EU legislation in this area. We were in charge of 20 files under the ordinary legislative procedure (codecision) and adopted in total over 60 reports, 130 opinions to other Committees and 15 questions for oral answer and motions for resolution. While most of the procedures have been completed, some of them are still ongoing and will be carried over to the forthcoming legislature.

One of our core legislative files was the revision of the posting of workers directive, which will make the free movement of workers within the Union fairer and guarantee equal pay for equal work in the same place. Other important achievements were the improvements of the rules to protect workers from carcinogens and mutagens, the increased focus on skills and qualifications, the establishment of the network of European Employment Services and of the platform to fight against undeclared work, and the ongoing revision of the rules on social security coordination and preparation of the next Multiannual Financial Framework.

The Committee has intensely contributed to formulating the principles and rights defined under the European Pillar of Social Rights aiming to ensure equal opportunities and access to the labour market, fair working conditions and social protection and inclusion. We have also been very active in contributing to translate the Pillar into concrete results through the adoption of various pieces of legislation such as on work-life balance, on transparent and predictable working conditions or on the European Labour Authority.

It is important that we continue to deliver on the Pillar of Social Rights and engage for a fairer and more social Europe in order to improve the living and working conditions of our citizens and help tackle the EU’s economic, social and political challenges.

Legislative files

· European Social Fund Plus (ESF+)

Rapporteur: LOPE FONTAGNÉ Verónica (EPP)

File to be completed during the forthcoming legislative term.

In preparation of the upcoming Multiannual Financial Framework (MFF) for 2021-2027, Parliament adopted its position on the Commission proposal for a regulation on the European Social Fund Plus (ESF+) on 16 January 2019. It proposes increasing ESF+ funding for the period 2021-2027 by approximately 19% compared to the European Commission proposal. It also suggests increasing resources devoted to youth employability and ensuring equal opportunities for children at risk of poverty or social exclusion.

The ESF+ aims to merge the existing European Social Fund (ESF), the Youth Employment Initiative (YEI), the Fund for European Aid to the most Deprived (FEAD), the Employment and Social Innovation Programme (EaSI) and the EU Health Programme. This merger should help streamline and simplify existing rules across the different funds and increase synergies between the components of the new European Social Fund+. This should make it easier for beneficiaries to access funding, help them combine different types of measures, and simplify funding management. The new fund will concentrate its investment in three main areas: education, employment and social inclusion. More information

· European Globalisation Adjustment Fund (EGF) 2021-2027

File to be completed during the forthcoming legislative term

The European Globalisation Adjustment Fund (EGF) was created in 2006 and aims to finance active labour market policies targeting workers who have lost their jobs because of trade adjustments. Since its creation, it has mobilised €611 million targeting 147,000 dismissed workers and young people not in employment, education or training. The Fund is currently under revision.

The Commission proposal introduces modifications to the eligibility criteria (especially regarding digitalisation and environmental changes), the co-financing rules and the mobilisation procedure. It is also proposed to maintain the EGF as a special instrument outside the MFF ceiling.

Parliament held its first reading on 16 January 2019. Among other things, MEPs propose to change the fund’s name to “European Fund for Transition”, to make it easier for the fund to help workers who were employed by small and medium-sized enterprises, and to speed up the application procedure. · Work-life balance for parents and carers

Rapporteur: CASA David (EPP)

The new Directive on work-life balance for parents and carers aims to boost women’s participation in the labour market and to improve the access for working parents and carers to work-life balance arrangements. In particular, the Directive introduces at least ten working days of paternity leave for fathers and equivalent second parents paid at not less than the level of sick pay. It also foresees two months of non-transferable paid parental leave, aiming to creating the appropriate conditions for a more balanced distribution of caring responsibilities. Moreover, it allows for 5 days of carer’s leave per year for workers providing personal care to a relative or a person living in the same household and with a serious medical condition or age-related impairment. Finally, working parents and carers will be able to request an adjustment to their working patterns including, where feasible, through remote working or flexible schedules. More information

· Establishing a European Labour Authority

Rapporteur: LENAERS Jeroen (EPP)

The creation of the European Labour Authority (ELA) aims to ensure that EU rules on labour mobility are enforced in a fair, simple and effective way. To do so, ELA shall assist Member States and the European Commission in applying and enforcing the relevant EU legal acts in the field of labour mobility and social security coordination. ELA also aims to provide information for employees and employers to take full advantage of the principle of free movement and to ensure fair labour mobility. It will support cooperation between national authorities in cross-border situations by helping them ensure that the EU rules on mobility are easily and effectively followed. Moreover, ELA shall provide mediation and facilitate solutions in case of cross-border disputes on how to apply EU law on labour mobility issues. The Authority will start working in 2019 and become fully operational by 2023. More information

· Transparent and predictable working conditions in the European Union

Rapporteur: CALVET CHAMBON Enrique (ALDE)

The new Directive on transparent and predictable working conditions in the EU complements and modernises existing obligations to inform each worker of his working conditions. It takes developments such as demographic change and digitalisation into account and creates new minimum standards to ensure that all workers, including those on atypical contracts (for instance domestic workers, platform workers or paid trainees) benefit from the increased predictability and clarity. Once entered into force, all workers need to be informed from day one, and no later than seven days where justified, of the essential aspects of their employment contract, such as a description of duties, a starting date, the duration, remuneration, standard working day or reference hours for those with unpredictable work schedules. There will also be more predictability regarding working hours and deadlines for cancellations for new forms of employment such as on-demand contracts. Furthermore, workers will be allowed to take up a job in parallel with another employer, the probationary period will be limited to a maximum of 6 months, and mandatory training foreseen in European and national legislation should be provided free of charge by the employer and count as working time. · Establishing a common framework for European statistics relating to persons and households, based on data at individual level collected from samples

Rapporteur: MESZERICS Tamás (Greens/EFA)

Social indicators play an essential role in informing and supporting the Union's key priorities for growth and job creation, the reduction of poverty and social exclusion, skills, mobility and the digital economy. In the context of the Europe 2020 Strategy and the reinforcement of the social dimension of the EU, a new Framework Regulation on the modernisation of social statistics relating to persons and households has been adopted. It encompasses and streamlines seven existing social surveys[footnoteRef:2] to make the data collection process more efficient and the statistical output more relevant. This will help to better support policy making in general and social policy in particular. Protection of workers from carcinogens or mutagens at work

To better protect workers from the exposure to carcinogens and mutagens at the workplace and to increase the effectiveness of the EU framework and promote clarity for economic operators, three pieces of legislation were adopted, which amend a Directive of 2004. Thanks to this, working conditions of millions of workers across the Unions will be improved and thousands of cases of work-related cancer can be prevented.

· Amendment to Directive 2004/37/EC on the protection of workers from the risks related to exposure to carcinogens or mutagens at work: exposure limit values

Rapporteur: ULVSKOG Marita (S&D)

The first directive adds 11 carcinogenic substances to the already existing list of dangerous substances and revises the limit values for two substances that were already listed. There will also be minimum requirements for eliminating and reducing all carcinogens and mutagens. Moreover, employers will have to identify and assess risks to workers who are associated with exposure to specific carcinogens and mutagens, and must prevent exposure where risks exist. More information

· Protection of workers from the risks related to exposure to carcinogens or mutagens at work: limit values and skin notations

Rapporteur: ROLIN Claude (EPP)

The second revision of the Directive sets exposure limits on eight additional carcinogens or mutagens, including diesel fumes and used engine oil. It also includes skin notations for these substances, which are used to warn against the potential health effects associated with skin penetration. More information

The third Directive sets exposure limits on another five carcinogenic chemical agents, namely cadmium, beryllium, arsenic acid, formaldehyde and 4,4'-Methylene-bis (2-chloroaniline) (MOCA). More information

· Better services for skills and qualifications (Europass)

Co-Rapporteurs: MALINOV Svetoslav Hristov (EPP) and MANN Thomas (EPP)

The legislation on the Europass portal, one of the EU’s most used websites, has been updated in order to simplify and modernise it. Europass provides a transparent framework for professional documents such as CVs and standardises them so that people's skills and competences can be used and understood in any EU country. That makes educational and working mobility in Europe much easier. Thanks to the update, Europass became more accessible, including to people with a disability, and protects personal data more effectively. Moreover, the recruitment process has been made easier through a data system that makes the recognition of skills and qualifications more transparent across the EU. Finally, the new electronic tool “e-portfolio” allows gathering all the information about a person in one place. More information

There are three tripartite agencies which provide the EU institutions and Member States with data and research in the field of employment and social policies: the European Foundation for the improvement of living and working conditions (Eurofound), the European Agency for safety and health at work (EU-OSHA) and the European Centre for the development of vocational training (Cedefop).

In order to update their respective objectives, tasks and structures and to take into account recent societal, institutional and economic developments, their founding regulations have been revised. While each regulation contains agency-specific parts linked to the specific tasks and remits of each agency, most of the provisions of the founding regulations were aligned to the so-called Common Approach on Decentralised Agencies, a comprehensive set of guiding principles to make the agencies more coherent, effective and accountable. · Posting of workers in the framework of the provision of services

The posting of workers plays an important role in the internal market, particularly in the cross-border provision of services. While the number of posted workers continues to increase significantly, problems such as unfair practices and unequal remuneration have arisen, and a better protection of the social rights of workers became necessary.

These and other challenges have been taken into account when revising the existing Directive on the posting of workers, which dated back to 1996. The new rules facilitate the transnational provision of services while ensuring better protection for posted workers and fair competition for companies. In particular, workers sent temporarily to another EU country will from now on get equal pay for equal work in the same place. More information

· Amending Regulation (EU) No 1304/2013 on the European Social Fund, as regards an increase of the initial pre-financing amount paid to operational programmes supported by the Youth Employment Initiative

Rapporteur: MORIN-CHARTIER Elisabeth (EPP)

In order to address the high levels of youth unemployment in the EU, the Youth Employment Initiative (YEI) provides support to young persons not in employment, education or training in the most affected regions. To ensure a quick response to fight youth unemployment, certain provisions have been laid down, foreseeing, among other things, the commitment of all the resources in the first two years of the programming period. However, the budgetary constraints faced by Member States and the lack of available funding at the initial stage of the programming period have caused significant delays in the implementation of the YEI. Therefore, the co-legislators amended Regulation 1304/2013 on the European Social Fund so that substantial funding could be released to Member States in the form of pre-financing, which in 2015 was exceptionally increased from 1-1,5% to 30% of the special YEI budget line. · Establishment of a European Platform to enhance cooperation in the prevention and deterrence of undeclared work

The European Platform tackling undeclared work was launched in 2016 to enhance cooperation among competent actors to combat undeclared work more effectively. There was no EU-level cooperation in this area prior to this since the responsibility to fight undeclared work is with the Member States. The platform brings together EU national authorities, social partners and the European Commission who regularly come together to exchange information and good practices, learn from each other and engage in closer cross-border activities. · European network of Employment Services, workers' access to mobility services and the further integration of labour markets

Rapporteur: BECKER Heinz K. (EPP)

The network of European Employment Services EURES provides information, advice and recruitment services to workers and employers and thus helps to enhance intra-EU labour mobility. In 2016, the new EURES Regulation has been adopted to better reflect new mobility patterns, technological changes and recruitment channels. Through improved tools, the inclusion of new service providers and increased transparency, EURES shall become a true European placement and recruitment tool. It improves coordination and information exchange on national labour shortages and surpluses among EU countries and provides candidates and employers support services such as language courses as well as information about social security, healthcare, taxation and labour law to facilitate recruitment and integrate workers in the new post abroad. · Directive (EU) 2015/1794 on seafarers amending Directives 2008/94/EC, 2009/38/EC, 2002/14/EC, 98/59/EC and 2001/23/EC

Rapporteur: MORIN-CHARTIER Elisabeth (EPP)

In order to improve the rights of seafarers, the co-legislators amended the scope of several European labour law Directives. As a result, seafarers now enjoy the same rights as employees on-shore, and their living and working conditions have been improved. As the number of EU seafarers has been steadily decreasing over the last years, this amended legislation also aims to increase the attractiveness of working in the maritime sector and avoid labour shortages. · Contingency measures in the field of social security coordination following the withdrawal of the United Kingdom from the EU

The Regulation on establishing contingency measures in the field of social security coordination following the withdrawal of the United Kingdom (UK) from the EU aims to ensure that in case the UK leaves the EU on 30 March this year without a deal, the entitlements of those people who exercised their right to free movement before the UK's withdrawal are safeguarded. These rights include periods of insurance, (self) employment or residence in the UK prior to its withdrawal. In concrete terms, this means that if, for example, an EU27 citizen worked for several years in the UK before Brexit, this period should be taken into account when this person’s pension rights are calculated in the EU Member State where he/she retires. The measures will enter into force only if the UK leaves the EU with no withdrawal agreement in place. More information

· Coordination of social security systems

File to be completed during the forthcoming legislative term

Making the coordination of social security systems across the EU clearer, fairer and simpler and taking into account recent social, economic and political developments is the aim of the ongoing revision of the regulations in this area. Coordination of social security systems is of vital importance in order to guarantee that EU citizens do not lose their social security protection when moving to another Member State. The revision aims to facilitate the free movement of workers and protect their rights. It shall also reinforce the tools for national authorities to fight abuse or fraud and make a closer link between the place where contributions are paid and where benefits are claimed, ensuring a fair financial distribution of burden between Member States. The amending regulation focuses on five areas: unemployment benefits, long-term care benefits, access to benefits for economically inactive persons, family benefits and applicable legislation for posted workers and persons working in two or more Member States. On 10 April 2019, the Council Presidency informed the EP that it has not succeeded to secure a qualified majority in Council to approve the provisional political agreement, found on 19 March 2019 between the EP, the Council Presidency and the Commission after 8 trilogue negotiations.

On 18 April 2019, the EP plenary decided to adjourn the vote on the EMPL report. This means that the EMPL report of 20 November 2018 falls under the category of “unfinished business”, i.e. it is deemed to have lapsed unless the next Parliament decides to continue based on this report.
