Happy New Year to all! I do hope you had a wonderful holiday season. As your incoming President, I would like to take this opportunity

to introduce myself and give you a preview of the exciting things AAGO has in store for 2016.

It’s hard to believe that I began my journey in the multifamily housing industry as a Leasing Consultant 25 years ago. As I reflect on my career and professional development, I am reminded how thankful I am for our association. As a member of AAGO, I’ve been blessed to work alongside amazing leaders and see our association grow in extraordinary ways. Before becoming AAGO’s President, I served as a committee volunteer, Executive Committee member and on the Board of Directors. My involvement with AAGO played an important role in my career development and I am beyond thankful to have the opportunity to give back to our association by serving as your President.

AAGO Advocacy at Work

AAGO is working for you by actively identifying and

monitoring issues the impact the apartment industry in

Lake, Orange, Osceola, Seminole, and Volusia County.

LOCALAs you may remember from our last issue, Fire Assessment

Fees are becoming increasingly more common in central Florida. A Fire Assessment Fee is an additional source of revenue that local governments are starting to utilize to pay for or supplement their fire protection services budget. Typically, local governments pass a Fire Assessment Fee ranging from $50-$200+ per residential unit depending on the municipality. This per residential unit fee quickly escalates for an apartment community with dozens or hundred or apartment homes.

Most recently, AAGO learned the City of Fruitland Park (Lake County) is exploring a Fire Assessment Fee for the 2016-2017 tax billing period. The Fruitland Park City Commission will meet in January to determine if the City will move forward with a Fire Assessment Fee or potentially dissolve its Volunteer Fire and Rescue Department for the next budget cycle. Rest assured, AAGO will continue to monitor this issue closely and update members on any new developments.

In addition to monitoring Fire Assessment Fees, AAGO is continuing to track the City of Orlando’s progress on an energy benchmarking ordinance. Orlando is one of ten cities participating in the City Energy Project (CEP). The CEP is a national initiative that seeks to improve the energy efficiency of large buildings. Cities that are associated with the CEP often implement a policy that requires buildings of a certain size to report their energy (and sometimes water) consumption on an annual basis. Property owners use the Environmental Protection Agency’s Energy Star Portfolio Manager® tool to track and report their consumption. Once the data is collected, it is publicized by the local government and available for potential renters or prospective buyers to review.

Orlando staff informed AAGO that the City plans to introduce an energy benchmarking ordinance in early 2016, which will directly impact the multifamily industry. AAGO is

thankful to have a positive working relationship with the City of Orlando and looks forward to providing feedback on the ordinance once a draft of the legislation is available.

In preparation for the ordinance draft to be released, members are highly encouraged to visit www.AAGO.org and read the AAGO White Paper that discusses how this issue will impact the apartment industry. This White Paper can be found under the Resources Tab: Government Affairs, Central Florida, Orlando City Energy Project.

STATEThe Florida Legislature’s regular session will convene on January 12th. Since the legislative session is starting earlier than usual this year, the Florida Apartment Association’s (FAA) Legislative Days will take place on Tuesday, January 26th and Wednesday, January 27th in Tallahassee.

FAA Legislative Days is a valuable opportunity for members from all facets of the apartment industry to communicate directly with lawmakers in Tallahassee. We hope you will join AAGO and your colleagues from across the state in Tallahassee for this important advocacy event! Every year, AAGO hosts a send-off breakfast prior to taking a luxury bus to Tallahassee as an association for Legislative Days. This year, we are excited to announce that we’ve added a Legislative Days Attendee Workshop on January 13th from 9:00 a.m. – 11:00 a.m. (Breakfast will be provided). This workshop will provide attendees with an overview of the legislative issues we will be discussing with lawmakers in Tallahassee, tips for conducting a successful meeting with legislators and what to expect for FAA Legislative Days. I hope you will join your colleagues from across the state for this important advocacy opportunity!

Did you know your APAC dollars were recently put into action to support Orlando Mayor Buddy Dyer’s 2015 re-election campaign? On October 27th Mayor Dyer attended AAGO’s Legislative Committee meeting to discuss his upcoming election, the development boom in Orlando and the City’s plan for public transit. After the meeting, AAGO presented Mayor Dyer with an APAC contribution for his campaign, which he won on November 3, 2015 with 63% of the vote. A special thanks to all of the AAGO members who attended the meeting with Mayor Dyer and represented the apartment industry to one of central Florida’s most influential leaders.

NATIONALThe 2016 NAA Capitol Conference will take place on March

8th and 9th in Washington, DC. This annual event provides members with a unique opportunity to experience the federal legislative process first hand while representing the apartment industry on Capitol Hill.

The events on March 8th will include policy issues training, advocacy orientation and a keynote speaker. On March 9th, attendees will conduct a Lobby Day on Capitol Hill to share the apartment industry’s views with members of Congress. Apartment development is once again more active throughout the AAGO area, the state of Florida and the country. Apartment construction peaked in our area in 2005 with almost 11,000 permits issued and then slowed down to almost a standstill in 2009 and 2010. Beginning in 2011 we’ve exceeded the previous year’s permits for six years in a row. See the chart below for the multifamily permitting history in your area.

The continued rise in permitting suggests that the developers and lenders are still optimistic about the future economic conditions in Central Florida. The AAGO region continues to add units - albeit not at the pace experienced in the early 2000’s - but at a healthy rate nonetheless. This year is on track to be the third year in a row Multifamily (MF) permitting exceeds 6,000 units in the AAGO area. MF permitting does account for both apartments and condominium permits so not every multifamily permit equates to a rental unit. That said, a good number of them are at this point.

Apartment New Construction Summary of AAGO Area

We show that about 6,276 units completed construction in the AAGO areas in 2014. Also, close to 5,500 units are currently

under construction and/or in initial lease-up in the AAGO Online Market Survey (“OMS”). Furthermore, we are tracking over 10,000 units that are planned and/or proposed that will try to get financed and developed over the next couple of years.

The developers that are building or planning to build in the AAGO area cover the gamut from local builder to national REITs. Some of these planned properties have been proposed for many years and we know that all of these planned

properties do not get developed. However, we have been seeing multifamily permits rising and expect that apartment development will continue at higher levels as well.

Charles Wayne Consulting, Inc. (“CWC”) stated that their numbers for under construction and planned units are in the ballpark of where we see them within the AAGO area. CWC also indicated that the greater Orlando market shows a demand for 6,000 to 6,500 apartment units for the next two years. CWC states new construction in the Greater Orlando Market is getting $1.40 a foot in rent. Currently, CWC says Downtown Orlando is getting $1.60 - $2.10 a foot. Those numbers seem to be inline with what the AAGO OMS show.

AAGO is proud to offer cutting edge courses and topnotch educational opportunities throughout the year. The continued success of AAGO’s education program depends on valuable feedback from leaders in the apartment industry who serve on AAGO’s Education Advisory Council. This group of

volunteers focuses on the strategic growth of AAGO’s Education Department, which includes marketing of current education programs, evaluating current course offerings, and assisting with the development of future programs. Membership on the Education Advisory Council is by invitation only and participants must hold a leadership position within their company in the area of Management, Marketing, or Human Resources.

After several months of hard work, the Education Advisory Council is excited to announce the AAGO Leadership Development Program will launch in Spring 2016! This new program will help teach students the essential skills and techniques they need to look at challenges in the workplace from a different perspective. The program will focus on assessing each attendee’s leadership competencies and areas of improvement. By the end of the program, the attendee will be well versed in: ethics, motivation, coaching, leadership styles, counseling and performance appraisals, the 10 Listening Habits, conflict resolution and time management skills just to name a few.

Drones have been all over the news lately. These small, stable, airborne devices have come a long way from your father’s toy helicopter.

The new breed of drones are not toys. They are high-tech, expensive platforms capable of precision aerial maneuvers. These platforms, combined with light, high-powered sensors have the potential to completely change a host of industries.

The Association for Unmanned Vehicle Systems International (AUVSI) estimates that drones used in agriculture and public safety will contribute over $80 billion to the U.S. economy.

How could this be? What’s the value of this new technology?

It’s not all about pretty pictures from the sky. It’s about bringing “big data” to any industry you can think of. It’s about pairing high-powered sensors with stable aerial platforms to gather any information a business could want.

Instant analysis of crops with multi-spectral imaging? Why not? 3-D as-built surveys of buildings under construction? Sure! Replacing manned aircraft that survey utility pipelines and wires with low-cost, unmanned platforms? Absolutely!

Right now, drone technology is in its “awkward teen years.” The capabilities are changing fast and getting better all the time.

You know what else is changing fast? Drone Law!

The Federal Aviation Administration (“FAA”) is writing the regulations to govern drone flights in the national airspace system. You heard that right: the regulations are not written yet. This means that there is no clear “rule book” for how drones are to be flown for commercial purposes.

The “rules” we have right now are general guidelines that lack specificity. This has led to confusion as more and more people have started flying drones for fun and profit.

Right now, there are generally two categories of temporary rules: (1) Hobbyists that are flying for non-commercial purposes should follow the FAA safety guidelines. (2) Commercial operators must have a special approval from the FAA in order to fly for profit. The most common of these approvals is called a “Section 333 Exemption.”

States have also jumped into the “drone law” game. Here in Florida, a complicated set of regulations are “on the books” that

impact commercial, hobbyist, and government use of drone technology. Similar laws are popping up around the nation.

What does this mean for landlords? Will residents be “invading” each other’s “privacy” left and right? Can drones be “banned” through lease documents?

These are all good questions. There are not many good answers right now.

Landlords inclined to ban drones through restrictive lease terms can probably do so. If you can ban dogs, you can ban drones.

The bigger question is why one would want to do that? What would be the purpose of the exclusion? This question is critical to answer in order to draft a provision that will accomplish the intended purpose.

I would caution landlords against reflexively banning a certain type of technology. If the point is to stop people from doing offensive things with a drone (like taking pictures of people who don’t want their pictures taken), can’t the same thing be done with a smartphone? What’s the difference between an iPhone in the third floor window and a $200 quad-copter? Technologically, not much!

These things can quickly become complicated. For example, would an “anti-drone” lease provision prevent a resident with an FAA-authorized drone business from housing their equipment on the premises? If so, why? What purpose would that serve? What if a person was hired to film a wedding at a residential facility and has the FAA approval to use a drone. Would that use be prevented by a lease exclusion? If so, why? What purpose would that serve? Who would that protect?

What if a drone operator is flying the drone for a government purpose? What if a police officer brings his drone equipment home to his apartment inside his squad car? Would the lease exclusion ban that? Could it? Should it?

Asking the right questions from the start will help landlords get to the right answer. With a new technology – like drones – that is changing so quickly, care should be taken to not throw the “baby out with the bathwater” in crafting responsible lease provisions.

Drones are set to become a much bigger part of the economy than they are now. Landlords wishing to draft lease provisions to address this technology should take the “long view,” and balance the needs of residents with the shifting state and federal regulatory requirements.

It has been over a decade since a major category storm hit Florida and the natives can run the risk of hurricane amnesia. As 2016 gets off and running why not add a rejuvenated disaster plan to this year’s resolutions list.

Natural disasters and property emergencies happen every day and cause billions of dollars in property damage annually. When destructive elements like rain, wind, lightning and hail strike, the result can be roof and structural damage, water intrusion, mold, electrical failures, plumbing problems . . . the list goes on.

When a natural disaster occurs, repairing even one apartment is demanding, but coordinating restoration for an entire community is a much more daunting task. And more often than not, multi-family developments face two separate losses when severe weather strikes – both to individual homes and exterior damage to common areas. Thus, it is critical to plan ahead before reconstruction is needed.

Organize and Communicate Most people are anything but calm when faced with

severe weather, and once a threat is identified, those in harm’s way work themselves into a panic – buying supplies and securing buildings. But, they often overlook one major precaution: forming a plan for remediation in the event damage occurs. While not all natural disasters come with advanced warning, creating a preparedness plan now will help to facilitate repairs – and get the community back to normal as efficiently as possible. Create an emergency plan to suit each type of disaster:

•Hurricanes: Though they can be deadly, hurricanes are one of the few weather threats that provide advance notice. Make sure your residents are well-informed – send out a list of supplies or organize community informational meetings. Also, find out if there are any elderly or disabled residents who need extra help to prepare.

•Tornados,ThunderstormsandFlooding: Wind and water damage from these storms can result in a litany of

problems: fallen trees, broken windows, roof damage and mold. Since there is little time to plan ahead, make sure you have established an emergency communication plan for residents to follow.

•Fire: A fire in one apartment unit can displace residents in an entire building. Unfortunately, the only remedy is to begin remediation immediately. Enlist a reputable general contractor to have on-call for emergencies.

•Mold: Gone (hopefully) are the days of spray bleach and wipe off. Mold growth is a serious problem in Florida and can be a threat to health as well as an expensive price tag if not remediated early. The statutes for mold remediation and licensing have changed over the past years and it is critical to contact a qualified mold assessor and a licensed remediator in the event mold growth is found. If your property sustains a water loss, it is imperative you get a qualified dry-out contractor to act quickly and stage equipment properly. Moisture mapping and continual monitoring within the first 72 hours will be crucial to mitigating the damages and avoid mold from growing.

Create the PlanWhen dealing with hundreds of units, repairs must be

completed promptly to both decrease resident displacement and to remediate general hazards associated with damage from water and wind. For that reason, disaster preparedness must begin well before the threat is imminent.

While you can’t necessarily control the actions of each individual tenant, you can provide easy-to-follow instructions for the quickest possible recovery. Ask the following questions to begin your community’s plan:

•Do you have a resident checklist? The list, which should be updated annually, should include emergency phone numbers (e.g., local police, Red Cross and relatives), as well as any pertinent guidelines to follow during a severe weather situation. If applicable, identify a safe room in each home (or ask residents to identify their own) and designate a meeting spot where they can safely gather after a storm. If you have advanced warning, take the time to purchase essential supplies, like batteries, food and water; charge your cell phone and laptop computer; fill your car’s gas tank; withdraw cash from the bank; and purchase prescription medication.

•Doyouknowyourneighbors?Encourage residents to communicate with one another. Also, see if any neighbors have medical expertise which might be needed during an emergency.

•Does our insurance cover that? Encourage, if not require, your residence to obtain renters insurance. We have countless stories of residence losing everything only to find out they don’t have renters insurance. It is inexpensive in comparison to the risk of losing everything.

•Is thereanythingelse Icando? Even with the best preparation, you can’t prevent damage from occurring, but you can try to minimize its effects. Cover torn-off roofs and broken windows with tarps and plywood – and, if water is the issue, use large fans to “dry-out” the home faster. To ensure the quickest recovery, establish a relationship with an “on call” disaster contractor.

Choosing a Disaster ContractorSearching for a reputable contractor after a natural

disaster occurs increases the chances for fraud and price gouging – especially if the destruction is widespread. Availability of the “good one’s” will be scarce. Establishing a relationship in advance reduces that risk and takes the decision-making out of an already chaotic time.

Therefore, one of the most important preemptive measures a property manager can make is to establish a relationship with a disaster contractor. These experts specialize in repairing damage caused by natural occurrences like fire, wind, water, mold and termites. Damaged roofs and walls, broken windows, flooding and mold require contractors with different expertise. Disaster contractors can bundle all these services – even coordinating multiple sub-contractors for their clients, if needed – thereby eliminating extra hassle for the client. Beyond being equipped to handle building repairs and complications from water intrusion, (like mold, for example), these companies are well-versed in working with insurance agencies to organize claims efficiently. In addition, many stockpile basic supplies like generators, lumber and tarps – crucial elements to responding promptly and beginning the recovery process. Also, early enrollment allows the contractor to survey the property ahead of time and note emergency electricity and water shut-offs for each building, among other preparatory measures.

And remember: Disaster contractors will provide different types of reconstruction services – it is a matter of doing your research and selecting the best company to complement your community’s needs.

Final Steps to Secure the CommunityIn addition to forming a relationship with a disaster

contractor, other steps should be taken before any damage occurs. If you have adequate warning:

•Remember to check vacant units prior to the storm and shut off their power and water.

•Keep an updated list of disabled residents and where they live in the community.

•Make sure shrubs and trees are trimmed in advance of storms to reduce debris.

• If a swimming pool is on the property, make sure pool furniture is placed in storage or even in the pool.

•Secure windows and doors – do not use tape on windows! Taping does not work and is difficult to remove.

Remember that restoration can take anywhere from a couple weeks to a few months to finish.

Because the hired contractor is going to become part of the property’s daily operations throughout the duration

of repairs, make sure it’s a company you are comfortable working with – and working around. Begin researching now, enroll for appropriate services and ride out

any storm season with confidence.

This year’s Charity Golf Tournament was held on October 30th at

Timacuan Golf and Country Club.

At 8:00 am, 115 AAGO golfers hit the green, including former Orlando Magic player, Bo Outlaw! After spending the morning on the course, attendees gathered for lunch and networking. AAGO is pleased to report, the Charity Golf Tournament raised over $13,000 for the AAGO Foundation. The mission of the AAGO Foundation is to work with three specific demographics: the homeless, veterans reintegrating into the workforce and teens aging out of foster care. Since 2013, the AAGO Foundation has raised funds to help local organizations that serve these demographics.

Dear Harry,One of our residents has been paying late on a regular basis. He always pays late fees, but it seems that the rent is coming in later and later each month. We gave this resident a 3-day notice and wrote on the notice that we will not accept a personal check. Sure enough, today in our drop box, the resident’s personal check appeared. We would like to refuse this check. Can we return this resident’s personal check and demand that he pay by money order or certified check?

Dear Demanding,You need to carefully look at the lease. Many leases provide that you can demand certified funds or money orders only if the resident has previously given you a check that was returned for non-sufficient funds or that was written on a closed account. Other leases state that you can demand payment by certified funds or money orders at any time. Once you have reviewed the lease, note that if you have not followed your lease and you have accepted a check in the past even when tendered late, the resident can raise the argument of waiver, which means that by you not enforcing the terms of the lease in the past, you may have waived your rights to do so now. In the future, always follow your lease, and have a written office policy under which you can refuse a late payment by personal check. You should set a fixed date for this, so every resident is treated equally.

Dear Harry,We have been receiving complaints from some residents that another resident is using her apartment for short term rentals. Sometimes they see the resident with unfamiliar visitors, other times they do not. We suspected that the resident was renting her entire apartment or a bedroom out to tourists and perused AIRBNB. Sure enough, we found our

resident’s listing where she is renting out her entire apartment or a bedroom only on a daily and weekly basis. We are very close to the attractions and in a desirable location. Our lease strictly prohibits subletting and also states that occupants may only stay there for 72 hours unless we give them written permission. How can we put an end to this? These people are using the pool and tennis courts, and other residents are noticing.

Signed: “Observing Subletting in Orlando” Dear Observing,You need to take action immediately and serve a Seven-Day Notice to Cure, which will clearly cite the resident’s violation of the lease. Always ask your attorney for the proper wording. You should then reexamine the lease agreement and include wording in future lease agreements that clearly prohibits subletting, room renting or renting the apartment in any way like this to tourists. This type of activity is on the rise and will not be stopped unless you take fast action. Enforce your present lease, and if necessary, modify your lease to better address this issue in the future. If you are using the Blue Moon Lease, put the proper wording under the Special Stipulations section until the Blue Moon Lease form gets modified.

Dear Harry,We suspect drug activity is occurring in one of our apartments. People are stopping by at all hours of the day and night for short periods of time. Sometimes the people stopping by have knocked on the wrong resident’s door looking for our problem resident. We called the police, and oddly they do absolutely nothing about it but take our information. Something just does not seem right. Why is law enforcement not doing anything? How can we get this problem resident out?

Dear Dealing,If law enforcement does nothing, as is often the case, you need to evict based upon excessive traffic to and from the unit and the unreasonable disturbances the traffic causes. You will need witnesses who will attend court if an eviction is contested, and possibly video surveillance to make a strong case. Affidavits by other resident are inadmissible hearsay. Your best approach is to confront the resident, tell him what you know, and try to get him to sign an agreement to vacate. Often this will solve the problem, as most drug dealers do not wish to continue business when they become aware that everyone has knowledge of the situation. Often the police are aware of the drug dealing, but they may allow it to go on unabated if it is part of a larger investigation. Many drug dealers are “busted” and allowed to walk free, making deals with the police that they will continue to sell drugs but become a police informant. Unfortunately, they end up moving into your apartment community as they have no police record, and you end up losing good residents due to their activity.

Dear Harry,We just took over a property and are trying to sort out who lives in each apartment. It seems that prior management was extremely sloppy, and we are finding that more occupants are in these apartments than are listed as residents on the lease. It is causing a serious parking problem, as we have limited parking. When we have confronted the residents, they claim that the other occupants have been living there sometimes for over a year, and the prior management company had no problems with this. We can’t tolerate this. We only allow those residents who are on the lease as residents plus minor children as occupants to reside in each apartment. Should we serve seven-day notices for the unauthorized occupants, and if they do not voluntarily move out, begin evictions? We have got to clean this place up. It is a mess.

Signed: “Taking Names in Tavares” Dear Taking Names, There are a couple approaches you can take. If you believe that there are unauthorized occupants residing in an apartment, you want to prepare and serve a Seven-

Day Notice to Cure. While that is the easy part, proving there are indeed unauthorized persons is difficult, and conversely, there is a waiver concern if the unauthorized occupants have been there a long time, and especially problematic if the residents on the lease tried to claim that prior management allowed them to reside there. You want to look at each lease and see how close you are to the ending date of the lease. If close to the end of the lease term, these residents need to be non-renewed in accordance with the terms of your lease. Finally, you may consider implementing a car registration parking tag situation along with assigned parking spaces, and then slowly tow vehicles after proper notice is given, and only as a last resort. Registration and sudden towing of cars that have been parked on your property for months can result in unpleasant and expensive, improper towing claims. Make sure that you have the statutorily compliant towing signs on the property, and carefully review the towing statute to make sure that the size, design and placement of the towing signs are proper.

This article will examine three recent jury verdicts in premises liability matters:

SHAW V OUTBACK STEAKHOUSE, Pinellas County Case No. 12-5561 (Judge Schafer 7/16/15):

Shaw sued Outback when he tripped and fell while walking down the steps. He claimed that there was a dangerous safety strip. He further stated that his heel caught on the quarter-inch raised safety strip that caused him to be propelled two steps into the parking lot.

Outback asserted that the steps were not dangerous and that the trip and fall resulted from Shaw drinking alcohol, taking pain medication and having pre existing vision issues. Outback offered the testimony of an expert who stated that the steps met all building code requirements and the strip was secure. Outback produced evidence that Shaw had taken Hydrocodone (a narcotic pain medication) and consumed four Jack Daniels before the fall. Further, Shaw had a prior

history of vision problems, and was advised by his doctor to use caution while walking. Outback offered an expert toxicologist who opined that Shaw’s judgment and perception would have been impaired at the time of the fall.

As a result of his fall, Shaw sustained a left hip fracture as a result of the fall, necessitating surgery. The jury found no negligence on Outback’s part which was a legal cause of damage to Shaw.

OPPENHEIM VS. NAP, INC„ D/B/A SCOTTI AUTO REPAIR, Palm Beach County Case No. 14-2571 (Judge Jamie Goodman 8/19/15):

Oppenheim slipped and fell in Nap’s garage at its auto repair shop. She asserted that Nap’s was negligent in allowing a dangerous condition to exist on the floor. Nap denied all negligence, and argued that Oppenheim went beyond the area of invitation by walking into the garage work area.

Oppenheim was a 61-year-old female at the time of the fall. She dropped her car off at Nap’s business for repairs. She

parked her car in front of the garage, walked into the work area, and slipped and fell.

Nap argued that Oppenheim ignored an obvious sign posted at the entry to the garage, which prohibited customers from entering the work area, and that there was no evidence of a dangerous condition on the floor. An eye witness stated that she did not see any foreign substance on the floor of the garage after Oppenheim fell.

Nap stated that Oppenheim had made an excellent recovery from her multiple fractures, and that she would not require future surgery if damages were awarded.

Oppenheim suffered a hip fracture, for which a complete hip replacement was performed. She also sustained a wrist fracture which necessitated surgery. There are were also recommendations for future surgery. Medical bills totaled approximately $90,000.

Oppenheim’s attorney asked the jury for a total damage award of $617,140.

Nap argued that it had a reasonable floor inspection and maintenance program in place at the time of the incident. Nap further argued that its policy was to clean spills immediately, but it had no notice of a spill at the time in question. Finally, Nap claimed that Oppenheim failed to watch where she was walking.

The jury found Nap 10% negligent and Oppenheim 90% comparatively negligent. Oppenheim was awarded $120,000 in gross damages, reduced to a net award of $12,000. The award included $90,000 in past medical expenses, and $30,000 in past pain and suffering but no future damages.

DUNLAP V RIDLEY PARK SWIM CLUB, Delaware County PA Case No: 12-9105 (Judge James Proud 3/19/14):

Dunlap was a 70 year old female who was a business invitee at the Ridley Swim club. On the grounds of the Club there was a black locust tree which fell and struck Dunlap. Prior to trial, the owner of the property settled with Dunlap for $350,000. Dunlap continued on with her suit against the Club arguing that the club should have trimmed the branches and should have limited parking near the tree. The Club argued that the tree was visible and they were unaware of it presenting any issue or problem.

As a result of being hit by the tree, Dunlap fractured her hip and knee and had to have surgery.

The jury awarded Dunlap $750,000 against the Club. This was in addition to the $350,000 that Dunlap had recovered against the owner.

CONCLUSION/TAKE AWAY:There are a lot of lessons to be learned by landlords reading about these three verdicts. Watch your steps. Watch your trees. Watch your slippery spots. In short, watch anything that you can repair, replace, fix or clean. Amen.

I hope this finds all of you healthy, safe and in the midst of happy holiday celebrations with family and friends. By the time you settle in to read my scribblings with a cup of eggnog or other festive

beverage, the House and Senate will hopefully have closed the book on the first session of the 114th Congress. They have already successfully passed the first long-term highway bill in a decade and now have only to knock out federal appropriations and tax extenders. No small feat to be sure, but apparently with Paul Ryan now Speaker of the House, the policy world is our oyster.

The final weeks of debate on Federal appropriations spending are a valuable lesson in how large bills get done in our political system. The good news is that the starting premise is that no one – especially Republicans – wants to shut down the government. With that in mind, everyone is willing to negotiate and find the sweet spot on a comprehensive, “omnibus” federal appropriations bill. Republicans want to include policy “riders” to stop several environmental rules promulgated by the Administration as well as toughen vetting standards for Syrian refugees. Democrats want to keep out any anti-Planned Parenthood provisions, fend off anti-immigrant proposals and preserve some of those very same proposed environmental regulations. A rider to stop EPA’s Waters of the United States (WOTUS) proposed rule is in the mix for inclusion in the omnibus. As you know, this rule would be

very, very bad for the apartment industry and we have been working with a large coalition of real estate organizations and others to stop it.

In the tax extenders bill, Democrats want extension, expansion and indexing of several refundable tax credits while Republicans want to make some of their favorite business tax provisions permanent. Moreover, Republicans want to end the 40-year-old ban on exports of domestic oil which Democrats are happy to give them in exchange for extending renewable energy tax credits, more funding for conservation and a bigger child tax credit. Depending on the conclusion of the negotiations, the price tag for the final extenders legislation could be north of $500 billion over 10 years as opposed to $85-plus billion for a simple one-year extension of all of the expiring tax provisions. As I have reported to you before, there are several extenders in play that are of great interest to the apartment industry. These have to do with expensing, energy efficiency benefits and affordable housing. All look to be in good shape for inclusion in the final package, though the jury is still out on what the term of that extension will be.

The issue of gun violence, mental health screening and stricter controls on gun ownership was put back in front of lawmakers by the recent terrorist acts in San Bernardino, California. Though there has been and will continue to be rigorous debate in Congress, it does not appear that any new legislation will be considered before adjournment. There is relevancy to the apartment industry here as owners and operators grapple with how to handle conceal carry, open carry and other laws that allow individuals to possess and carry firearms on their person in public. National firms and local independent owners alike are attempting to strike a balance between respect for legal rights and the safety of their residents. Because Congress is very unlikely to pass any national standards in this area, owners with property across municipal and state boundaries will have to comply with myriad different rules.

Remember to mark your calendars for the 2016 NAA Capitol Conference and Lobby Day which will take place in March in Washington, D.C. NAA has a new and ambitious goal for the event. We’re going to reach every one of the 535 Congressional offices – that’s 435 Representatives and 100 Senators – on Lobby Day on March 9. The Capitol Conference will be held the day before, starting right after lunch with an issues orientation and advocacy training followed by keynote speaker Joe Scarborough, a former member of the House and host of MSNBC’s Morning Joe. While members of the House will be in recess the week of March 7, NAA members can schedule meetings with their important key staff members in Washington and just as importantly schedule meetings with all 100 members of the U.S. Senate, which will be in session. NAA members who aren’t planning to attend the Capitol Conference will help us reach our goal by scheduling meetings or property tours at home with their Representatives that week.

Using our grassroots power is critical to our advocacy efforts on your behalf. Help us help you by coming to Washington and helping to carry our message to Congress.
