Sir,This has reference to your letter dated 9th June, 2014 alongwith project documents including

Form I, Terms of References, Pre-feasibility Report and EINEMP Report regarding above mentioned'4 project.

2.0 The Ministry of Environment, Forests and Climate Change has examined the application. It isnoted that the proposal is for expansion of bulk drug manufacturing unit from 10.5 TPA to 20.1 TPA atPlot No. A1/7 & A1/8, Phase-1, G.I.D.C. Estate, Vapi District Valsad, Gujarat by M/s. AvikPharmaceuticalsLtd. Total plot area is 3392 m2 out of which a total of 560 m2 is allotted for green belt.No additional land will be required for proposed expansion. The total cost of proposed project will beRs. 1.91 Crores out of which Rs.43.00 Lakhs allocated for EHS as capital cost. A budgetary provisionof Rs. 10.68 Lakhs per annum will be made for EHS expenses as recurring cost per annum. RiverDamanganga is flowing at a distance of 1.22 Km. The company shall manufacture anyone of the above mentioned product at a time or In combinationof various products but the quantity shall not increase.beyono 50 kgs/day.

4.0 Adequate stack height will be provided oil and gas fired boiler. Caustic scrubber will beprovided to control process emission viz. HCI. Water requirement from GIDC Water. Supply will beincreased from 27.5 m3/day to 29.4 m3/day after expansion. Total industrial effluent generation will be18.5 m3/day after proposed expansion. Effluent will be segregated into High TDS/COD and LowTDS/COD effluent streams. High TDS/COD effluent stream will be sent to common multiple effectevaporator (MEE) facility for final disposal. Low TDS/COD effluent stream will be treated in the effluenttreatment plant (ETP) and treated effluent will be sent to the CETP inlet through GIDC undergrounddrainage for further treatment after meeting the Standards prescribed by the GPC8. ETP sludge willbe sent to Treatment Storage & Disposal Facility (TSDF) for hazardous waste. Waste oil and usedbatteries will be sold to authorized recyclers/re-processors.

5.0 Public hearing was exempted as per section 7 (i), (iii) Stage (3), Para (i) (b) of EIA Notification,2006.

6.0 All synthetic organic chemical industries located inside the notified industrial estate/area arelisted at S.N. 5(f) under category '8' and appraised at State level. Due to applicability of generalcondition (i.e. interstate boundary within 10 Km and CriticaUy Polluted Area), project proposal istreated as category 'A' project and appraised at Central Level,

7.0 The proposal was considered by the Expert Appraisal Committee (Industry) in its 3rd and 34th

meetings held during s= - 5th December, 2012 and 1th_ 19th February, 2015 respectively. Proponentand the EIA Consultant namely M/s Precitech Laboratories Pvt. Ltd., have presented EIA / EMP reportas per the TOR. EAC has found the EIA / EMP Report and additional information to bessatisfactoryand in full consonance with the presented TORs. The Committee recommended t~ proposal forenvironmental clearance.

8.0 Based on the information submitted by the project proponent, the Ministry of Environment andForests hereby accords environmental clearance to above project under the provisions of EIANotification dated 14th September 2006, subject to the compliance of the following Specific andGeneral Conditions:

A. SPECIFIC CONDITIONS:National Emission Standards for Organic Chemicals Manufacturing Industry issued by theMinistry vide G.S.R. 608(E) dated 21st July, 2010 and amended time to time shall befollowed by the unit.

Stack of adequate height shall be provided to oil and gas fired boiler as per CPCB/GujaratPollution Control Board (GPCB) guidelines.

Caustic scrubber shall be provided to process vent to control HC!. The scrubbing mediashould be sent to effluent treatment plant (ETP) for treatment. Efficiency of scrubber shallbe monitored regularly and maintained properly. At no time, the emission levels shall gobeyond the prescribed standards. Scrubbers vent shall be provided with on-line detectionand alarm system to indicate higher than permissible value of controlled parameters.

Ambient air quality data shall be collected as per NAAQES standards notified by theMinistry vide G.S.R. No. 826(E) dated 16th September, 2009. The levels of PM1Q, S02,NOx, CO, HCI and VOC shall be monitored in the ambient air and displayed at aconvenient location near the main gate of the company and at important public places.Online monitoring for air emission to be installed. The company shall upload the results ofmonitored data on its website simultaneously and same to be sent to the Regional office ofMOEF, the respective Zonal office of CPCB and GPCB. All necessary steps should betaken for monitoring of chlorine and HCI as well as VOCs in the proposed plant.

In plant control measures for checking fugitive emissions from all the vulnerable sourcesshall be provided. Fugitive emissions shall be controlled by providing closed storage,closed handling & conveyance of chemicals/materials, multi cyclone separator and watersprinkling system. Dust suppression system including water sprinkling system shall beprovided at loading and unloading areas to control dust emissions. Fugitive emissions inthe work zone environment, product, raw materials storage area etc. shall be regularlymonitored.

vi) For further control of fugitive emissions, following steps shall be followed:

a) Closed handling system shall be provided for chemicals.

b) Reflux condenser shall be provided over reactor.

c) System of leak detection and repair of pump/pipeline based on preventivemaintenance. .

d) The acids shall be taken from storage tanks to. reactors through closed pipeline.Storage tanks shall be vented through trap receiver and condenser operated on chilledwater.

e) Cathodic protection shall be provided to the underground solvent storage tanks.

vii) The gaseous emissions from DG set shall be dispersed through adequate stack height asper CPCB standards. Acoustic enclosure shall be provided to the DG sets to mitigate thenoise pollution. Ii

viii) Total fresh water requirement from GIDC water supply shall not exceed 29.4 m3/day andprior permission shall be obtained from the Competent Authority. No ground water shall beused.

ix) Total industrial effluent generation shall not exceed 18.5 m3/day. . Effluent will besegregated into High TDS/COD and Low TDS/COD effluent streams. High COD effluentstream will be sent to common MEE facility for final disposal. Low TDS/COD effluentstream will be treated in ETP and treated effluent will be sent to CETP inlet through GIDCunderground drainage. No process effluent shall be discharged in and around the projectsite. Suitable treatment to be given for ammonical nitrogen in the effluent.

x) Treated effluent should be passed through guard pond. Online (24 x 7 monitoring devices)pH meter, flow meter and TOC analyzer should be installed. The data to be made availableto the respective SPCS and in the Company's website.

xi) Process effluent/any wastewater shall not be allowed to mix with storm water. Storm waterdrain shall be passed through guard pond.

xii) The company shall obtain Authorization for collection, storage and disposal of hazardouswaste under the Hazardous Waste (Management, Handling and Trans-SoundaryMovement) Rules, 2008 and amended as on date for management of Hazardous wastesand prior permission from GPCS shall be obtained for disposal of solid / hazardous wastein the TSDF. Measures shall be taken for fire fighting facilities in case of emergency.

xiii) The Company shall strictly comply with the rules and guidelines under Manufacture,Storage and Import of Hazardous Chemicals (MSIHC) Rules, 1989 as amended time totime. All Transportation of Hazardous Chemicals shall be as per the Motor Vehicle Act(MVA), 1989.

xiv) The company shall undertake following waste minimization measures :-

a. Metering and control of quantities of active ingredients to minimize waste.

b. Reuse of by-products from the process as raw materials or as raw material substitutesin other processes.

c. Use of automated filling to minimize spillage.

d. Use of Close Feed system into batchreactors.

e. Venting equipment through vapour recovery system.

f. Use of high pressure hoses for equipment clearing to reduce wastewater generation.

xv) The unit shall make the arrangement for protection of possible fire hazards duringmanufacturing process in material handling. Fire fighting system shall be as per the norms.

xvi) Training shall be imparted to all employees on safety and health aspects of chemicalshandling. Pre-employment and routine periodical medical examinations for all employeesshould be undertaken on regular basis. Training to all employees on handling of chemicalsshould be imparted. Occupational health surveillance of the workers should be done on aregular basis and records maintained as per the Factories Act.

xvii) As proposed, greenbelt should be developed at least 560 m2 area in and around the plantpremises to mitigate the effects of fugitive emissions all around the plant as per the CPCSguidelines in consultation with DFO.

xviii) All the recommendations made in the risk assessment report should ~e satisfactorilyimplemented. ...~

xix) The Company shall submit within three months their policy towards Corporate EnvironmentResponsibility which should inter-alia address (i) Standard operating process/procedure tobeing into focus any infringement/deviation/ violation of environmental or forestnorms/conditions, (ii) Hierarchical system or Administrative order of the Company to dealwith environmental issues and ensuring compliance to the environmental clearanceconditions and (iii) System of reporting of non-compliance/violation environmental norms tothe Board of Directors of the company and/or stakeholders or shareholders.

B. GENERAL CONDITIONS:

i. The project authorities shall strictly adhere to the stipulations made by the Gujarat PollutionControl Board.

No further expansion or modifications in the plant shall be carried out without prior approvalof the Ministry of Environment and Forests. In case of deviations or alterations in theproject proposal from those submitted to this Ministry for clearance, a fresh reference shallbe made to the Ministry to assess the adequacy of conditions imposed and to add additionalenvironmental protection measures required, if any.

The locations of ambient air quality monitoring stations shall be decided in consultationwith the State Pollution Control Board (SPCB) and it shall be ensured that at least onestations is installed in the upwind and downwind direction as well as where maximumground level concentrations are anticipated.

The overall noise levels in and around the plant area shall be kept well within the standardsby providing noise control measures including acoustic hoods, silencers, enclosures etc.on all sources of noise generation. The ambient noise levels shall conform to the standardsprescribed under Environment (Protection) Act, 1986 Rules, 1989 viz. 75 dBA (day time)and 70 dBA (night time).

The Company shall harvest rainwater from the roof tops of the buildings and storm waterdrains to recharge the ground water and use the same water for the process activities ofthe project to conserve fresh water.

Training shall be imparted to all employees on safety and health aspects of chemicalshandling. Pre-employment and routine periodical medical examinations for all employeesshall be undertaken on regular basis. Training to all employees on handling of chemicalsshall be imparted.

Usage of Personnel Protection Equipments (PPEs) by all employees/ workers shall beensured.

viii. The company shall also comply with all the environmental protection measures andsafeguards proposed in the documents submitted to the Ministry. All the recommendationsmade in the EIAlEMP in respect of environmental management, risk mitigation measuresand public hearing relating to the project shall be implemented.

ix. The company shall undertake all relevant measures for improving the socio-economicconditions of the surrounding area. CSR activities shall be undertaken by involving localvillages and administration.

x. The company shall undertake eco-developmental measures including community welfaremeasures in the project area for the overall improvement of the environment.

xi. A separate Environmental Management Cell equipped with full fledged laboratory facilitiesshall be set up to carry out the Environmental Management and Monitoring functions.

As proposed, the company shall earmark sufficient funds towards capital cost andrecurring cost per annum to implement the conditions stipulated by the Ministry ofEnvironment and Forests as well as the State Government along with the implementationschedule for all the conditions stipulated herein. The funds so earmarked for environmentmanagement! pollution control measures shall not be diverted for any other purpose.

xiii. A copy of the clearance letter shall be sent by the project proponent to concernedPanchayat, ZilaParisad/MunicipalCorporation, Urban local Body and the local NGO, if any,from whose suggestions/ representations, if any, were received while processing theproposal.

xiv. The project proponent shall also submit six monthly reports on the status of compliance ofthe stipulated Environmental Clearance conditions including results of monitored data (bothin hard copies as well as bye-mail) to the respective Regional Office of MoEF, therespective Zonal Office of CPCS and the Gujarat Pollution Control Board. A copy ofEnvironmental Clearance and six monthly compliance status report shall be posted on thewebsite of the company.

xv. The environmental statement for each financial year ending 31st March in Form-Vas ismandated shall be submitted to the concerned State Pollution Control Board as prescribedunder the Environment (Protection) Rules, 1986, as amended subsequently, shall also beput on the website of the company along with the status of compliance of environmentalclearance conditions and shall also be sent to the respective Regional Offices of MoEF bye-mail.

The project proponent shall inform the public that the project has been accordedenvironmental clearance by the Ministry and copies of the clearance letter are availablewith the SPCB/Committee and may also be seen at Website of the Ministry atwww.moef.nic.in.This shall be advertised within seven days from the date of issue of theclearance letter, at least in two local newspapers that are widely circulated in the region ofwhich one shall be in the vernacular language of the locality concerned and a copy of thesame shall be forwarded to the concerned Regional Office of the Ministry.

The project authorities shall inform the Regional Office as well as the Ministry, the date offinancial closure and final approval of the project by the concerned authorities and the dateof start of the project.

xvi.

9.0 The Ministry may revoke or suspend the clearance, if implementation of any of the aboveconditions is not satisfactory.

10.0 The Ministry reserves the right to stipulate additional conditions, if found necessary. Thecompany in a time bound manner will implement these conditions.

11.0 The above conditions will be enforced, inter-alia under the provisions of the Water (Prevention &Control of Pollution) Act, 1974, Air (Prevention &. Control of Water Pollution) Act, 1981, theEnvironment (Protection) Act, 1986, Hazardous Waste (Management, Handling and Trans-boundaryMovement) Rules, 2008 and the Public Liability Insurance Act, 1991 alongwith their amendments andrules.
