Neighbor to Neighbor: Living in Marquez Knolls Pacific Palisades

Angeles in 2011 (see

There’s little doubt that the
community of Marquez Knolls added to
the high ranking.
After all, where else do you find
sweeping views of the Pacific Ocean, a
mixture of architecture, and trees of all
species, sizes and shapes?
Yet, even when living in Paradise,
conflicts can and do arise with our
neighbors. Construction—including
remodeling, new structures on properties,
second story additions, as well as trees,
satellite dishes, chimneys, skylights, roof
top decks, solar panels, and air
conditioners that block a neighbor’s view
can not only be decisive but a violation of
Conditions, Covenants and Restrictions
(CC&Rs) in Marquez Knolls.
As a case in point, on a recent
December afternoon, I had the
opportunity to bring two neighbors
together to diplomatically resolve a
concern about trees obstructing one
neighbor’s tranquil view through
MKPOA’s mediation process.
Phase I provided information to all
parties regarding CC&Rs, the rights and
obligations of property owners and their
neighbors. Phase II enters into deliberations if necessary, and Phase III
provides for a verbal view assessment if
Phase II does not bring a resolution or
agreement. The primary objective of
these deliberations is to help the
neighbors to stay out of court and to
continue neighborly relationships. The
courts do look favorably on mediation by
MKPOA. In this specific case, both
neighbors complied by trimming trees,
shaking hands, and agreeing to
cooperative communication.
It is important to note that while
CC&Rs are enforceable in the courts, the
City of Los Angeles considers CC&Rs a
private matter between property owners
and therefore does not consider enforce
them in the building permit process.
That is our goal, to work in a
cooperative way with neighbors to
motivate them to voluntarily comply with
CC&Rs.
Even if you haven’t been affected by
a view issue you should know your tract
number (you can find this with your title records), understand CC&Rs and keep
trees trimmed and communicate with
your neighbors on remodeling plans to
prevent surprises for your neighbors and
yourself.

This 38-page document will give you
information on CC&Rs, Los Angeles
Municipal Code Enforcements, LA City Offices, LAPD and City Council
contacts. It is a section worth reading and
saving for future reference.
MKPOA is here for the 1250 homes
that make up our neighborhood.
However, as a voluntary homeowners
association run by unpaid board
members, we do rely on your annual
contribution of $40 per household or
$100 for businesses located within the
Marquez Knolls boundary.
Your board will continue working to
preserve and maintain this neighborhood
we all call home.

Coyotes (and deer) are a
normal part of the wildlife
population in the canyons of
Marquez Knolls. They roam a
pretty wide area and will hunt
on one area for several weeks
and then move on to greener
pastures and eventually
return.
Residents with small dogs or cats should always be
vigilant and watch their pets when they are outside
and be very cautious about letting them out after
dark.
That said, coyotes are our friends, part of the
wildlife diversity that makes Pacific Palisades a
pleasurable place to live.
Finally, remember never to feed any wild
animals. It makes them lose their natural fear of
humans resulting in a more dangerous animal/human
interaction.
Whoever said it takes more than one person to
move a mountain doesn’t know Marquez Knolls
resident Sam Lagana. For several weeks, he sent
e-mails along with pictures showing how the storm
drain gates, clogged with leaves, (no trash) were
causing flooding on Jacon and Lachman and down
Sunset. Lagana’s tenacity and the wonderful
assistance of City officials got the gates removed
and the safety bars replaced in Marquez Knolls.
As a result of his efforts, the City also removed
other gates in the Palisades to prevent serious
flooding. Our special thanks to Councilmember
Rosendahl and his staff for their assistance.

Marquez Knolls Home Sales 2011 vs. 2010*
As we begin 2012, the lowest-priced available home in Marquez Knolls is currently a 2-bedroom, 2-bath on Livorno being offered at $1,100,000. The highest priced property is a 5-bedroom, 6-bath on Bienveneda being offered at $4,995,000.
There have only been three sales so far this year in the Marquez Knolls area. The lowest sale price so far this year was $1,005,000 for a 2-bedroom, 1.75-bath on Chattanooga Place. The highest sale price so far this year, was $3,400,000 for a 3-bedroom, 3.5-bath on Las Casa Place.

A new Los Angeles City ordinance is now in
effect which could result in fines of up to $1,000
and/or jail of up to six months against the owners
of dogs that bark excessively. The law defines
too much barking as being continuous for 10 minutes or intermittent
for 30 minutes within a three-hour period. The Department of
Animal Services can issue penalties of $250 for the first offense,
$500 for the second and $1,000 for the third infraction. For more

Your homeowners association has a new
resource for all residents. The MKPOA Bulletin
Board is a place to list items for sale, announce
an upcoming charitable event, pet adoptions.
The list will be updated every Monday and an
e-mail will be sent to e-com as a reminder.
Marquez Knolls residents may list personal items under $500,
personal announcements, or community events. Please e-mail
your four-line message to [email protected] (subject to
approval and edit), and your name and address.
Construction-related noise is regulated by the
LAPD’s Noise Enforcement Team (NET).
While there are exceptions to this ordinance
construction is not allowed during these hours:
Between 9:00pm and 7:00am
Saturday: Before 8:00am or after 6:00pm (residential)
Sunday: Prohibited in residential areas
Disturbing the peace and quiet of neighboring residents

The Los Angeles Police Department can issue
a ticket of up to $100 to users of gas powered
leaf blowers. The law went into effect in 1992
and was amended in 1998 to add that these
tools cannot be used within 500 feet of a
residence at any time. Be sure your gardener is using an
electric blower, or you may also be fined.

Our neighborhood is often visited by solicitors—
students selling magazines subscriptions, curb
painters, non-profit organizations, religious
groups. Donating to worthy causes is a personal
choice, however there are many scams—be
cautious. Legitimate non-profit organizations will
have proper licensing and a tax-exempt status as a
charitable group. Before you give them a check or cash, call ACS to have them check their paperwork. If you see suspicious activity
alert LAPD immediately at www.alertcommunity.com. This site
is only viewed by LAPD officers.
