ThisSpecialReportdescribestheactivitiesofbillionaire“philanthropist”GeorgeSorosandhisOpenSocietyFoundationconcerningGuatemala.Soros,hisfoundationandtheiraffiliatespromoteandadvancearadical,progressiveagendathatseekstodestabilizelegitimategovernments,erasenationalbordersandidentities,targetconservativepoliticians,financecivilunrest,subvertinstitutionsofhighereducation,andorchestraterefugeecrisesforpoliticalgain.TheSorosnetworkisengagedinanactiveandongoingefforttoaffectpolitics,economics,andsocietiesacrossLatinAmerica.Guatemala,inparticular,hasbeensubjectedtoanaggressive,insidiouscampaignofsubversionandpoliticalmanipulationthatthreatensthesovereigntyofaconstitutionalrepublicandallyoftheUnitedStates.

TheSorosoperationsarehighlysophisticatedandmulti-faceted,workingacrossacademia;thecourts;laborandagriculture;“socialjustice”organizations;co-optedreligiousassociations;and,ofcourse,politicalgroups.SorosoperationsalsoutilizeU.S.-basednon-profitorganizationstofurthertheiragendainGuatemala.TheU.S.taxpayerisalsofundingSoros’effortsinthecountry.

JudicialWatchwillcontinuetoinvestigateandlitigatetoobtainevidencethatwewillanalyzeaswepursueadditionallinesofinquiryconcerningSorosandtheOpenSocietyFoundation–notjustinGuatemala–butaroundtheworld,inparticular,theUnitedStates.

Summary

In2018,HungarianbillionaireGeorgeSoros’OpenSocietyFoundations(OSF)areprojectedtoexpend$573,000,000ingrantsandprogramfundingthroughouttheworld.WhiletheOSF’sself-professedgoalsofstrengtheningtheruleoflaw,supportingdemocraticallyelectedgovernments,promotingfairnessinpolitical,legal,andeconomicsystems,andsafeguardingfundamentalrightsmayseeminnocuous--orevennoble--therealityisfardifferent.Undertheguiseofphilanthropy,Soros,throughhisweboforganizationsinmorethan40countries,haspromotedaradicalglobalistagendaineverycorneroftheglobe.IntheUnitedStates,thishasincluded:

• PromotinganopenborderwithMexicoandfightingimmigrationenforcementefforts

• Fomentingracialdisharmonybyfundinganti-capitalistblackseparationistorganizations

• FinancingtheBlackLivesMattermovementandotherorganizationsinvolvedintheriotsinFerguson,Missouri

• Weakeningtheintegrityofourelectoralsystems• Promotingtaxpayerfundedabortion-on-demand• Advocatingagovernment-runhealthcaresystem• OpposingU.S.counterterrorismefforts,and• Promotingdubioustransnationalclimatechangeagreementsthatthreaten

Americansovereignty• Workingtopromoteguncontrolanderode2ndAmendmentprotections

DespitetheOpenSocietyFoundations’statusasnon-profitentities,muchoftheirworkintheUnitedStatesishighlypoliticalinnature.TheyhavefundedtheliberalthinktankCenterforAmericanProgress(whichisheadedbyformerHillaryClintoncampaignchairmanJohnPodesta),theAssociationofCommunityOrganizationsforReformNow(ACORN)anditsrelatedentities,andDemocraticvoterturnoutinitiatives.In2003,SorosdescribeddefeatingPresidentGeorgeW.Bushas,“thecentralfocusofmylife,”anddonatedmorethan$15milliontoanti-Bushorganizationsandefforts.iAttheJanuary2018WorldEconomicForuminDavos,Switzerland,SorosattackedPresidentTrumpanddescribedhimasa“dangertotheworld.”ii

Similarly,inEurope,Sorosandhisfoundationshavesoughttoerasenationalbordersandidentities,targetedconservativepoliticians,financedcivilunrest,infiltratedinstitutionsofhighereducation,andorchestratedamassiverefugeecrisisthatwillleavethecontinentforeverchanged.

ThepresidentoftheOpenSocietyFoundations,PatrickGaspard,hasalonghistoryinDemocraticpartypoliticsandcommunityorganizinginsupportofleft-wingcauses.ThisincludedservingasthepoliticaldirectorforACORN’sNewYorkChapter,anorganizerforthesocialistNewParty,andforJesseJackson’s1988presidentialcampaign.HewentontoapositionasthepoliticalvicepresidentofapowerfulServiceEmployeesInternationalUnion(SEIU)chapterinNewYorkandanactivistwiththeACORN-alignedWorkingFamiliesParty.HeservedasthedirectorofPresidentObama’sOfficeofPoliticalAffairsfrom2009to2011andastheexecutivedirectoroftheDemocraticNationalCommitteefrom2011to2013,whenObamaappointedhimtobetheAmbassadortoSouthAfrica.ShortlyaftertherulingAfricanNationalCongressproposedaconstitutionalamendmenttoexpropriatelandfrompredominatelywhitefarmerswithoutcompensation,GaspardsentatweetlaudingSouthAfrica’sconstitutionas“moreinclusive”thanthatoftheUnitedStates.

TheSorosnetworkhasalsobeenengagedinanactiveandongoingefforttoaffectthepolitics,economics,andsocietiesofLatinAmerica.TheOpenSocietyFoundationsareprojectedtospendmorethan$36millionintheregionthisyear,withmostofthefundingdedicatedtohumanrights,justicereform,anddemocracypromotionprojects.iiiThefoundationshavespentmorethan$100millionintheregionsince2015.

TheinterventionoftheOpenSocietyFoundationsinLatinAmericahascoincidedwiththeso-called“pinktide,”theresurgenceofleft-wingleadersthroughoutmuchofLatinAmerica.ThishasincludedtheinstallationofsocialistpresidentsEvoMoralesinBolivia,DanielOrtegainNicaragua,andSalvadorSánchezCeréninElSalvador,aswellasthedisastrousreignsofHugoChávezandNicolasMaduroinVenezuela.

In2007,Guatemalaelecteditsfirstleft-wingpresidentinmorethanhalfacentury,ÁlvaroColom.Afterhiscorruption-plaguedterm,however,Guatemalansrejectedthe“pinktide”trendbyelectingformerGeneralOttoPérez-Molinatothepresidency.In2016,thecountryelectedconservativepopulistJimmyMorales,markingarenewalofconservatismandpro-U.S.sentimentinthecountry.

Concurrentwiththisrevival,GuatemalahasfounditselfincreasinglytargetedbytheSorosnetwork.In2016,Soros’OpenSocietyFoundationsprovidedmorethan$1,000,000toorganizationsthere,andhundredsofthousandsmoretoU.S.-basedorganizationssupportinghisagendainthecountry.RelativetoGDP,OSFsspendmorethantwiceasmuchingrantandprogramfundinginGuatemalathanintheUnitedStates.AsintheUnitedStates,theseprogramsincludefundingliberalmediaoutlets,supportingglobalistpoliticians,advocatingforopenborders,fomentingpublicdiscord,andinfluencingacademicinstitutions.InGuatemala,however,Soros’effortsareenhancedbytwosignificantfactors:theexploitationofallegedatrocitiescommittedduringtheGuatemalanCivilWarforpoliticalpurposes,andaclosealignmentwiththeUnitedNations,which

maintainsacolossalfootprintinthenation.ThesefactorshaveenabletheSorosnetworktoexerttremendousinfluenceoverthepoliticalandjudicialsystemsinGuatemala.

ThisreportwillexaminehowSorosandtheentitieshecontrolshaveadverselyimpactedthenationofGuatemalaandreviewtheorganizationsandprogramsthattheSorosnetworkhasfundedthere.ItwillalsosummarizehowtheOpenSocietyFoundationsareutilizingU.S.-basednon-profitorganizationstofurthertheiragendainGuatemala.Perhapsmostshockingly,itwillreviewtheroleoftheU.S.governmentinusingtaxpayerfundingtosupporttheSoros’effortsininthecountry.

OpenSocietyFoundations’InterferenceinGuatemala’sJudicialSystem

InMay2010,followinganunusuallypublicselectionandvettingprocess,liberalGuatemalanPresidentÁlvaroColomappointedConradoReyestoserveasthecountry’sAttorneyGeneral.Reyes,anattorneywithextensivepublicandprivatesectorexperience,hadbeenendorsedbythedeansofnineGuatemalanlawschoolsandtheChiefofthecountry’sSupremeCourtofJustice.ivDespitethesequalifications,andwithoutpresentinganyevidenceofwrongdoing,UnitedNationsdiplomatCarlosCastresanacriticizedtheappointmentandallegedthatReyeshadtiestocriminalorganizations.vAtthetime,Castresana,aSpanishjurist,wasthedirectoroftheComisiónInternacionalContralaImpunidadenGuatemala(CICIG),anextremelypowerfulU.N.bodydesignedtoinvestigatecorruptionthecountry.Shortlythereafter,Castresanaresignedfromhisposition.

DespitethelackofevidenceandthefactthatnochargeswereeverbroughtagainstReyes,theGuatemalanConstitutionalCourt,bowingtoU.N.pressure,annulledhisappointmentandremovedhimfromthepositionofAttorneyGeneralafteronly17days.Initsruling,thecourtmadenofindingregardingtheallegations,butruledthattheselectionprocess“hadnotfollowedproperprocedure.”

TheOpenSocietyFoundationshavebeenstrongsupportersoftheCICIG.JustweeksbeforeReyes’appointment,CastresanawasafeaturedspeakerattheOSFevententitled,“FightingImpunityinGuatemala:TheExperienceoftheCICIG.”viTheOSFhasalsopublishednumerouspaperslaudingtheworkoftheCICIG,includingonethatpraisesthebodyforitsinterferenceinthecountry’sjudicialsystem:

“Inajudicialelectionprocesswhichproducesintensepoliticalmaneuvering,CICIGhaspublicly,andwithsomesuccess,challengedtheelectionofjudgesunfittoserveonGuatemala’shighestcourts.CICIGintelligenceandadvocacyhasledtothedismissaloftwoattorneysgeneral,andfacilitatedtheappointmentofthecountry’smostreform-mindedchiefprosecutorinageneration.”vii

The“reform-mindedprosecutor”thattheOpenSocietyFoundationcreditstheUnitedNationswithbringingtopowerwasClaudiaPazyPaz,whoassumedthepositionofAttorneyGeneralafterReyes’removal.Inabreakwithtradition,PazyPaz’appointmentwasnotableforitspoliticalnature.AsjournalistandGuatemalaexpertSteveHechtnoted,“Unlikeherpredecessor,whosecredentialshadbeenfreeofpartisanship,PazyPazwasqualifiedbyherpoliticalassociations.ShewasespeciallyknownandlikedforherworkwiththeUnitedNationsandothertransnationalorganizations.Shecametotheofficewithafirmagenda.”viiiIntheassessmentofGuatemalanattorneyMoisesGalindo,“Sheistheattorneygeneralbylaw,butshedidnotgettherelegitimately.ItwasafraudulentmaneuverbytheUNcommission,whichpushedGuatemala’sinstitutionstoremovethepriorattorneygeneral.Then,undertheumbrellaofthesameUNcommission,hersupportersincivilsocietypropelledherintooffice.”ix

PazyPaz’appointmentwasclearlyasuccessfuleffortbytheUnitedNationstoinstall“oneoftheirown”inthepositionofAttorneyGeneral.ShehadpreviouslyservedastheNationalConsultanttotheUnitedNationsMissioninGuatemalaandhasanextensivebackgroundinhumanrightsissues.xIn1994,shefoundedtheInstituteforComparativeCriminalStudiesofGuatemala(ICCPG),ahumanrightsorganizationthathasreceivedfundingfromtheOpenSocietyFoundations.xi

PazyPaztenureasAttorneyGeneralisbestknownforherprosecutionofformerGuatemalanPresidentandArmyGeneralEfraínRíos-Monttandothermilitaryofficialsforallegedhumanrightsviolationscommittedduringthecountry’scivilwar.DespitethefactthatGuatemalahadtheworld’sfifth-highesthomiciderate,whenshetookofficexii,PazyPazfocusedmuchofheroffice’seffortsontheprosecutionof86-yearoldRíos-Monttforcrimescommitted30yearsearlierduringthegovernment’seffortstosuppressaMarxistrebellion.

Ríos-MonttwasconvictedofgenocideandcrimesagainsthumanityinMay2013;however,theverdictwasannulledbytheGuatemalanConstitutionCourttendayslater.Anewtrialhasbeenpostponedduetohisageanddeclininghealth.

TheOpenSocietyFoundationshavereportedextensivelyontheRíos-Montttrial.Asdetailedbelow,theyhavealsodonatedhundredsofthousandsofdollarstonon-governmentalorganizationsworkingtosupporttheprosecutionsofRíos-Monttandotherformermilitaryofficials.xiii

OnDecember15,2011,PazyPazwasoneoffourwomenhonoredbythen-SecretaryofStateHillaryClintonattheInternationalCrisisGroup’s“InPursuitofPeace”awardsdinner.xivTheInternationalCrisisGroupisheavilyfundedbytheOpen

OnOctober13,2015,U.S.AmbassadortotheUnitedNationsSamanthaPowerspokeatanOpenSocietyFoundationseventhonoringClaudiaPazyPazandJudgeYassmínBarrios,thepresidingjudgeintheRíos-Monttgenocidetrial.HerjudicialauthoritywaslatersuspendedforoneyearpursuanttoamisconductcomplaintfiledbyoneofRíos-Montt’sattorneys.

In2015,PazyPazpublishedabook,TransformingJusticeinGuatemala:StrategiesandChallengesInvestigatingViolentDeaths,thatwasfundedbytheOpenSocietyFoundation.xixIn2016,shewasappointedaSeniorFellowattheWashingtonOfficeonLatinAmerica(WOLA),xxahumanrightsadvocacyorganizationthatreceivednearly$1millioningrantfundingfromtheOpenSocietyFoundationsin2016.xxiByitsownaccount,“WOLAwasinstrumentalinthecreationoftheInternationalCommissionagainstImpunityinGuatemala(CICIG).”xxii

WOLA,oneofthemoreinfluentialactivistgroupsoperatinginGuatemala,iscloselytiedtoboththeSorosnetworkandtheUnitedStatesGovernment.RobertVarenik,theDirectorofOpenSociety’sJusticeInitiative,alsoservesonWOLA’sboardofdirectors.xxiiiTheformerExecutiveDirectorofWOLA,Dr.GeorgeVickers,leftthatpositiontobecometheSeniorPolicyAnalystforLatinAmericawiththeOpenSocietyPolicyCenter(Soros’(c)(4)entity).xxivVickersisalsoontheboardoftheEast-WestManagementInstitute,anotherSoros-fundedproject.xxv

DuringtheObamaadministration,then-WOLAexecutivedirectorJoyOlsonvisitedwithWhiteHouseofficialsonapproximately20occasions.TheseincludedprivatemeetingswithformerNSCSouthAmericaDirectorBenjaminGedanandWhiteHouseDomesticPolicyCouncilDirectorCeciliaMuñoz,aswellastwomeetingswiththeNationalSecurityCouncilWesternHemisphereAffairsDirectorDanRestrepo.WOLAProjectDirectorandheadoftheorganization’sCubaProjectGeoffThalevisitedtheObamaWhiteHouse10times.Mostnotably,hemetwithformerNSCofficialMarkFeiersteininJune2015(justacoupleofweeksbeforeObama’sannouncementofreopeningdiplomaticrelationswithCuba).Feierstein’sprofessionalbiographynotesthat,“hehelpedimplementthepresident’snormalizationpolicytowardCuba”.xxvi

WOLAhasactivelylobbiedforweakenedimmigrationenforcementandhasbeenparticularlycriticaloftheproposedborderwall.xxviiIthasalsosupportedendingtheeconomicsanctionsagainsttheCastroregime.xxviii

WOLAhassupportedtheworkoftheCICIGinGuatemala,includingparticipatinginasocialmediacampaigntoimprovepublicperceptionofthebodyamongGuatemalans.xxix

ComisiónInternacionalContralaImpunidadenGuatemala(CICIG)

TheUnitedNations’InternationalCommissionAgainstImpunityinGuatemala(CICIG)wasestablishedin2007viaatreatybetweentheRepublicofGuatemalaandtheU.N.Itwascreatedinresponsetohistorical,endemiccorruptioninGuatemala’sgovernmentalinstitutionswiththefollowingobjectives:

• TohelptheStatetodisbandclandestinesecuritystructuresandillegalsecuritygroups,andpromotetheinvestigation,criminalprosecutionandpunishmentofthecrimescommittedbythemembersofsuchgroups.

• TomakerecommendationstotheStateofGuatemalaregardingpublicpoliciestobeadopted—includingthenecessaryjudicialandinstitutionalreforms—toeradicateandpreventthere-emergenceofclandestinesecuritystructuresandillegalsecurityforces.xxx

WhiletheCICIGhassuccessfullyinvestigatednumerouscasesofofficialcorruptionintheGuatemalangovernment,ithasalsobeenwidelycriticizedforexceedingitsmandatebyexertingagreatdealofinfluenceinGuatemalanpolitics.In2015,aCICIGinvestigationledtotheremovalandarrestofPresidentOttoPerez-Molinaforhisinvolvementinacustomsservicebriberyscheme.In2016,thebodyaccusedconservativeGuatemalanPresidentJimmyMorales’brotherandsonwithaschemetodefraudthegovernment.xxxi

In2017,theCICIGannouncedthatitwasinvestigatingPresidentMoralesforallegedcampaignfinanceviolations.InAugust2017,inresponsetotheCICIG’sincreasinglypoliticalactivities,PresidentMoralesorderedtheexpulsionofCICIGdirectorandformerColombianprosecutorIvanVelasquez.DespitesignificantpublicsupportfortheousterofVelasquez,theGuatemalanConstitutionalCourtimmediatelyblockedMorales’order,contraveningtherightofsovereignnationstoexpelforeigndiplomatsundertheViennaConventiononDiplomaticRelations.xxxii

Despitethecontroversy,theUnitedStatesgovernmentcontinuestostronglysupporttheworkoftheCICIG.xxxiiiIn2015,formerVicePresidentJoeBidenthreatenedtowithholdforeignaidtoGuatemalaiftheCICIG’smandatewerenotextended.xxxivInaFebruary2018speech,formerSecretaryofStateRexTillersonstatedthattheTrumpadministration,“continue[s]tosupporttheCICIG–aUNbodycreatedin2006–toupholdtheruleoflaw,strengthenaccountability,andindependentlyinvestigateillegal,corruptactivityaffectinggovernmentinstitutions.”TheyarejoinedbyGeorgeSoros,whoseOpenSocietyFoundationsdescribedtheCICIGas,“apotentialmodelforotherstates.”xxxv

SincetheformalendingoftheGuatemala’s36-yearcivilwarinDecember1996,politicalstabilityinthecountryhasbeenelusive.Threeofthesixpresidentselectedsincethesigningofthepeaceaccordshavebeenarrestedoncorruption-relatedcharges,ashavecountlessothergovernmentofficials.Corruptionandotherendemicproblemswithinthecountry’ssecurityapparatushavecontributedtoaprecariouspublicsafetysituationandengenderedcrediblefearsofGuatemaladevolvingintoa“narco-state.”Thejudiciaryhasbeensimilarlyafflicted.In2017,SupremeCourtjusticeBlancaStallingwasarrestedonofficialcorruptioncharges.HectorTrujillo,aformerjusticeonthecountry’sConstitutionalCourt,wasconvictedlastyearforchargesrelatedtotheFIFAbriberyscandal.

Dueinlargeparttothecitizenry’sfrustrationwithendemiccorruptionperpetratedbythecountry’spoliticalelite,GuatemalanselectedpoliticalneophyteJimmyMoralestothepresidencyin2015withnearly70percentofthevote.Hiscampaignslogan,“neithercorrupt,norathief,”reflectedhiscommitmenttoaddressthepervasivecultureofcorruption.Morales,aconservative,hasalsosoughttoincreaseprivateinvestmentinGuatemalaandimprovebilateralrelationswiththeUnitedStates.
