An Introduction to the Settlement Industry in Jerusalem In view of the continued policy of illegal settlement expansion throughout Palestinian Jerusalem, Grassroots Jerusalem is calling for a renewed look at the deliberate violation of international law and profiteering being pursued by numerous international businesses operating in Palestine. While the issue of settlement profiteering has been widely publicised in the West Bank, Jerusalem is often overlooked in this examination. Jerusalem is the largest Palestinian metropolitan city and the capital of Palestine. There are over 200,000 illegal settlers living in 11 settlements in the middle of Palestinian neighbourhoods and villages of Jerusalem.

In Palestinian neighbourhoods and villages, municipal planning priorities deny development and basic services such as waste management, proper drainage/sewage, and road upkeep. Throughout the decades of occupation since 1967, infrastructure, education, and economic development have been drastically limited in the Palestinian communities of Jerusalem. Since the 1967 occupation, no new master plans for Palestinian neighbourhoods have been created, causing an almost five-decade freeze in any development in Palestinian Jerusalem. Thousands of families have lost their homes to demolition and theft.

Meanwhile, during this period, large settlement neighbourhoods such as Gilo, Ramot, East Talpiot, Pisgat Ze’ev, Neve Ya’aqov, and Har Homa were prioritised for swift development on occupied lands. Development over the decades includes new infrastructure, roads and streets, schools, community centres, parks, swimming pools, and shopping centres. The economy in the settlements functions in line with the mainstream Israeli economy, and in fact, they are one and the same. Israeli and multinational corporations such as the Egged transportation bus company, together with the French Veolia public transportation, connect settler residents to the centre of town as regularly as any other neighbourhood. Additionally, the light rail train in Jerusalem, operated by the company Citypass, provides services to settlements. A UN Human Rights Council resolution was passed in 2010 condemning the operation of the light rail between West and East Jerusalem as a violation of international law and UN resolutions. Furthermore, investment in private security companies reaches multi-million shekel amounts for each of the settlement enclaves. This economic development focuses on benefiting settlements, usually to the detriment of Palestinian residents.

Currently, 75 per cent of Palestinians in Jerusalem live under the poverty line. The workforce in the suburbs is severed from the Central Business District of the largest Palestinian metropolitan area by an eight metre high wall. Over 5,000 businesses have shut down over the last decade. Gradual mass displacement in Jerusalem has been a bureaucratic method of ethnic cleansing since the 1948 occupation when over half the city’s Palestinian population was forced out of their homes. Today, over 200,000 settlers live on stolen Palestinian land in Jerusalem. Over the past five decades, the Israeli priority has been to develop Israeli neighbourhoods as much and as fast as possible. Billions of dollars are invested in settlement expansion and industry.

Grassroots Jerusalem is calling on the international community to take action against the businesses profiting off of settlement construction and expansion. The information enclosed in this package contains the tools needed to facilitate direct action against these businesses. Business profiles and templates for petitions are provided to assist citizens in petitioning their governments to take action against the illegal businesses based in their home countries and operating in settlements in Palestinian Jerusalem.

Settlement Business Profiles

Alstom

The French-based multinational corporation Alstom is among the world’s most important suppliers of high-speed transport infrastructure, maintenance equipment, and global rail systems. It operates projects worldwide and in 2012 achieved 19 billion Euros in revenue and a net profit of 744 million Euros.1 As such, it also involved in the Jerusalem light rail project. The company supplied the project with 46 trains. Although the corporation sold its stake in the Citypass consortium running the project, they continue to hold shares of EPC and Citadis Israel.2 At the end of March 2013 Alstom won their case in front of the French court of appeal, in which the company was charged with the breach of international law. Recently the company made headlines by facing allegations of bribery spanning several countries worldwide. According to the Financial Times, it has already faced investigations by US (most recently), UK, French and Swiss authorities regarding cases of bribery.3 Charges also came up in a number of other countries such as: South Africa,4 Sambia,5 Brazil,6 and Algeria.7 According to the Swiss corporate watchdog-organisation Public Eye: "The frequency of known cases is such that one wonders if this is a deliberate business strategy.”8 Alstom’s top five shareholders are Aperio Group LLC, Parametric Portfolio Associates, United Financial INC, Indpeendent Portfolio Consultants INC, Sterling Capital Management LLC . Activities The Israel Light Rail project (ILR) aims to connect the settlements in East Jerusalem to the city centre. It therefore serves to cut off Palestinian Jerusalem from its natural connection with the rest of the West Bank and irreversibly annex occupied territory. As such it constitutes a breach of international law and possibly a war crime. Caterpillar

Caterpillar is a US-based company specializing in heavy building machinery. In 2012 the company had a revenue of 66 Billion Dollars and a net income of 8,6 Billion Dollars11. Activities House Demolitions Caterpillar equipment has been and is being used in house demolitions in Palestinian Jerusalem, as well as other places in the OPT. The Israeli company Zoko enterprises represents Caterpillar in Israel, it is also responsible for upgrading Caterpillar vehicles for military use (armouring them).12 Since the beginning of the occupation Israel has destroyed more than 18,000 Palestinian homes in the OPT.13 While some of these demolitions are punitive measures against the families of individuals involved in armed actions against Israel (and therefore constitute the crime of collective punishment14) or serve the purpose of "clearing territory" for military measures,15 in other cases and specifically so in Palestinian Jerusalem, house demolitions are employed against illegally built structures. The existence of the latter is mostly due to the fact that Israel pursues a discriminatory policy regarding the issuance of housing permits, which often leaves Palestinian families with no other possibility other than to build illegally.16 In more than a few cases houses were bulldozed with residents still inside or with indiscriminate destruction wreaked on local communities through bulldozing actions for alleged military purposes. A high-profile incident occurred during the "Operation Defensive Shield" operation of the Israeli army in Jenin in 2002.17 One of the drivers of a D9 bulldozer talked about his experiences afterwards:

"For three days I just erased and erased. The entire area. I took down any house from which there was shooting. To take it down, I would take down several more. The soldiers warned with a speaker, that the tenants must leave before I come in, but I did not give anyone a chance. I did not wait…. I would give a house the hardest push, so it would fall as fast as possible… Others may have been more restrained. Or they say the have. Don’t believe their stories… There were many people in the houses we started to destroy… I did not see a house fall on a live person. But if there was such a case, I don’t give a damn. I’m sure that people died in these houses, but it was hard to see, there were tons of dust and we worked a lot at night. I enjoyed seeing each house fall, because I knew that they don’t mind dying, but a house hurts them more… If something hurts me, it’s that we did not erase the entire camp.”18

Israel mainly uses Caterpillars D9 and D10 bulldozers for house demolitions.19 The company is well aware of the use of its products and the board of director repeatedly and unanimously came out against divestment from Israel when conscious shareholders raised the issue20.

An Armoured D9 Bulldozer21 The Tel Aviv Jerusalem High Speed Train The Tel Aviv Jerusalem High Speed train project was originally conceived in 1996. It is supposed to connect the two cities via a bi-hourly train line, which will be running partly through occupied territory. Part of the train line will cross the Latrun Enclave close to the illegal settlement of Horon,22 as well as, intrude into the OPT north of Mevasseret Zion.

G4S

Group 4 Securicor (formerly Group 4 Falck) is a corporation that provides private security services worldwide in over 125 countries. It is located in the UK. In 2011 G4S had 7.5 billion pounds in revenue and a net profit of 198 million pounds.24 Through its Israeli subsidiary Hashmira, G4S works in various sectors directly related to the Israeli system of occupation. G4S’s prominent shareholders include Invesco (15.03%), Prudential (6.33%), Tweedy Brown LLC (5.06%), William H Gates III (3.2%). Activities Al Mascobiyya (Russian Compound) Detention Centre The Russian Compound is a detention centre located in the centre of Jerusalem. Originally under jurisdiction of the Jerusalem Police it was transferred in 2007 to the Israeli Prison service.25 Several human rights organisations among them the Public Committee Against Torture in Israel, Amnesty International, and B'Tselem have documented countless instances of torture in this particular facility. The forms of torture documented involved: Being shackled in painful positions for hours, being beaten, verbally abused, threatened (including the threat of harming family members) and other forms of torture. Often prisoners were also denied access to their lawyers.26 Furthermore Palestinian detainees (which include child detainees27) suffer from being incarcerated in unsafe, unhygienic and overcrowded conditions in the Russian Compound.28 G4S supplies this facility with security systems and the equipment for the central control room, this includes "computerized control and monitoring systems, entrance and visitation control systems, control rooms with touch screens, internal and external CCTV monitoring and recording systems and optic fibre communication lines.”29 Ofer Prison The Ofer compound is a prison for Palestinian political prisoners located close to Ramallah. It also includes a military court whose jurisdiction only applies to Palestinian residents of the OPT. In these courts only 0,29% of all defendants are found not guilty, sentenced by judges which are themselves military officers. Adequate access to lawyers is regularly denied, so is the possibility for families of the detainees to attend court proceedings. Verdicts are often reached based on "confessions" extracted through torture30. G4S provided the compound with a perimeter defence system and central command room for surveillance31. Checkpoint 300 // Qalandiya Checkpoint Both checkpoint 300 and Qalandiya checkpoint are located well within the OPT. Both checkpoints are incorporated into the separation wall, which de facto annexes large swaths of Palestinian territory to Israel. It separates Palestinian framers from their lands, has a devastating effect on the

Palestinian economy and severely infringes on the right to free movement of the Palestinians often making the daily way to work an hours long ordeal. Many communities in and around Jerusalem are severed from their natural social and economical connection to Jerusalem. Others (for example the Shufat Refugee Camp) are becoming completely isolated enclaves. G4S supplies these checkpoints with luggage and full body scanning devices.

The Israeli Police Headquarters G4S also provides security equipment for the Israeli police headquarters in the Westbank which are located in the E1 area East of Jerusalem. This area is considered to be of vital strategic interest for the Israeli settlement schemes since it constitutes the potential link between Ma'ale Adumim and the East Jerusalem settlements. In November 2012 the Israeli government announced the erection of 3000 new housing units in this area33. The Police headquarters in this area are part of the Israeli land-grapping scheme that will serve to seal off Jerusalem even further from the Westbank making the realization of a workable two-state settlement increasingly unlikely. Further Developments In 2011 G4S Israel has won the tender to build a training center for the Israeli police in Beit Shemesh. The tender includes design, construction, management, operation, maintenance, provision of training.34 According to the Financial Times, G4S plans to quit its involvement in the Ofer prison, the Qalandiya and 300 checkpoints and the West Bank police headquarters by 2015. There are, however, no immediate plans to divest from Israel altogether.35

REMAX

Remax is an international real estate agency network. It is the number one seller of real estate in the US36 and the biggest real estate company in the world, working in more than 87 countries through its franchise system. Remax also rents and sells real estate in all major settlements in the OPT. It runs offices in the West Bank settlements of Ma'ale Adumim, Pisgat Ze'ev, Ramot, and the French Hill.37 Remax is owned by Bernard Raskin & Pengold Holdings (Israeli franchise), David & Gail Lingier (international company). Israeli Settlements in the OPT Jerusalem is surrounded by concentric rings of Israeli settlements, which serve to cut off Palestinian Jerusalem from its natural connection with the rest of the West Bank and irreversibly annex occupied territory. Its main strategic objective is to make it possible for any part of Jerusalem to become part of a Palestinian state in any future settlement. Jerusalem, however, has always been the social, economic, and cultural centre of the West Bank, organically linked with both Ramallah in the North and Bethlehem in the South, and is the capital of Palestine. Therefore, the policies to which Remax is an accomplice actively serve to undermine and make impossible any settlement of the conflict that is based on democracy, equality, and international law. The Israeli settlement policy constitutes a breach of international law and possibly a war crime. Toyota

Toyota is a Japanese based manufacturer of automobiles. In 2012 Toyota’s revenue totalled 226 billion dollars and ended the year with a net income of 3,45 million dollars.40 Activities Vehicles for the Israeli army and Police Toyota supplies the Israeli army with various vehicles, most prominently the Toyota "Hilux" and "Camry" models, which are also being used against unarmed protesters in the Occupied Palestinian Territory. Veolia

Veolia is a French multinational company working in waste management and transport services. In the year 2012 the company’s revenue totalled 29.4 billion euros and ended the year with a net income of 530 million euros.45 It has operations in 27 countries including Australia, UK, the Netherlands, Germany, and USA and is owned by Veolia Environment, Caisse des Depots et Consignations. Activities The Jerusalem Light Rail Apart from providing services to the Israeli Ministry of Defence, Veolia, through its subsidiary Transdev, also holds a five per cent share in the Citypass consortium, which built the Jerusalem light rail.46 The Israel Light Rail project (ILR) aims to connect the settlements in Palestinian Jerusalem to the city centre. It therefore serves to cut off Palestinian Jerusalem from its natural connection with the rest of the West Bank and irreversibly annex occupied territory. As such it constitutes a breach of international law and possibly a war crime. The International Court of Justice has, in its 2004 Advisory Opinion on the "Legal consequences of the Construction of a Wall in the Occupied Palestinian Territory", clearly stipulated that: "those settlements have been established in breach of international law."47 Furthermore Israel’s settlement policy constitutes a breach of Article 49 of the Fourth Geneva Convention, which determines that: "The Occupying Power shall not deport or transfer parts of its own civilian population into the territory it occupies.”48 Although the company has announced selling its share of Citypass to Egged, no such transfer has occurred as of yet.49

Road 443: "Apartheid Road" Road 443 links the settlements of Modi'in with Jerusalem and the other settlements in the occupied West Bank. The road was established by expropriating thousands of dunums of private and public Palestinian land. An action legalised by the Israeli High court argued that the highway would also serve the needs of the Palestinian population. However, Palestinians were banned from using the road at the start of the second Intifada in 2002. Road 443 has traditionally been a main traffic artery connecting Ramallah with its environs in the area. Israel reacted to this by building several "fabric of life" roads. These however are far longer and of inferior quality compared to Road 443. In December 2012, the Supreme ordered the army to lift the total ban of Palestinian travel on Road 443. Lacking precise instructions to the army as to how to implement the new policy, the verdict was quickly rendered meaningless. The army allowed Palestinians limited use of the road for travel between villages in the area, but the road remains inaccessible for travel to Ramallah, which was traditionally its main function.50 The Tovlan Landfill Veolia operates the Tovlan Landfill in the occupied Jordan valley. The state of Israel has confiscated private and public Palestinian lands in order to establish the landfill; an action that contradicts international law, since Israel expropriated occupied territory for the sole use of its own population and misuses Palestinian lands as a garbage dump. Garbage from the nearby settlements as well as from within Israel is dumped there. The United Nations General Assembly has, in 2011, explicitly reaffirmed the illegality of theses practises and called on Israel: "to cease all actions harming the environment, including the dumping of all kinds of waste materials in the Occupied Palestinian Territory [...].”51 Although Veolia has apparently sold the landfill to the nearby settlement of Madua, it is still active in operating it. Volvo

Volvo is a Swedish company manufacturing cars, buses and civil engineering equipment. In 2012 the Volvo Group had revenue of 47 billion dollars and a net income of 1,7 billion dollars.54 Activities Volvo owns 27 per cent of Merkavim, an Israeli company manufacturing buses, which are being used both to transport Palestinian political prisoners, as well as on routes connecting settlements in the West Bank with Israel proper.55 Furthermore, Volvo bulldozers and trucks are being used in House demolitions and in the construction of illegal Israeli settlements, as well as the Separation Wall. Cape Gate

Cape Gate is a group of companies based in South Africa that manufactures steel and wire products including fencing, barbed wire and construction materials. Previously owned by Mendel Kaplan, an Israeli citizen and philanthropist, the group is now chaired by Nathan Friedman.59 Financial information for the year 2012/13 is not available. Activities The Cape Group owns the company Yehuda Welded Mesh, which has eight plants in Israel. YWM is alleged to have supplied fencing for the Separation Wall in the area around Jerusalem, provided materials to the Jerusalem Light Rail compound, and involved in construction in the settlements of Pisgat Ze’ev, Beit Horon, Kedar, and Ramat Shlomo in the Jerusalem area. Elsewhere YWM has also supplied fencing for the wall around the Gaza Strip, the seam line expanse separation project in the Mahola junction area (Gilbo’a), for the Cross Shomron road to the settlement of Ariel, and the tunnels road connecting Gush Etzion and Jerusalem. Cemex

Founded in Mexico in 1906 and owned by Lorenzo H. Zambrano (CEO), Cemex is one of the world’s largest building materials suppliers and cement producers. The company now operates in over 50 countries around the world spanning North America, the Caribbean, South America, Europe, Asia and Africa61. In 2012 the company reported a revenue of ~197 billion Mexican Pesos (~16 billion US Dollars) and a net income of ~1.2 billion Pesos (~944 million US-Dollars).62 Activities Cemex subsidiary Readymix Industries has supplied materials used in the construction of the Jerusalem Light Rail project, connecting Jerusalem to surrounding settlements.63 It has plants in a number of settlements in the West Bank and Golan Heights including Mevo Horon, Atarot, Ariel, Mishor Edomim and Katzerin and has provided material for the construction of settlements outposts and checkpoints in the occupied territories. Its Israeli subsidiary Readymix operates a plant in the Atarot Industrial Zone. The Tahal Group is an Israeli engineering and construction company. It specialises in wastewater treatment. The Dutch investment group Kardan NV owns Tahal. In 2012 Kardan had revenue of 383 million dollar and a net income of 138 million dollars.66 The Thahal Group has a global presence, principally in East and Central Europe, Asia, Africa, Central and South America and the Mediterranean Basin. Metrontario Group

The Metrontario Group is a Canadian real estate investment company. Activities The group is involved in construction work in illegal Israeli settlements in the OPT. Its subsidiary CIM Lustigman is currently involved in a housing project in the new settlement of Giv'at Yael. In the past it has constructed housing units in the French Hill, Har Homa, Ma'ale Adumim and the Israeli police station in the E1-Area.68 The Givat Yael Plan According to planning schemes the new settlement of Givat Yael is supposed to stretch from the Jerusalem neighbourhood of Malha toward the Palestinian Village of Al-Walajeh. The plan contains the building of 14.000 residential units. The plan would further isolate Al-Walajeh from the rest of the West Bank, while strengthening Israel's territorial contiguity with the Gush Etzion settlement bloc. Conclusion As our report shows, there are a large number of companies across a range of sectors that are heavily invested in occupied Jerusalem. The impact of this investment is significant: it directly contributes to the isolation of Palestinian neighbourhoods, the demolition of Palestinian homes, the exploitation of Palestinian resources and the underdevelopment of the Palestinian economy. It has been argued that if companies withdrew their investment Palestinians would suffer, in terms of lost jobs and services. But in the longer term, the occupation of Jerusalem can only harm the Palestinian economy and compromise Jerusalem’s position as the economic and political capital of a future state. Grassroots Jerusalem is therefore calling on:

Appendix B: Direct Action Advocacy Guide Every single person can make a difference through his/her contribution. Take action and call on your respective governments, the EU and the companies themselves to end the countless violations of international and humanitarian law that they either perpetrate themselves or help to perpetrate by idly standing by when Palestinian human rights are violated. Call upon: The companies themselves: - To end business practices which violate international and humanitarian law. Write letters of complaint, e-mail or phone those companies under the addresses given in the body of this report and remind them that they are profiting from the Israeli occupation of Palestinian land. The Governments of France, the UK, the USA, Japan, Sweden, South Africa, Mexico and Canada - To insure that companies which are subject to the respective national jurisdiction uphold and respect the principles of international law, as determined in legally binding treaties and conventions to which the respective states themselves are a signatory. The US government: - To divest from projects being run by General Mills, Remax and Caterpillar. The Canadian Government: - To divest from existing projects with the Metrontario Group The Dutch Government: - To take into consideration the position of the national public prosecutor on the issue of Dutch companies involved in illegal Israeli settlements: "Persons and legal entities within the Dutch Jurisdiction are required not in any way to be involved in, or contribute to, possible violations of the Geneva convention or other rules of the International Humanitarian Law. They are also required to take decisions of authoritative international bodies and judicial institutions such as the International Court of Justice about the status, legitimacy and consequences of the barrier extremely serious.”73 - To take into consideration that the crimes to which the Tahal group is an accomplice also constitute offenses under Dutch domestic law. The European Union: - To act in accordance with those principles of international law most recently upheld by the EU in its "Guidelines on the eligibility of Israeli entities and their activities in the territories occupied by Israel since June 1967 for grants, prizes and financial instruments funded by the EU from 2014 onwards", which reaffirm the: "non-recognition by the EU of Israel’s sovereignty over the territories occupied by Israel since June 1967.79" - To consider, especially with regard to the award of public works contracts, the EU's own regulation in this regard, which clearly stipulate that: "Any economic operator may be excluded from participation in a contract where that economic operator [...] has been guilty of grave professional misconduct proven by any means which the contracting authorities can demonstrate80" Use your power as a shareholder: - To demand an end to the illegal business practices of theses companies.
