ABOUT UNITEDWORLD SCHOOL OF LAW, KARNAVATI UNIVERSITY

Unitedworld School of Law is a statutory institute established by Unitedworld Group amidst lush

green environment near Gandhinagar. The institute is recognized by the Bar Council of India and it

is constituent college of Karnavati University. Prior 2017, we offered degree courses affiliated with

Gujarat University (State University). The institute also functions as a nodal agency to uplift

education in Gujarat. We firmly believe “Knowledge is power”. Our vision is to impart legal

education with the aim of percolating constitutional values in the students of Law, to constantly

work for the betterment of the nation through legal education and to effectively contribute and

strengthen justice delivery system, making law, implementing law and interpreting law in India.

UWSL offers interdisciplinary law courses namely, BB.A. LL.B. (Hons.) with various specialization

like IPR, Business Law, Criminal Law, International Law, LL.M. as well as doctoral programmes.

ABOUT KARNAVATI UNIVERSITY MOOT COURT COMPETITION

Unitedworld School of Law, Karnavati University has a vibrant and active mooting culture, with a

student population of roughly 400 students. The Karnavati University Moot Court Society

(KUMCS) is a student run committee under the guidance of faculty Advisors, which seeks to

channelize the students on the mooting path. KUMCS aims at providing opportunities to hone

Research, Argumentation and Legal Drafting Skills and other essential prowess to mould an

individual into an adept mooter. In order to achieve this objective, the KUMCS has organized

various events like Memo-Pundits for enhancing drafting skills, Intra Moot competitions to nurture

drafting and argumentation skills, National Client Counselling Competition etc.

ABOUT ‘CENTRE FOR ADVANCED RESEARCH IN CONSTITUTIONAL LAW

(CARCL)’:

The Centre aspires to promote advanced research in the domain of Constitutional Law, publicpolicy

and democratic governance.

CARCL strongly believe that teaching of Constitutional Law has to be complimented with debates,

quizzes, panel discussions, conferences, seminars and research about its application by all the three

organs of the State- Legislature, Executive and the Judiciary. We also look at the dynamics of

Constitutional Governance from the political prism because most of the Constitutional Law issues

have their epicenter right in the political decision making and vote bank politics. Hence, CARCL is

committed to multidisciplinary study of Constitutional Law, Political Theory and Public Policy in

producing advanced research in Constitutional Law.

RULES OF THE COMPETITION

GENERAL INFORMATION:

The 1st UWSL National Moot Court Competition, 2020 (hereinafter referred as Competition) shall

be conducted in accordance with the rules mentioned hereunder:

The Competition, 2020 shall be held from 27th- 29thMarch 2020 at Unitedworld School of

Law, Karnavati University, Gandhinagar.

The Organizing Committee shall function as the only point of contact. The Organizing

Committee reserves right to make subsequent changes in the Rules of the Competition and

in such case the same shall be notified by email to all participating teams.

The official email for all correspondence with respect to the Competition is

[email protected]

DEFINITIONS:

“Administrator/Organizing Committee/Moot Court Committee” means Unitedworld

School of Law, Karnavati University.

“Appellant” shall include Appellant, Plaintiff, Petitioner, Complainant, Prosecution,

Informant etc.

“Bench” refers to the members duly invited adjudge the oral rounds, collectively.

“Clarifications” means explanation published by the Host University on the moot

problem, at any point of time of the competition to a query posed by any participating team

within the given deadline.

“Competition” means the 1st UWSL National Moot Court Competition, 2020.

“Compendium” means a compilation or collection of legal or other authorities that a

Team seeks to rely upon during the Oral Pleading Session.

“Identity” means any fact pertaining to the identity of the Team, its members, or the

Institution/College/University represented by the Team and the state or region where such

Institution/College/University is located, and includes any identification marks/ seal of the

Team or the Institution/ College/University represented.

“Moot Proposition” means the Proposition released by the Organizers on the date specified

in Rule II (2) and shall include any subsequent clarification(s) as and when issued by the

Organizers.

“Official Website” means the website of the Competition:

“Oral Pleading Session” means the oral pleadings before a Panel as explained in Rule 8 of

the Rules of the Competition.

“Oral Score” means the score given by a Panelist in accordance to the Rules of the

Competition.

“Orator” means one of the two designated speakers in a Team.

“Organizing Committee” or “OC” means the committee, including any other authorized

persons, appointed for the administration and conduction of the Competition and of all

events leading to the Competition.

“Panel” refers to the Panelists in an Oral Pleading Session collectively.

“Panelist” means an adjudicator of an Oral Pleading Session.

“Participating Team” means the team which is eligible to participate in the competition

after completion of registration procedure.

“Participating Institution” shall be presumed to be the parent institution of the

participating teams.

“Rebuttals” refer to the set of arguments/challenges that the Complainant shall raise at the

end of the main pleadings of all the Orators.

“Reply to Rebuttals” means the defense presented by the Respondent in response to the

Rebuttals.

“Researcher” means that member of a Team who is not an Orator.

“Researchers Test” means a written test conducted during the Competition in accordance

with Rule of the Competition.

“Respondent” means that Team which argues on behalf of the respondent at any given

point in the Competition.

“Scouting” means any person observing the Oral Pleading Session of a Team other than the

Team such person is associated with.

“Team Code” means the code allotted to a Team through a draw of lots.

“Written Submission” means the memorandum of written submissions submitted by any

Team as per Rule 6 of the Rules of the Competition.

“Written Submission Score” means the score determined in accordance with Rule 9.1 of

the Rules of the Competition.

ELIGIBILITY AND TEAM COMPOSITION:

The Competition is open to all students pursuing LL.B. 3 year/ 5 year course during the

current academic year.

A recognized College/Institution/University shall be entitled to send only one Team to

the Competition.

Each Team shall comprise of a minimum of two members and a maximum of three

members. In a Team comprising of two members, both the members shall be designated

as Orators. In a Team comprising of three members, two members shall be designated as

Orators and the third member shall be designated as a Researcher.

Any additional member or Team Coach accompanying a Team will not be entitled to a

certificate and any other entitlements of participation from the OC.

REGISTRATION:

General Rules

The teams shouldregister through e-mail by sending the names of members, Institute Name,

Contact Details through mail on [email protected] with the subject “Registration for 1st

UWSL National Moot Court Competition, 2020” on or before February 20th, 2020. The

Registration Form is appended to this brochure as Annexure I.

The Final registration of the team can only be completed by submission of duly filled

Registration Form appended to this brochure as Annexure I along with the receipt of

Payment of Registration Form.

Each Team shall complete such registration on or before February 20th, 2020(23:59 Hrs). A

scanned copy of the duly filled Registration Form and Travel Form available in Annexure I

and Annexure 2 respectively along with the Scanned copy of Demand Draft or Receipt of

Online Payment shall be sent to [email protected] the subject NMCC 2020 |

Registration.

The Registration Form (Annexure I) shall be duly verified and authenticated by the

respective authorities of the Institution/University. Registration forms without

signatures/seals of such authorities shall not be considered.

Once a Team registers by completing the formalities given, a code (hereinafter “Team

Code”) shall be assigned to the Team by February 24th, 2020.

A Team that has registered pursuant to Rules of the Competition may change its

composition only after giving information regarding the change to the Organizing

Committee by way of email on [email protected]. Changes to the team composition may

not be made later than March 10th, 2020.

Any changes in the contact details of Team members must be notified to the OC at the

earliest. The obligation to inform shall continue throughout the course of the Competition,

unless such Team withdraws or is disqualified from the Competition.

Registration Fee

REGISTRATION FEE is Rs. 4,500/- (Rupees Four Thousands Five Hundred) only.

Registration Fee is a NON REFUNDABLE, in case of non-participation or otherwise as

may deem fit.

Mode of Payment

Demand Draft: Institutions/teams may pay the Participation Fees by way of drawing

Demand Draft of INR 4,500 (Rupees Four Thousands Five Hundred) per team in favor of

Unitedworld School of Law payable at Ahmedabad.

Online Payment: The Online Payment of Participation Fees can be done by making

payment on the below Account:

ANONYMITY OF TEAMS:

Teams shall not reveal their Identity in any form, except by means of the Team Code

assigned to them in accordance with the Rules of the Competition.

Teams shall not, in any way, reveal their Identity in the Written Submissions or in the course

of the Oral Pleadings Session. The Written Submissions shall not bear the logo, name, etc. of

the Team, its members or the Institution/College/University represented by the Team.

Any material, including the Compendium, books, legal texts, or any other reference material,

carried into the courtroom for the Oral Pleading Session, whether presented to the Bench or

not, shall not reveal the Team‟s Identity and will be devoid of any identification marks/ seal

of the Team or the Institution/College/University represented. If anything on the material

carried into the courtroom reveals the Team‟s Identity, the Team shall render the same

unrecognizable to the satisfaction of the OC prior to leaving the Waiting Area.

Any violation of the Rules of the Competition may attract disqualification of the Team from

the Competition or any other penalty as determined by the OC. The decision of the OC in

this regard shall be final and not subject to challenge.

Any attempts by a Team or a member of the Team to contact, either directly or indirectly,

the drafter of the Moot Problem for any reason whatsoever after the release of the Moot

Problem and before the Competition closes shall lead to the disqualification of such Team

from the Competition.

CLARIFICATIONS TO THE MOOT PROBLEM

Teams may seek Clarifications via e-mail to [email protected] , latest by February 24th 2020 (23:59

Hrs).

WRITTEN SUBMISSION

Teams may raise grounds of challenge other than those indicated in the Statement of Facts.

One soft copy of Memorial (only in MS Word .doc/.docx format) must be emailed to

[email protected] latest by 16th March, 2020 (23:59 Hours IST) with the subject

“Memorials for TC _ _”. The file names of the electronic copies of the Memorials must

contain only the team code and the side being represented in the following format: e.g. (for

Team Code 13) 13P or 13R, “P” being for “Petitioner” Memorial and “R” for “Respondent”

Memorial and so forth.

The Late Submission of Memorial (i.e. submissions made after 16th March 2020) shall result

into penalty of negative marking of such memorials for each days.

The Organizers will NOT be responsible for the non-receipt of the soft copies of the

memorials. Teams are requested to ensure that soft copies vide email are sent well in time

and that the attachments can be viewed.

The teams shall mention their Team Code in the email by which the Memorials are sent to

the Organizers. The names of the participants or their Colleges, Universities or Law Schools

shall not be mentioned anywhere on the Email or the Memorial.

It is the responsibility of the teams to ensure that the correct number of copies of the

memorials are submitted to the Organizers and acknowledgement obtained.

All memorials submitted must conform to the following requirements and a team will attract

negative marking for failure to keep within the limitations as described below :

i) Each submitted memorials shall be printed on A-4 paper with black ink and must be

neatly bound.

ii) The font of the body of the Memorial must be Times New Roman, size 12, with 1.5

line spacing and the font-size of footnotes/endnotes, if any, must not be less than size

10. A uniform method of citation of authorities must be followed.

iii) Each page must have a margin of at least an inch on all sides.

iv) The Memorial should not exceed 30 typed pages (not including the Cover Page) and

shall at least consist of the following parts :

o Cover Page – [colored blue for Appellant, and red for Respondent]

o Table of Contents

o Index of Authorities

o Statement of Jurisdiction

o Written Pleadings

o Prayer

The Cover Page must contain:

o Team Code in the upper right-hand corner

o The year of the Competition

o The name of the Case

o The party for which the Written Submission has been prepared.

o Name of the forum resolving the dispute.

There will be a deduction of 1.0 mark for each page exceeding the 30 page limit, and a

deduction of 0.25 marks for each „objective‟ error, i.e., non-adherence to the rules set out

hereinabove. This negative marking (along with the negative marking for delayed

submission) shall be deducted once from the total memorial score obtained by a team.

SCORING OF MEMORIALS

The memorials shall be checked by a panel of three judges. Each judge shall score each

memorial out of 20 marks, and the average of scores shall be announced by the Organizers

on the conclusion of the Preliminary Rounds. The teams shall be scored on the basis of the

average of their scores for the Appellant and Respondent Memorials (after appropriate

deductions, if any).

The scoring criteria for memorials shall be as follows:

Application of Facts 25%

Reasoning 25%

Use of Authorities and Precedent 25%

Understanding Law and Procedure 15%

Presentation 10%

All Teams are required to submit Five (05) hard copies of the Written Submissions for each

side (05 for the Complainant and 05 for the Respondent) at the following address:

All Teams should ensure that their hard copies reach to the OC by March 21st 2020 (23:59

Hrs).

The teams are required to submit a cover letter along with the hard copy of the Written

Submissions. The cover letter should specify the Team Code assigned to such Team, details

of the Team members and the College/Institution/University represented.

The hard copies of the Written Submissions must be exactly the same as the soft copies of

the Written Submissions sent by the Team. Any violation of this rule shall attract penalty as

determined by the OC. The decision of the OC in this regard shall be final and not subject

to challenge.

Teams may carry hard copies of their Written Submissions for their personal use. No hard

copies of Written Submissions submitted by a Team to the OC in accordance with Rule of

the Competition shall be provided to such Team for their personal use.

Binding- As Unitedworld School of Law promotes eco – friendliness, written submissions

must be fastened by stapling or stitched on the left hand side of the pages. No other type of

binding is permitted.

Plagiarism- Participants must refrain from using same language or copying from other‟s

memorials and other sources. Even use of publicly available information must be

accompanied by proper citations. These rules shall apply to all parts of the memorial and not

just the Pleadings and Prayer. A failure to comply with this rule may result in the guilty

participants being debarred from mooting in 1st UWSL National Moot Court Competition,

2020. The Organizing Committee in consultation with the memorial judges will take a final

decision regarding determination of cases of plagiarism and penal measures for such action.

RESEARCHERS’ TEST

The Researchers‟ Test shall be conducted on Day 1 of the Competition, i.e. March 27, 2020.

The test shall be for duration of Sixty (60) minutes only. The test will be based on MCQs

(Multiple Choice Questions).

If a team comprises of three (3) members, then ONLY the Researcher is eligible to take the

test.

Researcher test marks will NOT be added up in the marking criteria.

If a team comprises of two members then one of the two members shall be eligible to take

the test. However, the team must notify the organizers as to which of the two team

members shall take the test.

NOTE: Participants are not allowed to carry/use any study material during the researcher‟s test.

ORAL ARGUMENTS

The language of the Court shall be English.

Each team would be given 35 minutes to present their oral arguments, subject to a

maximum of 20 minutes per Speaker in the Preliminary Rounds. This shall include the

pleadings and any rebuttal time, if applicable. For the Quarter Finals, Semi Finals and Final

Rounds, each team would get 40 minutes each, subject to a maximum of 25 minutes per

Speaker.

Judges, at their discretion, may extend oral argument time up to a maximum of 5 minutes

per team.

Rebuttal would be allowed only to the Applicant. The Applicant will have to specify the

length of time (if at all) they want to set aside for rebuttal, before beginning their oral

arguments.

If a team scheduled to take part in a round does not appear for 10 minutes after the

scheduled start of the round, a walkover shall be declared in favour of the team present.

Response to questions and Articulation 20%

Use of Authorities and Precedents 20%

Reasoning in the Application of Principles 20%

Application of Facts and Advocacy skills, Court Craft and Demeanor 20%

NOTE: The marks allotted for "Reasoning in the Application of Principles" shall be awarded to

teams which demonstrate as to why a principle of law derived from precedent or otherwise is well-

founded and desirable.

STRUCTURE

The competition will be held over a period of 3 days i.e. March 27 to March 29, 2020.

The competition shall consist of four(4) rounds; Preliminary Rounds, Quarterfinal Rounds,

Semi Final Round and the Final Round.

Draw of Lots: The Draw of Lots will determine from which side will the participating team

present their arguments i.e. Petitioner/Plaintiff or Respondent/Defendant. The Draw of

Lots will also decide which team you will be competing against (There will be no pre-

decided fixtures).This shall be conducted on 27th March 2020.

Preliminary Rounds: Each team shall present both sides in this round. The team will

represent Petitioner‟s side as well as the Respondent‟s side, in the sequence determined

under Draw of Lots. The top 8 team based on their Total Preliminary Score in the

Preliminary Rounds, shall qualify for the Quarter Final Rounds. Total Preliminary score

does not include the memorial score.

Quarter-Finals: The top 8 teams from the Preliminary Round shall proceed to the

quarterfinals. This will be a knockout round; hence winners will be decided on the basis of

courtroom win. The sides of the teams will be determined by draw of lots, held on 28th

March, 2020. The Draw of Lots will also decide which team you will be competing

against(There will be no pre-decided fixtures).

Semi Final: The top 4 teams from the Quarter Finals shall proceed to the semi-finals. This

round again will follow the knock-out fashion. The sides of the teams will be determined by

Draw of Lots held on 28th March, 2020. The Draw of Lots will also decide which team you

will be competing against (There will be no pre-decided fixtures).

Final Round: The winner of each court room fixture i.e. 2 teams from the semi-final round

shall proceed to this round. The sides of the teams will be determined by Draw of Lots held

on 29th March, 2020.

Tie-Breaking Procedure(if required): If at any point in this competition there is a tie

between two competition teams, then the team which has obtained a higher score whilst

memorial evaluation proceed to the next round. In case of a further tie, the scores obtained

by teams in the researcher‟s test or the preliminary round will be taken into consideration.

SCOUTING

Scouting shall be deemed to have happened if the speakers, researcher or any other person

affiliated with a team is found:

Witnessing, hearing, observing, etc the oral submissions in a Round, except where the

Round is one in which the team to which he/she is affiliated is participating in;

Reading a Memorial of a team except where: it is of the team to which he/she is affiliated;

or the

Memorials have been obtained on account of an exchange of Memorials prior to a Round

of the team to which he/she is affiliated.

AWARDS/TROPHY

The team with the maximum score in the final round will be declared as the “Winning

Team” and the team with the second highest score in the final round will be declared as

the “Runners up Team”.

The speaker with the maximum score in the Preliminary Rounds will be declared the “Best

Mooter/Speaker”.

The team with the maximum Memorial scores will be awarded “The Best Memorial”.

The researcher scoring the highest marks in the researcher test will be awarded “Best

Researcher”.

The Prizes are as follows*:

2nd Runner Up (Cash Prize) 20,000.00

1st Best Memorial 10,000.00

2nd Best Memorial 5,000.00

*Certificates shall be issued to all the participants (Certificate of Participation).

All participants/teams are required to attend the Valedictory Ceremony on 29th March, 2020 in order

to collect their certificates. They will not be provided later.

ACCOMMODATION AND TRANSPORTATION

Accommodation shall be provided to the participants only on the days of the Competition. Teams

which intend to arrive prior to or leave after the specified dates are required to make their own

arrangements.

Teams shall be responsible for their transportation to and from the airport / railway station / bus

station to the accommodation. They will be received by the OC at their respective places of

accommodation.

The OC will be responsible for transportation from the accommodation to the Competition venue.

MISCELLANEOUS

The OC reserves the right to amend, modify, change, or repeal any of the Rules of the

Competition. The OC shall communicate any changes made in the Rules of the

Competition to the Teams.

The OC reserves the right to take decisions on any matter not mentioned in the Rules

of the Competition. Any such decision taken by the OC shall be final and binding.

The OC reserves the right to interpret any of the Rules of the Competition. Such

interpretation shall be final and binding.

If any one member of a team is notified or informed of any detail or information

concerning the Competition, it shall be deemed as if the said team as a whole has been

duly notified or informed.

The copyright in the Written Submissions of Teams shall vest with Unitedworld School

of Law. UWSL shall not be responsible for any liability accrued to any person or for

any loss caused to any person because of the content of the Written Submissions.

Any audio or video recording of oral pleadings by any team is prohibited.

If a Team believes that the Rules of the Competition have been violated at any stage of

the Competition, the Team shall, within half an hour after the completion of the round

in which the alleged violation has occurred, register a complaint with the Student

Conveners of the Competition.

Team(s) shall not approach the Panel with any complaints, under any circumstances

whatsoever.
