Application for Minor Variance

Wednesday June 16, 2021

“A” 028-21, Corporation of the Town of Caledon, 6215 Old Church Road, Caledon East,

Ward 3

RECOMMENDATION

Staff is of the opinion that the proposal meets the four tests as set out in Section 45(1) of the Planning Act, R.S.O. 1990, as amended. Staff have no objection to approval of Minor Variance application A 028-21 to permit a revised parking standard for the lands.

PROPOSAL

The Corporation of the Town of Caledon is proposing a new addition to the Caledon East Community Complex in Caledon East. The proposed new addition will be a two (2) storey building that consists of approximately 4,878 m2 of gross area added to the north end of the facility. The new addition will accommodate a library, pool, gymnasium with upper walking track, multipurpose rooms, change facilities, fitness and cardio spaces. The Caledon East Community Complex is part of the Caledon Civic Campus Masterplan.

The applicant is seeking relief from Zoning By-law 2006-50 to:

1. Permit a parking requirement of 1 parking space per 22 m2 for lands within the Caledon Civic Campus Masterplan, in accordance with the decision previously issued under File A 042-09.

The subject lands are located on the south side of Old Church Road, between Innis Lake Road and Airport Road. The site is currently occupied by the Caledon East Community Complex and the Town of Caledon Town Hall, in addition to other office and open space uses.

Town of Caledon Official Plan

The subject property is designated “Institutional”, “Open Space/Institutional Policy Area”, “Open Space Policy Area” and “Environmental Policy Area” on Schedule ‘D’ in the Town of Caledon’s Official Plan. The proposed expansion to the Caledon East Community Complex is situated on lands designed “Institutional” and “Open Space/Institutional Policy Area”. Lands designated “Institutional” generally permit institutional uses such as government buildings and libraries, while lands zoned “Open Space/Institutional Policy Area” permit public parks, playground, playfields, public utilities and commissions and other public institutional uses which provide services to the general public.

Section 7.7.13.2 and Section 7.7.13.3 of the Town’s Official Plan requires that expansion and upgrading of the active recreational uses within the Open Space/Institutional Policy Area shall be determined through a town-wide review of future parks and recreational needs and consider the policies of the Town of Caledon Parks and Recreation Master Plan. Such Town-wide review was conducted and implemented into the Town of Caledon’s Parks and Recreation Master Plan. The Caledon Civic Campus Masterplan was updated to reflect this proposal and includes a parking analysis for the entirety of the campus, which includes the subject lands.

In view of the above, staff is satisfied the proposed parking variance for the Caledon Civic Campus meets the general intent and purpose of the Town’s Official Plan.

Zoning By-law 2006-50, as amended

The Subject Lands are zoned “Institutional (I)” in the Town of Caledon Zoning By-law 2006-50, as amended. Lands zoned Instructional permit a range of uses which includes Community Centre, Sports Arena, Wellness Centre, Library and Emergency Service Facility. The lands are subject to a previous Minor Variance decision, under file A 042-09 which was approved by the Committee in 2009 to:

1) To permit the (minimum) required Parking Spaces to be calculated in accordance with Section 5 of By-law 2006-50 as amended, whereby net floor area does not include any playing surface area, such as an ice surface or gymnasium floor;

2) To provide relief from Section 3.16 Lots Divided into more than 1 zone; and, 3) To permit adjacent Town owned lands subject to this application to be treated as

one lot for the purposes of applying zone standards.

As per Minor Variance decision A 042-09, the entirety of the lands within the Caledon Civic Campus Masterplan are to be treated as one lot for the purposes of applying zone standards. The intent of the decision was to view the entirety of the Civic Centre as one cohesive Campus, therefore parking can be shared between all the facilities and amenities on site. As per Section 5.2.3 “Non-Residential Parking Requirements”, various parking requirements are specified for the various uses in the Caledon Civic Campus ranging from 1 parking space for every 10 m2 to 1 parking space for every 30 m2.

To accommodate the proposed building expansion, Planning Services staff support establishing a single parking zone requirement of 1 parking space per 22 m2 which applies to all lands within the Caledon Civic Campus. The standard as requested is an acceptable balance of the various parking standards that apply for uses within the By-law on the lands. Staff are of the opinion that the proposed Minor Variance meets the general intent and purpose of the Town’s Zoning By-law 2006-50, as amended.

Toronto and Region Conservation Authority (TRCA)

The Toronto and Region Conservation Authority are technical advisors to the Town of Caledon and have had the opportunity to review this proposal. A portion of the subject property is located within TRCA’s Regulated Area of the Humber River Watershed. Specifically, the subject property is located within 120 m of an unevaluated wetland and a Provincially Significant Wetland (PSW). As such, a TRCA permit pursuant to Ontario Regulation 166/06 will be required for any development or site alteration within the Regulated Area on the property. TRCA staff had no objection to the application.

Oak Ridges Moraine Conservation Plan (2017)

The subject property is located on the Oak Ridges Moraine (ORM), within the Settlement Area land use designation of the Oak Ridges Moraine Conservation Plan (ORMCP). Lands designated Settlement Areas in the ORMCP permit a range of urban uses that reflect community needs and values and permit development as set out in municipal Official Plans.

Based on the review conducted by the TRCA, the proposed works are located approximately 85 m from the unevaluated wetland feature, valley corridor, and watercourse feature. The proposed area for development is within a previously disturbed area in front of the existing buildings on the property, on an asphalt parking lot with no significant natural features. In addition, the supplementary parking is proposed within a mowed area and also void of any significant natural features. It is the opinion of TRCA

staff that the proposed works will not negatively impact the ecological integrity of the ORM.

Planning Services staff recommend establishing a single parking zone standard that will apply to the lots within the Caledon Civic Campus.

“New Parking Need” for the Caledon Civic Campus Masterplan has been provided, which demonstrates all existing and proposed buildings/uses along with their respective parking standards. Based on the provided submission materials, a total of 1,042 parking spaces are currently

provided/proposed for the Caledon Civic Campus Masterplan, with 1,119 parking spaces required.

As per the materials provided, the proposed gross floor area for the Caledon Civic Campus Masterplan is approximately 21,720.15 m2. Planning Services Staff recommend requesting relief from the zoning by-law to:

permit a parking requirement of 1 parking space per 22 m2 for lands within the Caledon Civic Campus Masterplan, as per A 042-09.

This letter acknowledges receipt of the above noted application circulated by the Town of Caledon. The materials were received by Toronto and Region Conservation Authority (TRCA) on April 7, 2021. TRCA staff has reviewed the above noted application, and as per the “Living City Policies for Planning and Development within the Watersheds of the TRCA” (LCP), provides the following comments as part of TRCA’s commenting role under the Planning Act; the Authority’s delegated responsibility of representing the provincial interest on natural hazards encompassed by Section 3.1 of the Provincial Policy Statement, 2020; TRCA’s Regulatory Authority under Ontario Regulation 166/06, Development, Interference with Wetlands and Alterations to Shorelines and Watercourses; and, our Memoranda of Understanding (MOU) with Town of Caledon and the Region of Peel, wherein we provide technical environmental advice related to provincial plans.

Purpose of the ApplicationsIt is our understanding that the purpose of the above noted Minor Variance Application A 028-21 is to permit reduced off-street parking. The objective of this variance is to facilitate development of a recreation facility expansion including a pool, library, gymnasium, fitness and common amenity spaces.

Ontario Regulation 166/06A portion of the subject property is located within TRCA’s Regulated Area of the Humber River Watershed. Specifically, the subject property is located within 120m of an unevaluated wetland and a Provincially Significant Wetland (PSW). As such, a TRCA permit pursuant to Ontario Regulation 166/06 will be required for any development or site alteration within the Regulated Area on the property. Further details regarding TRCA’s permitting process have been provided in Appendix ‘B.’

Oak Ridges Moraine Conservation Plan (ORMCP):The subject property is located on the Oak Ridges Moraine (ORM), within the Settlement Area land use designation of the Oak Ridges Moraine Conservation Plan (ORMCP). Based on our review, it

appears that a portion of the subject property is located within the 120 metre Minimum Area of Influence (MAI) of a valley corridor, a watercourse feature, PSW and an unevaluated wetland. These features are identified under the ORMCP as Key Natural Heritage Features (KNHFs) and/or Hydrologically Sensitive Feature (HSFs).

TRCA has objectives related to the maintenance, restoration, and enhancement of the ORMCP area. As technical advisors to the Town of Caledon, the TRCA must be satisfied that there will be no negative impacts on the natural features resulting from the approval of the subject application. Please note that given that municipalities are the designated approval authority under the Oak Ridges Moraine Conservation Act, we recommend that the Town of Caledon ensure that this application conforms to the provisions of the ORCMP.

Based on our review, the proposed works are located approximately 85 metres from the unevaluated wetland feature, valley corridor, and watercourse feature. The proposed area for development is within a previously disturbed area in front of the existing buildings on the property, on an asphalt parking lot with no significant natural features. In addition, the supplementary parking is proposed within a mowed area and also void of any significant natural features. It is the opinion of TRCA staff that the proposed works, will not negatively impact the ecological integrity of the ORM.

Recommendations Based on the comments noted in this letter, TRCA staff recommends conditional approval of Minor Variance Application A 028-21 based on the following condition:

1. The applicant acquires a TRCA permit pursuant to Ontario Regulation 166/06; and 2. The applicant submits the variance application fee of $1,100.00 payable to TRCA.

Fee By copy of this letter, the applicant is advised that the TRCA has implemented a fee schedule for our planning application review services. This application is subject to a fee of $1,100.00 (Variance -Industrial/Commercial/Subdivision/Institutional - Minor). The applicant is responsible for fee payment and should forward the application fee to this office as soon as possible.
