C. Project Description The property owner, Promenade at Castle Rock Metropolitan District No. 2, is requesting approval of an L & E application for the construction of a regional stormwater detention facility at 935 Evalena Road. The project includes two detention ponds on two parcels zoned Agricultural One (A1). The Promenade at Castle Rock is in the process of purchasing a portion of the Grace Chapel property for the proposed project. The proposed stormwater ponds have a footprint of 2.72 acres and a volume of 15.23 acre-feet. The two ponds will treat and detain captured stormwater runoff before releasing runoff to an existing downstream culvert that conveys drainage under I-25. Construction is scheduled for July 2015 to September 2015. During construction it is estimated that 15 vehicles will be on site per day. Pond improvements include a micropool, trash rack and orifice plate, outlet structure, and overflow spillway. The operation of the facility does not require mechanical equipment. The ponds will each include 12-foot maintenance paths to provide access to the bottom of the basin and access to the outlet structures and micropools. The ponds will be reseeded with native seed. After construction, no significant traffic is expected, with only 1-2 trips per month for maintenance and any required repairs.

III. CONTEXT

A. Background This proposed regional detention facility is immediately upstream of an existing stormwater culvert that conveys drainage under I-25. The applicant has indicated that this proposed facility is in general conformance with the Phase III Drainage Report for Grace Chapel detention facility, prepared for the Town of Castle Rock. An L & E for a detention pond north of the site was approved by the Planning Commission in February 2015. This detention pond was also proposed as a regional detention facility to serve the Promenade of Castle Rock development on the west side of I-25.

B. Adjacent Land Uses and Zoning The following table reflects those zone districts and land uses directly surrounding the proposal.

IV. PHYSICAL SITE CHARACTERISTICS

A. Site Characteristics and Constraints

The 2.72-acre regional detention facility is located primarily on the southern 2.55-acre parcel owned by the Promenade at Castle Rock LLC. The Promenade at Castle Rock Metropolitan District is in the process of purchasing a portion of the Grace Chapel

property. The property boundary shown on the exhibit may be redrawn to accommodate the necessary setbacks for the church parking lot and building. No existing conditions on the property constrain installation of the new regional detention facility. The Promenade at Castle Rock LLC will transfer the property to the Promenade at Castle Rock Metropolitan District at a future date.

B. Access

The site will be accessed by an existing paved access drive off of Evalena Drive as well as a proposed access drive between the two detention ponds from Harvey Street. Also proposed are 12-foot wide maintenance paths for access to the bottom of each of the ponds and access to the outlet structures and micropools.

C. Drainage and Erosion Control

A Phase III Drainage Report was submitted to Engineering Services for review and acceptance. The Phase III Drainage Report, a Grading Erosion Sediment Control (GESC) plan and report, and construction plans must be accepted by Engineering Services prior to permits being issued for the proposed improvements.

V. PROVISION OF SERVICES

A. Fire Protection The Castle Rock Fire and Rescue Department provides firefighting and emergency medical services to the site. As of the writing of the staff report, no response had been received from Castle Rock Fire and Rescue Department.

B. Sheriff Services The Douglas County Sheriff’s Office (DCSO) provides emergency services to the site. DCSO provided a “no comment” response on the application. At the writing of the staff report, no response had been received from the Office of Emergency Management, the DCSO Hazmat, or the DSCO E911.

C. Water and Sanitation The proposed regional detention facility does not require any water or sewer services.

D. Utilities Referrals were sent to the utility service providers, CenturyLink (telephone), Black Hills Energy (gas), Intermountain Rural Electric Association (IREA) (electric), and Silver Heights Water and Sanitation District. IREA provided a referral response indicating that existing utilities are located within the project area and that an additional 15-foot easement will be needed for underground electric feeders to service the Promenade development. The applicant will work directly with IREA to provide the necessary easements, which will be dedicated by separate instrument. No response from CenturyLink or the Silver Heights Water and Sanitation District had been received at the writing of this staff report.

VI. OTHER PROCESSES AND PERMITS In addition to L & E approval, the following permits and approvals are required prior to commencement of construction:

· A Phase III Drainage Report, Grading Erosion Sediment Control (GESC) plan, GESC report, and construction plans must be finally accepted by Engineering Services prior to permits being issued for the proposed improvements.

· A backup drainage easement to be dedicated to Douglas County is needed for pond access and maintenance.

VII. PUBLIC NOTICE AND INPUT

Courtesy notices of an application in process were sent to adjacent property owners. At the preparation of the staff report, no comments or concerns in response to courtesy notices had been received. Referral responses were sent to required referral agencies on April 24, 2015. Referral responses are due at the conclusion of the referral period on May 8, 2015 or prior to the Planning Commission hearing. Agency responses that have been received to date are included as an attachment to this staff report. Any additional responses received after the date of this staff report will be provided to the Planning Commission prior to the hearing and added to the project record.

VIII. STAFF ASSESSMENT

Staff has evaluated all of the information above, the plan exhibit, referral comments, and public input. In staff’s assessment, the L & E request may be approved, as subject to additional information that may be presented at the Planning Commission hearing.

Association has reviewed the contents in the above-referenced referral response packet. We reviewed the project for maintaining our existing facilities, utility easements, electric loading, and service requirements. We are advising you of the following concerns and comments: The Association has existing underground/overhead electric facilities on the subject property. The Association will maintain these existing utility easements and facilities unless otherwise requested by the applicant to modify them under the Association's current extension policies. The Association is requesting a fifteen-foot (15') utility easement to accommodate the installation of electric facilities in this project, and the relocation of existing overhead electric facilities. Also, IREA submitted a redlined set of plans which indicated a need for a 15-foot easement for underground feeders to serve the Promenade development.

The applicant will work directly with the association to determine the location of any necessary easements, which will be recorded by separate instrument.
