At the Hearing, the City of Longview (the City), acting by and throughthe Office of the City Attorney, requested that the building or structure located on theProperty be declared a dangerous building or structure, a public nuisance, and a threatto the public health, safety and welfare in accordance with Article Ill, Chapter 19 of theCode of Ordinances of the City of Longview and Chapters 54 and 214 of the Texas LocalGovernment Code. In accordance with said authority, the City also sought an appropriateCourt Order to demolish or repair the aforesaid building or structure. Based on theevidence presented at the Hearing, this Court makes the following findings of fact withregard to the Property:1. The owner(s) of the Property, to wit: Charla E & Claudia A Brehmer, Carl Collins,

Emmanuel Lilly, Dessie Mae Johnson, Jeronme & Resa Elena Lambarria,Longview Holding LLC, Edward G King, Sergio Martinez, Ophelia ConwrightStinson, Richard & Anna Jeppsen Tabor. and were given notice of the Hearingin accordance with the requirements of Article Ill, Chapter 19 of the Code ofOrdinances of the City of Longview and Chapters 54 and 214 of the Texas LocalGovernment Code.

2. The following owner(s) appeared at the Hearing: Charla E & Claudia A Brehmer,Rosie Lee Johnson-Smith for Dessie Mae Johnson, Edward G King, SergioMartinez, and Richard Tabor appeared at the hearing of the case.

3. The holder(s) of any recorded mortgages or liens against the Property, to wit: N/Awere given notice of the Hearing in accordance with the requirements of ArticleIll, Chapter 19 of the Code of Ordinances of the City of Longview and Chapters 54and 214 of the Texas Local Government Code.

4. The following recorded mortgagee or lienholder appeared at the Hearing: N/A.5. At the Hearing, evidence was presented by the Office of the City Attorney, in

part consisting of written documentation, a copy of which is appended to thesefindings of fact and incorporated herein for all purposes.

6. At the Hearing, the following person(s) appeared and presented testimony CharlaE & Claudia A Brehmer, Rosie Lee Johnson-Smith for Dassie Mae Johnson,Edward G King, Sergio Martinez, and Richard Tabor appeared at the hearing ofthe case.

7. The buildings or structures located on the Property are substandard and in viola-tion of Article Ill, Chapter 19 of the Code of Ordinances of the City of Longview forthe following reasons:VACANT SUBSTANDARD STRUCTURE, DANGEROUS BUILDING, ATTRACTIVENUISANCE, UNSECURED BUILDING, DAMAGED SWIMMING POOL, DAM-AGED ACCESSORY STRUCTURE, DAMAGED PERIMETER FENCE - AND OFINSUFFICIENT HEIGHT, OTHER VIOLATIVE EXISTING CONDITIONS.

8. Based on the evidence presented at the Hearing and on the findings of this Court,the building or structure located on the Property is a dangerous and substandardbuilding or structure, a public nuisance, and a threat to the public health, safetyand welfare in accordance with Article Ill, Chapter 19 of the Code of Ordinancesof the City of Longview and Chapters 54 and 214 of the Texas Local GovernmentCode.

It is therefore ORDERED, ADJUDGED AN DECREED by the Court that the buildingor structure located on the Property is a dangerous building or structure, a publicnuisance, and a threat to the public health, safety and welfare in accordance with ArticleIll, Chapter 19 of the Code of Ordinances of the City of Longview and Chapters 54 and214 of the Texas Local Government Code and that, AS LISTED ABOVE, the owners of theProperty, are commanded to make the following repairs: as listed in number 7 aboveand any and all building, mechanical, plumbing, structural and electrical repairs neces-sary to eliminate code of ordinance violations in and on said property, It is specificallyordered that:The Respondent, AS LISTED ABOVE, shall make all repairs necessary to bring thestructure into conformity and compliance with the requirements of existing code,statute and ordinance, within 30 or 60 days of the date of this hearing- or contin-uance of case till next hearing on September 25 or October 23, 2018;andThe Respondent, shall complete all other repairs upon the structure, includingelectrical, mechanical and plumbing repairs, to bring the structure into completecompliance with the requirements of existing code, statute and ordinance, within30 or 60 days of this hearing- or- continuance of the case until the next docketscheduled for September 25 or October 23, 2018;andThe cases against N/A were dismissed due to the violative conditions on theirproperties being eliminated;andThe Respondent, shall secure the property and structure within thirty days of thishearing,andThe Respondent shall return to this Court for any subsequent hearing, as request-ed by the City of Longview and ordered by this Court,Should said owners, mortgages or lienholders fail to complete repairs as ordered, saidowner of the property, is commanded to demolish said building or structure and toremove it so that it in no manner violates the aforesaid ordinance and statutes within 30or 60 days from the date of this Order, and that, if said owner fails to comply with thisOrder within said 30 or 60 days of the order to demolish said building or structure, thenany recorded lienholder(s) and/or mortgagee(s) of record, shall have an additional sixty(60) days to demolish said building or structure and to remove it so that it in no mannerviolates the aforesaid ordinance and statutes.SIGNED AND RENDERED this the 25 day of September, 2018.ACCT: 01-022-000-521 0LARRY MERRIMANJudge, Municipal CourtCity of Longview, Texas
