This Department is in receipt of petition and multiple requests from residents in the northern Skyline Drive area requesting a survey of the property owners for the purpose of determining interest in extending water service into the communities. The size of the proposed project area would include all of the properties along Skyline Drive from the Jensen Beach Community Church to the Railroad Track as well as properties along Cheri Drive, Hyline Drive, Sunset Drive, Carroll Court, Robin Court, Sunrise Terrace and Oceanview Circle that are presently without water service availability. There are 245 properties in the project area.

On February 14, 2013, a letter was sent from this Department to an estimated 250 property owners along with a ballot which read “Please accept this as an official request from the 250 properties in the Skyline North Area without public water supply to Martin County Utilities to install at the resident’s expense County water supply to our properties. Each property owner clearly understands the cost of the project will be distributed equally between the 250 properties presently without public water supply. I/we property owner(s) understand the estimated cost will be between $7,000 and $8,000. I/we further understand that the cost can be amortized over ten years including interest and fees, which would be included on the annual tax bill.” On March 18, 2013, a 2nd request letter was sent to those property owners that had not responded to the 1st request and the final tally of all the ballots received to date indicate 106 properties FOR the project and 84 AGAINST with 55 non-respondents.

In June 2013, various discussions were had with Mrs. Irene Gomes and Ms. Carolyn Dunshee who own a residential lot at 4180 N.E. Hyline Drive to request a 9’ utility easement be granted to Martin County by them for the purpose of a water main interconnection from the proposed project area to a 10” water main along N.E. Savannah Road. Mrs. Irene Gomes and Ms. Carolyn Dunshee executed a utility easement agreement on September 30, 2013. As per the attached Water Service Agreement the County agrees that in consideration for the Utility Easement, the County will grant a credit towards the Owner’s water assessment, including capital facility charges.

A Florida Department of Environmental Protection Construction Permit has been received and cost proposals from the Martin County annual underground utility contractors were opened on January 15, 2014 and Underground Construction Management, Inc. submitted the lowest responsive proposal.

A staff level workshop was held on March 12, 2014 to explain the project scope, costs and the assessment process. All of the 245 affected property owners were either mailed or hand delivered invitations to that workshop.

Based on the final design, the initial prepayment amount is $5,871 per equivalent residential connection (ERC) which is less than the estimated range as outlined in the ballots mentioned above. Amortizing the project over a 10 year period will result in an estimated annual payment of $773.64 per ERC. The annual payment will be included in the tax bill. The proposed assessment will include 245 properties at 245 ERC’s.

As required by the initial assessment resolution adopted by the Board on February 25, 2014, the notice for the hearing was advertised in the Stuart News and individual notices were mailed to each property owner proposed to be assessed at the mailing address indicated on the tax roll.

Chris Traber, the County’s Special Assessment Counsel, has prepared the resolution, reviewed the proposed documents and the agenda item summary and confirmed that the form of each is proper.

RECOMMENDED ACTION:

RECOMMENDATION Staff recommends that the Board adopt the Final Assessment Resolution to create the Skyline

Drive Water Main Municipal Service Benefit Unit. Staff recommends that the Board adopt the resolution accepting the utility easement

agreement. Authorize a budget transfer from Utilities reserves in the amount of $1,079,000.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MARTIN COUNTY, FLORIDA, RELATING TO THE CONSTRUCTION AND FUNDING OF WATER DISTRIBUTION FACILITIES AND RELATED CAPITAL FACILITY CHARGES; CREATING THE SKYLINE DRIVE WATER MAIN MUNICIPAL SERVICE BENEFIT UNIT; AMENDING AND CONFIRMING THE INITIAL ASSESSMENT RESOLUTION; IMPOSING SPECIAL ASSESSMENTS; APPROVING THE ASSESSMENT ROLL; PROVIDING FOR COLLECTION OF THE ASSESSMENTS; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, the Board of County Commissioners (the "Board") of Martin

County, Florida, enacted Ordinance No. 96-493 on April 9, 1996 (the "Ordinance"), to

provide for the creation of municipal service benefit units and authorize the imposition of

special assessments to fund the construction of local improvements to serve the property

located therein; and

WHEREAS, on February 25, 2014, the Board adopted Resolution No. 14-2.37

(the "Initial Assessment Resolution") proposing creation of the Skyline Drive Water

Main Municipal Service Benefit Unit and describing the method of assessing the cost of

Water Distribution Facilities and related Capital Facility Charges against the real

property that will be specially benefited thereby, and directing preparation of the tentative

Assessment Roll and provision of the notices required by the Ordinance; and

WHEREAS, pursuant to the provisions of the Ordinance, the County is required

to confirm or repeal the Initial Assessment Resolution, with such amendments as the

Board deems appropriate, after hearing comments and receiving objections of all

interested parties; and

WHEREAS, the Assessment Roll has heretofore been filed with the office of the

County Administrator, as required by the Ordinance; and

WHEREAS, as required by the terms of the Ordinance, notice of a public hearing

has been published and mailed to each property owner proposed to be assessed notifying

such property owner of the opportunity to be heard; the proof of publication and an

affidavit of mailing are attached hereto as Appendices A and B respectively; and

WHEREAS, a public hearing was held on April 1, 2014 and comments and

objections of all interested persons have been heard and considered as required by the

terms of the Ordinance;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MARTIN COUNTY, FLORIDA, AS FOLLOWS: SECTION 1. AUTHORITY. This Resolution is adopted pursuant to the

Ordinance, Chapter 125, Florida Statutes, and other applicable provisions of law.

SECTION 2. DEFINITIONS. This Resolution is the Final Assessment

Resolution as defined in the Ordinance. All capitalized terms in this Resolution shall

have the meanings defined in the Ordinance and the Initial Assessment Resolution.

SECTION 3. CREATION OF MSBU. The Skyline Drive Water Main

Municipal Service Benefit Unit is hereby created to include the property described in

Appendix E attached hereto and incorporated herein. The MSBU is created for the

purpose of improving the use and enjoyment of property located therein by funding the

construction of Water Distribution Facilities to provide access to potable water and

financing the related Capital Facility Charges to reduce the immediate cost of connecting

to the County's potable water distribution system.

SECTION 4. AMENDMENT TO INITIAL ASSESSMENT

RESOLUTION. All references to "November 2015" and "November 2024"in the Initial

Assessment Resolution are hereby replaced in their entirety with "November 2014" and

"November 2023," respectively.

SECTION 5. CONFIRMATION OF INITIAL ASSESSMENT

RESOLUTION. The Initial Assessment Resolution, as amended by Section 4 hereof, is

hereby confirmed and ratified and such terms and provisions are hereby incorporated by

reference.

SECTION 6. APPROVAL OF ASSESSMENT ROLL. The Assessment

Roll, a copy of which is attached hereto as Appendix D, is hereby approved.

SECTION 7. ASSESSMENTS.

(A) The Tax Parcels described in the Assessment Roll are hereby found to be

specially benefited by construction of the Water Distribution Facilities and related

Capital Facility Charges in the amount of the maximum annual Assessment set forth in

the Assessment Roll. The methodology for computing annual Assessments described in

the Initial Assessment Resolution is hereby approved. Annual Assessments computed in

the manner described in the Initial Assessment Resolution are hereby levied and imposed

on all Tax Parcels described in the Assessment Roll at a maximum annual rate of $773.64

per ERC for a period of 10 years, commencing in November 2014. The resulting Initial

Prepayment Amount is $5,871.00 per ERC.

(B) Upon adoption of the Annual Assessment Resolution for each Fiscal Year:

(1) The Assessments shall constitute a lien against assessed property

equal in rank and dignity with the liens of all state, county, district or municipal

taxes and other non-ad valorem assessments. Except as otherwise provided by

law, such lien shall be superior in dignity to all other liens, titles and claims, until

the ad valorem tax bill for such year is otherwise paid in full pursuant to the

Uniform Assessment Collection Act. The lien shall be deemed perfected upon

adoption by the Board of the Annual Assessment Resolution and shall attach to the

property included on the Assessment Roll as of the prior January 1, the lien date

for ad valorem taxes.

(2) As to any Tax Parcel that is to be acquired or otherwise transferred

to an entity for which Assessments cannot be collected pursuant to the Uniform

Assessment Collection Act through condemnation, negotiated sale or otherwise

prior to adoption of the next Annual Assessment Resolution, the Adjusted

Prepayment Amount shall constitute a lien against assessed property equal in rank

and dignity with the liens of all state, county, district or municipal taxes and other

non-ad valorem assessments to the extent permitted by law. Except as otherwise

provided by law, such lien shall be superior in dignity to all other liens, titles and

claims, until paid. The lien shall be deemed perfected upon adoption by the Board

of the Annual Assessment Resolution and shall attach to the property included on

the Assessment Roll upon adoption of the Annual Assessment Resolution.

SECTION 8. COLLECTION OF ASSESSMENTS. The Assessments

shall be collected pursuant to the Uniform Assessment Collection Act. Upon adoption of

the Annual Assessment Resolution for each Fiscal Year, the County Administrator shall

cause the certification and delivery of the Assessment Roll to the Tax Collector by

September 15, in the manner prescribed by the Uniform Assessment Collection Act.

SECTION 9. EFFECT OF FINAL ASSESSMENT RESOLUTION.

The adoption of this Final Assessment Resolution shall be the final adjudication of the

issues presented herein and in the Initial Assessment Resolution (including, but not

limited to, the method by which the Assessments will be computed, the Assessment Roll,

the maximum annual Assessment, the levy and lien of the Assessments and the terms for

prepayment of the Assessments) unless proper steps are initiated in a court of competent

jurisdiction to secure relief within 20 days from the date of Board action on this Final

Assessment Resolution.

SECTION 10. ASSESSMENT NOTICE. The County Administrator is

hereby directed to record this Resolution as notice of the Assessments in the Official

Records Book in the office of the Martin County Clerk of Courts. The preliminary

Assessment Roll and each annual Assessment Roll shall be retained by the County

Administrator and shall be available for public inspection.

SECTION 11. PREPAYMENT NOTICE. The County Administrator is

hereby directed to provide notice by first class mail to the owner of each Tax Parcel

described in the Assessment Roll of the opportunity to prepay all future annual

Assessments, without financing cost. The notice, in substantially the form attached as

Appendix C, shall be mailed to each property owner at the address utilized for the notice

provided pursuant to Section 2.05 of the Initial Assessment Resolution.

SECTION 12. EFFECTIVE DATE. This Resolution shall take effect

immediately upon its adoption.

WHEREAS, Martin County needs a Utility Easement from Irene Gomes and Carolyn Dunshee

for the installation and maintenance of certain utility facilities; and

WHEREAS, by document entitled “Utility Easement” executed on September 30, 2013, Irene

Gomes, a married person, and Carolyn Dunshee, a single person, granted to Martin County a perpetual

non-exclusive Easement; and

WHEREAS, Sec. 139.31 and 139.32, General Ordinances, Martin County Code require that any

conveyance of an interest in land to Martin County for any public purpose shall be accepted and approved

by resolution of the Board of County Commissioners of Martin County.

Notice is hereby given that the Board of County Commissioners ofMartin County, Florida, will conduct a public hearing to considercreation of the Skyline Drive Water Main Municipal Service BenefitUnit, as shown above, and to impose special assessments againstcertain parcels of property located therein. The hearing will beheld at 9:00 A.M., or as soon thereafter as the matter can beheard, on April 1, 2014 in the County Commission Chambers ofthe Martin County Administration Building at 2401 S.E. MontereyRoad, Stuart, Florida for the purpose of receiving public commenton the proposed MSBU and assessments. If you are a person witha disability who needs any accommodation in order to participatein this proceeding, you are entitled, at no cost to you, to the provi-sion of certain assistance. The Assessments have been proposed to fund construction of pot-able water distribution facilities and to finance related capital fa-cility charges. The assessment for each parcel of property will bebased upon the number of equivalent residential connections at-tributable to such parcel. A more specific description is set forth inthe Initial Assessment Resolution adopted by the County Commis-sion on February 25, 2014. Copies of the Initial Assessment Reso-lution, the plans and specifications for the water distribution facili-ties, and the preliminary assessment roll are available for inspec-tion at the offices of the Martin County Utilities Department locat-ed at 2378 S.E. Ocean Boulevard, Stuart, Florida (as designated bythe County Administrator).

The assessments will be collected on the ad valorem tax bill, as au-thorized by Section 197.3632, Florida Statutes. Failure to pay theassessments will cause a tax certificate to be issued against theproperty which may result in a loss of title. The County Commis-sion intends to collect the assessments in ten (10) annual assess-ments, the first of which will be included on the ad valorem taxbill to be mailed in November

2015. Future annual assessments may be prepaid, in whole, at theoption of the property owner.
