1:30 PM SESSION 2 – The Impact of the Legal and Regulatory Environments on Standards and Standardization

The world in which standards and standardization exists is fast paced, at times quixotic, and generally not in favor of embracing additional regulation or legal constraints. However, the existence of both regulatory and legal institutions is necessary to create a safe, stable, and democratic society. The interplay and impact legal and regulatory environments have on standards and standardization can be most dynamic. This impact is most noted in such areas as international trade, product development, and consumer protection. At times, technology, invention, or societal forces leap ahead of the regulatory, legal and standards communities. When such a scenario occurs these communities may join together to address the situation. This session will explore what happens or could happen when a product gets to market before the legal, regulatory, or standardization community is prepared.

Today, your microwave may have features and functionality that enable it to serve as more than simply an appliance for heating and cooking foods. As product functionality and connectivity evolve, users and developers of technology, including government, seek to have seamless and easily adopted products. In today’s virtual world, we are still more sensitive to what we see than what we don’t see. However, with everything being more “digital” and thus more connected now, there is a shift in the risk parameters for users. As a consequence, standards committees have many more parameters to address during standards development. Regulators must consider not just how these new technologies meet the regulator’s objective but also how they might affect other products, services, and regulated areas. This course is designed to enhance the knowledge of those working with standards and conformity schemes – whether newcomers or seasoned professionals. This course will provide fundamentals along with tools and resources to be used throughout one’s career. Attendees will also earn 15 credits towards the SES Certification program for standards professionals.

Laura has over 35 years of diversified experience in standards, standards administration, and management and has held numerous leadership positions with key standards developers including ANSI, ASTM, IEEE, SAE, ASME, and ISO. Laura will teach the morning session of the course.

Karen Reczek, National Institute of Standards and Technology (NIST), Gaithersburg, MD. Karen has over 20 years of experience in standards and conformity assessment and research techniques, and has held leadership position in SES and SLA (Special Libraries Association.)

Mary Donaldson, National Institute of Standards and Technology (NIST), Gaithersburg, MD. Mary has over 30 years diversified experience in federal agency use of standards, regulations, and standards policy. She serves as the Executive Secretary for the Interagency Committee on Standards Policy (ICSP) for the US government, and serves on the ANSI Executive Standards Council and the ANSI ISO Council.

Industry Update on Intellectual Property Issues— Bird’s Eye View and Interactive Workshop

Description The (inaugural) Intellectual Property Workshop for the Standards Community will address the many questions, struggles, solutions and the future of intellectual property (IP) protection. This interactive event will bring together standards developers, sellers, vendors and users to openly discuss key issues and how the community can work together to effectively combat illegal use of IP. A question and answer panel comprised of experts from a wide variety of backgrounds will kick off the morning. Nicolas Fleury (Acting Deputy secretary General of ISO) will wrap up the panel with a presentation on the future of IP from an international perspective. The morning will conclude with a roundtable where each attendee will have the opportunity to share a burning question, experience, or issue and get support from their colleagues. Please join us to be a part of the evolving discussion and solution! This is sure to be a lively discussion. Our hope is that each attendee leaves with valuable insights and questions to take back to their place of work.

Conference Cancellation Policy All cancellation requests and changes must be received in writing. A 20% cancellation fee will be charged to registrants who cancel after July 18, 2016. No refunds will be provided to registrants who cancel after August 1, 2016 however, you may send a substitute. If the conference or course(s), or both, are cancelled, SES’s responsibility is limited to the return of the fees paid by the registrant.
