Basis For Investigation: This investigation was initiated upon notification froU.S. Arm Criminal Investigation Command, Inspector General's Office reported SFC

Headquarters and Headquarters Company, (HHC), 2nd Battalion, 325th Infantry Regiment, ort Bragg, NC 28310 (FBNC) reported he witnessed a detainee being struck by a soldier while

deployed to Iraq.

b7C665 A review of the Ina( Generals Complaint revealed while on a search for weapons mission of a warehouse. PVT platoon encountered approximately 5 security guards with weapons that were performing security on the warehouse. The platoon entered the building and secured the warehouse facility. Upon completion of detention, the security guards were escorted outside to a more secure environment according to Standard Operating Procedure (SOP). While outside the guards were ordered to take a knee or sit down and be quiet. One security guard began to get loud and aggressive in Arabic and came to his feet. While caning to his feet in an aggressive manner, with his hands behind his head, the detainee spit on PVT . It was reported that PVT reacted with a right back hand strike to the top of the guards head. blua&5 bleb 6-6

dol About 1330, 3 Ju 04 Si' conducted a witness interview of SF who related he witnessed P strike a detainee upon the head with a right back hand. He related he did not think P intended to abuse the detainee but reacted to the aggression of the detainee. (See Sworn Statement for details)

6. INVESTIGATIVE SUMMARY:

THE INFORMATION IN THIS REPORT IS BASED UPON AN ALLEGATION OR PRELIMINARY INVESTIGATION AND MAY BE CHANGED PRIOR TO THE COMPLETION OF THE INVESTIGATION.

THIS INVESTIGATION WAS INITIATED UPON NOTIFICATION FROM HQ, U.S. ARMY CRIMINAL INVESTIGATION COMMAND WHO RECEIVED INFORMATION FROM THE INSPECTOR GENERAL'S OFFICE THAT SFC HHC, 2/325TH AIRBORNE INFANTRY REGIMENT (FBNC), WITNESSED A DETAINEE BEING ABUSED BY PFC11111WHILE DEPLOYED TO IRAQ.

PRELIMINARY INVESTIGATION REVEALED THAT WHIL EARCH FOR WEAPONS MISSION OF A BAGHDAD WAREHOUSE, PFC LATOON ENCOUNTERED APPROXIMATELY 5 SECURITY GUARD If • EAPONS WHO WERE PERFORMING SECURITY ON THE WAREHOUSE. THE PLATOON SECURED THE FIVE GUARDS, ENTERED THE BUILDING AND SECURED THE WAREHOUSE FACILITY, WHICH WAS TO ALLEGEDLY HELD A WEAPONS CACHE. THE PLATOON THEN ESCORTED THE FIVE SECURITY GUARDS OUTSIDE TO A MORE SECURE ENVIRONMENT ACCORDING TO SOP. WHILE OUTSIDE, THE GUARDS WERE ORDERED TO TAKE A KNEE OR SIT DOWN AND BE QUIET. ONE SECURITY GUARD BEGAN TO GET LOUD AND AGGRESSIVE IN ARABIC, CAME TO HIS FEET AND SPIT ON PFC • THEN RESPONDED WITH A IGHT BACK HAND STRIKE TO OP 0 S HEAD. SFC THEN INFORMED PFC THAT HE EW HE WAS OWED TO STRIKE THE DETAINEE DETAINEES RETURNED THEIR WEAPONS AND RELEASED.

PFC11111 IS CURRENTLY ON EMERGENCY LEAVE AND HIS INTERVIEW IS SCHEDULED FOR 7 JUN 04.

INVESTIGATION CONTINUES BY USACIDC.

7. COMMANDERS ARE REMINDED OF THE PROVISIONS OF AR 600-8-2 PERTAINING TO SUSPENSION OF FAVORABLE PERSONNEL ACTIONS AND AR 380-67 FOR THE SUSPENSION OF SECURITY CLEARANCES OF PERSONS UNDER INVESTIGATION.

THIS INVESTIGATION WAS INITIATED UPON NOTIFICATION FROM HQ, U.S. ARMY CRIMINAL INVESTIGATION COMMAND WHO RECEIVED INFORMATION FROM THE INSPECTOR GENERAL'S OFFICE THAT SFC HHC, 2/325TH AIRBORNE INFANTRY REGIMENT (AIR), FORT B (FBNC), WITNESSED A DETAINEE BEING ABUSED BY PF ILE DEPLOYED TO IRAQ.

PRELIMINARY INVESTIGATION REVEALED THAT WHILE EARCH FOR WEAPONS MISSION OF A BAGHDAD WAREHOUSE, PFC LATOON b?'GbLS ENCOUNTERED APPROXIMATELY 5 SECURITY GUARDS WITH WEAPONS WHO WERE PERFORMING SECURITY ON THE WAREHOUSE. Preliminary investigation revealed whit on earch for weapons mission of a Baddad warehouse. PVTlatoon encounterechltbb 3.-

appoximately 5 security guards with weapons who were performing security on the warehouse. The platton entered entered the building and secured the warehouse facility. Upon completion of detaintion, the security guards were escorted outside to a more secure environment according to SOP. While outside the guards were ordered to take a knee or sit down and be quiet. One security guard began to get loud and agressive in Arabic and came to his feet.
