THE Governor deeply regrets to announce the death bydrowning of M r. Aloysius Joseph Obunga, Assistant DistrictOë cer, which occurred at K akam ega on 5th July, 1953.

. M r. 'OEunga' joined the Education Department as a teacherat the Governm ent African School, Kisii, on 1st October, 1936,and was subsequently appointed headm aster of that school. H ewas appointed an . Assistant District Ofhcer in the Provinci. a'lAdrnimstration on 1st January, 1949, and by his death theGovernment laas lost the services of a loyal and eKcient ofjicer.

4. The application for the plot shall be deem ed to be uponand subject to the conditions herein contained and the provisionsof the Crown Lands Ordinance (Cap. 155 of the RevisedEdition of the Laws of Kenya) and in particular Part VI1thereof.

(bj Special Conditions1. The grantee shall erect com plete for occupation within 24

3. In the rvent of the grantee failing to comply witil anyconzition herein contained, any proceedings that may benecessary will forthwith be instituted for the recovery of theland. M oneys that may have been paid in respect of the . plotwill be forfeited to the Crown.

8. Subject to Special Condition No. 7, the grgntee shall notat any time during the continuance of the term of the grantsubdivide the land or assign, sub-let or otherwise dispose of anyportion without prior consent in writing of the G overnor.

9. A1l out-buildings, oëces, etc-, shall be properly sited andscreened from view to the satisfaction of the Local Authorityor such person as may be appointed for the purpose and shallbe kept so screened during the continuance of. the grant.10. The Government or such person or authority as m ay be

11. The grantee shall pay such rates, taxes, charges, duties,assessments or outgoings of whatever description as may be im- j.

d, charged, or assessed by any Government or Local .A ,poseAuthority upon the larfd or buildings erected thereon inclttdingany contribution or other sum paid by the Governm ent in 'lieuthereof .

12. The grantce shall as aforementioned make an initial pay-ment for the estim ated am ount for the cost of constructïon ofroads and drains along the southern boundary of the plot asshown in the Schedule hereto. On com plçtion of the constnzctionof 'roads and drains and the ascertainm ent of the actual propor-tionate amount payable in respect of the plot the grantee shalleither pay (within seven days of demand tbereforlhor be refundedthe am ount by which the actual cost exceeds or falls short ofthe am ount previously paid on account as the 'case m ay be. lnaddition, the grantee will be required to pay proportionateroads and drains charges in respect of the 40 feet road to therear of the plot (within seven days of the demand therefor) asand when it is decided jo undertake its construction.

13. The annual cost of the m aintenance of the roads, whenconstructed will be paid in proportion to the frontage of theplot by the grantee.'14. Should the Local Authority at any tim e require the road

to be constructed to a higher standard, the costs of this con-structioh .will be paid proportionately by the said grantee on thebasis set out in Condition N o . 12.15. The grantee shall use and perm it to be used the land

hereby granted for business purposes only, excepting any tradeor business which has been or may be declared. to be dangerousor offensive by notice in the Oë cial G azette. N ot m ore than 90per cent of the area shall be built upon. - '.
