    Rambus Inc. ("Rambus") respectfully submits copies o f (l) the judgment entered by the) United States District Court for the District of Delaware (the "Delaware Court") today in Micron3 Tech., Inc. v. Rambus Inc., Civ. No. 00-792-SLR (attached hereto as Exhibit A); and (2) a4 February 9, 2009 order issued by the Delaware Court directing the Clerk to enter judgment in that5 matter (attached hereto as Exhibit B). The Delaware Court entered judgment against Rambus on6 its patent claims and patent counterclaims, and in favor ofMicron Technology, Micron7 Electronics, and Micron Semiconductor Products ("Micron") on their patent declaratory judgment8 claims and counterclaims. (See Exh. A.)9 As the Court is aware, Rambus intends to take an appeal to the Federal Circuit from the10 Delaware Court's spoliation ruling and the just-entered judgment. This Court has previouslyI I recognized the need for the proceedings in Hynix 1 "to move forward as expeditiously as possible12 with the anticipation that any appeal from the judgment in that case will presumably be13 coordinated with any appeal in the Micron Del. Action." (2/3/09 Order Entering Stay o f14 Proceedings, at 3.) Rambus believes that in order to ensure that the Federal Circuit is able toI 5 coordinate the appeal from Hynix 1with the appeal from the Micron Delaware action, this Court16 should, if possible, enter judgment in Hynix 1within the next 30 days. To this end, the parties are17 in the process ofmeeting and conferring on the form o f judgment to be entered in Hynix 1, and18 have set a telephonic hearing with the Court to discuss any remaining disputes on February 18,19 2009 at 10 a.m.202122
