THEIR RIGHT TO VOTE

This pamphlet describes services available to make voting easier for senior citizens and persons with disabilities. If you need more information, please call the Voter Services Office at 727-2525.

VOTER REGISTRATION BY MAIL.

To register to vote in the District, you must be:

• a U.S. citizen;

• a D.C. Resident; and

• at least 18 years old by the next election.

If you wish, the Board of Elections will send a post-age-free voter registration form to your home. Call 727-2525 anytime, day or night, to request a registration form. If you have a TDD device, you may call 639-8916 from 8:30 a.m. to 4:45 p.m. on weekdays.

ASSISTANCE IN VOTING

Each of the District's polling places has a trained Voting Assistance Clerk on staff. This person is available to help senior citizens, disabled persons, or other voters who may have trouble voting. If you wish, you may choose a person other than the Voting Assistance Clerk to help you if you are elderly or have a disability. Call 727-2525, for more information.

REMOVING BARRIERS AT THE POLLS

During the last few years, the Board of Elections has been overseeing a program to build curb cuts and wheelchair ramps at several public buildings that are used as polling places. As a result, most of the polling places in the District meet federal guidelines for accessibility to senior citizens and persons with disabilities.

If you have a question about accessibility to your assigned polling place, call 727-2525, for more information. If your polling place is one of the few that are not accessible, we will make arrangements for you to vote at another, more accessible site.

CURBSIDE VOTING

If you are driven to the polling place, but cannot get inside to the voting room because of age, or disability, you may vote "curbside", from the car.

When notified that someone wishes to vote "curb-side", one of the pollworkers will bring a ballot to

. the car and assist you as needed. We suggest that you call ahead to inform us that you wish to vote "curbside". Call 727-2525 for more information (TDD Device 639-8916).

ABSENTEE VOTING BY MAIL.

If you cannot vote at the polls because of age or . physical disability, you may vote by absentee ballot through the mail.

To recieve an absentee ballot, you must send a writ-ten request to the Board of Elections. Your request must reach our office at least one week before the election and must include the following information:

• your name and address;

• the address where you would like the ballot to be sent (if different);

• your reason for voting absentee; and

• your signature or mark.

Someone else may write the request for you, but the request must include your own signature or mark. If you wish, we will send you a request form that you can fill out. Just call 727-2525 (TDD device: 639-8916) weekdays, from 8:30 a.m. to 4:45 p.m.

1. Complete the Voter's Affirmation box on the front of this envelope. Be sure to sign your name in the space provided. Give the envelope back to the Special Ballot clerk. The clerk will complete the Election Worker's Certification box; indicating the reason(s) for the special ballot and will sign their name.

THE BALLOT WILL NOT BE COUNTED IF THE ENVELOPE IS NOT SIGNED BY THE VOTER.

2. The Special Ballot Clerk will give you the following items:

• the ballot(s) - stamped "special" in red ink; and

• the secrecy envelope - to put your voted ballots in.

---------------------Since passage of the "Initiative, Referendum, and Recall Proce-dures Act" in 1978, there have been 58 Initiative and 6 Refer-endum Measures submitted by voters, plus a Federally-man-dated Initiative-''Life hnprisoument or Death Penalty for Murder in D.C.". Of these, 14 of the voter Initiative measures and the Federal one, and 3 of the Referendum measures have made it to the ballot for voter consideration. Of those measures which made it onto the ballot, 10 Initiative and 2 Referendum measures were successfully accepted by the voters

The District of Columbia Board of Elections and Ethics -Its Roots and Evolution.

1955 - The Board of Elections and Ethics was created by the Congress of the United States and had its fust meeting on October 4, 1955.

1956 - In May 1956, the District had its fust election-for Democratic and Republican party officials and convention delegates.

1961 - Passage of the 23rdAmendment to the U.S. Constitution granted District residentsJor the FIRST time, the right to vote for President and Vice-President.

1964 - In November 1964, the District conducted an election which, for the first time, allowed residents to vote for President and Vice-President

1968 - In April 1968, Congress: Created an elected Board of Education; Divided the City into eight Wards; and Established permanent voter registration.

The Board of Elections and Ethics became a permanent organization.

1971 - In 1971, the fIrst Primary election was held for Delegate to the House of Representatives:

For the fust time 18 year-olds could vote; New legislation allowed a Presidential Preference Primary.

1994 - The District installed a major software upgrade to implement the new "National Voter Registration Act of 1993", a major feature of which was the "Motor Voter" program - a process already in place in the District

1995 - The Board acquired its second major hardware upgrade with the procurement of a second IBM "RlSC 6000" which will be used for ballot tabulation. With two "RlSC 6000s" in place, the Board also has mutually support-ing hardware systems for voter registration and ballot tabula-tion.

1997 - The Board successfully conducted an unprecented tIrree Special Elections in this ''no election" year; in April forWard 6 Council Member, in July for Chairman of the Council, and in December for At-Large Council Member.

1998 - In an unprecedented move, but cne designed to further improve the accuracy of the voter roll, the Board initiated a computer crosscheck of registered voters and election participants, with surrounding jurisdictions. The number of "rnatches" - dual registration or double voting-- was considerable and resulted in some removals from the voter roll and some legal action by Maryland and D.C. to consider prosecution of the "double voters".

1973 - "Home Rule" legislation passed, allowing an elected Mayor and City Council.

1974 - The fIrst elections were held for Mayor and the City Council. Advisory Neighborhood Commissions were created.

1976 - First elections were held for Advisory Neighborhood Commissions.

1978 - "Initiative, Referendum, and Recall Procedures Act" was established giving District voters the chance to fIle measures with the Board of Elections to place ballot questions before District voters.

1979 - The Board acquired an on-line voter registration system, punch card voting equip-ment, and an automated ballot tabulation system, thereby becoming totally independent from the District's Central Computer System and remov-ing any perception of elected official capability to influ-ence activity. The two systems resided in a Data General "Eclipse" mini-computer and use external disk drives, with data entry being performed by terminal operators within the agency. A major drawback of this combination was the iriability to access vital voter registration data while in the ballot tabulation mode.

1983 - To correct error rates in voter registration data, the Board conducted a massive citywide registration revalidation program, and in effect rebuilt the District's entire voter roll.

1985 - The City Council passed legislation to eliminate "odd-year" elections after 1987. The Board instituted a biennial voter residency canvass to improve voter roll accu-racy.

1989 - The District became one of the early election jurisdictions to develop a combined form for applying for a driving license and registering to vote. "Motor Voter" had arrived in the District.

1990 - The flTst election of "U .S. Senators (2) and a Representative" --local, not Federal offices -- resulted from the "Statehood Constitutional Convention Initiative" of 1980.

1991 - The Board acquired its flTst major upgrade to its automated systems. A new mM "RISC 6000" is used for voter registration, with the Data General "Eclipse" being used only for ballot tabulation. This dual system conforms with new Federal guidelines which recommend that voter registra-tion and ballot tabulation not be on tlu same hardware systems.

1992 - The District set all-time voter registration and turnout records in the 1992 PresidentaI General election with 340,953 registered voters and 231,445 voters participating.

Qualifications for Public Office in the District of Columbia

Delegate to the U. S. House of Representatives

To hold the office of D.C. Delegate to the House of Representatives, an individual must meet the following qualifications on the date of the general or special election (D.C. Code § 1-401).

I. Be a qualified elector in the District of Columbia, as defined by D.C. Code § 1-1001.2(2).

2. Be at least 25 years of age.

3. Hold no other paid political office.

4. Have resided in the District of Columbia continuously since the beginning of the three year period ending on the date of the general or special election.

Mavor of the District of Columbia

To hold the office of Mayor of the District of Columbia, an individual must meet the following qualifications (D.C. Code § 1-204.21(c)(I).

2. Have resided in the Single Member District continuously for the 60 day period immediately preceding the day on which the nominating petition is filed.

To hold the office of United States Senator, an individual must meet the following qualifications, as defined in the U.S. Constitution (Article I, Section 3):

I. Be at least 30 years of age.

2. Have been a citizen of the United States for at least nine years.

3. Be a resident of the District of Columbia on the date of the general or special election.

To hold the office of United States Representative, an individual must meet the following qualifications, as defined in the U.S. Constitution (Article I, Section 2):

I. Be at least 25 years of age.

2. Have been a citizen of the United States for at least seven years.

3. Be a resident of the District of Columbia on the date of the general or special election.

DEFINITIONS

I. D.C. Code § 1-100 1.02 defines "qualified elector" as a United States citizen who:

a. Resides or is domiciled in the District and does not claim voting residence or the right vote in any state or territory.

b. Is, or will be, 18 years old on the day of the election.

c. Is not mentally incompetent as adjudged by a court of competent jurisdiction.

e. Is not incarcerated for conviction of a felony.

2. Qualifications required in order to "hold public office" must be met at the time the duly elected individual begins his or her term of office. This date generally is January 2nd of the year following the general election, except in cases where a term begins after a fixed number of days following the certification of election results.

GUIDE TO THE INITlA TlVE AND REFERENDUM PROCESS

The process for placing an Initiative or Referendwn Measure on the ballot in the District of Colwnbia has several steps, which are defmed in the law. The Board of Elections and Ethics has written this circular to provide you with general information about this process. For a complete account, check D.C. Code Sections 1 -28 1 through 1 -286, 1 -1320 or Chapter 10 of the Board's Regulations (DCMR Title 3: Elections and Ethics).

1. Supporters File the Measure with the Board of Elections ------------------------------------------------------------------.----

The process begins when a registered voter files the proposed Measure in the Board's Voter Services Office. The filing must include five copies of the following:

The legislative text of the proposed law,

A short title of 15 words or less to describe the Measure, and

A "Summary Statement" of I 00 words or less, to outline the proposed law for voters.

The proposer must also file a notarized statement swearing that he or she is a registered voter. This. statement must include the person's residence address and telephone nwnber. The·supporters of the Measure must also file documents with the Office of Campaign Finance, listing their campaign committee and other financial information.

2. The Board of Elections Considers the Subject Matter

Once an Initiative or Referendwn is filed, the Board publishes it in the D.C. Register and provides notice of a public meeting to consider whether the subject matter meets the requirements set in the law. Members of the public are invited to submit '.>,'ritten testimony on the subject matter and to testify before the Board at the public meeting.

Under the law, an Initiative or Referendwn may not appropriate funds, violate the Home Rule Charter, negate a Budget Act, or violate the Hwnan Rights Act. When the Board makes its subject matter determination, it may consider only whether the Measure meets these requirements.

3. The Board Approves a Short Title and Summary Statement

After approving the subject matter, the Board prepares the official Short Title and Summary Statement. The Summary Statement is a statement of I 00 words or less that describes the Mea~irre for voters. It appears on both the petition form and the election ballot.

The Short Title and Swnmary Statement "formulated" by the Board are presented at a public meeting, where both proponents and opponents are invited to comment. The Board's responsibility is to approve language that is clear and impartial, and fairly reflects the contents of the Measure.

4. Tbe Cballenge Period Begins

Once approved, the official language is published in the D.C. Register, along with the legislative text. The D.C. Register publication begins a ten day challenge period, during which any registered voter may object to the short title, swnmary statement, or legislative form in the Superior Court.

5. Tbe Petition Form is Approved

At the end of the challeng~Qeriod (or once any court challenges are successfullyJesolved),-'th=e ___ _ Board holds a public meeting to approve the petition form for circulation.

6. Supporters Circulate tbe Petition

Once the petition is approved, the supporters of an Initiative have 180 days to gather signatures. (Referendum supporters collect their signatures before the end of the Congressional Review Period.) To place a Measure on the ballot, supporters of an Initiative or Referendum must collect the signatures of at least five percent of the voters registered citywide. These signatures must be distributed to reflect at least five percent of the registered voters in at least five of the eight wards.

7. The Board's Staff Verifies Petition Signatures

Once the petition is filed, the Board of Elections has thirty days to determine whether it contains the required number of voter signatures. In the presence of watchers--and according to detailed procedures--the Board's staff checks each name on the petition to determine whether the signer is registered. Once the staff determines that the petition contains the required number of voter entries, a random sample of I 00 signatures from each ward is checked agai.!lst the voter's original registration

. form to ensure signature validity.

8. Tbe Measure is Certified for tbe Ballot

At the end of the signature verification phase, the Board calls a public meeting to announces whether the petition meets the citywide and ward-level requirements. If the petition meets the requirements, the Measure is then "certified" for the election ballot. In the case of a Referendum Measure, a special election is called. This election must occur v.~thin I 14 days of the submission of the petition (except if another citywide election is already scheduled to occur within 54 to 114 days of the petition submission.) An Initiative Measure does not require a special election, and is voted on during the next citywide election at least 90 days after the petition submission. All registered voters--regardless of party affiliation--are eligible to vote on Initiative or Referendum Measures.


BOARD OF ELECTIONS AND ETHICS WASHINGTON, D.C.

. . INFORMATION ON THE RECALL OF ELECTED OFFICIALS

In 1979, District residents were granted the right to recall elected officials with the passage of the Initiative, Referendum, and Recall Procedures Act. The Board of Elections and Ethics has published this infomlation sheet to outline the recall process, which has three phases: the signature gathering phase, the petition filing and verification phase, and the election phase. For a complete reading of the laws and regulations conceming the recall of elected officials, see D.C. Code, Section 1-1321 and Chapter II, "Recall of Elected Officials" (3 DCMR, 1100, et seq.).

THE SIGNATURE GATHERING PHASE

1. The Notice of Intention to Recall - The recall proceedings begin when a registered voter files with the Board of Elections a "Notice ofIntention to Recall". This document must state the reasons for the 'proposed recall and is limited to 200 words. A "Notice of Intention to Recall" for a citywide or ward-level office may not be filed during the first or last 365 days of the official's tenn. In the case of an ANC recall, the "Notice of Intention to Recall" may not be filed during the first six months or last six months of the Conunissioner's tenn.

The Board serves a copy of the "Notice" to the official, who may file a response of two hundred words or less. The response must be filed within 10 calendar days after the filing of the "Notice of Intention to Recall".

2. The Petition Form - After the official is given the oppOitunity to file a response, the proponent may begin to circulate the petition calling for a recall election. The petition by law must include the proponent's notice and the official's response (if any), along with other requirements outlined in the Board's regulations. By law, the recall petition foml must be approved by the Board before it can be circulated.

3. Signature Requirements - The recall petition must be signed by at least 10 percent of the voters registered in the election district which the elected officer represents -- citywide, ward, or ANC. This figure is detennined by the published registration totals in effect thirty days before the filing of the "Intention to Recall".

In the case of a citywide recall, the signatures submitted must also meet ward distribution requirements, such that the petition contains signatures of at least 10 percent of the voters in at least five of the city's eight election wards, in addition to meeting the 10 percent reguirement citywide.

PETITION FILING AND VERIFICATION PHASE

1. Filing of Recall Petition - The proponents of a citwide or ward-level recall have a maximum of 180 days to collect the signatures and file the recall petition with the Board, beginning on the date that the elected official submits his or her response to the Intention to Recall. In the case of an ANC recall, the proponents have sixty days.

2. Board Determination of the Sufficiency of the Recall Petition - The process for verifying the petition signatures is complex and detailed. The Board of Elections must detennine whether each person whose name appears on the petition is a properly registered D.C. voter (in the particular election district, if applicable) and then verify a random sample of the signatures on the petition against the signature on file for the voter in the Board's records. Statistical fonnulas are used during the random sample to ensure, with at least a 95 percent confidence level, that the petition meets the legal requirements. The Board is given thirty days to complete the entire process. Under the law, the proponents of the measure and the elected official may send representatives to watch the petition verification process.

If the number of signatures meets the statutory requirements, the petition IS certified by the Board, and a recall election is scheduled.

THE ELECTION PHASE

1. Recall Election - By law, a special election is scheduled within 114 days after the Board certifies the sufficiency of the recall petition. The purpose of the election is to detennine whether to remove the elected official from office. If the number of citizens voting "FOR" the removal of the elected official is greater than the number voting "AGAINST", then the official is removed from office, and the office is filled as provided by law until a subsequent special election may be held to fill the remainder of the official's tenn.

2. Special Election to Fill a Vacancy - A special election to fill the remainder of the recalled official's tenn is held the first Tuesday occurring 114 days after the Board certifies the results of the recall election. In the case of an ANC, the special election to fill the vacancy may be held simultaneous with other, regularly-scheduled ANC special elections.

The official recalled is not prohibited from being a candidate for the same office in the special election.

FILUNG VACANCIES IN ADVISORY NEIGHBORHOOD COMMISSION OFFICES BY APPOINTMENT OF THE ANC \

Vacancies in ANC offices are filled by a process that includes two basic steps: .'

1. Interested candidates file nominating petitions with the Board of Elections, and

2. The Commission appoints someone or conducts an election to fill the remainder of the term from among the qualified candidates.

This Information Circular explains the ANC vacancy-filling process in general terms. For authoritative references, please consult D.C. Code Section 1-257.

Howa Vacancy Occurs

A vacancy in an ANC office may occur for a number of reasons -. Le., the Commissioner dies, resigns, moves out of the SMD, or otherwise loses the qualifications for office.

When a Commissioner Resigns

When a Commissioner resigns, he or she must submit a letter of resignation to the Board of Elections, the Mayor, the Council, and the Chairperson of the affected ANC.

If the Commissioner loses the qualifications to hold office but does not submit a letter of resignation, the Commission must declare the seat vacant. D.C. Code Section 1-257(f)(2), outlines this procedure.

Beginning of the Vacancy-Filfing Process

The Board of Elections certifies any ANC' vacancies that exist by publishing a notice in·the ,. D.C. Register. The Board's notice lists the date

that petitions are available, as well as the filing deadline and the dates for the petition challenge period. (The petition period runs for 21 days beginning on the date that petitions are first made available in the Board's office.)

How to Become an ANC Candidate

Nominating petitions are available in the Board's office in Room 250 of the One Judiciary Square Building. When peiitions are picked up, the candidate also receives a list of registered voters in the SMD eligible to sign the petition, as well as other materials.

Candidate Filing Reguirements

A candidate must file the following documents with the Board of Elections by the filing deadline:

1. A petition with the signatures of at least 25 duly registered voters registered in the SMD;

2.

A notarized "Declaration of Candidacy· signed by the candidate; and

An "Affidavit of the Person Filing the Petition" stating that the petition has the minimum number of signatures.

The Petition Challenge Period

Petitions are available for public inspection and possible challenge in the Board's office, for five working days, beginning on the third day after the filing deadline.

Certification of Nominee(sl

At the end of the challenge period (or after all challenges are resolved), the Board certifies a list of the individuals who qualify for appointment to the AdviSOry Neighborhood Commission.

Appointment Or Election To Fiff The Vacancy

If no qualified candidates file petitions, the Board must recertify-the vacancy by publishing notice in the D.C. Register and making petitions available again.

If only one candidate meets the qualifications for appointment, the Commission must appoint that person to fill the vacancy at its next regularly scheduled meeting.

If more than one candidate meets the qualifications, the ANC must give notice at a public meeting that at the next regularly scheduled meeting there shall be an open vote of the registered voters of the affected SMD to elect the new Commissioner. Votes must be counted by at least two impartial vote counters and the results must be read aloud by the Chairperson or his or her designee.

The AN(~ must send the Board of Elections a copy of any resolution which appoints or elects a candidate to the office of Commissioner. The Board then declares the' vacancy filled by publishing notice in the D.C. Register.

Qualifications for Office

To hold the office of ANC Commissioner, a person must meet these requirements:

Be a registered D.C. voter;

Live in the SMD from which nominated;

Have lived in the SMD continuously for the 60 days immediately preceding the day on which the nominating petition is filed; and

Hold no other elected public office.

Information Circular on Advisory Neighborho!ld Commissions

What is an ANC? .....

Called " ... a unique experiment in neighborhood democracy" by the League of Women Voters, ANC's were established by the Home Rule Charter in 1973 and approved by voters in the May 7, 1974 Charter Referendum Election. ANC's function as citizen advisory boards, which represent the citizens of a particular neighborhood area. Their role, as defined by the D.C. Election Code, includes advising the District government,

" ... on matters of public policy including decisions regarding planning, streets, recreation, social services programs, health, safety, and sanitation in that neighborhood commission area;" (D.C. Code, Section 1-2SI(c)(I».

The law also states that recommendations made by the ANC " ... shall be given great weight" (D.C. Code, Section 1-261(d» by government agencies as they deliberate on matters that affect the residents of the ANC area.

ANC Commissioners serve two-year terms as unsalaried, nonpartisan officials elected by voters to represent their neighborhood areas. The structure of these neighborhood areas is discussed below.

Structure of the ANC's

The District's 299 Single Member Districts (SMD's) are smaller geographical and political units within the city's 37 Advisory Neighborhood Commissions. Each SMD contains approximately 2,000 residents and elects one Commissioner to serve on the area's Advisory Neighborhood Commission.

In most cases, the ANC's exist within ward boundaries, and each ANC is numbered to identify the ward where it is located: For example, ANC's 4A, 4B, 4C, and 4D lie within Ward 4. The SMD's within each ANC are numbered consecutively. For example, SMD's 4AOI, 4A02, 4A03, 4A04, 4AOS, 4A06, 4A07, and 4A08 comprise ANC 4A. Candidates running for a seat on the ANC are elected by the registered voters of the SMD in which the candidate resides.

How to Become an ANC Candidate

To appear on the ballot - either in a scheduled general election or in a special election to fill a vacancy - an ANC candidate must submit a nominating petition with the signatures of 25 registered voters to the D.C. Board of Elections. Voteis signing the petition must reside within that ANC Single Member District. Petitions are available through the Board of Elections, at 44 I 4th Street NW, Room 250. Check the calendar for each election to find out the dates that petitions are available.

All ANC candidates must be registered voters and residents or the Single Member District rrom which they are elected. In addition, they must have resided in the SMD for at least 60 days before the date on which the nominating petition is filed.

All ANC petition forms are posted for public inspection and possible challenge after they are filed. DUring the challenge period, any registered voter may challenge the validity of the signatures on the petition form. Check the calendar for each election for the exact dates of the challenge period.

Assistance for ANC Candidates

The Board offers special services to assist ANC candidates, including a brief conference with a member of the Voter Services Staff to answer questions and to outline procedures for circulating and filing a nominating petition. During this conference, the candidate is given a listing of the registered voters in his or her SMD, a map of the ANC/SMD area, and other information materials.

ANC Voting Information ; ;

Because ANC's are nonpartisan offices, all registered voters-regardless of party arriliation-are eligible to vote for ANC candidates. The candidate receiving the highest number of votes (nofnecessarily a majority) in each ANC contest is declared the winner.
