STANDARD MONTHLY BUSINESS

Mr. Shissler announced that Ann Lantz has turned in her resignation from Delmont Council due to medical reasons. Becky Matesevac made the Motion to Accept Ann Lantz’s resignation, Pam Simpson Seconded the Motion - All Approved.

Bill Marx made the Motion to have Dennis Urban fill the vacancy on Council for Ann Lantz since Mr. Urban was selected in the recent preliminary election to be on the ballot with the highest amount of votes. Becky Matesevac Seconded the Motion. Mr. Urban will be seated at the next Borough Council Meeting after his Statement of Financial Interest is turned in, Mr. Hewitt composes the Resolution and Oath are in place.

MEETING MINUTES:

Council reviewed the July Council Meeting Minutes, Pam Simpson made the Motion to Accept the July Council Minutes. Becky Matesevac Seconded the Motion. All Approved.

TREASURER’S REPORT:

Prepared and submitted by Council President, Andrew Shissler, on display, but not read. Motion to Approve Treasurer’s Report made by Stan Cheyne. Motion Seconded by Bill Marx. Motion Passed unanimously.

BILLS:

Bills on display but not read. Bill Marx made the Motion to Pay the Bills. Becky Matesevac Seconded Motion. Motion Passed unanimously without further discussions.

FTMSA – DEP CONSENT COA

Wes Long, solicitor for FTMSA spoke on the Consent COA that Delmont Borough was going to vote on. There are 9 municipalities that are within the order. March 2020, FTMSA will start 6 months of FTMSA flow monitoring. September 2021 FTMSA will present the results. January 2021 there would be the requirement of visual inspection of system/popping off the manhole covers in the Borough. September 2022 FTMSA will have the overflow elimination plan that will be presented to all impacted municipalities for their review. March 2022 FTMSA will have the Model of the plan. He expressed that hopefully by mid-2028 this will be completed. A separate agreement would need to be signed by all the boroughs for paying for the solution once it is reached.

Stan Cheyne asked what the recourse would be if the Borough did not sign the agreement. Mr. Long said the Borough would not be granted any tap-ins until it was signed. DEP would also take steps to make the Borough sign the agreement. Mr. Long also answered questions regarding which municipalities have agreements in place with FTMSA to cover the cost of the repairs. It was noted that Salem, Export, and Delmont do not have any agreements in place with FTMSA for the cost to repair any deficiencies found.

Stan Cheyne made the Motion to sign the 2019-12 DEP Agreement. Bill Marx Seconded the Motion – Motion Passed Unanimously.

MEGHAN SHISSLER – GIRL SCOUT TROOP 24142 – GOLD AWARD

Megan Shissler told Council and audience about her Girl Scout project. She participated in a program that was held in July at the Delmont Public Library – Space-themed Program (ages 5-8). This project was based on math skills with using Oreos. There was also a camp she attended entitled PFEW (Pennsylvania Free Enterprise Week). This was a business camp where they had to create a company and its structure. Her company of 15 people was a fitness-type that produced patches similar to Icy Hot patches. This is all part of her achieving the next level of Girl Scouts.

CITIZENS’ COMMENTS

Anna Marie Stackiwicz – 222 Aurora Street The Westmoreland Heritage Murrysville to Export section will be finished August 17th. This will coincide with the Export Music Festival. Next they will start work on Export to Delmont connection.

Brewhaus will take place on September 7th at Newhouse Park. Tickets are $20 to benefit Delmont Recreation. Kids are free!

David Boles – 8 Faith Drive Mr. Boles brought up the lack of consistency with Republic garbage services. Sometimes the recycling is done on Fridays, other times it is not done till Monday. Republic does not have a dedicated line to contact them if there is an issue. He feels there is no communications. He said that Republic was to replace the bins, but have not yet done so. Mr. Cheyne reminded all that Westmoreland Cleanways takes glass for recycling. He said there will be an additional charge for wheeled cans and that contacting Republic for information on how to upgrade totes can be done, but there are not plans for Republic to replace everyone’s recycling bins. Mr. Hewitt said he will pull the contract to see if there are any walkaway possibilities with the Republic Services.

John and JoAnn Orszulak – 18 Harrison Avenue Mr. Orszulak wanted to talk about the issues he is having with a huge walnut tree located on his neighbor’s property, but the nuts are dropping on the road and his property. He had pictures to show the mess that the nuts leave after being broken. He is concerned for his safety with the nuts dropping. Mr. Hewitt said it was not within the Borough’s responsibilities unless the branches over the roadway impair any vehicle safety. As long as trucks like the garbage collection vehicles can safely pass under the branches, the Borough cannot help with the situation. It was suggested to try to work it out with the neighbor.

WHEREAS, Delmont, FTMSA, Export, Salem, PTSA, MMA, Murrysville, Penn Township and Monroeville have negotiated a Consent Order and Agreement with the DEP to resolve sanitary sewer overflows (“SSOs”) in the FTMSA sewer system; and WHEREAS, the Council of the Borough of Delmont finds it necessary to pass this resolution authorizing the Borough to enter into and execute the Consent Order and Agreement, a true and correct copy of which is attached hereto, made a part hereof, and marked Exhibit “A.” NOW, THEREFORE, the Council of the Borough of Delmont hereby resolves as follows:

1. The Council of the Borough of Delmont agrees to enter into and execute the Consent Order and Agreement with Export, Salem, PTSA, MMA, Murrysville, FTMSA, Penn Township, Monroeville and the DEP to participate in the resolution of the SSOs in the FTMSA sewer system in accordance with the terms, conditions and provisions of the Consent Order and Agreement. 2. The Council of the Borough of Delmont, by entering into the Consent Order and Agreement, agrees to be bound by the terms, conditions and provisions thereof and shall perform and discharge the duties and obligations imposed upon the Borough by virtue of the terms, conditions and provisions of the Consent Order and Agreement.

ENGINEERING REPORT – Kevin Brett

Mr. Baird instructed Council on required Municipal Separate Storm Sewer System (MS4) training. This showed the updated permit schedules, annual MS4 tasks, pollutant reduction plan and pollutant control measures.

SOLICITOR’S REPORT Daniel J. Hewitt, Esq., Avolio Law Group, P.C.

Resolution 2019-13 – Appoint Tim Beadling to the Delmont Recreation Board through December 31, 2023. Stan Cheyne made the Motion to Approve Resolution 2019-13, Ms. Matesevac Seconded the Motion – All Approved.

Resolution 2019-14 – Authorizing the Borough to Submit an Application for Federal Financial Assistance with the U.S. Department of Agricultural, Rural Development, Rural Utility Service. Stan Cheyne made the Motion to Approve Resolution 2019-14, Mr. Marx Seconded the Motion - All Approved.

Proclamation the Mayor has signed for August 15, 2019 to dedicate the new basketball court at Newhouse Park – Dedicated Nursing Association Day. Stan Cheyne made the Motion to accept the Proclamation, Pam Simpson Seconded the Motion – All Approved.

Authorization to prepare a memorandum between Delmont Borough and the window company to have access to Shields Farm for their stormwater improvement project at the boundary. DCNR asked that Delmont has their engineers work with the window company to properly size the pipe they will need to take our stormwater out of the amphitheater area. Bill Marx made the Motion to give Authorization, Stan Cheyne Seconded the Motion – All Approved.

PUBLIC SAFETY/POLICE AND FIRE DEPARTMENT REPORT – Mayor, Alyce Urban

Mayor Urban told Council that she stopped by the new Ace Hardware store. The Grand Opening will be the weekend of September 21st and 22nd. The Pilgrimage Committee is holding a Vintage Sock Hop at the Parklett on Saturday, August 24, 2019, from 4:00 pm to 7 pm. Tickets are $10. Stan Cheyne made the Motion to Allow the Alley (Heaps Way) to be closed during the Vintage Sock Hop. Pam Simpson Seconded the Motion – All Approved.

Chief Klobucar provided the Delmont Borough Police Department July Report. Copies were made available for the attendees. 110 Total Calls – 51 Traffic Citations, 4 Criminal Arrest and 2 Non-Traffic Citations. Chief Klobucar addressed the incident on West Pine Street. There will be additional information at next month’s Council Meeting. The Chief wanted to stress that at no time was the public in any danger. All departments worked well together.

Chief Klobucar met with the Apple and Arts Festival leads. They decided on assigning levels to storm events to have responders know to assess the situation. The Chief is looking into notification systems.

Brant Waugaman, part-time officer, gave notice that he will be going to Pittsburgh University. That leaves the Borough with 2 part-time Officers at this time. Becky Matesevac Made the Motion to hire Officer Greg Stull as a full-time Delmont Police Officer pending he passes the final required exam – Pam Simpson Seconded the Motion – All Approved.

BUILDING AND RENTALS Ann Lantz and Bill Marx, Council Vice President

Mr. Bill Marx told Council he would like to hold off the roof bids at this time. Council will revisit the possible costs or replacing the Borough Building roof with the possibility of repairing the problem areas.

Bill Marx spoke on the suppliers that are available for the electricity for the Borough accounts. The bids they had received needed to be signed by September 1, 2019. Kellie Miele will reach out to the supplier to extend that date and get the updated prices for next Council Meeting in September.

Mrs. Matesevac said there was nothing new to report regarding Personnel or Insurance.

FINANCE COMMITTEE Andy Shissler, Council President, Becky Matesevac

The “Big Picture” monthly report for the General Funds shows that the Borough is on track with revenue and expenses. Numbers reflect being about 60% through the fiscal year. The Borough is tracking the revenue for the wreaths and the Farmers Market.

Stan Cheyne turned over a check from the Pittsburgh Foundation that will be used to purchase (two) 15 ft. player’s benches at the new basketball court at Newhouse Park.

Sewage Fund Report is showing the revenues and expenses are on track for the time period.

SEWAGE COMMITTEE Stan Cheyne and Bill Marx

No additional information was given.

SHIELDS FARM – Andrew Shissler, Council President

Mr. Shissler spoke on the Log Cabin restoration effort. He had no new information that was confirmed at that time.

GRANTS – David Piper.

Mr. Piper was not present.

CONTRACTED TRASH – Stan Cheyne

Mr. Cheyne no additional information.

OLD AND NEW BUSINESS: No other updates.

Mr. Rebitch asked if there was an Ordinance with Rental Properties in Delmont. Suggested that the Borough should look into that since most of the buildings in the downtown area are rental properties.

Council will adjourn to Executive Session to discuss property issues.
