1.0 SUBMISSIONS

1.1 DELIVERY AND OPENING OF TENDERS

1.1.1 Given the current situation with the COVID-19 pandemic, the Municipality of Sioux Lookout will ONLY be accepting electronic submissions via e-mail. All submissions should be sent with the subject line stating “Bid Submission T015-2020” and sent to:

All tenders must be received no later than Monday, June 8th 2:00 p.m. Local Time. Tenders submissions will not be accepted by faxsimile or hardcopy.

1.2 PREPARATION OF TENDERS/QUOTES

1.2.1 All tenders must be submitted on the bid form provided together with security as specified. The tender must be signed by the Tenderer and witnessed and the lump sum price for the work must be both in words and figures as computed from the schedule of unit prices. Unit price extensions and totals will be checked following tender opening and, in the event that discrepancies occur, the corrected sum price shall govern.

1.2.2 Tenders will be considered incomplete and will be rejected if the following is not included:

1.2.2.1 Completed Bid Form, Division 0, Section 00 41 00, all pages inclusive.

1.2.2.2 Tender Deposit.

1.2.2.3 Agreement to provide a Performance Bond and Labour and Material Payment Bond.

1.2.3 Upon submission of a completed Bid Form, Division O, Section 00 41 00, all pages inclusive, from the Bidder at the designated office before the established time of closing Bids, the Bidder may make amendments to Bid only by letter provided such letter is complete with Project Title, the revised unit cost(s) and revised total cost(s) of the revised item(s) and the new Total Estimated Contract Price. The letter must be received in the designated office prior to 1:00 pm, Local Time, on the specified closing date. Neither tender submissions nor revisions will be accepted by facsimile.

1.3 DISCREPANCIES, OMISSIONS, INTERPRETATIONS

1.3.1 Should a Tenderer find discrepancies in or omissions from the Contract Documents or be in doubt as to any meaning or have any questions whatsoever in connection with this tender, they should enquire directly to Andrew Jewell, Public Works Manager, Telephone No. (807) 737-1234 or by email - [email protected]. No oral interpretation will be effective to modify any provision of the Contract Documents. Any modification will be an addendum issued by the Municipality and sent to all known Tenderers.

The last date and time for inquiries with respect to this tender shall be 2:00 p.m. Friday, June 5th 2020, Local Time.

1.4 BID BOND AND AGREEMENT TO BOND TENDER DEPOSIT

1.4.1 A tender deposit will not be required for this contract. The tender will be invalid if a Tender Deposit in the form of a certified cheque is not submitted with the offer.

1.4.2 The Bid Bond shall be on CCDC Form 220, issued by a company whose guarantee bonds are acceptable to the Municipality.

1.4.3 The Bid Bond shall be in the amount of 10% of the tender value. The Bond shall be valid for a period of sixty (60) days from the date of tender submission. The amount of the Bid Bond shall forfeit to the Municipality if the Bidder fails to furnish a Performance Bond and Labour and Material Payment Bond within thirty (30) days of receiving notification of being awarded the Contract. The Tender Deposit shall be equal to 10% of the amount of the tender, in the form of a certified cheque payable to the Municipality of Sioux Lookout. The Tender Deposit of the Tenderer awarded the contract will be retained as contract security until the issuance of Substantial Completion. All other Tender Deposits will be returned after award of the contract.

1.4.4 Submit with the tender an Agreement to Bond including a Performance Bond in the amount of 50% of the contract value and a Labour and Material Payment Bond in the amount of 50% of the contract value. Such agreement shall be by surety company authorized by law to carry out business in the Province of the Place of Work.

1.4.5 The Tender Deposit value shall be derived from the entire cost of the work, less the HST amount.

2.0 PERFORMANCE AND LABOUR MATERIALS PAYMENT BONDS

2.1 The Performance Bond shall be fifty percent (50%) of the Contract Sum. The Labour and Materials Payment Bond shall be fifty percent (50%) of the Contract Sum. The Bonds shall guarantee the faithful carrying out of work to satisfactory completion. The Performance Bond and Labour and Materials Payment Bond shall be deposited with the Municipality before the contract is signed. Cost for bonding shall be included in the stipulated price of the Contract.

3.0 REQUIRED INFORMATION

3.1 Each Tenderer is required to supply the following information with their tender submission on the form provided.

3.1.1 Details of the Tenderer's experience including details of the work performed, for whom and the value.

3.1.2 Numbers and functions of personnel to be employed on the work.

4.0 REJECTION OF TENDERS

4.1 The Owner reserves the right to reject any tender or all of the tenders, and the lowest or any tender will not necessarily be accepted.

4.2 Without limiting the generality of the foregoing, any tender which is incomplete, conditional,

illegible or obscure or which contains additions not called for, reservations, erasures, alterations or irregularities of any kind may be rejected.

4.3 Any tender in which any price is omitted or in which prices are obviously unbalanced, may be rejected.

5.0 DISQUALIFICATION OF TENDERS

5.1 Under no circumstances will tenders be considered which are received by the Municipality’s authorized representative in his office after the advertised closing time.

6.0 WITHDRAWAL OR QUALIFYING OF TENDERS

6.1 A Tenderer who has already submitted a tender may submit a further tender at any time up to the official closing time. The last tender received shall supersede and invalidate all tenders previously submitted by that Tenderer for this contract.

6.2 A Tenderer may withdraw or qualify his tender at any time up to the official closing time by submitting a letter bearing his signature and seals as in his Tender to the Municipality’s authorized representative in his office who will mark therein the time and date of receipt and will place the letter in the tender box. The Tenderer shall show his name and the project and contract numbers on the envelope containing such letter. Tender withdrawal or qualification will not be accepted by facsimile.

7.0 TENDER ACCEPTANCE AND CONTRACT AWARD

7.1 The Contract, if awarded, will be awarded to the qualified bidder who has proposed the lowest contract sum subject to the Owner’s right to reject any or all bids and to waive informality and irregularity in bids and bidding. The Owner may use the Credit Prices (if requested in the tender form) provided by bidders to determine the lowest contract sum. Further, the Owner reserves the right to negotiate a reduced bid price with the lowest compliant bidder.

7.2 The Tenderer whose tender is accepted will be required to execute the Contract within fifteen (15) days (except Sundays and statutory holidays) after notice that the Contract documents are available for execution. Failure to do so shall constitute a breach of the agreement effected by the acceptance of this tender.

7.3 The form of the Agreement which the successful bidder, as Contractor, will be required to execute is CCDC 4 – 2011 Unit Price Contract. This document shall be considered an integral part of the specification.

8.0 LIABILITY INSURANCE, WORKPLACE SAFETY AND INSURANCE BOARD (WSIB), RETAIL SALES

TAX

8.1 The following must also be provided by the successful Tenderer prior to signing of the Contract Documents:

8.1.1 An insurance policy(ies) as required by the Contract documents.

8.1.2 A certificate from the Contractor's insurer outlining the expiry dates of all insurance policies and certifying that the Municipality under the terms of this Contract will be given thirty (30) days notice regarding any change or cancellation in the policies concerned.

8.1.3 WSIB Clearance.

8.2 SALES TAX

8.2.1 The Tenderer shall include or exclude sales tax in accordance with current sales tax legislation taking into account any changes that have been made known by the Government and that will occur during the life of the Contract.

8.2.2 If sales taxes are increased or decreased, or other amendments are made in the legislation, during the course of the Contract, that alter tax amounts carried in the Contract price, an adjustment will be made accordingly.

8.2.3 The Contractor shall keep records and invoices of accounts subject to Federal and Provincial sales tax for the purpose of establishing taxes paid and for substantiation in the event of changes to the tax legislation during the course of the Contract.

8.2.4 The Tenderer shall contact the sales tax authorities and determine what the applicable taxes are and the procedures for tax exemption and/or refunding and include related administrative costs in the tender.

9.0 INSPECTION OF SITE

9.1 The Tenderer shall be deemed to have inspected and examined the site and its surroundings and to have satisfied himself before submitting the tender as to all matters relative to the nature of the land and subsoil, the form and nature of the site, details and levels of existing services, the quantities and nature of the work and materials necessary for the completion of the works, the means of access to the site and in general to have himself obtained all necessary information as to risks, and other climatic, hydrological and natural conditions or such contingencies which influence or affect his tender.

9.2 No claim will be entertained in this respect.

9.3 A non-mandatory site visit is set for 3:00 p.m., Tuesday, April 28h, 2020, Local Time. Bidders will meet at the location of the work, Sioux Lookout.

10.0 DURATION OF TENDER VALIDITY

10.1 Tenders must be submitted on the basis of remaining firm and valid for acceptance by the Municipality for a period of thirty (30) days from the date of closing. Beyond the thirty (30) day period, the tender can be regarded as null and void by either the Municipality or the Tenderer.

11.0 BREAKDOWN OF STIPULATED SUMS

11.1 The Tenderer shall complete the breakdown of stipulated sums on the forms included with the Bid Form where indicated.

12.0 CONTRACT SCHEDULE

12.1 The Contractor may commence work on-site upon contract award, acceptance of time schedule of operations by the Municipality and as weather and site conditions permit.

12.2 The successful Contractor will be required to furnish a complete time schedule of the various operations of the work within seven (7) days of contract award.

12.3. The final date for Substantial Performance, July 31st, 2020, is based on a Contract award date no later than June 19th, 2020.

12.4 Total Completion inspection to be thirty (30) days after the date of Substantial Performance.

13.0 CONTRACT ORGANIZATION

13.1 Throughout the documents, the words "Owner" and "Municipality of Sioux Lookout" (Municipality) will be considered interchangeable.

13.2 Throughout the documents, the words “Consultant” or “Engineer” shall mean the “Owner” or

“Public Works Manager” or “Owner’s Designate” and will be considered interchangeable. 13.3 The Contract described in these documents will be between the Municipality of Sioux Lookout

and the Contractor.

13.4 The Municipality will administer the Contract and will provide site representation during the duration of the Contract.

14.0 SITE SURVEY

14.1 The Contractor is responsible to verify any existing site survey, invert or depth of bury information provided on the Drawings. The Contractor is responsible to obtain any additional survey, invert or depth of bury information required to complete the construction.

15.0 SOILS REPORT

15.1 There were no soils investigations conducted.

16.0 OWN FORCES

16.1 Where the bidder has indicated own forces on Section 00 41 00 provide, at the request of the Engineer, proof that the person(s) to be employed to undertake this work are qualified, competent, experienced tradesmen.

16.2 The Owner reserves the right to reject a sub-trade on the basis of qualification or demonstrated ability on the job site at the discretion of the Engineer. No compensation will be made for replacement of a sub-trade rejected on the basis of qualification or competency.

17.0 SITE ACCESS, EQUIPMENT AND MATERIAL MOBILIZATION

17.1 The Contractor shall be responsible for the mobilization of all equipment and materials required to complete this project.

17.2 Mobilization includes the preparation, transportation, off-loading and secure storage of all material, equipment, supplies, etc. required for the completion of the project.

17.3 The contractor will be fully responsible for providing access to all required work areas of the project to facilitate construction.

17.4 No claim, arising from the tenderer’s failure to access the work site or mobilize equipment and material, will be considered.

19.0 AVAILABILITY

19.1 Documents may be obtained electronically on the Municipality’s Website (siouxlookout.ca).

19.2 Bid documents may also be ordered directly from the Municipality. A non-refundable charge of $50 per set payable by cash or cheque is required to process the order.

19.3 Bid documents are made available only for the purpose of obtaining offers for this project. Their use does not confer license or grant for other purposes.

1.0 GENERAL

1.1 GENERAL PROTECTION

1.1.1 Provide temporary protection for the safe movement of local traffic and pedestrians. All traffic control plans must conform to the Ontario Traffic Manual, Book 7

1.1.2 Provide barricades and lights where directed and where required by the Ontario Occupational Health and Safety Act.

1.2 UNDERGROUND SERVICES

1.2.1 There are various underground services (cables, piping, etc.) located within the boundaries of the construction site. Some of the underground services are in use and to remain in service while others must be relocated/replaced or abandoned and removed under the contract. Include sufficient allowance in the contract price to thoroughly locate, investigate and determine the function of each underground service. Ensure that the existing underground services unaffected by this project are maintained operational throughout construction.

1.2.2 The Contractor shall be responsible for locating existing surface and underground structures and utility installations that may affect the work or may be damaged during construction.

1.2.3 The contract site plan provides a preliminary indication of the existing underground services which requires further investigation by the Contractor.

1.2.4 The Contractor shall confirm exact locations and elevations of underground facilities by test excavations.

1.2.5 The Contractor shall contact the appropriate local agency responsible for locating water, electric, phone, cable etc. This activity will be discussed at the pre-construction meeting.

3.1 This project will be completed, ready for Substantial Performance, no later than:

3.2 If there are no delays in the performance of the work, as specified in the Contracts General Condition Items GC 6.5.1, GC 6.5.2 and GC 6.5.3, then liquidated damages in the amount of 400.00 per day will be deducted for each day beyond the date specified that Substantial Performance is not obtained.

3.3 If our Tender is accepted we agree to start work no later than seven (7) days after Contract Award and to work vigorously and continuously to complete the project as specified in the previous paragraph.

4. LIST OF SUB-CONTRACTORS

We submit herewith a list of sub-contractors whom we propose to employ for the performance of such portion of the work as indicated. We have investigated the following sub-contractors and confirm that they are reliable and competent to carry out the work satisfactorily. It is agreed that there will be no substitution in sub-contractors without the approval of the Consultant having been previously obtained in writing. We agree to provide on-site supervision/representation at all times when a sub-contractor is conducting any work required under this Contract. Failure to provide Contractor representation or on-site supervision while a sub-contractor is performing their work will result in a charge of $600/per day by the Owner or Consultant for fulfilling requirements of the Contractor.

7. If our Tender is accepted it is agreed that we will execute (if called upon to do so), a formal

Contract based on the terms and conditions contained in these documents within seven (7) days of contract award.

8. It is understood and agreed that on the event of this Tender being accepted within sixty (60)

calendar days of the time stated for closing of tenders and our failing or declining to enter into a contract in accordance with the terms of our tender, our security deposit will be forfeited to the Owner or if in the form of a certified cheque in lieu of any damages to which the Owner may be entitled by reason of our failure to enter into such a Contract, and it shall not be necessary to prove any special damages.

9. To do any extra work not covered by the Schedule of Unit Prices which may be ordered by the

Consultant, and to accept as full compensation therefore, such prices as may be agreed upon in writing by the Consultant and the Contractor in accordance with Part 6 of the General Conditions - Valuation and Certification of Changes in the Work.

The General Conditions of the Unit Price Contract, Canadian Construction Documents Committee Document - CCDC 4 - 2011, shall be considered complete only as amended and supplemented by the following Supplementary General Conditions. These Supplementary General Conditions are part of the Contract Documents. AGREEMENT ARTICLE A - 5 PAYMENT

GC 3.10 SHOP DRAWINGS

GC 5.3 PROGRESS PAYMENT

Revise item 5.3.1. from "twenty calendar days" to read "twenty-eight calendar days"

GC 5.4 SUBSTANTIAL PERFROMANCE OF THE WORK Delete items 5.4.1, 5.4.2, and 5.4.3. Add items 5.4.4 to 5.4.15, inclusive as follows:

5.4.4 This Contract shall be deemed substantially performed in accordance with the Ontario

Construction Act when the Work is;

5.4.4.1 ready for use or is being used for the purpose intended; and

5.4.4.2 capable of completion or, where there is a known defect, correction, at a cost of not more than;

5.4.4.2.1 3% of the first $1,000,000 of the Contract Sum.

5.4.4.2.2 2% of the next $1,000,000 of the Contract Sum.

5.4.4.2.3 1% of the balance of the Contract Sum.

5.4.5 Where the work or a substantial part thereof is ready for us or is being used for the purposes intended and the remainder of the Work cannot be completed expeditiously for reasons beyond

the control of the Contractor or, where the Owner and the Contractor agree not to complete the Work expeditiously, the price of the services or materials remaining to be supplied and required to complete the Work shall be deducted from the Contract Sum in determining substantial performance.

5.4.6 Prior to advising the Consultant that the Work is substantially performed, the Contractor shall

undertake an inspection of the Work with his forces and those Subcontractors or their representatives as he may require.

5.4.7 Upon completion of this inspection a list of all uncompleted and unsatisfactory work shall be

prepared by the contractor and issued to all those concerned. A copy shall be forwarded to the Consultant.

5.4.8 The Contractor and all those concerned shall proceed with the uncompleted work and remedy

those parts considered unsatisfactory as expeditiously as possible. 5.4.9 When the Contractor has determined the project meets the requirements of substantial

performance, as defined above, he shall then make a written application to the Consultant for a Certificate of Substantial Performance.

5.4.10 This application shall include:

5.4.10.1 a statement to the Owner to the effect that:

5.4.10.1.1 the Contract is substantially performed; and

5.4.10.1.2 the performance of the balance of the Contract is in process and total performance is scheduled for the day of:

5.4.10.2 a statement showing the amount of holdback monies due for release and payment

following the issue of the Certificate of Substantial Performance.

5.4.10.3 the Contractor's invoice for payment, together with definite evidence by means of Statutory Declaration (CCDC 9A) that all accounts, assessments and levies in connection with the Work under the contract have been paid; that no claims, liens or encumbrances exist; and that all requirements in connection with the Workmen's Compensation Act or other social or labour legislation and all other liabilities of the Contractor have been paid.

5.4.10.4 a list of operating instructions, maintenance manuals, spare parts and materials,

and those things which are required by the Owner in order to be able to properly operate the premises.

5.4.10.5 a statement of completion with cost values of:

5.4.10.5.1 work to be completed included work found by the Consultant to be

unsatisfactory;

5.4.10.5.2 outstanding items referred to above;

5.4.105.3 work which cannot be performed for reasons beyond the control of the Contractor.

5.4.11 Within ten (10) days of receipt of this written application the Consultant shall carry out the

inspection together with any consultants as he may require, the Contractor and any Sub-contractor deemed necessary by the Contractor, and the Owner's representatives.

5.4.12 In the event that the Consultant deems the completion of the Work does not qualify for issuance

of the Certificate of Substantial Performance, they shall so notify the Contractor in writing within five days of his inspection and give reasons for the non-acceptance. The Contractor shall complete the Work necessary to comply with the requirements of Substantial Performance as herein before defined, and re-submit his application. The Consultant shall make a re-inspection within ten (10) days of the notification. The Contractor is responsible for all consultant costs associated with re-inspections.

5.4.13 On the application of the Contractor, the Consultant shall determine whether the Contract has

been substantially performed. Where they so determine, they shall certify the Substantial Performance.

5.4.13.1 the Consultant shall set out in the Certificate the date on which the Contract was

substantially performed.

5.4.13.2 where the Consultant certifies the substantial performance of a Contract they shall, within seven (7) calendar days of the Day of the Certificate is signed, give or send a copy of the Certificate to the Owner and to the Contractor.

5.4.13.3 the Contractor shall publish a copy of the Certificate once in a construction trade

newspaper. 5.4.14 The Contractor's application for a Certificate of Substantial Performance and the release of

holdback monies shall be submitted separately from his application for regular progress payments, the latter shall continue to be made throughout the duration of the Contract.

5.4.15 The date on which a copy of the Certificate of Substantial performance is published in a

construction trade newspaper shall be the commencement of the sixty (60) day period prior to the release of holdback monies. The Contractor's and his Sub-contractor's forces shall continue to work towards total completion during the sixty (60) day period mentioned above.

GC 5.5 PAYMENT OF HOLDBACK UPON SUBSTANTIAL PERRFORMANCE OF THE WORK

Delete items 5.5.1 and 5.5.2. Add items 5.5.6 to 5.5.10, inclusive as follows: 5.5.6 The 10% holdback shall be paid to the Contractor as follows:

5.5.6.1 10% after the expiration of the 60 days from the date of Primary Acceptance 5.5.6.2 3% at the termination of the guaranteed one (1) year Maintenance Period

5.5.7 When the Contractor receives his copy of the Consultant's Certificate of Substantial

Performance, the Contractor shall immediately deliver to the Consultant all operating instructions, maintenance manuals, as built drawings, spare parts and material, and those things which are required by the Owner in order to properly operate the premises; delivery of these items will facilitate the release of holdback monies on the expiry of sixty (60) days from the date of publication of the copy of the Certificate of Substantial Performance.

5.5.8 The Consultant shall prepare the Certificate of Payment of the lien holdback monies and

promptly upon receipt of the documentation, as listed above, required for the release of these monies, issue the Certificate to the Owner, with a copy to the Contractor. This Certificate shall be dated one day after the termination of the sixty (60) day period.

5.5.9 The Owner shall, subject to prior claims and existing liens, make payment of the lien holdback

monies fifteen (15) days after the termination of the sixty (60) day period. 5.5.10 Before expiry of the sixty (60) day period, all forms of insurance shall be reviewed jointly by the

Consultant and the Contractor to ensure adequate coverage for all parties.

GC 5.7 FINAL PAYMENT

Delete item 5.7.4. Add items 5.7.5 to 5.7.10, inclusive as follows: 5.7.5 When the Contractor is satisfied that the entire Work is completed, and after making his own

inspection, he shall make a written request for a final inspection by the Consultant, who in turn shall notify the Owner. This inspection shall be carried out within ten (10) days of the request, and completed as quickly as possible, and shall constitute the inspection precedent to the issuance of the final certificate of payment.

5.7.6 The final inspection team shall include the Consultant and such Consultants as he may require,

the Contractor, and any Sub-contractors deemed necessary by the Contractor, and the Owner's representatives.

5.7.7 If there are any deficiencies determined by this inspection, they shall be listed by the Consultant

and provided to the Contractor. This list shall be recognized as the final deficiency list for the purpose of acceptance of the Work under the Contract.

5.7.8 Such deficiencies shall be corrected by a date mutually agreed upon between the Consultant

and the Contractor, unless a specific date is required by the Contract, and a re-inspection by the Consultant shall be called for by the Contractor following his own inspection to take place within seven (7) days from the date of request.

5.7.9 The Contractor shall thereafter submit his invoice for final payment together with definite

evidence by means of a Statutory Declaration (CCDC 9A) that all accounts, assessments and levies in connection with the Workmen's Compensation Act or other social or labour legislation and all other liabilities of the Contractor have been paid.

5.7.10 Subject to prior claims and existing liens, final payment shall be made to the Contractor no later

than fifteen (15) days after the termination of the sixty (60) day lien period. GC 6.5 DELAYS 6.5.6 Add General Condition No. 6.5.6 to read as follows: “If the Contractor shall neglect, fail, or refuse to complete the Work within the time specified for Substantial Performance in the Contract, and the Contractor is not delayed in the performance of the Work, as specified in the Contract’s General Condition Items GC 6.5.1, GC 6.5.2 and GC 6.5.3, then the Contractor does hereby agree, as part consideration for the awarding of this Contract, to pay the Owner, as liquidated damages and not as a penalty, the sum of $400 per day for each calendar day beyond the dates set forth in the Agreement that the Contractor fails to achieve Substantial Completion for the Project. The said amount is fixed and agreed on by and between the Contractor and the Owner because of the impracticality and extreme difficulty of fixing and ascertaining the true value of the damages which the Owner will sustain by failure of the Contractor to complete the Work on time, such as service charges, interest charges, delays caused to other construction activities of Owner by failure to perform this Contract, and other damages, some of which are infinite and not susceptible of easy proof, said amount shall be deducted from any monies due or that may become due to the Contractor, and if said monies due or that may become due to the Contractor, and if said monies are insufficient to cover damages, then the Contractor shall pay the amount of the difference.”

GC 9.1 PROTECTION OF WORK AND PROPERTY

Revise Item 9.1.1.1 to read:

GC 12.3 WARRANTY

Revise Item 12.3.1 by:

1. substituting “Total” for “Substantial” at each occurrence in 12.3.1;

Revise Item 12.3.3 by adding:

“Should the Contractor fail to comply promptly with a written notice given by the Consultant, the Owner may, 48 hours after a further written notice to the Contractor, perform the necessary Work, which costs shall be payable by the Contractor to the Owner.”

Add Item 12.3.7:

“The Contractor does by this Agreement assign to the Owner all warranties that might be furnished to the Contractor by the Product Suppliers and Subcontractors during the course of the Work with respect to the Work.”

PART 13 OPERATIONAL RISKS 13.1 Damage, loss, expense and delay incurred or experienced by the Contractor in the performance

of the Work, by reason of unanticipated difficulties, bad weather, strike, wars, acts of God, or other mischances, shall be borne by the Contractor and shall not be the subject of a claim for additional compensation.

13.2 The position of existing pole lines, conduits, watermains, sewers and other underground and

overground utilities and structures is not necessarily shown on the Contract Drawings, and where shown, the accuracy of the position of such utilities and structures is not guaranteed. Before starting Work, the Contractor shall inform itself of the exact location of such utilities and structures and shall assume liability for damage to them. Unless otherwise specified, the

Contractor shall support such utilities and structures, or temporarily remove the, and restore them, to the satisfaction of the owners of the utilities and structures.

HEALTH AND SAFETY PROCEDURES 00 85 00

1.0 PURPOSE

The purpose of this section is to define the procedure to be followed in the administration of the Health and Safety procedure and to outline the functions of this procedure.

2.0 SCOPE

This procedure applies to all contractors and subcontractors. Each person is responsible for implementing the safety goals of this procedure.

WHMIS procedures, as required by Provincial Law, shall be adhered to and although each province has implemented standard occupational Health and Safety Acts, the requirements of these Acts are only a minimum. An employee’s common sense must be further utilized in applying on/off-the-job safety.

3.0 RESPONSIBILITIES

3.1 The Contractor is to have a Health and Safety Procedure and is responsible for ensuring that:

• its employees, sub-contractors and sub-contractor’s employees follow these guidelines; • training is provided to all its employees, sub-contractors and sub-contractors employees; • work is carried out in the manner and with protective devices, measures and procedures

required; • new employees or sub-contractors are provided with timely notice of the measures and

procedures to follow for their protection while on the job site; • protection for the public is maximized and inconvenience form the work is minimized; • current WHMIS inventory is on site and kept current by the person in charge of the site; • any employee injured receives the necessary medical attention required to ensure a speedy, safe

return to gainful employment; • when an accident occurs, appropriate reports are prepared and submitted to the appropriate

Provincial authority; • the accident is thoroughly investigated; • the Owner designee is notified of all Ministry of Labour safety inspections or direction to comply,

as soon as possible after any occurrence; • a copy of the Ministry of Labour report is submitted to the Owner designee’s attention for any

follow-up as required.

The Contractor’s worker’s responsibilities include:

• knowing and following the Health and Safety procedures; • using or wearing the equipment, protective devices or clothing that is required to be used or worn; • checking all equipment and tools prior to using them; • reporting any defects in equipment, devices, breaches of the Act and hazards to their supervisor; • avoiding “horseplay” that could result in an accident; • abiding by all Federal and Provincial Operational Health and Safety Acts and Regulations;

• abiding by all site rules and regulations imposed by an owner, general contractor, industrial establishment or Provincial Orders.

4.0 ACCIDENT / INCIDENT INVESTIGATION

Accident investigations are conducted solely to determine what caused the accident and what steps can be taken to avoid an occurrence. The Contractor is responsible for ensuring that all accidents and incidents occurring during the performance of the work or at the work site are investigated. However, the level of the investigation is dependent on the severity of the accident. First aid cases do not require investigating but should be analysed in sufficient depth to ensure that no learning experience is missed.

Investigations should be conducted promptly and without bias. It is essential that all facts concerning the accident are covered, therefore the following procedure is recommended:

a) physically check the conditions at the site of the accident including any equipment, materials, tools or environmental condition that could have contributed to the cause;

b) establish factually what happened by interviewing the injured person, witnesses and supervisor responsible and, where possible have the witnesses and the injured Person(s) return to the positions they were in when the accident occurred;

c) determine the conditions or actions that led to and cause the accident;

d) prepare a list of recommendations for preventing a similar accident.

In the case of a fatality or critically injured person, the Contractor and employer must conform to all requirements as described in the Provincial Occupational Health and Safety Acts.

The Contractor superintendent, or appointed delegate, must inform their home office of any work- related injury or illness requiring treatment beyond the first-aid level on the same day as the accident occurred.

5.0 ACCIDENT REPORTING

The Contractor shall provide reports to the Provincial Workplace Safety and Insurance Board (WSIB), the Ministry of Labour, the Health and Safety Representative and the Trade Union, as the Act requires.

5.1 The Contractor’s Responsibilities

a) Reporting to the WSIB:

1. Telephone the Owner designee to give a detailed verbal report stating job number, employee’s name, name of the doctor or hospital referred to, and the description of the accident. This activity is in addition to the report given to the Contractor’s Head Office.

2. Fill in the WSIB Treatment Memorandum form at the job site and give it to the injured employee for presentation to the doctor or hospital.

The Contractor shall act promptly as the WSIB must have the reports within 24 hours of the accident occurring. A substantial fine is levied by the WSIB for each late claim filed.

b) Reporting occupational illness:

1. Should an employee discover a case of such illness, the Superintendent shall be advised immediately.

c) Reporting accidents, including explosions, floods, failure of any equipment, device, supports, etc.

d) Reporting unsafe conditions:

1. If the risk is serious, put up a temporary barrier, attach a “danger” tag, or take other appropriate steps to prevent possible personal injury or other accident, before you report unsafe conditions.

5.2 The Worker’s Responsibilities

The worker shall report an accident immediately to the Supervisor and be available to the Supervisor to record details of the accident. The worker shall follow instructions provided by the Supervisor. The following situations shall be reported:

a) Death or critical injury:

1. The injured person should not be moved except to save the injured person’s life; wait for a certified First Aid Responder, or other, trained person;

2. Equipment and/or materials should not be moved or disturbed except to prevent further damage or injury;

3. Wait for instructions.

b) Other personal injury:

1. Depending on the circumstances, if there are any doubts about moving an injured person, send someone for a certified First Aid Responder;

2. If the injured person can move readily, accompany the injured person to the site safety office.

All personal injuries (Workplace Safety Insurance) are to be reported, including any occasion on which the worker (a) loses time, (b) receives medical aid, (c) goes to the doctor’s office and/or (d) goes to a hospital emergency ward.

Falls, with or without safety belts, unconsciousness and complaints or sprains or back strain must also be reported. These injuries are to be reported to the worker’s immediate Supervisor.

6.0 SITE SAFETY INSPECTIONS

It is recognized that good site conditions reduce the risk of injury to all persons present at the worksite and contribute greatly to the overall profitability of the project. When required by the Jurisdictional Authority, the Contractor shall provide a safety plan to the Owner designee for review prior to commencement of work. Each person should be on the lookout for unsafe acts and conditions in the workplace and take immediate action to correct any potential unsafe or hazardous situation.

1 GENERAL

1.1 This Division governs the Work of all other Sections, Sections of Division 01 are complementary and shall be read together with others.

1.2 Conform to General Conditions (CCDC) of the Contract.

1.3 Further to requirements of General Conditions (CCDC) of the Contract, Contractor shall have responsibility to study Contract Documents to determine extent of work required by each Section and upon which work of other Sections depend and to coordinate scope and extent of work to be performed by each trade. Neither organization of Specifications into Divisions and 3-part Sections format nor arrangements of Drawings, Schedules and Standard Drawings shall affect in any way Contractor’s control in dividing Work or establishing each trade’s scope of work. Claims for additional compensation arising from disputes between trades due to lack of coordination by Contractor will not be considered.

1.4 Contractor shall promptly, and not later than 10 working days of becoming aware of circumstances, which may require a change in the Work or other directions, give written notice to Consultant outlining such circumstances and requesting his written directions. Do no work in affected area, or that would prevent Consultant from properly assessing situation or evaluating change, without his prior written approval. Consultant will act promptly to give Contractor directions so work is not unreasonably delayed.

1.5 Maintain in good condition and order on site one (1) copy of Addenda, proposed changes in the Work, change orders, test reports, manufacturer’s installation and application instructions, progress photographs, as-built drawings, approved progress schedules, minutes of site meetings, and other modifications to the Contract Documents.

1.6 In accepting award of this Contract, Contractor hereby reaffirms that it is fully informed regarding all conditions affecting the Work including its company’s provincial taxes are in good standing and further accepts to complete Work for purpose intended in accordance with Contract Documents. Contractor hereby reaffirms that it does not and will not have any conflict of interest in executing work of this Contract.

1.7 In accepting award of this Contract, Contractor hereby confirms full understanding of Barrier-Free Standards in accordance with the Ontario Building Code and Accessibility for Ontarians with Disabilities Act (AODA). The Contractor and its Subcontractors shall carry out its services in accordance with the Ontario Building code, AODA, Barrier-Free Standards and with all laws, codes, regulations and all amendments.

1.8 The Contractor shall provide and pay for all materials, labour, water, tools, plant, equipment, light, heat and power and other things necessary for the execution of the Work. Both quality of work and materials shall be of requisite types and qualities specified. The care and control of the Work and site shall be the full responsibility of the Contractor and it shall be the Contractor’s duty to ensure that the Work is performed in a proper manner and as expeditiously as possible.

1.9 The Contractor shall provide fulltime, skilful and efficient superintendence to the Work, and until completion, shall provide a competent Superintendent and any necessary assistants, whenever work

is in operation on site.

2 SPECIFICATION FORMAT

2.1 Specifications are not intended as detailed description of installation methods but service to indicate particular requirements in completion of the Work.

2.2 Where Contract Documents do not provide sufficient information for complete installation of an item, then as supplement, comply with manufacturer’s written instructions for quality of work.

2.3 Portions of Specifications are written in short form. Therefore, it shall be understood that where item of the Work is stated in heading followed by material, equipment, component, or operation, works “shall be”, “shall consist of“ or similar words or phrases are implied which denote supply, fabricate and supply, install, provide or commission of such materials, equipment or operations for component of the Work designated by heading.

2.4 Whenever used in Specifications following definitions shall apply:

2.4.1 Supply – Procurement or fabrication of standard components not to special design of materials, equipment, or components, or performance of services to extent indicated. Where used with respect to materials, equipment, or components, term shall include delivery to site but is not intended to include installation of item, either temporary or final.

2.4.2 Fabricate and Supply – Fabrication of materials, equipment, or component, to special customized design to extent indicated including delivery to site, assisting in form of supervision to those Section(s) installing materials, equipment or component. Term does not include installation of item either temporary or final.

2.4.3 Install – Placement of materials, equipment, or components, including receiving, unloading, transporting, storage, uncarting and installing, and performance of such testing and finish work as is compatible with degree of installation specified complete ready for use.

2.4.4 Provide (in any used form) – To supply and install complete and in place, including accessories, finishes, tests and services as required to render item so specified complete ready for use.

2.4.5 Commission – Start up and initial operation of equipment as required and/or as specified in respective Sections, to demonstrate satisfactory operation of components and entire system including calibration of any control instrumentation as required to maintain operations.

2.5 Drawings, Lists or Schedules of Items are intended to show scope and arrangement of work. For location of item described refer to such Drawings, Lists or Schedules unless location stipulated in Specifications.

2.6 Wherever words “acceptable”, “approved”, “reviewed”, “satisfactory”, “selected”, “directed”, “designated”, “permitted”, “inspected”, “instructed”, “clarification”, “required”, “report”, “submit”, “obtain”, “consult”, “advise”, or similar words or phrases are used in Standards or in Contract Documents, it shall be understood that, unless context provides otherwise words “by/to/with/from the Consultant” shall follow them as applicable.

2.7 Term “NIC” means that work of this Project, which is not being performed or provided under this Contract; term means “Not In this Contract” or “Not a Part of the Work to be Performed or Provided by Contractor.”

2.8 “NIC” work may be specified or indicated on Drawings as an aid to Contractor in scheduling amount of time and materials necessary for completion of Contract

3 STANDARDS

3.1 Where reference is made to specification standards produced by various organizations, conform to edition of standards specified or, if not specified, to latest edition as amended and revised to date of Contract.

3.2 If requested provide copy on site of such standard(s).

3.3 Where standard designates authorities such as “Engineer”, “Consultant”, “Purchaser” or some other such designation, these designations shall be taken to mean “Consultant”.

4 BUILDING CODE

4. Comply with The Building Code Act, as amended; and the Ontario Building Code, as amended; and Regulations and by-laws of other authorities having jurisdiction including latest amendments thereto: all hereafter referred to as Code, where Code or Contract Documents do not cover particular requirement which is covered by National Building Code, 2010, conform to requirements of NBC including its related supplements. Where Drawings and/or Specifications exceed Code requirements satisfy such additional requirements.

4.2 Where material is designated in contract Documents for certain application, unless otherwise specified, that material shall conform to standards designated in Code and in absence of more restrictive requirement comply with “Housing and Small Buildings Part 9” of Code. Similarly, unless otherwise specified, and not required otherwise by Code, installation methods and standards of workmanship shall also conform to standards of Part 9. Where specific requirements for a material are not specified for certain use select from choice offered in Part 9.

5 COORDINATION

5.1 Coordinate work of each section as required for satisfactory and expeditious completion of the Work. Take field dimensions required. Take into account existing installations to assure best arrangements of components in available space. Consult before commencing the Work in critical locations. Fabricate and erect work to suite field dimensions and field conditions.

5.2 Provide forms, templates, anchors, sleeves, inserts and accessories or other components required to be fixed to or inserted in the Work. As applicable set them in place or instruct related Sections as to their location.

5.3 Pay cost of extra work caused by, and make up time lost as result of failure to comply with these requirements at proper time.

6 EXAMINATION

6.1 Examine work upon which your work depends. Report in writing defects in such work. Application of your work shall be deemed acceptance of work upon which your work depends.

7 INCLEMENT WEATHER AND COLD WEATHER WORK

7.1 Take precautions during inclement weather and provide adequate protection.

7.2 Continue the Work including winter months, until the Work is completed and accepted.

7.3 Inclement weather or extra work caused thereby shall not be considered valid reason for additional payment or delay in satisfactory conclusion of the Work.

8 MATERIALS, PLANT AND EQUIPMENT

8.1 Materials, plant and equipment specified shall form basis of Bid and Contract. Where more than one brand or manufacturer is named in Specifications, or on Drawings, base bid on material, plant and equipment which is the more costly.

8.2 Unless explicit statement is made in Bid/Contract Documents to say no substitutions will be permitted, then words “or approved equal” are hereby deemed to apply to material, plant and equipment specified by brand or manufacturer, subject to following conditions:

8.2.1 Request for substitution is made after Contract award and in accordance with the Contract documents.

8.2.2 Proposed substitution satisfies all other indicated or specified requirements and conditions.

8.3 Materials, plant and equipment shall not be damaged or defective and shall be of quality compatible with Specifications for purpose intended. If requested provide evidence as to type, source and quality. Remove and replace defective products, at own expense, regardless of previous inspections, and be responsible for delays and expenses caused thereby.

8.4 Replace factory finished equipment, or parts thereof, whose paint finish is damaged and cannot be reasonably remedied by paint touch-up.

9 MATERIAL STORAGE AND HANDLING

9.1 Store packaged materials in original, undamaged containers with manufacturers’ labels and seals intact. Handle and store materials in accordance with manufacturers’ and suppliers’ recommendations and in manner to prevent damage to materials during storage and handling.

10 LINES, LEVELS AND DIMENSIONS

10.1 Establish two (2) permanent bench marks on site, referenced to established bench marks provided by Consultants. Provide and maintain control lines and levels required.

10.2 Lay out the Work in accordance with lines, levels and dimensions indicated and/or provided on bench marks established by survey.

10.3 Verify lines, levels and dimensions. Report errors or inconsistencies in Drawings and obtain direction before commencing the Work.

10.4 Except as provided by survey, provide lines, levels and dimensions necessary to relate your work to work of other Sections.

11 GENERAL QUALITY OF WORK

11.1 Do the Work in accordance with industry practice for type of work, unless Contract Documents stipulate more precise requirements.

11.2 Do the Work in neat and careful manner to retain work plumb, square and straight.

11.3 When required by Specifications or by manufacturer’s recommendations, have manufacturer, supplier or accredited agent, inspect work which incorporates their products.

12 ACCESSORIES

12.1 Provide accessory items or materials required, such as brackets, cleats, connectors, sealants, lubricants, cleaners, protection, and similar items, whether specified or not, so that Work is complete and will perform as required.

13 DESIGN AND SAFETY REQUIREMENTS FOR TEMPORARY WORK

13.1 Be responsible for design, erection, operation, maintenance and removal of temporary structural and other temporary facilities. Engage and pay for registered Professional Engineering personnel skilled in appropriate disciplines to perform these functions where required by law or by the Contract Documents; and in cases where such temporary facilities and their method of construction are of such nature that Professional Engineering skill is required to produce safe and satisfactory results.

13.2 Engage and pay for Professional Consultant(s) registered in Province of Ontario to design and supervise construction and maintenance of hoardings, covered ways, protective canopies and project sign(s). Submit shop drawings of such work. Designs provided by Minister for such work cover general appearance only.

14 PROTECTION AND SAFETY

14.1 Under the Occupational Health and Safety Act, as amended, the Contractor shall undertake the role of the “Constructor” as defined in the Act. Be responsible to provide full safety program for anyone who gets paid for services on site including management, labour, delivery drivers, service personnel and others involved for services on Site. Arrange for pre-project meeting related to safety, joint safety inspections with Consultant where required, Site safety training and safety committees complete with accident investigation procedures.

14.2 Prior to commencement of the Work, carry out pre-construction safety audit to identify hazards and establish protocols, commitment to safety, safety rules, and safety related chain of commands for selective demolition work, sequential contract work, removal of designated hazardous materials, replacements of components and glazing items. For sequential contracts, pre-construction safety audit shall include reviewing work carried out under previous contract, which is to be taken over to form part of this Contract. Design, implement, monitor and maintain a safe work environment throughout Contract in accordance with procedures established during pre-construction safety audit. Consultant will have authority to correct deficiencies and disregard for good safety practice at Contractor’s expense. Attendance to pre-construction safety audit shall be mandatory for Contractor, Sub-Contractors and major suppliers.

14.3 Comply with requirements of Acts and Regulations with respect to health and safety including Occupational Health and Safety Act, as amended, and Workplace Hazardous Materials Information System (WHMIS) Regulation including following:

14.3.1 Before commencement of the Work, and throughout Contract, maintain on site, and readily accessible to all those who may be exposed to hazardous materials, list of hazardous materials proposed for use on site or workplace together with current Materials Safety Data Sheet (MSDS). – Provide Consultant with copy of list and MSDS as required for his transmittal to occupying ministry.

14.3.2 Ensure hazardous materials used and/or supplied on site are labelled in accordance with WHMIS requirements.

14.3.3 Provide detailed written procedures for safe handling, storage and use of such hazardous material including special precautions, safe clean up and disposal procedures. Conform to Environmental Protection Act for disposal requirements.

14.3.4 Ensure that those who handle, and/or are exposed to, or are likely to handle or be exposed to, hazardous materials are fully instructed and trained in accordance with WHMIS requirements.

14.3.5 Obtain from Consultant, where applicable, list and MSDS of hazardous materials that may be handled, stored or used by Government employees and/or Other Contractor(s) on site.

14.4 Protect excavation, trenches and building from damage by rainwater, ground water, and backing up of drains or sewers and other water, frost and other weather conditions. Provide sheeting, piling, shoring, pumps, equipment, temporary drainage, protective covering and enclosures. Provide necessary pumps including spare pump for keeping project free of water throughout construction period.

14.5 Protect, relocate and maintain existing, active services wherever they are encountered. Wherever inactive services are encountered, cap them off and remove unwanted portion, with approval of authorities having jurisdiction or public utility concerned in manner approved by them.

14.6 Load no part of structure during construction with load greater than it is calculated to bear safely when completed. Make every temporary support as strong as permanent support. Place no load on concrete structure until it has sufficient strength to safely carry such load.

14.7 Protect work of other sections from damage resulting from your work.

14.8 Damaged work shall be made good wherever possible by section whose work is damaged but at expense of those causing damage.

14.9 Prior to beginning of construction, design fire safety plan in conjunction with local Fire Chief. Post fire plan throughout construction as recommended. Do not allow accumulation of waste that may constitute fire hazard.

14.10 Provide and maintain in working order, suitable Underwriters’ labelled fire extinguishers and locate in suitable positions, to approval of authorities having jurisdiction.

14.11 Provide minimum of 3 safety helmets for Consultant and any other authorized visitors to site if required.

14.12 Protect public and those employed on the Work from injury. Equipment (mobile) when not in use shall have keys removed and locked up in secure location.

14.13 Provide watch person to guard site, premises and materials at times other than when supervised work in progress.

14.14 Be responsible to provide control measures, restraining procedures, and treatments to prevent infestation and spread of insects, rodents and other pests deemed to be present at site and/or noticed during course of the Work. Carry out fumigation, pest control procedure, and posting of warning signs, notices including contents of such notices in accordance with requirements of Pesticides Act and any other authorities having jurisdictions.

15 MANUFACTURERS’ DIRECTIONS

15.1 Except where specified otherwise, use each product in accordance with manufacturer’s published or written instructions, specifications, or recommendations regarding handling, storage, preparation, Site conditions, ancillary products or accessories, methods of installation, protection and cleaning. Submit copy of such instructions, and indicate if and where there is discrepancy between them and requirements or Specifications and obtain direction.

15.2 Whenever specific reference to follow manufacturer’s directions or instructions is made in Specifications, submit 3 copies thereof for review before commencing such work.

16 SPARE PRODUCTS

16.1 Where specified in other Sections, provide spare materials and products for future repair and replacement.

16.2 Ensure such materials are of same production run as those incorporated in the Work.

16.3 Deliver quantities required, in separate labelled containers, and store where directed.

16.4 Labels shall state material description, colour, pattern and location of installation.

17 EXISTING SERVICES

17.1 Before commencing the Work, establish location and extent of existing services in area of work and notify Consultant of findings.

17.2 Whenever it is necessary to cut, interfere with, or connect to existing services or facility, do so at hours and times recommended by governing authorities and approved by Consultant and with minimum disturbance to occupants, pedestrian and vehicular traffic and public and private property.

17.3 Submit schedule to and obtain approval from Consultant for each proposed shut-down of active service or facility. Adhere to approved schedule and provide notice to affected parties.

18 EXISTING CONDITIONS

18.1 Make good surfaces and finishes damaged or disturbed due to the Work of this Contract to match existing. Ensure that materials used to repair damage are compatible with existing work.

18.2 Term “make good” shall mean repairing or filling operations performed on existing floors, walls, ceiling or any other exposed surfaces. It is intended that finished surfaces match and line with existing adjoining surfaces.

18.3 Restore site to condition equal to or, if specified elsewhere, to condition better than existing conditions.

18.4 Restore lands outside of limits of the Work, which are disturbed due to work to original condition in addition to complying with requirements of General Conditions (CCDC) of the Contract.

19 NO SMOKING POLICY

19.1 Cooperate, respect and comply with any Smoke-Free Workplace Policy requirements established by the Municipality.

19.1.1 Smoke-Free Workplace Policy applies to enclosed areas in buildings, including cafeterias and washrooms.

19.1.2 Smoke-free workplace policy applies to everyone in the workplace and to visitors.

19.1.3 Ensure that Contractor’s employees, sub-contractors and suppliers, performing work on site on Contractor’s behalf, are instructed to comply with Smoke-Free Workplace Policy requirements.

20 RELICS AND ANTIQUITIES

20.1 Relics and antiquities and items of historical or scientific interest such as cornerstones and contents, commemorative plaques, inscribed tablets, and similar objects found on Site or in building(s) to be demolished, shall remain property of the Owner. Protect such articles and request direction from Consultant.

1.1 DESCRIPTION OF WORK

1.1.1 The Work is to supply all labour, materials, equipment and services necessary for the construction, completion, and commissioning of the 2020 Rural Road Work- Preparation for Resurfacing in Sioux Lookout, Ontario.

1.1.2 The Work includes, but is not limited to the following items:

1.1.2.1 All required pre-contract and pre-construction submittals;

1.1.2.2 Co-ordination, supply and delivery, storage and security of all equipment and

material required to complete the Work in Sioux Lookout, Ontario.

1.1.2.3 The scope of the project is summarized, but not limited to the following:

Road Works: Drayton Road, Sturgeon River Road, Sun and Sand Road

1. Pulverize and grade 18,900 m2 of existing low class bituminous (LCB) surface. 2. Supply, place and compact 2,550 m3 of base course, 150 mm granular A. 3. Final grading and compaction of granular A base course at 3% cross slope. 4. Existing entrance transitioning to road grade raise elevation (approximately 42

entrances in total) utilizing granular A with an estimated quantity of 150 m3 Drayton Road 5. Supply, place and compact 880 m3 of base course, 250 mm granular A at locations

indicated on drawings. Sun and Sand Road 6. Sub-ex 120 m3 of existing road base at location indicated on drawings and dispose

of excavated material. 7. Supply, place and compact 85 m3 of sub-base course, 150 mm granular B Type III at

location indicated on drawings.

1.1.4 Layout and survey for all work from control point(s); control points will be provided by Owner or as stated on drawings.

1.1.5 Other miscellaneous works as shown on the drawings. 1.1.6 All required submittals and demonstrations for operation and maintenance of the project.

1.1.7 Attendance at all project meetings including final inspection, mid-warranty and one year inspections.

1.1.8 Timely submittals of all required project paperwork including; schedule and revisions to

schedule, payment requests, statutory declarations, inspection and testing results and permits.

1.1.9 Timely coordination and attendance to required maintenance and warranty work. 1.1.10 Submission of all required Shop Drawings. The Contractor shall maintain a record of all Shop

Drawings submitted, including dates of submittals, returns and re-submittals. A complete set of approved Shop Drawings to be maintained at the work site.

1.1.11 A clean set of Shop Drawings and an as-built (red-line) drawing to be submitted to the

Owner at Substantial Completion. 1.1.12 Provide all on-site operation and maintenance training as specified.

1.2 OWNER

1.2.1 The Owner is The Corporation of the Municipality of Sioux Lookout.

1.3 DRAWINGS AND SPECIFICATIONS

1.3.1 The Work is to be executed in conformance with the Drawings and Specifications, which are to form a part of the contract documents. The Drawings and Specifications are complimentary, and what is called for in one is to be considered as called for by both.

1.3.2 The arrangement and compilation of the Drawings and Specifications under the several

Sections and Divisions is purely arbitrary and is intended to relate and clarify the work and shall be interpreted as a whole. The responsibility for the arrangement of the supply of the several and varied materials and labour wherever they may appear shall rest solely with the Contractor.

1.3.3 In the event of discrepancy between Drawings and Specifications, the Contractor is to base

his tender on that product, material, or method which is the more costly, unless such conflict is resolved by Addendum.

1.4 CONTRACT DOCUMENTS

1.4.1 The Work will be performed under one Contract; the Contract will be in the form of a completed Agreement, as specified in Division 0, Section 00 21 13, Item 7.3, Page 3.

1.4.2 The General Conditions (CCDC) of the Contract will govern the Work specified in each

Section of the Specifications.

1.4.3 Division 1, General Requirements, of the Specifications generally specifies the Work and coordination of the Work that is the direct responsibility of the Contractor, but shall not be interpreted to define absolutely the limits of responsibility that must be established between the Contractor and his Subcontractors by separate agreements.

1.4.4 Ensure that Subcontractors understand that the General Conditions (CCDC) of the Contract,

and Division 1, General Requirements, apply to Sections of the Specifications governing their Work.

1.4.5 Work in the Specifications is divided into descriptive Sections which are not intended to

identify absolute contractual limits between Subcontractors, nor between the Contractor and his Subcontractors.

1.4.6 Wherever in the Contract Documents the word "Project Manager" is used it shall mean the

Owner.

1.4.7 Wherever in the Contract Documents the words "approval", "approved", "direction", "directed", "selection", "selected", "request", "requested", "report", and similar words are used, such approvals, directions, selections, requests and reports shall be given by the Owner unless specifically stated otherwise.

1.4.8 Wherever in the Contract Documents the word "provide" is used in any form, it shall mean

that the Work concerned shall include both supply and installation of the products required for completion of that part of the Work.

1.4.9 Wherever in the Specifications it is specified that the Work is to proceed or to meet

approval, direction, selection or request of jurisdictional authorities or others, such approval, direction, selection or request shall be in writing.

1.4.10 Wherever in the Specifications it is specified that the Work shall be repaired, made good or

replaced, it shall be performed without any additional cost to the Owner. 1.5 DIVISION 1, GENERAL REQUIREMENTS

1.5.1 The provisions of all Sections of Division 1 shall apply to each Section of the Specifications. 1.6 CONSTRUCTION SCHEDULE

1.6.1 Submit a construction schedule as noted in Division 0, Section 00 21 13.

1.6.4 The Contractor shall maintain at all times; local vehicular and pedestrian traffic on the road(s); and access to all residences.

1.7 COST BREAKDOWN

1.7.1 Before submitting first progress claim, submit breakdown of Contract Price in detail as directed by Project Manager and aggregating Contract price. After approval by Project Manager, cost breakdown will be used as basis for progress payments.

1.8 EXAMINATION

1.8.1 Site: Examine all sites, and ensure that each Subcontractor performing work related to site conditions has examined it, so that all are fully informed on all particulars which affect the Work.

1.8.2 Previously Completed Work:

1.8.2.1 Where dimensions are required for proper fabrication, verify dimensions of

completed work in place before fabrication and installation of work to be incorporated with it.

1.8.2.2 Verify that previously executed work and surfaces are satisfactory for installation or

application, or both, and that performance of subsequent work will not be adversely affected. Commencement of the Work constitutes acceptance of previously executed work, surfaces, etc.

1.8.2.3 Ensure that work installed in an unsatisfactory manner is rectified by those

responsible for its installation before further Work proceeds. 1.8.2.4 Defective work resulting from application to, or installation on, or incorporation

with, unsatisfactory previous work will be considered the responsibility of those performing the later work.

1.9 PROTECTION OF WORK, PROPERTY AND PERSONS

1.9.1 Include in the Work, necessary methods, materials and construction, to ensure that no damage or harm to work, materials, property and persons results from the Work of this Contract. Temporary facilities relating to protection are specified in Section 01 01 00.

1.9.2 Keep excavations, and pits free of water. Pump dry as required.

1.9.3 Protect adjacent private and public property from damage and, if damaged, make good to

match in all details.

1.9.4 Keep surfaces, on which finish materials will be applied, free from grease, oil, and other contamination which would be detrimental in any way to the application of finish materials.

1.9.5 Do not apply visible markings to surfaces exposed to view in finished state or that receive

transparent finishes.

1.9.6 Protect surfaces of completed work exposed to view from staining, disfigurement and all other damage by restriction of access or by use of physical means suitable to the material and surface location. Establish with each Subcontractor the suitability of such protection in each case.

1.9.7 Schedule finish work at end of construction when interference from tradesmen is at a

minimum.

1.9.8 Enforce fire prevention methods at site. Do not permit bonfires, open flame heating devices or accumulation of debris. Use flammable materials only if proper safety precautions are taken, both in use and storage.

1.9.9 Where flammable materials are being applied, ensure that adequate ventilation is provided,

spark-proof equipment is used, and smoking and open flames are prohibited.

1.9.10Ensure that volatile fluid wastes are not disposed of in storm or sanitary sewers or in open drain courses.

1.9.11Public Utilities and Services:

1.9.11.1 Verify location of and limitations imposed by, existing mechanical, electrical, telephone and similar services, and protect them from damage. If necessary, relocate active services to ensure that they function continuously in safety and without risk of damage.

1.9.11.2 Coordinate the capping off, removal and reconnection of a utility with the authority

having jurisdiction over utility and make payment for costs involved.

1.10 CLEANING 1.10.1 Ensure that spatters, droppings, soil, labels, and debris are removed from surfaces to

receive finishes, before they set up. Leave work and adjacent finished work in new condition.

1.10.2 Use only cleaning materials which are recommended for the purpose by both the

manufacturer of the surface to be cleaned and of the cleaning material.

1.10.3 Maintain areas "broom clean" at all times during the Work.

1.10.4 Do not burn or bury waste material at site unless approved by Consultant. Remove as often as required to avoid accumulation.

1.10.5 Do not allow waste material and debris to accumulate in an unsightly or hazardous manner.

1.10.6 Ensure that cleaning operations are scheduled to avoid deposit of dust or other foreign matter on surfaces during finishing work and until wet or tacky surfaces are cured.

1.11 ADJUSTING

1.11.1 Ensure that all parts of the Work fit snugly, accurately and in true planes, and that moving parts operate positively and freely, without binding and scraping.

1.11.2 Verify that the Work functions properly, and adjust it accordingly to ensure satisfactory

operation.

1.11.3 Lubricate products as recommended by the supplier.

1.12 SALVAGE

1.12.1 Unless otherwise specified, materials on the site at the time of signing of Contract shall remain property of the Municipality.

1.12.2 Unless otherwise specified, salvaged material resulting from construction, and surplus

materials and construction debris shall become property of Contractor, who shall dispose of it away from site.

1.12.3 Treasures, such as coins, bills, papers of value, and articles of antiquity, discovered during

digging, demolition and cutting at the site shall remain property of the Municipality. Protect such articles and request instructions from Owner.

1.13 OWNER OCCUPANCY

1.13.1 The Owner reserves the right to occupy and use portions of the premises, whether partially or entirely completed, or whether completed on schedule or not, provided such occupancy does not interfere with the Contractor’s continuing work.

1.13.2 Partial occupancy or installation by the Owner of his equipment shall not imply acceptance

of the Work in whole, or in part, nor shall it imply acknowledgment that terms of the Agreement are fulfilled.

1.14 ROADS AND TRAFFIC CONTROL

1.14.1 Prior to road closures or traffic restrictions, notify the Municipality, the fire department, the

police department, ambulance service and school bus company with a minimum seven (7) days notice prior to closing or restriction.

1.14.2 Road closures or traffic restrictions must have the consent of the Road Authority for the

Municipality. The Contractor is responsible to develop a traffic control plan which must be submitted to the Road Authority for approval. All traffic control plans shall conform to layouts as detailed in the Ontario Traffic Manual, Book 7.

1.14.3 Detours will be permitted by the Municipality during the construction under the following

1.14.4 The Contractor shall expedite the construction in order to minimize the length of traffic restrictions

4 CONTRACT MODIFICATION PROCEDURES

4.1 Conform to the General Conditions (CCDC) of the contract for Changes of the Work.

4.1.1 Further to the General Conditions of the Contract (CCDC), Contractor shall promptly and not later than 10 working days of becoming aware of circumstances which may require a change in the Work or other directions, give written notice to Consultant outlining such circumstances and requesting proposed change. Do no work in affected area, or that would prevent Consultant from properly evaluating circumstances and proposed change, without obtaining written approval. Consultant will act promptly to give Contractor directions so work is not unreasonably delayed.

4.1.2 Advise Consultant in writing of any contradictions, discrepancies, omissions or errors discovered or revealed. Do not proceed before obtaining clarifications and directions from Consultant in writing. Failure to follow this shall result in Contractor assuming full responsibility for resulting circumstances and any expenses due to this will be borne by Contractor.

1 INVOICES FOR PAYMENT

1 GENERAL

1.1 Comply with Division 1 requirements and documents referred to therein as applicable.

2 PROJECT MANAGEMENT

2. Project Coordination

2.1.1 Refer to the General Conditions (CCDC) of the Contract.

2.1.2 Contractor shall promptly, and not later than ten (10) working days of becoming aware of circumstances, which may require a change in the Work or other directions, give written notice to Consultant outlining such circumstances and requesting his written directions. Do no work in affected area, or that would prevent Consultant from properly assessing situation or evaluating change, without his prior written approval. Consultant will act promptly to give Contractor directions so the Work is not unreasonably delayed.

2.1.3 Contractor shall have responsibility to study Contract Documents to determine extent of the Work required by each Section and upon which work of other Sections depend and to coordinate scope and extent of work to be performed by each trade. Neither organization of Specifications into Divisions and 3-part sections format nor arrangements of drawings, Schedules, and Standard Drawings shall affect in any way Contractor’s control in dividing the Work or establishing each trade’s scope of the Work. Claims for additional compensation arising from disputes between trades due to lack of coordination by Contractor will not be considered.

2.1.4 Coordinate work of each Section as required for satisfactory and expeditious completion of the Work. Take field dimensions required. Take into account existing installations to assure best arrangements of components in available space. Consult before commencing the Work in critical locations. Fabricate and erect work to suite field dimensions and field conditions.

2.1.5 Provide forms, templates, anchors, sleeves, inserts and accessories or other components required to be fixed to or inserted in the Work. As applicable, set them in place or instruct person(s) responsible for performing work in related Sections as to their location.

2.1.6 Pay cost of extra work caused by, and make up time lost as result of failure to comply with these requirements at proper time.

2.1.7 Be responsible to coordinate work of all trades including construction sequence, schedule, and interfacing of all work. Coordinate work as required to incorporate metric modular components. Coordinate work of each trade as required for satisfactory and expeditious completion of the Work. Ensure that components to be built in are supplied in time with setting drawings and other related information. Fabricate and erect work to suite field dimensions and field conditions.

2.1.8 Ensure that all Contract Documents are fully coordinated with respect to architectural, structural, mechanical, electrical and other specialty requirements.

2.1.9 Cooperate and coordinate with Consultant for moving Owner equipment into building when the Work or substantial part thereof is ready for use for purpose intended.

2.1.10 The Contractor shall apply for the local building permit and pay all charges, for all additional necessary permits or licences required for the execution of the Work, and fees required to be paid prior to issuance of the local building permit. The Contractor shall notify the Chief Building Official or the Registered Code Agency where applicable, of the readiness, substantial completion and completion of the stages of construction set out in the Building Code. The Contractor shall be present at each site Inspection by an inspector or Consultant as applicable under the Building Code.

During construction, the Contractor shall assume designation of Building Permit Applicant, as per the Building Code Act, and ensure that all inspection is completed at each stage of construction and shall provide notice under corporate seal to Municipal Building Authorities having jurisdiction to confirm designation.

2.2 Documents on Site

2.2.1 Refer also to the General Conditions (CCDC) of the Contract.

2.2.2 Maintain in good condition and order on site 1 copy of Addenda, proposed changes in the Work, change orders, test reports, manufacturer’s installation and application instructions, progress photographs, as-built drawings, approved progress schedules, minutes of site meetings, and other modifications to Contract Documents.

2.3 Monthly Site Meetings

2.3.1 In conformance with the General Requirements Division of the Contract, attend site meetings at regular intervals (monthly). Consultant also reserves right to call additional site meetings on short notice without any cost to Owner. The following points are relevant to regular monthly meetings:

− The Consultant will prepare the agenda for meetings.

− The Contractor will make physical arrangements for meetings.

− The Consultant shall prepare and distribute written notice of each meeting minimum four (4) dates in advance of meeting date, stating time, and place, to all persons whose presence is required.

− The Consultant shall reproduce and distribute copies of meeting summary within one week after each meeting to agreed distribution list.

− Contractor to ensure that representatives, (Contractors, Subcontractors, and suppliers) attending meetings are qualified and authorized to act on behalf of each entity each represents.

− The Contractor’s Project Manager and Site Supervisor must attend all meetings.

− Ensure that relative information is available to allow meetings to be conducted efficiently.

− Documents, including Requests for Information, Shop Drawing Schedule / Log and Construction Progress Schedule.

− Construction Progress Schedule will be reviewed to ensure timely and efficient completion of the

3 CONSTRUCTION PROGRESS DOCUMENTATION

3.1 General Review

3.1.1 Work shall be reviewed for general conformance with Contract Documents, Code, and Authorities having jurisdiction.

3.1.2 General review shall include review of Shop Drawings, review of field work, and review of reports produced by various inspection and testing agencies.

3.1.3 Each review shall be recorded in manner suitable for submission to Consultant at completion of Project along with inspection and testing reports at site meetings every week.

3.2 Progress Schedule

3.2.1 Refer also to the General Conditions (CCDC) of the Contract.

3.2.2 Conform to the General Requirements Division and prepare computer generated schedule in a form acceptable to Consultant. Within seven (7) days following Contractor’s receipt of order to commence the Work from Owner, deliver copies of progress schedule to Consultant in amounts requested. Progress schedule, shall indicate without limitations dates for:

− erection and dismantling of temporary facilities;

− submission of Shop Drawings for various divisions of the Work;

− submission of samples and installation dates for mock-ups and sample installations;

− commencement and completion of each major division of the Work, including work to be done by Subcontractors;

− critical work sequencing;

− major equipment deliveries and priorities;

− final completion date – commissioning

3.2.3 Include with progress schedule, a cash flow chart calendarized on a monthly basis in a manner acceptable to Consultant. Cash flow chart shall indicate anticipated Contractor’s monthly progress billings from commencement of the Work until completion.

3.3 Completely update construction progress schedule and cash flow chart whenever changes occur to scheduling and in manner and at times satisfactory to Consultant, minimum monthly updates.

3.4 Progress Report

3.4.1 Maintain on site, permanent written record of progress of the Work. Record shall be open to inspection of Consultant at all times and a copy shall be furnished to Consultant upon request.

3.4.2 This record shall show dates of commencement, progress and completion of various trades and items of the Work. Particulars pertaining to number of employees of various trades and type and quantity of equipment employed daily, weather, and indoor and outdoor temperature, protection methods and other such data shall be noted. Give particulars to placing of concrete and like.

3.5 Certificates and Transcripts

3.5.1 Before commencement of the Work, submit WSIB status, transcription of insurances and other certificates and transcripts requested in Contract Documents or by Consultant.

3.6 Contractor’s Personnel and Subcontractors

3.6.1 Submit complete list of Subcontractors with addresses, phone numbers, and personnel along with Contractor’s list of personnel.

1 SUBMITTAL PROCEDURES

1.1 Submittals

1.1.1 Submit to Consultant, and to Authorities having jurisdiction as required, documents listed to be submitted for review. Submit with reasonable promptness and in an orderly sequence so as not to cause delay in the Work. Failure to submit in ample time is not considered sufficient reason for an extension of Contract time or extra costs and no claim for extension of Contract time or increase to Contract Price by reason of such default will be allowed. Final approval of Authorities having jurisdiction, where required, shall be obtained prior to submitting Shop Drawings or other documentation to Consultant.

1.1.2 Prior to submission to Consultant, Contractor shall review all submittals. Submittals not stamped, signed, dated and identified as to specific Project will be returned without being examined and shall be considered rejected. Confirm and correlate information that pertains to fabrication processes, quantities, techniques of construction and installation and similar information.

1.1.3 Provide Submittals for review, unless otherwise specified, in PDF format. Fully identify by Project name and number, name of Contractor, name of manufacturer, date, sample number, trade name or product or generic name of product as it appears in Specifications.

1.1.4 Submittals shall meet requirements of Contract Documents unless Consultant is advised in writing, at time of submission, how they do not meet such requirements. Resubmit as required to obtain final review.

1.1.5 Consultant will retain one reviewed Submittal until the Work is completed. Finished work shall conform to final reviewed samples for visual characteristics designated such as colour, texture, gloss and to other requirements of Contract Documents unless otherwise authorized in writing.

1.2 Shop Drawings

1.2.1 Refer also to the General Conditions (CCDC) of the Contract.

1.2.2 Contractor shall prepare a schedule fixing dates for submission and return of Shop Drawings. Shop Drawings showing load bearing structures shall be certified by registered Professional Engineer licensed to practice in the Province of Ontario, who shall affix his/her seal and signature to Shop Drawings, confirming that structure is capable of supporting its own weight and required live loads. Consultant will identify required Shop Drawings for review. Submit Shop Drawings in accordance with requirements of the General Conditions (CCDC) of the Contract.

1.2.3 Term Shop Drawings means drawings, diagrams, illustrations, schedules, performance charts, product data, brochures and other data which are to be provided by Contractor to illustrate details of a portion of the Work.

1.2.4 Contractor shall arrange for preparation of clearly identified Shop Drawings as called for in Contract Documents or as Consultant may reasonably request.

1.2.5 Prior to submission to Consultant, Contractor shall review all Shop Drawings. By this review Contractor shall verify all field measurements, field construction criteria, materials, catalogue numbers and similar data. Check and coordinate each shop drawing with requirements of the Work and of Contract Documents. Contractor’s review of each Shop Drawing shall be indicated by stamp, date, and signature of an authorized person.

1.2.6 Shop Drawings shall be submitted in PDF format, as specified herein. Provide additional copies when required by Consultant. At time of submission Contractor shall notify Consultant in writing of any deviations in shop drawings from requirements of Contract Documents.

1.2.7 Catalogue cuts showing all aspects, design, sizes, components and rough-in information for equipment may be submitted as Shop Drawings.

1.2.8 Contractor shall make changes in Shop Drawings, which Consultant may require to be consistent with Contract Documents and resubmit unless otherwise directed by Consultant. When resubmitting, Contractor shall notify Consultant in writing of, and clearly indicate on Shop Drawing, any revisions other than those requested by Consultant.

1.2.9 Shop Drawings shall define division of responsibility between different Contractors and Subcontractors and trades and items shown on Shop Drawings shall be supplied as part of Contract. Shop Drawings shall show materials, methods of construction and attachment or anchorage, erection diagrams, connections, and other details necessary to complete the Work.

1.2.10 Shop Drawing submission to Consultant is for sole purpose of information regarding compliance with intent and requirements of Contract Documents. This submission shall not mean that Consultant approve detail design inherent in Shop Drawings, responsibility for which shall remain with Contractor submitting same and submission shall not relieve Contractor of its responsibility for errors or omissions in Shop Drawings or of its responsibility for meeting all requirements of Contract Documents. Contractor is responsible for dimensions to be confirmed and correlated at job site, for information that pertains solely to fabrication processes or to techniques of construction and installation, for coordination of work of all sub-trades, and for coordination of the Work of this Contract with work of other Contractors.

1.2.11 Any adjustments made on Shop Drawings by Consultant are not intended to change Contract Price. If Contractor deems that such adjustments affect value of the Work, he shall so state in writing before proceeding with fabrication and installation of the Work.

1.2.12 Submit Shop Drawings to Consultant for review.

1.2.13 Shop Drawing Numbering: Identify, date, register, and number Shop Drawings and revised Shop Drawings to correspond with applicable Section numbers of Specifications (Divisions 1-49).

1.2.14 Each Shop Drawing submission must include a transmittal form containing the following information:

• Name of project. • Name of General Contractor. • Name of Subcontractor responsible. • Name of Supplier/Fabricator.

1.3 Shop Drawing Distribution 1.3.1 After proper identification and numbering as described above, Contractor shall examine and sign

each Shop Drawing to confirm compliance with requirements of Contract Documents. 1.3.2 Shop Drawings, signed as checked by Contractor, shall be forwarded to Consultant in PDF format.

1.4 Shop Drawing Review By Consultant

1.4.1 The Consultant will indicate comments and required revisions on the Shop Drawings.

1.4.2 Following review of each submission the Consultant will sign particular Shop Drawing, retain a copy for record purposes, and return to Contractor.

1.5 Interference Drawings

1.5.1 Prepare drawings indicating relationship of new and existing and/or unforeseen conditions at congested areas prior to commencement of work in area.

1.5.2 For congested locations, before commencing installation, prepare drawings showing relationship of ductwork, conduit, piping, sprinklers, ceiling supports and framing, communication and specialized equipment located within ceiling and shaft spaces.

1.5.3 Indicate locations of visible items such as air handling outlets, light fixtures, smoke detectors, sprinkler heads, communication grilles, and access panels occurring at these locations.

1.5.4 Drawings shall be initialled by responsible person of each Subcontractor involved along with Contractor’s signature and submitted to Consultant for review and record purposes.

1.5.5 Failure to prepare interference drawings shall not relieve contractor of responsibility for coordination of the work. Claim for extra will not be approved for failure to coordinate the work.

1.6 Samples

1.6.1 Submit samples in accordance with requirements of the General Conditions (CCDC) of the Contract. For purpose of this Article, “samples” includes samples, models, and templates. Samples are physical examples furnished by Contractor to illustrate materials, equipment, workmanship, or component parts, and to establish minimum standards for the Work. Finished work shall conform to reviewed samples in every respect.

1.6.2 Samples shall be submitted to Consultant in number specified in respective Section or as requested by Consultant in sufficient time to permit review process before item is needed to be installed or as otherwise directed by Consultant.

1.6.3 If either Contactor or Consultant so requests, they shall jointly prepare a schedule fixing dates for submission and return of samples, including time allowances for re-submissions.

1.6.4 Samples shall be submitted by Contractor only, unless it has authorized its Subcontractor to submit them and has notified Consultant to this effect and obtained his approval.

1.6.5 Contractor and/or Subcontractor shall remove samples, which are “rejected” or designated as “resubmit”.

1.6.6 Samples will receive consideration only when delivered or mailed accompanied with a covering letter or enclosure form of transmittal signed by Contractor. Letter or enclosure form shall be delivered or sent via Courier and shall contain a list of samples being submitted, date of submission, name of Project, Contractor, Subcontractor, manufacturer, brand, also Consultant’s Project number, Specification article and paragraph numbers to which samples refer, and such additional information as may be required by Specifications for particular item being furnished. A copy of letter or enclose form shall be enclosed with samples and any sample rectified without identification letter or enclosure form will be considered “unclaimed goods” and will be held for a reasonable limited time only.

1.6.7 Each sample shall be labelled to identify names of Project, Contractor, Subcontractor, manufacturer, brand, product trade name and number, material type, and Consultant’s Project number.

1.6.8 Where Consultant rejects samples, new samples shall be submitted as soon as possible after notification of rejection and shall be marked “Second Submission” in addition to other information required on label. Remove rejected samples or samples no longer required when requested within five (5) working days.

1.6.9 Review by Consultant is for sole purpose of ascertaining conformance with general design concept and requirements of Contract Documents. Such review shall not mean that Consultant approves detail design inherent in samples, responsibility for which shall remain with Contractor submitting same and such review shall not relieve Contractor of its responsibility for errors or omissions or of his responsibility for meeting all requirements of Contract Documents.

1.6.10 Make changes in samples, which Consultant may require, consistent with Contract Documents.

1.6.11 Adjustments made on samples by Consultant are not intended to change Contract Price. If adjustments affect value of the Work, state such in writing to Consultant within five (5) days of receipt of reviewed samples.

1.6.12 Materials used in the Work shall be in accordance with reviewed samples in every respect without limitations, texture, finish, colours, and quality of work.

1.6.13 Cost of all samples shall be paid by Contractor including all carrying charges, which shall be prepaid.

1.7 Maintenance Manuals

1.7.1 Provide in accordance with (no reference in this document).

1.8 As-Built Drawings

1.8.1 Obtain one set of white prints as the Work progresses. Clearly note: (a) dimensioned locations of buried and concealed services and utilities including existing ones found during course of work and (b) changes and deviations to the Work as built.

1.8.2 Regularly review updating of these drawings.

1.8.3 Provide final, neat, clear set of as-built drawings for review and approval of Consultant and in accordance with General Requirements of the Contract.

1.9 Contract Closeout Submittals

1.9.1 Substantial performance of the Contract is subject to review and approval of all closeout submittals. Prior to advising the Consultant that the Work is substantially performed, the Contractor shall undertake an inspection of the Work with the Contractor’s forces and those Subcontractors or their representatives as the Contractor may require, and the Consultant. At least ten (10) days prior to such notice, the Contractor shall submit to the Consultant for approval, the following but not limited to: 1. Application for Substantial Performance of contract by Contractor; 2. Signed Substantial Performance Certificate – Signed by Consultant; 3. Approved Shop Drawings if applicable; 4. Occupancy permit; 5. Warranty Certificates; 6. Operation and Maintenance Manuals (3 hard and 1 electronic copies); 7. As-Built Drawings (3 hard and 1 electronic copies via PDF format); 8. Deficiency List if applicable; 9. Statutory Declaration for holdback release; 10. Other requirements as may be noted in Section 01 77 00.

2 COLOURS

2.1 Colour and gloss value selection by Consultant. Obtain direction on colour and gloss value in advance of need. If requested, submit samples for colour and gloss selection. Follow colour schedule provided by Consultant and use colours and gloss designated.

1 GENERAL

1.1 Comply with Division 1, General Requirements, and documents referred to therein.

2 DESCRIPTION

2.1 This Section covers work for protection of environment as applicable to this Project.

2.2 Provisions of this Section supplement requirements of Contract Documents.

3 ENVIRONMENTAL PRACTICES

3.1 Implement environmentally sound practices in this Project by incorporating products that lessen burden on environment in production, use and final disposition. Support implementation of reduction, reuse and recycling strategies and use of environmentally sound products. Promote use of environmentally responsible packaging practices by reducing and/or eliminating products with excessive packaging in this Project where these practices do not negatively affect the proper protection of materials from inclement weather, especially water damage.

3.1.1 Employ environmentally sound products which are made, used and disposed of in a manner that significantly reduces harm to environment. Base project selection criteria on requirements of CSA Z760: Life Cycle Assessment and CSA Z762: Design for Environment. Use Products which improve energy efficiency in its production and use, reduces hazardous by-products, uses recycled material, and/or Product itself can be recycled or reused, and/or in some way is environmentally benign.

3.2 WASTE REDUCTION

3.2.1 Implement waste reduction on this Project by using products specified in Contract Documents from manufacturers who promote reduction and elimination of excessive packaging practices in accordance with O. Reg. 104/94 made under the Environmental Protection Act. Adhere to Canadian Code of Preferred Packaging Practices.

3.2.2 Use, where appropriate, combination of packaging materials such as re-usable containers, blanket wrap or cushioning material provided that all reasonable requirements of materials handling, transportation and storage are observed.

3.2.3 Where storage conditions provide adequate protection from weather and other sources of wetting, use packaging materials such as kraft paper and corrugated cartons which are made from reclaimed products to facilitate recycling of secondary materials.

3.2.4 Use packaging material which clearly displays their recycled content and recyclability.

3.2.5 Ensure packaging materials are removed from site and disposed of or recycled in an environmentally responsible manner.

3.2.6 Reduce construction and demolition waste following Ont. Reg. 102/94 as a guide.

3.2.7 REDUCE (REDUCTION) – Reduction involves actions to minimize quantity of waste at source and

consequently, assumes highest priority in hierarchy of 3R activities.

3.2.8 REUSE – Direct reuse of products which otherwise would become waste, provides another means of diverting quantity of waste destined for landfill.

3.2.9 RECYCLE – Recycling involves collection of materials for use as feedstock in manufacturing of new projects. Recycling can be most effectively accomplished if recyclable materials have been source separated at point of generation.

3.2.10 Recyclable construction materials shall include, but not be limited to, paper, corrugated cardboard, non-treated dimensional lumber, manufactured wood, non-painted gypsum board, bricks and masonry concrete blocks. Sort recyclable construction materials separately and cart away to appropriate listed recycling facility or any other approved facility which recycles or reuses construction materials.

3.2.11 Do not mix recyclable construction materials with other construction wastes and debris to be carried to landfill area or other dump or transfer station which would accept these materials.

3.2.12 Inform Consultant 24 hours prior to disposal so that visual quantity inspection can be made. Give two (2) copies of receipts issued by appropriate recycling depot and/or landfill site.

4 PROTECTION OF NATURAL ENVIRONMENT

4.1 Submit to Consultant environmental plan, site waste management implementation plan (if any), and sketch showing areas proposed to be used for construction storage, areas for implementation of site separation of construction waste, and including dimensions of such areas and location and size of trees within and adjacent to these areas.

5 SITE REVIEW

5.1 The Ministry of the Environment, Conservation and Parks (MOECP) and other Authorities having jurisdiction may visit site periodically during construction. Where the Work does not comply with environmental protection requirements, said Authorities have power to use a stop work order. Consultant’s acceptance of the Work may be withheld until MOECC or other Authorities concerned have issued their approval.

6 SITE WORKING AREAS

6.1 Confine operations to limits of site working area indicated on Drawings.

6.2 Provide access roads to site working area and on site in locations acceptable to Consultant.

6.3 Install suitable fencing to clearly define limits of site working area, haul routes, parking areas, access routes and maintenance areas to ensure construction activity is confined to these areas.

7 SURFACE DRAINAGE AND WATERCOURSES

7.1 Maintain ditches and watercourses for surface water drainage of site and external properties during construction. Be responsible for damage due to negligence.

7.2 Incorporate appropriate retention, detention and settling ponds, or similar methods, reviewed by Consultant, to control surface water run-off to adjacent ditches or other watercourses and to prevent oil, sediment or de-icing materials being carried into such ditches and/or watercourses. Tested quality of water discharged to ditches and/or watercourses shall not be of worse quality than that present in ditches and/or watercourses prior to any discharge of site surface water. Monitor and test discharge water at east weekly and provide copies of test result to Consultant.

7.3 Locate and protect stockpiles of semi-permanent nature to satisfaction of Authorities having jurisdiction to ensure minimum environmental interference.

8 NOISE CONTROL

8.1 Adhere to local noise By-laws.

8.2 Equip vehicles and equipment with efficient noise attenuation devices (mufflers) to minimize noise levels in vicinity of site.

8.3 Where necessary place noise attenuation devices (barriers) around stationery pumps and compressors.

8.4 Noise generating activities are not to be scheduled during times that occupants of space are present. In spaces that are occupied 24/7, schedule for noise generating activities to be approved by Site Manager and occupants.

9 DUST CONTROL

9.1 Undertake control measures to prevent nuisances due to dust in any phase of construction.

9.2 Application of calcium chloride shall be kept to minimum and shall be restricted to vehicle right-of-way. In close proximity to watercourses, frequent applications of water is preferred method. Obtain Consultant’s approval before chemicals for dust control are used.

9.3 Transport dusty materials in covered haulage vehicles.

9.4 Transport wet materials in suitable watertight haulage vehicles.

10 WASTE DISPOSAL

10.1 Do not burn rubbish on site. Obtain approval, and use the following off-site disposal alternatives, depending upon materials involved; burying, composting, recycling, municipal collection, or local dump or sanitary landfill site.

11 EQUIPMENT FUELLING, MAINTENANCE AND STORAGE

11.1 Obtain Consultant’s acceptance of refuelling areas.

11.2 Procedures for interception and rapid clean-up and disposal of fuel spillages shall be submitted to Consultant for review prior to starting the Work.

11.3 Ensure that materials required for clean-up of fuel spillages are readily accessible on site at all times.

11.4 Carry out refuelling of equipment at acceptable refuelling areas.

11.5 Ensure that water used for cleaning of equipment does not drain into streams, lakes or watercourses. Do not empty fuel, lubricants and/or pesticides into any watercourse.

11.6 Clean construction equipment prior to entering public roadways to prevent littering. Debris from cleaning equipment shall not be permitted into storm sewers or watercourses.

11.7 Store equipment and materials in orderly manner and in location acceptable to Consultant.

12 SPILLS REPORTING

12.1 In event of spill or other emission of pollutant into natural environment, notify:

12.1.1 Local office of the MECP (Kenora) and MECP Spills Action Centre,

12.1.2 Municipality or Regional Municipality within boundaries of which spill occurred,

12.1.3 Person having control of pollutant, if know, of spill, or circumstances surrounding the spill and of any action taken or intended to be taken.

13 CONTINGENCY PLAN FOR CONTROL AND CLEAN-UP OF SPILL

13.1 Prior to commencing construction, prepare contingency plan for control and clean-up of spills. Contingency plan to include:

13.1.1 Names and telephone numbers of persons in local municipalities and MECP to be notified forthwith of spill.

13.1.2 Names and telephone numbers of representatives of fire, police and health departments of local municipalities who are responsible to respond to emergency situation.

13.1.3 Names and telephone numbers of companies experienced in control and clean-up of hazardous materials that would be called upon in emergency involving spill.

13.1.4 Contingency plan shall include provisions for spills of hazardous or unknown materials (i.e. puncturing on unmarked drain during excavation).

13.1.5 Proposal for immediate containment and control of spill, clean up procedures to be initiated

13.1.6 Be responsible for preparing, implementing, directing and supervision of contingency plan.

13.2 Ensure immediate availability of products with which to effect temporary repair to broken pipelines and other services so spill or other emission of pollutant is immediately controlled and stopped and to mitigate damages.

13.3 Submit for Consultant’s review copy of contingency plan and make appropriate changes as requested.

14 MOULD

14. 1 There are no known materials containing mould in area of the Work. Should mould or any other hazardous substance be encountered during the performance of the Work, cease all construction activities immediately and notify the Consultant.

14.2 If encountered mould removal must comply with:

14.2.1 Canadian Construction Association guideline (cca82)

14.2.2 Environmental Abatement Council of Ontario (EACO) guidelines

14.2.3 NY Protocol for mould abatement/remediation

14.3 In the event of discovery of pre-existing mould contaminated materials that are suspect, or other wet/vulnerable conditions, immediately report the discovery orally and in writing to the Consultant. The Consultant, will approve remedial work, if any, following an inspection and report issued by an environmental consultant experienced in fungal investigations. This report will detail the variety and extent of the fungal damage, and provide an account of the predisposing conditions responsible for the damage and requirements for remedial action.

14.4 Removal of mould to be carried out under guidelines recommended by all Authorities having jurisdiction.

1 REFERENCES

1.1 Standards and Codes

1.1.1 Where reference is made to codes, specification standards, manuals, contract forms, installation, application and maintenance instructions, produced by various organizations, conform to the latest edition as amended and revised to date of Contract.

1.1.2 Amendments to reference documents after award of Contract affecting Contract Price shall be dealt with in accordance with the General Conditions of the Contract (CCDC) – Part 6 Changes in the Work.

1.1.3 Consultant may appoint separately inspection and testing companies to verify the Work in conformance with applicable standards, or where he may require. Owner will pay costs of such inspection and testing; except where tests or inspections reveal work not in accordance with Contract then Contractor shall bear cost of such tests and further tests as required, to verify acceptability of corrected work.

1.1.4 If requested provide copy on site of such standard(s).

1.1.5 Where standard designates Authorities such as “Consultant”, “Engineer”, “Owner”, “Purchaser”, or some other such designation, these designations shall be taken to mean “Public Works Manager” or “Owner’s Designate””.

1 GENERAL

1.1 Comply with Division 1, General Requirements and documents referred to therein.

2 JURISDICTIONAL AUTHORITIES

2.1 Where reference is made to jurisdictional Authorities, it shall mean all Authorities who have within their constituted powers the right to enforce the laws of the place of building.

2.2 Requirements of jurisdictional Authorities shall apply to the Work in precedence to the requirements of the Contract Documents, except that more stringent requirements of the Contract Documents shall take precedence over requirements of jurisdictional Authorities.

2.3 The Contractor shall carry out all work in full compliance with the requirements of the Municipal, Provincial and national Authorities having jurisdiction.

2.4 No work shall commence until all permits are obtained.

3 REGULATORY REQUIREMENTS

3.1 Permits, Notices, Laws and Rules

3.1.1 Conform to the General Conditions (CCDC) of the Contract as required. Comply with The Building Code Act, as amended; and the Ontario Building Code, 2006, (OBC) as amended; and Regulations and By-laws of other Authorities having jurisdiction including latest amendments thereto: all hereafter referred to as Code, where Code or Contract Documents do not cover particular requirement which is covered by National Building Code (NBC), 1995, as amended, conform to requirements of NBC including its related supplements. Where Contract Documents exceeds Code requirements satisfy such additional requirements.

3.1.2 Conform to NFPA 101, Life Safety Code for exit requirements.

3.1.3 Confirm to The Ontario Fire Code – Ontario Regulation 388/97 enacted under The Fire Marshall’s Act, including latest amendments.

3.1.4 Where material is designated in Contract Documents for certain application, unless otherwise specified, that material shall conform to standards designated in OBC and in absence of more restrictive requirement comply with “Housing and Small Buildings Part 9” of Code. Where specific requirements for a material are not specified for certain use select from choice offered in Part 9.

3.1.5 The Contractor shall pay for the building permit as required by authorities having jurisdiction.

3.1.6 Unless otherwise indicated, obtain and pay for all other permits, licences and certificates of inspection. Ensure that permits, licences and certificates included under specific Sections are provided as specified. Forward copies of all permits to Consultant before commencing construction.

3.1.7 Apply The Trades Qualification and Apprenticeship Act, R.S.O. 1990, chapter T-17 including latest amendments and regulations to performance of this Contract.

3.2 Imperial/International System of Units (SI)

3.2.1 Submittals containing measurements of any kind in Imperial system of measurement shall be on Consultant’s approval only. Submit all measurements in International System of Units (SI).

3.2.2 Submittals containing measurements of any kind shall have measurements in language of International System of Units (SI) conforming to following standards:

3.2.2.1 National Standard of Canada CSA3-Z234.1 “Metric Practice Guide”.

3.2.2.2 IEEE-ASTM-10, IEEE/ASTM S1-10 “Standard for Use of the International System of Units (SI) “The Modern Metric System”.

4 QUALITY ASSURANCE

4.1 General Quality of Work

4.1.1 Do the Work in accordance with industry practice for type of work unless Contract Documents stipulate more precise requirements.

4.1.2 Do the Work in neat and careful manner to retain the Work plumb, square, and straight.

4.1.3 Ensure the Work is properly related to form close joints and appropriately aligned junctions, edges and surfaces and is free of warp, twist, wind, wave or other irregularities.

4.1.4 When required by Specifications or by manufacturer’s recommendations, have manufacturer, supplier or accredited agent, inspect the Work which incorporates their products.

4.1.5 Do not permit materials to come in contact with other materials whether in presence of moisture or otherwise if conditions will result in corrosion, stain or discolouration or deterioration of completed work. Provide compatible, durable separators where such contact is unavoidable.

4.2 Fabricator’s Qualifications

4.2.1 Conform to requirements specified under respective trade Section as applicable.

4.5 Manufacturer’s Field Services

4.5.1 Conform to requirements specified under respective trade Section as applicable.

4.6 Testing Agency Qualifications

4.6.1 Testing shall be conducted in accordance with requirements of Ontario Building Code unless advised otherwise in Contract Documents or by Consultant. Obtain certification where required by applicable codes and standards.

4.6.2 Qualifications of Inspectors: Submit list of inspectors to be employed on this Project and obtain Consultant approval.

4.6.3 All testing and inspection shall be performed by qualified independent inspectors and/or technologist certified by Professional Engineer or performed directly by Professional Engineer in conformance with applicable codes and certification programs and specifications.

4.6.4 Inspectors shall be qualified to perform type of inspection or testing required, and shall meet basic requirements of ASTM E329, “Standard Specification for Agencies Engaged in the Testing and/or Inspection of Materials Used in Construction”.

4.6.5 Concrete testing shall be performed by testing company conforming to requirements of CSA A283 Qualification Code for Concrete Testing laboratories, as required for this Project. Inspection report format and distribution requirements will be established by Consultant.

5 QUALITY CONTROL

5.1 Contractor’s Qualifications and Responsibilities

5.1.1 Prior to commencement of the Work, be responsible to establish quality control system protocols, rules, related chain of commands and commitment to provide quality work as intended in Contract Documents for the Work.

5.1.2 Provide position specification of quality control staff, shop and field supervisors complete with their skills, knowledge, duties, and responsibilities.

5.1.3 Include in the Contract Price (not to be covered by an allowance) labour, materials, and facilities for the following:

5.1.3.1 Access for inspection and testing at the place of the Work and at off-site facilities;

5.1.3.2 On-site storage of concrete specimens at the required temperature and free from vibration;

5.1.3.3 Obtaining and handling of samples and materials on site and delivery to off-site inspection facilities.

5.1.4 In accordance with the Contract documents, inspection and testing results do not relieve Contractor of its responsibility for performance of the Work. Be responsible for care and control of the Work.

5.1.5 Advise Consultant promptly when product or system fails to meet applicable Standards.

5.1.6 Notify Consultant and inspection and testing agency as far in advance of testing as possible, but at least seventy-two (72) hours before the Work is to be inspected and/or tested.

5.1.7 Contractor shall perform all inspections and testing required by code or governing Authorities, by other sections of the Contract Documents and as required to clearly demonstrate integrity of materials and quality of performance of the Work.

5.2 Inspection

5.2.1 Refer to General Conditions (CCDC), GC 2.3.

5.3 Defective Work

5.3.1 Refer to General Conditions (CCDC), GC 2.4.

5.4 Independent Inspection and Testing Agencies

5.4.1 Independent Inspection and Testing Agencies (IITA) will be engaged by the Contractor for the purpose of specialized inspecting and/or testing specific portions of the Work designated by the Consultant. Submit names of nominated inspection and testing agencies to Consultant for approval.

5.4.2 The Consultant shall establish schedule of testing in regards to those portions of the Work specified for inspection and/or testing by IITA.

5.4.3 The following portions of the Work shall have quality control checked by an IITA:

5.4.3.1 All cast-in-place concrete work shall be sampled and tested in accordance with CSA A23.1

5.4.3.2 All compacted granular materials shall be sampled and tested (gradation, standard proctor maximum dry density, compaction).

5.5 Payment for Quality Control Services

5.5.1 For those portions of the Work that have been specified to be tested by an IITA (refer to clause 5.4.2) payment for such services shall be made from the Materials Testing Cash Allowance. The Contractor shall pay all other specified inspections and tests.

1.1 Final Cleaning

1.1.1 In addition to requirements for cleaning-up specified in General Conditions (CCDC) GC 3.13 of the Contract, and in Section 01 74 00, include in work final cleaning by skilled cleaning specialist on completion of construction.

1.1.2 Remove temporary protections and make good defects before commencement of final

clearing. 1.1.3 Clean final roadway, sidewalk, curb, unit paver surfaces of all debris, dirt and mud. 1.2 Submittals 1.2.1 Submit maintenance manual, project record drawings, and extra stock as specified in Section

1.2.1.3 Documentation of system shall include system monitoring prior to Substantial

Performance which shall include tabulating at least for first week of operation all significant system parameters. Process may involve measurement of those parameters during operation and assessment of results by comparing design values against actual performance values.

1.2.1.4 Commissioning shall be performed and/or supervised by technologists familiar with

mechanical and control systems specified in Contract Documents and experienced with design, and commissioning activities.

1.5.1 Inform the Engineer of proposed source of aggregates and provide current satisfactory test data on proposed source of aggregates at least two weeks prior to delivery of aggregate to the site.

1.5.2 If, in opinion of the Engineer, materials from proposed source do not meet, or cannot reasonably be processed to meet specified requirements, procure alternative source.

1.5.3 Should change of material source be proposed during work, advise the Engineer and provide current satisfactory test data on proposed aggregate source at least two weeks prior to delivery of aggregate to the site.

1.5.4 Acceptance of material at source does not preclude future rejection if it is subsequently found to lack uniformity, or if it fails to conform to requirements specified when incorporated into the Work.

1.6 SUBMITTALS

1.6.1 General 1.6.1.1 For existing stockpiles of material submit results of Quality Control testing to the Engineer at least two weeks prior to delivery of aggregate to the site.

1.6.1.2 For material produced during the course of the work, submit the results of Quality Control testing within 24 hours of completion of the test.

1.6.1.3 Submit samples of aggregates (minimum 50 kg) as requested by the Engineer for Quality Assurance testing. Provide the Engineer with access to aggregate sources if requested.

1.7 QUALITY CONTROL 1.7.1 General

1.7.1.1 Quality Control shall be the responsibility of the Contractor. Quality Assurance tests performed by the Engineer shall not be considered Quality Control tests. 1.7.1.2 The Contractor shall use professional engineering services and a CSA certified testing laboratory licensed to practice in the Province of Ontario to assess and where necessary, modify the aggregate materials being produced to ensure their end use meets all specification requirements.

1.7.1.3 Inspection or testing by the Engineer shall not in any way relieve the Contractor of the responsibility for providing aggregates that meet the specification in all respects.

Part 2 PRODUCTS 2.1 GENERAL

2.1.1 Aggregate Quality: sound, hard, durable material free from soft, flat, elongated or laminated particles, organic material or other deleterious substances.

2.1.2 Flat and elongated particles are those where their greatest dimension exceeds five times their least dimension.

1.3.2 Supply, install and maintain erosion control structures across drainage ways leaving site. Site run-off to be kept clear from contamination by silt, sediment and construction debris, during construction.

1.3 MEASUREMENT FOR PAYMENT

1.3.1 The Consultant will measure items in the units as detailed in the Bid Form. Measurement will be taken in the horizontal plane unless noted otherwise.

1.3.2 Length of roads will be based on length along centerline to projected face of shoulder line on

the nearest side of intersecting streets as shown on the Contract Drawings. 1.3.3 The “travelled portion” of the road is defined as from edge of gutter to edge of gutter or

outside edge of shoulder to outside edge of shoulders. 1.3.4 Granular Courses: The measured volume for granular road materials will be based on the

theoretical mid-course width of granular courses shown on the detail drawings multiplied by the centerline length and multiplication by compacted, design thickness.

1.3.5 Existing Embankment Excavation: Payment for excavation of existing granular embankment

fill material quantities shall be based on “in-bank” measurements and shall include excavation, hauling, stock-piling on-site; and any other work necessary to complete this item.

1.4 BASIS OF PAYMENT

1.4.1 Conditions 1.4.1.1 The Consultant will measure the Work when completed and the Contract price will be

increased or decreased in accordance with the final measurements. 1.4.1.2 No additional payment will be allowed for difficulties resulting from relocating of utilities by

others not being done until after road excavation or placing of granular base. 1.4.1.3 Payment at the contract unit price for the tender items shall be full compensation for all

1.4.2.1.1 Road Construction: Work to be included in the unit prices for road construction shall be:

a) Provide 150 mm and/or 250 mm OPSS Granular “A” Base Course: Supply,

load, haul, place and compact to 98 percent Standard Proctor Density, and fine grade.

b) Provide350 mm OPSS Granular “B” Type III, Subbase Course: Supply, load,

haul, place and compact to 98 percent Standard Proctor Density, and grade. c) Geotextile (if warranted and approved): Supply, lay specified geotextile to

the width as directed by Consultant.

Part 2 PRODUCTS 2.1 GENERAL

2.1.1 Granular Materials 2.1.1.1 Granular Subbase Course: Ontario Provincial Standards Specifications (OPSS)

Granular “B”, Type III. 2.1.1.2 Granular Base Course: OPSS Granular “A”. 2.1.1.3 Sand Cushion: sand to meet the requirements of CAN3-A23.1 M77 for fine

aggregate. 2.1.2 Native Fill: 2.1.2.1 Site or imported material, free of peat, organic matter and debris and which field

compaction of 95% standard proctor dry density is attainable. 2.1.3 Culverts and Subdrains: 2.1.3.1 Culverts shall be manufactured from corrugated steel pipe (CSP) conforming with

the requirements of standard CSA CAN3-G401, latest revision or corrugated HDPE (plastic) conforming to CSA B182.8.

2.1.3.2 Subdrains, where indicated shall be perforated 150 mm dia. corrugated polyethylene (PE) pipe and fittings conforming to ASTM F405 or F667 requirements. All perforated subdrains shall be complete with geotextile filter sock.

2.1.3.3 Culverts 700 mm diameter and smaller shall have a minimum wall thickness of 1.6

mm. Culverts 800 mm diameter and larger shall have a minimum wall thickness of 2.0 mm.

Part 3 EXECUTION 3.1 REMOVALS

3.1.1 pulverize existing oil surface treatment and grade as indicate don drawings. 3.1.2 Relocate all existing items in roadway as indicated on drawings.

3.2 EXCAVATION AND EMBANKMENT FILL

3.2.1 Excavate existing granular base and subbase soils, where required for water & sewer main construction.

3.2.2 Excavate subgrade and install water and/or sewer mains and appurtenances with bedding

material placed to 300 mm above crown of pipe. 3.2.3 Backfill with Type 2 Fill or Select Subgrade Material (SSM), place in maximum 300 mm lifts,

and compact to 95 percent Standard Proctor Density. 3.2.4 Fine grade fill to finish subgrade elevations in preparation for the application of granular

base.

3.3 ROAD SUBBASE COURSE

3.3.1 Inspection of Underlying Surface

1) Do not place Granular Subbase Course until underlying surface, subgrade, is inspected and approved.

3.3.2 Placing

2) Construct Granular Subbase Course to depth and grade in areas indicated. 3) Ensure no frozen material is placed. 4) Place material only on clean, unfrozen surface, properly shaped and compacted and

free from ice and snow. 5) Have sufficient graders, water trucks, and rollers on site to meet the specified

spreading and compaction requirements for the amount of material hauled in each shift.

6) Organize equipment such that the material hauled in one day is spread and

compacted the same day. 7) Do not leave windrows un-spread overnight. 8) Do not commence spreading and compacting crushed material until the hauled

material is bladed into a uniform continuous windrow. 9) Begin placing Granular Subbase Course material on crown line or high side of one-

way slope. 10) Place material using methods which do not lead to segregation or degradation of

aggregate. 11) Place material to full width in uniform layers not exceeding 200 mm compacted

thickness. The Engineer may authorize thicker lifts if specified compaction can be achieved.

12) Shape each layer to smooth contour and compact to specified density before

succeeding layer is placed. 13) Remove and replace that portion of layer in which material becomes segregated

during spreading. 14) Segregation of aggregates shall be avoided and the material as spread shall be free

from pockets of large or fine material. Segregated materials shall be remixed until uniform.

3.3.3 Compaction

15) Compact Granular Subbase Course to a minimum of 98% of Standard Proctor Maximum Dry Density, ASTM D698.

16) Shape and roll alternately to obtain smooth, even and uniform compacted base. 17) When necessary apply water during compaction to obtain specified density. If

material is excessively moist, aerate by scarifying with suitable equipment until moisture content is corrected.

18) When it is impracticable with larger types of compaction equipment to obtain the

required degree of compaction in areas where working space is limited, the Contractor shall provide and use mechanical hand compaction equipment in order to achieve the required density.

19) The moisture content shall be maintained at the optimum moisture content as defined by ASTM D698 until the next layer is placed.

3.3.4 Finish Tolerance

20) Finished Granular Subbase Course to be within ± 20 mm of established grade and cross section, but not uniformly high or low.

21) Correct surface irregularities greater than ± 20 mm by adding or removing material

until surface is within specified tolerances.

3.3.5 Maintenance

22) Maintain finished Granular Subbase Course in condition conforming to this section until succeeding material is applied.

23) Acceptance of finished Granular Subbase Course by the Engineer does not relieve

the Contractor of his responsibility to provide a finished Granular Subbase Course meeting the requirements of this Section until succeeding material is applied.

3.4 ROAD BASE COURSE

3.4.1 Inspection of Underlying Surface

3.5 SURFACE COURSE

3.5.1 Double Lift Surface Treatment Surface Course: As per Section 32 13 19.

3.6 COMPACTION TESTS

3.6.1 During compaction of subgrade, embankment fill and base/subbase courses, the Engineer will carry out compaction testing.

3.6.1.1 Co-operate with the Engineer by scheduling the placing and compaction of fill and

granular courses so that tests can be progressively taken. Provide labour and equipment when requested by the Engineer to facilitate testing, at no extra cost.

3.6.1.2 The Contractor will be invoiced for testing services and will be paid through the

Material Testing Allowance.

3.7 SETTING MANHOLES AND VALVE BOXES

3.7.1 Slope castings parallel to slope of finished grade. 3.7.2 Provide a minimum of three (3) adjustment rings on each manhole and catch basin. 3.7.3 Adjust manholes & catchbasins frames and valve boxes to surface course.

3.8 REMOVAL OF TEMPORARY APPURTENANCES

3.8.1 Remove and dispose of all temporary appurtenances when instructed by the Consultant. 3.9 DAMAGE TO ROADS, DITCHES & CULVERTS

3.9.1 Be responsible for the cost of repair of roads and ditches or other surface works which may be damaged as a result of poor workmanship or settlement caused by lack of compaction, frost heaving, use of wet backfill material or as a result of the Works subsurface.

3.9.2 Be responsible for the cost of repair to roads or other surface works due to having to excavate through such roadways to repair underground services.

3.9.3 Be responsible for the cost of repair to roads or other surface Works should a total collapse

of the road occur caused by loss of the supporting soil through infiltration into sewers or through Contractor’s negligence.

3.9.4 Be responsible for the cost to repair any existing or new culvert damaged during the work.

3.10 SNOW PLOWING

3.10.1 Plow roadways and access roads as required for construction access.

3.11 HOUSEKEEPING

3.11.1 Control dust prior to and during the placing of granular stone materials, using either watering trucks or other means when ordered by the Consultant.

3.12 RESTORATION

3.12.1 Provide restoration of the Works and areas damaged adjacent to the Works to the same or better condition as existed previous to this Contract and as specified in 01 74 00?

3.13 CLEARING AND GRUBBING TREES

3.13.1 Clear and grub all trees and shrubs within roadways, and other areas designated by the Consultant.

3.14 CULVERT AND SUBDRAINS

3.14.1 Supply and install CSP OR HDPE culverts and subdrains at locations shown on the drawings. 3.14.2 Set culverts at proper elevations and backfill with Granular “B”, Type I, material. 3.14.3 Set subdrains at proper elevations and slopes and backfill with 19 mm stone and geotextile

as specified on the drawings.
