Proposal: Construct a detached dwelling with rear attached garage with a variance to the minimum rear yard setback
Deemed Use: Permitted Use - Detached Dwelling
Land Use Bylaw Designation: Residential Single Family District (R-1C)
Civic Address: 4507 50 Avenue, Innisfail, AB

Applicant: DB Homes Inc.
On October 16, 2018 the Municipal Planning Commission APPROVED DP18D-094 subject to the conditions outlined below:
1. The development of the buildings and site improvements shall proceed in substantial accordance with the attached approved plans and drawings. Any modification or changes from the approved plans requires written approval from the Development Authority.
2. A variance to the minimum required rear yard setback from 8.0 metres (26 ft.) to 3.35 metres (11 ft.) has been approved.
3. All driveways, parking pads and areas used for vehicle storage shall be hard surfaced.
4. Driveway width providing vehicle access to the parcel shall not exceed 6 m (20 ft.).
5. Front yard sodding and landscaping consisting of 1 tree or 3 shrubs must be completed as soon as seasonal work allows or within one year of occupancy, whichever occurs first. All areas of a parcel not covered by buildings, driveways, parking, storage and display areas shall be seeded to grass, sodded, cultivated as a garden, hard landscaped or left with its natural, weed-free grass and vegetative cover.
6. Landscaping shall be completed to the satisfaction of the Development Authority by the end of the first full growing season following completion of construction or the commencement of the use, whichever occurs first.
7. Storm water run-off and sub-surface drainage shall be directed to Town road right-of-ways.
8. Use and development of the subject site shall conform to all other applicable requirements of the Town of Innisfail Land Use Bylaw, except where a relaxation has been expressly granted.

9. The approval of this Development Permit does not in any way limit the application of regulations in the Alberta Building Code, Occupational Health & Safety Act, the Public Health Act and Food Regulation, the Alberta Liquor and Gaming Commission or any other applicable legislation or requirements, nor does it constitute any permit or permission under such regulations.

On October 16, 2018 the Municipal Planning Commission APPROVED DP18D-095 subject to the conditions outlined below:
PRIOR TO RELEASE CONDITION(S):
1. All 2018 paving of Hazelwood Estates Phase 4 to be completed as approved by the Director of Operational Services prior to issuance of the development permit.
STANDARD CONDITIONS:
1. The development of the buildings and site improvements shall proceed in substantial accordance with the attached approved plans and drawings. Any modification or changes from the approved plans requires written approval from the Development Authority.
2. A variance to the minimum required rear yard setback from 9.0 metres (30 ft.) to 6.63 metres (21.8 ft.) to the northwest corner of the detached dwelling and 7.96 metres (26.1 ft.) to the northwest corner of the rear covered deck has been approved.
3. All driveways, parking pads and areas used for vehicle storage shall be hard surfaced.
4. Driveway width providing vehicle access to the parcel shall not exceed 6 m (20 ft.).
