NARAL Pro-Choice America’s 2017 Congressional Record on Choice documents the key choice-related House and Senate votes taken during the first session of the 115th Congress.

As expected, 2017 was a calamitous year for reproductive freedom. Rarely since Roe v. Wade has the right to choose been more vulnerable to legislative, judicial, and executive-branch threats. In fact, as the year came to a close, only 40 of 100 senators and 174 of 435 members of the House were fully pro-choice.

The House, as in years past, began this congress by turn-ing its attention almost immediately to attacking reproductive freedom. In January, the House passed a bill effectively banning abortion coverage in the state health-insurance exchanges, and shortly thereafter passed another bill to make it easier for states to defund abortion providers like Planned Parenthood. This assault on the right to choose continued throughout the year, and the chamber eventually passed a measure blocking a D.C. reproductive-health non-discrimination law and a ban on abortion after 20 weeks. Fortunately, many of these measures haven’t yet moved in the upper chamber.

In the Senate, the Trump administration saw great success in its efforts to stack both the executive and judicial branches with anti-choice extremists. After confirming two such exec-utive nominees, Tom Price to be Health and Human Services Secretary and Jeff Sessions to be Attorney General, right out of the gate, the Senate turned its attention to the fight over the nomination of now-Justice Neil Gorsuch to the Supreme Court. When a strong coalition of pro-choice senators announced their intent to vote against the nomination, anti-choice lead-ers went so far as to change the rules of the Senate so that they could confirm Gorsuch with a simple majority, handing

him a seat from which he will be free to promote Trump’s anti-choice agenda for decades to come.

Despite these constant attacks, we are heartened by the strong resistance put forth by the American public and our pro-choice champions in Congress this year. Nowhere was this strength more evident than in the repeated defeat of efforts to repeal the Affordable Care Act and defund Planned Parenthood. After seven years boasting of their plans to repeal the landmark healthcare law, anti-choice leaders were met with unprecedented opposition from their pro-choice colleagues and from their own constituents. It took several tries to get this extreme piece of legislation passed in the House, and the Senate was unable to pass the bill in its entirety. Unfortunately, both chambers did succeed in dismantling a key ACA provision in separate legislation. Blocking full repeal of the law was a great victory and is thanks entirely to the incredible individ-uals who filled rallies, flooded congressional phone lines, and bravely shared their stories, and by our pro-choice champions in Congress, who lifted up those stories, rallied with their con-stituents, and held their colleagues accountable.

2017 was an undeniably tough year. But in the face of assaults on all fronts, we saw the very best of this country: mil-lions of people worldwide marched for women’s rights, thou-sands showed up at airports to support immigrants banned from entering the country on the basis of religion, and a com-munity of Americans of many backgrounds came together to promote kindness, acceptance, and freedom. NARAL Pro-Choice America is proud to be a part of the fight to preserve this country’s values. Hand in hand with our 1.2 million member activists, we will continue to defend the fundamental freedoms guaranteed to all Americans in the United States Constitution.

VOTE DESCRIPTIONS SENATE

1. Support Women’s Access to No-Copay Contraception. FY’17 senate budget resolution, S.Con.Res.3. Gillibrand (D-NY) and Hirono (D-HI) amendment to ensure that women retain their guaranteed no-cost contraceptive coverage. Failed 49-49. A pro-choice vote (+) was in support of the amend-ment (1/12/17).

2. Sessions Confirmation. Vote to confirm anti-choice nominee Jeff Sessions to the post of attorney general. Confirmed 52-47. A pro-choice vote (+) was against confir-mation (2/8/17).

3. PriceConfirmation. Vote to confirm anti-choice nominee Tom Price to the post of secretary of Health and Human Services. Confirmed 52-47. A pro-choice vote (+) was against confirmation (2/10/17).

4. Rescind Title X Protections. A resolution to express congressional disapproval of the final rule relating to compliance with Title X requirements, H.J.Res.43.

Motion to proceed to consideration of the resolution. This measure reverses the Obama administration rule prohibit-ing discrimination against healthcare providers in the Title X program. Passed 51-50. A pro-choice vote (+) was against the motion to proceed (3/30/17).

5. Rescind Title X Protections. A resolution to express congressional disapproval of the final rule relating to compliance with Title X requirements, H.J.Res.43.

Final passage. This measure reverses the Obama administra-tion rule prohibiting discrimination against healthcare pro-viders in the Title X program. Passed 51-50. A pro-choice vote (+) was against the resolution (3/30/17).

6. Gorsuch Nomination: Motion to End Debate. Motion to invoke cloture (end debate) on the nomination of anti-choice Neil Gorsuch to the post of associate justice of the Supreme Court. Three-fifths of the Senate (60 votes) is required to invoke cloture. Cloture motion failed 55-45. A pro-choice vote (+) was against cloture (4/6/17).

7. Gorsuch Nomination: Rules Change. Vote to sustain the decision of the Chair that Supreme-Court nominees must pass a 60-vote threshold. This rules change lowered the threshold to a simple majority. Failed 48-52. A pro-choice vote (+) was in support of the 60-vote threshold (4/6/17).

8. GorsuchNomination:Confirmation.Vote to confirm anti-choice nominee Neil Gorsuch to the post of associate jus-tice of the Supreme Court. Confirmed 54-45. A pro-choice vote (+) was against confirmation (4/6/17).

9. GottliebConfirmation. Vote to confirm anti-choice nomi-nee Scott Gottlieb to the post of commissioner of the Food and Drug Administration. Confirmed 57-42. A pro-choice vote (+) was against confirmation (5/9/17).

10. BushConfirmation.Vote to confirm anti-choice nominee John Bush to the U.S. Court of Appeals for the Sixth Circuit.

Confirmed 51-47. A pro-choice vote (+) was against confir-mation (7/20/17).

11. ACA Repeal and Attack on Planned Parenthood. Better Care Reconciliation Act of 2017, H.R.1628. Motion to waive certain Senate rules on the FY’17 budget reconciliation leg-islation. Waiving these rules would move forward a bill to dismantle the Affordable Care Act, including restrictions on private insurance coverage of abortion care, and disqualify Planned Parenthood from participating in federal health-care programs for one year. (Some anti-choice lawmakers cast what appear to be pro-choice votes; most observers recognize that those votes were cast for reasons unrelated to reproductive health.) Failed 43-57. 12. ACA Repeal and Attack on Planned Parenthood. Obamacare Repeal Reconciliation Act of 2017, H.R.1628.

Motion to waive certain Senate rules on the FY’17 budget reconciliation legislation. Waiving these rules would move forward a bill to dismantle the Affordable Care Act, restrict private insurance coverage of abortion care, and disqualify Planned Parenthood from participating in federal health-care programs for one year. (Some anti-choice lawmakers cast what appear to be pro-choice votes; most observers recognize that those votes were cast for reasons unrelated to reproductive health.) Failed 45-55. A pro-choice vote (+) was against the motion (7/26/17).

13. Abortion-Coverage Ban. American Health Care Act of 2017, H.R.1628. Motion to waive the point of order that removes certain abortion-coverage restrictions in the budget rec-onciliation bill. This motion reinstates abortion restric-tions on private insurance in the budget reconciliation bill. Failed 50-50. A pro-choice vote (+) was against the motion (7/27/17).

14. ACA Repeal and Attack on Planned Parenthood. Health Care Freedom Act of 2017, H.R.1628. McConnell (R-KY) Amendment to FY’17 budget reconciliation legislation to defund Planned Parenthood and to eliminate the Affordable Care Act requirement to have health insurance. (Some anti-choice lawmakers cast what appear to be pro-choice votes; most observers recognize that those votes were cast for reasons unrelated to reproductive health.) Failed 49-51. A pro-choice vote (+) was against the amendment (7/28/17).

15. ACA Repeal. FY’18 budget resolution, H.Con.Res.71. Lee (R-UT) amendment to provide budget reconciliation instructions to repeal the Affordable Care Act. Paul (R-KY) amendment to provide budget reconciliation instructions to repeal consumer protections, includ-ing protections for pre-existing conditions and required coverage of essential health benefits, provided by the Affordable Care Act. (Some anti-choice lawmakers cast what appear to be pro-choice votes; most observers rec-ognize that those votes were cast for reasons unrelated to reproductive health.) Failed 66-33. A pro-choice vote (+) was against the amendment (10/19/17).

17. BarrettConfirmation. Vote to confirm anti-choice nom-inee Amy Coney Barrett to the U.S. Court of Appeals for the Seventh Circuit. Confirmed 55-43. A pro-choice vote (+) was against confirmation (10/31/17).

conference report overhauls the tax system and eliminates the Affordable Care Act’s requirement for individuals to purchase health insurance. 1. No Taxpayer Funding for Abortion Act. No Taxpayer Funding for Abortion Act, H.R.7. Final Passage. Smith (R-NJ) bill to effec-tively ban abortion coverage in the state health-insurance exchanges, penalize small businesses that purchase private health plans that include abortion coverage, mandate that health plans make biased, one-sided “disclosures” of abortion coverage, and reiterate and expand bans on public-insurance coverage of abortion. Passed 238-183. A pro-choice vote (+) was against the bill (1/24/17).

2. Rescind Title X Protections. A resolution to express congres-sional disapproval of the final rule relating to compliance with Title X requirements, H.J.Res.43. Final Passage. This measure would reverse the Obama administration rule prohibiting dis-crimination against healthcare providers in the Title X pro-gram. Passed 230-188. A pro-choice vote (+) was against the resolution (2/16/17).

3. ACA Repeal and Attack on Planned Parenthood. American Health Care Act, H.R.1628. Final passage. A bill to dismantle the Affordable Care Act, restrict private insurance coverage of abortion care, and disqualify Planned Parenthood from par-ticipating in federal healthcare programs for one year. (Some anti-choice lawmakers cast what appear to be pro-choice votes; most observers recognize that those votes were cast for reasons unrelated to reproductive health.) Passed 217-213. A pro-choice vote (+) was against the bill (5/4/17).

4. Anti-Choice Refusal: D.C. Reproductive-Health Non-Discrimination Law. Department of the Interior, Environment, and Related Agencies Appropriations Act, H.R.3354 (omnibus appropriations bill). Palmer amendment to block a D.C. law that prohibits employers from taking adverse action against employees based on their repro-ductive-health decisions. Passed 214-194. A pro-choice vote (+) was against the amendment (9/14/17).

5. Attack on Family-Planning Funding, Planned Parenthood, and Abortion Coverage. Department of the Interior, Environment, and Related Agencies Appropriations Act, H.R.3354 (omnibus appropriations bill). Final Passage. Appropriations bill that defunds Planned Parenthood, eliminates funding entirely for critical family-planning services through Title X and international programs, and includes anti-choice policy riders such as restrictions on abortion care for women who obtain their healthcare coverage through the federal government, prohibitions on abortion coverage in the private market, a broad new refusal law, a ban on federal funding for fetal-tissue research, and codification of the global gag rule. Passed 211-198. A pro-choice vote (+) was against the bill (9/14/17).

6. 20-Week Abortion Ban: Add Health Exception. Pain-Capable Unborn Child Protection Act, H.R.36. Motion to recommit the bill with instructions to add a health exception. Failed 187-238. A pro-choice vote (+) was in support of the motion to recommit (10/3/17).

7. 20-Week Abortion Ban. Pain-Capable Unborn Child Protection Act, H.R.36. Final Passage. Franks (R-AZ) bill to ban abortion after 20 weeks nationwide. Passed 237-189. A pro-choice vote (+) was against the bill (10/3/17).

8. Granting Legal Rights to a Pregnancy (“Personhood”). Tax Cuts and Jobs Act, H.R.1. Final Passage. A bill to overhaul the tax system which grants separate legal rights to a pregnancy, laying the legal groundwork to ban abortion outright. (Some anti-choice lawmakers cast what appear to be pro-choice votes; most observers recognize that those votes were cast for reasons unrelated to reproductive health.) Passed 227-205. A pro-choice vote (+) was against the bill (11/16/17).

9. Attack on the ACA. Tax Cuts and Jobs Act, H.R.1. On agreeing to the conference report as amended by the Senate. Final passage. The conference report overhauls the tax system and eliminates the Affordable Care Act’s requirement for individuals to purchase health insurance. (Some anti-choice lawmakers cast what appear to be pro-choice votes; most observers recognize that those votes were cast for reasons unrelated to reproductive health.). Passed 224-201. A pro-choice vote (+) was against the bill (12/20/17).
