A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, TO ENACT “ALICIA’S LAW” BY ADDING SECTION 1-7-180 SO AS TO CREATE THE INTERNET CRIMES AGAINST CHILDREN FUND TO INVESTIGATE, PROSECUTE, AND PREVENT INTERNET CRIMES AGAINST CHILDREN.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. This act may be cited as “Alicia’s Law”.

SECTION 2. Article 1, Chapter 7, Title 1 of the 1976 Code is amended by adding:

“Section 1-7-180. There is created in the State Treasury the Internet Crimes Against Children Fund. This fund is separate and distinct from the general fund of the State and all other funds. Earnings and interest on this fund must be credited to the fund and any balance in the fund at the end of a fiscal year carries forward in the fund in the succeeding fiscal year. The funds only may be used to investigate, prosecute, and prevent Internet crimes against children, such as cyber-enticement and child pornography, including the necessary staffing, training, and equipment. Of the revenue credited to the fund each year, sixty percent must be allocated to the Attorney General to operate the Internet Crimes Against Children Task Force, and the remaining forty percent must be allocated to the Department of Public Safety to provide grants to local law enforcement agencies to be expended in accordance with the purpose of the fund. Before awarding a grant to any local law enforcement agency, the Department of Public Safety and the South Carolina Public Safety Coordinating Council must consult

with the Internet Crimes Against Children Task Force and consider the recommendations of the task force in awarding the grants. Any funds allocated pursuant to this section may be carried forward by each respective agency to be used for the same purpose. This fund shall be funded by the General Assembly in the annual general appropriations act.”

SECTION 3. This act takes effect upon approval by the Governor.
