Fish Resources Management Act 1994

Fish Resources Management Amendment Regulations 2016

Made by the Governor in Executive Council.

1. Citation

These regulations are the Fish Resources Management Amendment Regulations 2016.

2. Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette;

(b) the rest of the regulations — on the day after that day.

3. Regulations amended

These regulations amend the Fish Resources Management Regulations 1995.

4. Regulations 22A and 22B inserted

At the beginning of Part 4 Division 5 insert:

22A. Term used: gear identification float

In this Division —

gear identification float means a surface float attached to a rock lobster pot that is marked with a gear identification number.

22B. Persons taken to be using rock lobster pots

In any proceedings for an offence under this Division, if a rock lobster pot that is being used to fish for rock lobster has attached to it one or more gear identification floats, each person whose gear identification number is marked on any of the gear identification floats is, in the absence of proof to the contrary, to be taken to be using the pot to fish for rock lobster.

5. Regulation 32 amended

(1) In regulation 32(1)(b) delete “licenced” (each occurrence) and insert:

(2) In regulation 32(1) delete the Penalty and insert:

Penalty for this subregulation: a fine of $5 000.

(3) After regulation 32(1) insert:

(1A) A person must not use a rock lobster pot to fish for rock lobster if there are more than 2 gear identification floats attached to the pot.

Penalty for this subregulation: a fine of $5 000.

(1B) A person does not commit an offence under subregulation (1A) if, at the time the person attached the person’s gear identification float to the rock lobster pot, no more than one other gear identification float was attached to the pot.

(1C) If a rock lobster pot is on a boat or in the water, a person must not remove a gear identification float from the pot unless the float is marked with that person’s gear identification number.

Penalty for this subregulation: a fine of $5 000.

Fish Resources Management Amendment Regulations (No. 3) 2016

Made by the Governor in Executive Council.

1. Citation

These regulations are the Fish Resources Management Amendment Regulations (No. 3) 2016.

2. Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these regulations are published in the Gazette;

(b) the rest of the regulations — on the day after that day.

3. Regulations amended

These regulations amend the Fish Resources Management Regulations 1995.

4. Regulation 123 amended

(1) In regulation 123(1) delete “A person” and insert:

(2) A person who has not attained the age of 16 years may fish for all freshwater fish (other than crustaceans) in waters south of 29° south latitude above the tidal influence including all lakes, dams, rivers and their tributaries without holding a recreational fishing licence.

Made by the Director of Energy Safety under section 33B(1A) of the Act.

1. Citation This notice is the Electricity (Prescribed Appliances) Notice 2016.

2. Commencement This notice comes into operation as follows— (a) clauses 1 and 2—on the day on which this notice is published in the Gazette; (b) the rest of the notice—on the day after that day.

3. Terms used (1) extra low voltage means voltage of 50V or less ac rms or 120V or less ripple-free dc; (2) low voltage means voltage greater than extra low voltage, but not more than 1000V ac rms or 1500V dc; (3) low voltage electrical appliances means low voltage electrical appliances designed, or marketed as suitable, for household, personal or similar use; (4) inverter means an electrical appliance that converts direct current into alternating current at 240 volts (nominal) that is available at one or more outlets fixed to the body of the inverter or to a cord or cords fixed internally to the body of the inverter;

4. Classes or types of electrical appliance not to be sold unless approved For the purposes of section 33B(1A)— (a) the prescribed class and types of low voltage electrical appliance requiring approval by the

Director before being made available for sale or hire are those electrical appliances listed as in-scope level 3 in Table B4 of Appendix B of Australian Standard AS/NZS 4417.2:2012;

(b) notwithstanding subclause (a) above the following appliances are not approved by the Director and must not be made available for sale or hire in Western Australia—

(i) television receivers that were first sold to the public in Australia or New Zealand prior to 1 July 1997; and

(ii) inverters with one or more plug type outlets; and (iii) low voltage electrical appliances subject to a recall notice published on the

Commonwealth Government’s website www.recalls.gov.au ; (c) the date specified is the day on which this clause comes into force.

5. Notices revoked The notice titled “Electricity (Prescribed Appliances and Published Specifications) Notice 2012” published in the Gazette No. 196 on 30 October 2012 at pages 5190, 5191 and 5192 is revoked.

The Western Australian Planning Commission proposes to amend the Peel Region Scheme, in respect of various landholdings throughout the Peel region, and is seeking public comment. The primary purpose of the amendment is to reserve land in the Peel region, which has been set aside and acquired for a public purpose, and to correct several minor anomalies. (c) Aerobic treatment units (ATU’s) or alternative systems shall be used for the onsite treatment and disposal of effluent where specified to the specifications and satisfaction of the local government and Department of Health WA.

(d) Effluent disposal areas shall have a minimum 2 metres vertical separation from highest known ground water level and be set back at least 100 metres from the bank of the Margaret River and 50 metres from any creek line, waterway and subsoil drainage system.

(b) Modifying the land use definition of ‘holiday house’ at Schedule 1 as follows— “holiday house” means a dwelling, grouped dwelling or multiple dwelling used to provide

short-term accommodation for no more than six (6) people but does not include a bed and breakfast.
