About the Lawsuit Reform Alliance of New York
The Lawsuit Reform Alliance of New York (LRANY) is a non-partisan 501(c)(4) nonprofit
organization which advocates for the reform of New York’s legal system in order to
foster a better business climate, promote job growth, and address the growing cost of
lawsuit abuse. LRANY’s members include local and national businesses,
entrepreneurs, healthcare providers, taxpayers, and concerned citizens from across
the state.
Overview
This report analyzes spending by plaintiffs’ lawyers on state-level elected officials
between January 1st, 2015 and December 31st, 2015. The report builds upon LRANY’s
2015 Power of Attorney report, which is available at www.lrany.org.
This report relies on publicly available information to examine the three main
components of monetary influence:
1. Lobbying expenditures
2. Campaign contributions by plaintiffs’ lawyer political action committees
(PACs)
3. Independent campaign contributions by law firms and lawyers

Notes on Political Influence in New York
This report expresses power and influence following analysis of lobbying expenditures and
campaign contributions as monetary inputs into state politics and does not attempt to
quantify the outputs attributable to or resulting from such activity (such as the enactment
or blockage of legislation). However, it should be noted here that in 2014 Governor
Andrew Cuomo told the Crain’s Editorial Board that despite his position on the issue, it
would be difficult to pass legislation reforming the trial lawyers-backed Scaffold Law
because “the trial lawyers are the single most powerful political force in Albany.”
While campaign contributions – which can be made through a variety of entities in New
York – and lobbying are both common expressions of money in politics, they are indeed
very different mechanisms of policy influence.
Lobbying is defined as direct activity meant to influence the passage or defeat of any
legislation or official act by either the houses of the state legislature or the executive
branch. In short, lobbying involves any attempt to shape legislation, resolutions, orders, or
regulatory rules. Entities spending more than $5000 on lobbying in any given year must
register its lobbyists with the Joint Commission on Public Ethics (JCOPE) and disclose all
lobbying expenditures to the public. New York does not have a limit on such spending.
Campaign contributions include spending on the outcome of a public election. All
contributions must be reported to the state Board of Elections which makes this
information publicly available. Under New York law, limited liability companies (LLCS) and
individuals may contribute up to $150,000 annually, incorporated businesses and not-for-
profits can contribute up to $5,000, and partnerships – as most law firms are organized –
may contribute up to $150,000 per partner.
Additionally, special interest groups make contributions through associated political action
committees (PACs). The New York State Trial Lawyers Association (NYSTLA) operates and
makes contributions through its LAWPAC, and the New York State Academy of Trial
Lawyers (NYSATL) operates its own ATL PAC. These PACs and their related organizations
are used interchangeably in LRANY’s Power of Attorney reports for both convenience and
precision.
Although the arrest and conviction of former Assembly Speaker Sheldon Silver shines light
on how outside income may influence the official duties of elected representatives, this
report does not analyze any official’s employment or affiliation with plaintiff’s firms.
Investigations into the possible impact of outside income on official activities are the
responsibility of duly authorized law enforcement agencies and their agents.

Summary of Findings
Lobbying
In 2015, the two plaintiffs’ lawyer special interest groups, the New York State Trial
Lawyers Association (NYSTLA) and New York State Academy of Trial Lawyers (NYSATL),
spent a record high $1,375,433 lobbying New York elected officials, representing a 10%
increase over the previous year and a 64% increase since 2010.
Campaign Contributions
In 2015, plaintiffs’ lawyers as a whole1 made $1,268,781.43 in political contributions to
state elected officials, which is a decrease from last year’s record high due to the fact
that 2015 was not an election year:
- $450,250.00 from NYSTLA and NYSATL political action committees
- $818,531.43 from individual plaintiffs’ lawyers and law firms associated with
NYSTLA and NYSATL
In 2015, NYSTLA, the dominant plaintiffs’ lawyer special interest group in New York,
contributed $441,000 to state-level campaigns, including:
- 63% of all the members of the legislature
- 83% of the Senate
- 55% of the Assembly
In 2015, NYSTLA contributed $299,320 to campaign committee accounts:
- $65,000 to the Democratic Senate Campaign Committee
- $109,600 to the Democratic Assembly Campaign Committee2
- $109,600 to Senate Republican Campaign Committee2
- $13,100 to the Republican Assembly Campaign Committee
- $2,000 to the Senate Independent Democratic Conference
In 2015, plaintiffs’ lawyers as a whole contributed $126,575 to statewide offices,
including:
- $65,325 to the Office of the Governor
- $46,000 to the Office of the Attorney General
- $15,250 to the Office of the Comptroller

Methodology
Sources
Data for this report was aggregated from publicly available reports. Figures for lobbying
expenditures were obtained from the Joint Commission on Public Ethics (JCOPE), and
totals for campaign contributions were calculated using New York State Board of
Elections campaign finance disclosure reports.
Total lobbying dollars were calculated as the sum total of all “reportable lobbying
expenses” and “reportable lobbying compensation” reported on the JCOPE Client Semi-
Annual Reports of NYSTLA and NYSATL. These two groups overwhelmingly represent
plaintiffs’ attorneys and their interests.
Total plaintiffs’ lawyer PAC campaign contributions were calculated as the sum total of
all campaign contributions to candidates by the two plaintiffs’ lawyer political action
committees, NYSTLA’s LAWPAC, and NYSATL’s ATL PAC. In terms of total dollar
contributions, LAWPAC is the dominant committee by an overwhelming margin. In the
cases where ATL PAC did not make political contributions, only contributions by
LAWPAC were analyzed.
Contributions by law firms and lawyers were calculated by identifying contributions
made to candidates by individuals and firms who also contributed to LAWPAC and ATL
PAC. This process of reverse engineering contribution data is detailed in the graphic
below, with the red arrow representing the contributions identified in this component.

Exploring the Influence
Overview
This section explores, to the extent possible, the recipients of plaintiffs’ lawyer money.
Lobbying expenditures are not attributed to individual elected officials - only campaign
contributions have traceable beneficiaries. 5 Therefore, this analysis focuses on
campaign contributions by PACs and individual law firms and lawyers.
Executive Branch
New York’s four elected statewide positions – Governor, Lieutenant Governor, Attorney
General, and Comptroller – serve four year terms and are not subject to term limits.
Governor/Lieutenant Governor
In 2015, LAWPAC contributed $65,100 to Governor Andrew Cuomo. ATL PAC did
not make any contributions to the Governor. Individual lawyers and law firms
affiliated with NYSTLA and NYSATL contributed $225.
Attorney General
In 2015, LAWPAC contributed $40,700 to Attorney General Eric Schneiderman. ATL
PAC did not make any contributions. Individual lawyers and law firms affiliated with
NYSTLA and NYSATL contributed $5,300 to Attorney General Schneiderman.
Comptroller
In 2015, LAWPAC contributed a total of $15,000 to Comptroller Thomas DiNapoli.
ATL PAC did not make any contributions. Individual lawyers and law firms affiliated
with NYSTLA and NYSATL contributed $250 to comptroller candidates.

Campaign Committees
In addition to contributing to campaigns directly, NYSTLA also supports candidates by
making contributions to party campaign committees. These committees may receive up
to $109,600 annually6 per individual, partnership, or PAC, and up to $5,000 annually
from a corporation. They may make unlimited contributions to candidates. Between
2006 and 2015, LAWPAC made substantial contributions to campaign committees,
frequently reaching the legal maximum.

The Legislature
Much of the NYSTLA’s campaign contributions are
directed to members of the legislature. In 2015
63% of all state legislators received campaign
contributions from LAWPAC. In total, 83% of state
senators and 55% of members of assembly
received campaign contributions from LAWPAC.
Legislative Committees
All legislation must be reviewed by the
appropriate legislative committees before being
considered for a vote by the full house. Our
analysis of campaign finance data reveals that
NYSTLA and NYSATL make substantial campaign
contributions to the powerful Rules and
Finance/Ways and Means committees, as well as the committees which consider
legislation relating to civil law (Judiciary and Codes, in the Senate and Assembly). The
graphics on the following pages highlight the extent of these contributions for the
respective committees during 2015.

Rules Committees
The Rules committees are chaired by leaders of each house, the Senate President Pro
Tempore and the Assembly Speaker respectively, and are populated by the senior
members of each party. The Rules committees have broad influence over the flow
and passage of legislation. Accordingly, a majority of the members of the Rules
committees receive campaign contributions from LAWPAC and/or ATL PAC.
Finance Committees
The Senate Finance committee, and its equivalent, the Assembly Ways and Means
committee, are responsible for approving all legislation which has a fiscal impact on
the state. These committees are also responsible for reviewing the Governor’s
Executive Budget and proposing changes. Both the Finance and Ways and Means
committees are chaired by senior members, and like the Rules committees, receive
substantial contributions from LAWPAC and/or ATL PAC.

Judiciary Committees
The Judiciary committees are responsible for considering legislation which affects the
civil practice law and rules. As these committees focus on legislation which directly
impacts the practice of law, members of these committees frequently receive
sizeable campaign contributions from LAWPAC and/or ATL PAC.
Codes Committees
The Codes committees have broad jurisdiction over legislation which affects the
criminal code. These committees also occasionally consider legislation with civil
impacts as well. A majority of the members of the Codes committees receive
campaign contributions from LAWPAC and/or ATL PAC.

Judicial Campaign Contributions
A portion of the spending by
individual plaintiffs’ lawyers and
firms associated with NYSTLA and
NYSATL, $99,794, was on state
Supreme Court judicial
candidates.7 This is a decrease
from the previous year due to the
fact that there were no primaries
in 2015 for the Supreme Court of
the State of New York. The
election candidates were chosen
by delegates.8 There were
contested elections in only seven
districts in 2015.
Conclusion
Despite the fact that 2015 was not an election year, the trial lawyer’s spent 10% more than they did in 2014 in New York’s state political realm. NYSTLA, NYSATL, and the individual plaintiffs’ lawyers associated with these organizations continue to invest large amounts of money to promote and protect their agenda. We conclude that:
- Lobbying and political spending by plaintiffs’ lawyers as a whole has increased
dramatically since 2010.
- NYSTLA has sufficient resources to seek influence in a targeted manner
through contributions to key leaders and legislative committees, and in a
broad manner through contributions to a vast majority of state legislators.
- Given the recent corruption conviction, and disbarment of former Assembly
Speaker Sheldon Silver, it is critical to continue to explore the political
activities of personal injury trial lawyers.
As examined throughout this report, trial lawyers as a whole expend considerable
resources to push the boundaries of civil liability and increase profits for their members.
As recent efforts to reform New York’s civil justice system stall in Albany, and as we
continue to reveal the substantial campaign contributions and lobbying spending of the
plaintiffs’ lawyers, we recognize that the influence of the trial lawyer’s special interest is
a significant roadblock to common sense lawsuit reform.
