Added new ordinance 6-3-12 (Bear Resistant Containers), 8-3-3 (Fishing Regulations), 7-4-78 (Misuse of Wireless Telephone), and 7-6-31 (Horse Trailer Parking). Previous Bicycle and Moped violations that were $50 fines are now $100 (“pay and close”). Please see pages 24 – 25. All other violations on a bicycle or moped should follow the schedule for traffic violations. All Bear-Resistant Container Required (6-3-12) tickets should be marked “Mandatory Appearance” and “Check Eligibility.” Important Reminders: “Pay and close” eligible 0 – 2 point traffic infractions remain $100. The fine for all 0 – 2 point traffic infractions (including seatbelt violations) is $100 and the fine for all 3 - 4 point traffic infractions is now $125. The fine for traffic offenses remains $300. Fines are doubled for speeding violations in a construction zone and for speeding offenses and any type of infraction in a school zone. The bond for general offenses will usually be $100, $250, $500, or $1,000 as indicated on the attached schedule. The bond for parking violations continues to be the amount printed on the ticket, but if no amount is printed on the ticket, the bond will be $15.00 unless otherwise indicated on the attached schedule. The bond for any violation not specified in the revised schedule shall be $15 for parking offenses, $300 for traffic infractions ($600 for speeding violations in a construction zone and $600 for any type of infraction in a school zone), $300 for traffic offenses ($600 for speeding offenses in a construction or school zone), and $1,000 for general offenses. Pursuant to B.R.C. Section 2-6-14, all traffic infractions are penalty assessments (PA). Traffic offenses are not penalty assessments, except for Inattentive Driving (Careless Driving). “Pay and close” (PA) tickets may be written only if: (1) only one violation has arisen out of the same episode (unless the second violation is a seatbelt violation – “pay and close” is okay); and (2) the offense does not appear to be an intentional or reckless violation; and (3) the police officer would not be entitled to incarcerate the defendant under B.R.C. Section 2-6-18. Inattentive Driving (Careless Driving) may be written as a “pay and close” at the discretion of the officer. “Pay and close” tickets are reduced by 2 points. Private property designations are noted throughout the bond schedule. Please see the “CAO Key” column and corresponding notation at the bottom of each page.
