FOREWORD: PROSPECTIVE CANDIDATE FOR NOMINATION CHECKLIST

No member can seek a nomination without first receiving the approval of the BC NDP Provincial Executive.

Please ensure all required pieces are included before submitting your candidate application as incomplete applications will not be considered. This guide explains each of those requirements. To be considered a prospective candidate for nomination the following items must be included in your application for candidacy for nomination:

1. A copy of your letter of intent to the constituency association president. The letter must be signed by ten members in good standing resident within the electoral boundaries of the constituency association for at least 90 days prior to the Nominating Convention who consent to your candidacy (Addendum A);

2. Your signed BC NDP Candidate Confidentiality Agreement (Addendum B);

3. Your signed BC NDP Declaration of Candidate Responsibilities and Personal Disclosure Statement (Addendum C);

4. Confirmation that you have requested a criminal record check.5. Your $2,000 Candidate Administrative Fee payable to the BC NDP;

6. If you fail to meet the membership requirement in Article 9.04 of the BC NDP Constitution, a written explanation pursuant to section 11 of the Regulations Governing the Nomination of Candidates and a request that the requirement be waived; and

7. A fully completed candidate application package.

INTRODUCTION

Congratulations on your decision to seek a nomination to run as an NDP candidate!This guide has been prepared to assist potential candidates for nomination with the BC NDP nomination process and to walk you through the application for candidacy for nomination that must be submitted to the Provincial Executive (at which point you are considered a prospective candidate for nomination) to be given consideration for approval.Potential candidates for nomination are also encouraged to be in contact with the President of their constituency association and/or local Candidate Search Committee with any questions about the nomination process.

A copy of the Regulations Governing the Nomination of Candidates will be sent to you upon request.

UNDERSTANDING THE ROLE OF A BC NDP CANDIDATE

The candidate is the main representative of the NDP in the constituency during an election period. The candidates main job is to meet as many voters as possible and deliver a locally nuanced version of the central campaign message. The candidate is also one of the campaigns best fundraisers and volunteer recruiters.During the course of the pre-election and election periods, the candidates duties will include:

Volunteer recruitment

Fundraising

Door to door canvassing

Telephone canvassing

Attending all-candidates meetings

Conducting media interviews

Attending public events

Mainstreeting, bus-stopping, plant-gating and Burma-shaving

BC NDP POLICIES AND PROCEDURES

Pursuant to the BC NDP Constitution, the Partys Provincial Executive governs the process of approving candidates for nomination and local Nominating Conventions.All candidates seeking a nomination to run in the provincial election on behalf of the New Democratic Party must receive approval from the Provincial Executive of the BC NDP prior to their names appearing on the ballot at a Nominating Convention.

As per section 9.04 of the BC NDP Constitution, all persons proposed as candidates of the Party for public office shall be only those members who have been in good standing in the Party for at least 90 days prior to a Nominating Convention, and shall obtain acceptance from the Provincial Executive. This requirement may be waived in special circumstances upon application by the prospective candidate to the Provincial Executive before the date of the Nominating Convention.In order to receive this approval from the Provincial Executive, a complete application must be filed with Provincial Office. The checklist on page two of this guide lists the required components of this application. Please ensure all pieces are included before submitting your application as incomplete applications will not be considered.By seeking approval from the Provincial Executive and completing all required pieces of the application process, candidates for nomination agree to accept and abide by the BC NDP Constitution and the principles and policies of the New Democratic Party. Breach of this agreement is a violation of the Constitution as per Article 16. To be approved as a candidate for nomination for the BC NDP, a member must have a clear and strong commitment to the principles of the BC NDP. The Provincial Executive may reject prospective candidates for nomination who do not meet the criteria.

Party PolicyIn signing the BC NDP Declaration of Candidate Responsibilities form required for approval as a candidate for nomination, prospective candidates agree to abide by all policies of the BC NDP. This includes policies that are current at the time of approval as a candidate, as well as any new policies and/or platform items introduced in the pre-election or election periods.

These policies also include the BC NDP policy on revenue sharing, candidate spending limits and membership recruitment, all of which are outlined in this guide.

Although not necessarily in agreement with every policy position taken by the Party, individuals, and especially candidates, must acknowledge the majority position of the Party.RULES GOVERNING BC NDP NOMINATING CONVENTIONS

All rules pertaining to the conduct of a local BC NDP Nominating Convention are governed by the BC NDP Constitution. The Provincial Executive has the responsibility for making regulations on nominating procedures. The Regulations Governing the Nomination of Candidates are attached to this guide as Addendum E.Candidate Spending Limits

There is a spending limit of $3,500 for candidates seeking a nomination. Please consult the Election Act section of this guide for additional information related to nomination contestant spending. Candidates must accurately record all donations received and all expenses incurred in the course of their nomination campaign.

Candidate Rights and Responsibilities

All candidates for nomination are to be treated fairly and equitably as per the BC NDP nomination rules. In addition, candidates also have responsibilities to adhere to the Party and the constituency association nomination process. Please consult the BC NDP Regulations Governing the Nomination of Candidates as found in Addendum E of this guide.APPLICATION FOR CANDIDACY FOR nomination and the approval process

A complete application for candidacy for nomination consists of the following components:

A copy of your letter of intent to the constituency association president. The letter must be signed by ten (10) members in good standing resident within the electoral boundaries of the constituency association for at least 90 days prior to the Nominating Convention who consent to your candidacy (Addendum A);

Your signed BC NDP Candidate Confidentiality Agreement (Addendum B);

Your signed BC NDP Declaration of Candidate Responsibilities and Personal Disclosure Statement (Addendum C);

Completed criminal record check or confirmation that you have requested a criminal record check.

The application must be filed with the Provincial Director. The letter of intent must have been filed with the constituency President prior to or concurrently with the application being received at Provincial Office.

It is up to the potential candidate to ensure paperwork is completed properly; it is upon the submission of a complete application for candidacy for nomination that you are considered a prospective candidate for nomination. Incomplete packages will not be considered for approval by the Provincial Executive.

Once the completed candidate application is submitted to the Provincial Director, the eligibility of the prospective candidate and the members consenting to their candidacy will be checked, and a rigorous vetting process will take place. The Provincial Director will recommend qualified candidates to the Provincial Executive for approval. The ten members giving consent must be members in good standing resident within the electoral boundaries of the constituency association for at least 90 days prior to the Nominating Convention as per the BC NDP Constitution. Upon approval by Provincial Executive, a prospective candidate for nomination will be considered a candidate for nomination for the BC NDP.All prospective candidates for nomination will be subject to a third-party background check.

Please note that the Candidate Campaign Administrative Fee is not eligible for a tax receipt. Cheques must be made out to the BC NDP.

Public contact information

Candidates should note that once they receive approval from Provincial Executive, that approval may be made public by the Party as they are considered to be a BC NDP candidate for nomination. For this reason, prospective candidates must provide Provincial Office with a public contact number and/or email address.

Individuals who are not ready to have their candidacy become public should consider the timing of their request for approval.

Access to membership lists

Once a prospective candidate has completed all requirements for approval as outlined in this guide and been approved by the Provincial Executive, the candidate is considered an approved candidate for nomination. At this stage, candidates are entitled to receive membership lists.As part of the application process, all candidates sign the Confidentiality Agreement which binds candidates and their agents to proper use of membership information. By signing this form, the candidate accepts that they will be held responsible for any improper use of confidential information provided to their campaign.Candidates for nomination are entitled to emailed membership lists upon receiving approval of candidacy by the Provincial Executive. The lists will include current, lapsed (under section 2.07 of the BC NDP Constitution) and transfer out members. A set of lists will be sent to the candidate by email automatically following the candidate approval by the Provincial Executive.

Candidates should allow a minimum of one week from the date of the Provincial Executive meeting to which their approval goes forward until the time the lists are received as per BC NDP list procedures.

Access to Additional Lists

Due to privacy legislation and Party policy, candidates are not entitled to access any other lists, including lists from constituency associations or lists of previous campaign supporters such as those contained in our political database NDP Vote until after securing a nomination.

Membership RecruitmentBC NDP membership forms are available on the BC NDP website or from Provincial Office. Memberships are date stamped upon receipt at Provincial Office during regular office hours (Monday to Friday, 8:30 am to 5:00 pm). Strict rules are in place to protect the integrity of the nomination process, and anyone intending to conduct a membership drive should contact Membership Secretary Karl Riley at karl.riley@bcndp.ca before beginning signups. Incomplete membership forms will be rejected and only date stamped on the date they are returned completed to Provincial Office.

Party procedure requires that all new memberships and membership renewals obtained by candidates or their agents be promptly submitted to Provincial Office.

It is important that candidates for nomination who plan to recruit new members understand the rules that apply to membership canvassing in the BC NDP.

Criteria for BC NDP Membership

Membership in the BC NDP is governed by Article 2 of the BC NDP Constitution. Specifically, eligibility for membership includes the following requirements:

A Canadian Citizen, Permanent Resident or a person who has been granted the status of Convention Refugee or Protected Person, with discretion for the Provincial Executive to grant membership approval in special circumstances. Twelve (12) years of age or older for new members; No member of the BC NDP may be a member of another political party, either provincially or federally. A canvasser should direct the attention of the applicant to the prohibition against membership in another political party.

Training

Campaign team building and training

While the nomination campaign is not the time to be slotting campaign workers for the actual election period, it is never too early to identify local volunteers and members to play key roles on the constituency Election Planning Committee and other pre-election structures.

Party staff will work closely with the successful nomination candidate and local executive to identify and/or provide campaign volunteers and staff.

BC ELECTION ACT AND PROSPECTIVE CANDIDATES

Even prospective candidates who are only interested in running for nomination must be aware of the BC Election Act rules as this legislation pertains to candidates for nomination from the moment a person begins to seek the nomination.

nomination contestants include individuals who have not yet formally entered the nomination contest but who are considering seeking the nomination and who do become contestants. If undeclared nomination contestants, candidates, or self-declared candidates are accepting contributions or incurring expenses for entering the contest or election, they must follow the rules in relation to those contributions or expenses

The Election Act rules do not just come into effect after a candidate for nomination is approved by the Party, as outlined in the following excerpt from Elections BC.

a contestant expense is the value of property or services used by or on behalf of a nomination contestant to promote or oppose, directly or indirectly, the selection of a nomination contestant as the candidate to represent a registered political party

These definitions mean that anything used in an election or nomination campaign is an election expense, even if the item was purchased before the election or the nomination contest was called

Elections BC has created several excellent handbooks to assist in explaining the Election Act and how it applies to your campaign. Candidates and their teams should be familiar with these guides available on their website at www.elections.bc.ca.

Please familiarize yourself with the sections on "nomination contestants" immediately. The Election Act (BC) requires candidates for nomination to maintain various financial records:

175(5)A nomination contestant, although not required to have a financial agent, must ensure that records are maintained respecting nomination contestant contributions and nomination contestant expenses to comply with the requirements of section 209 if applicable.

Sub-section 209(1) requires that financial agents for candidates for election (i.e. if you win the nomination and run for MLA), have to file with Elections BC, within 90 days after the provincial election, a financial report that includes contributions accepted by the candidate as a nomination contestant (209(2)(f)) and expenses (209(2)(f)).

Contributions and expenses are described in the Election Act (BC). Particular attention should be paid to sections 180 through 184.

Use of Party logo

Candidates for nomination are not entitled to use the Party logo on any printed or electronic material until after the Nominating Convention when they become the officially nominated candidate. Candidates for nomination are welcome to use the Partys colours.

Public statements

Candidates for nomination are not entitled to speak on behalf of the Party on any matter. Any statements made to the media or individuals are expressions of a candidate for nominations own opinion, and prospective candidates must make sure this is understood.

It is important that the opinions of candidates for nomination do not contradict or undermine the official positions of the Party and the Leader, nor should they aim to commit the Party or the Leader to a course of action that has not been decided through appropriate means. In signing the BC NDP Declaration of Candidate Responsibilities form required for approval as a candidate, prospective candidates agree to abide by all policies of the BC NDP.

Candidates for nomination are strongly encouraged to check in with BC NDP staff prior to making public statements to ensure that they are not undermining the message from the Party or Leader.Additional Resources for Candidates

Once a candidate is officially nominated, they can access the full pre-election services of the BC NDP.

You will receive additional information from Provincial Office after the Nominating Convention has been held. Once you are officially nominated, your Organizer at Provincial Office will be able to work with you and your local constituency EPC in developing solid pre-election and election plans.

ADDENDUM B: CONFIDENTIALITY AGREEMENT

AGREEMENT BETWEEN THE NEW DEMOCRATIC PARTY OF BRITISH COLUMBIA (BC NDP) and a candidate for nomination (candidate) CONCERNING THE USE OF Membership INFORMATION

Statement of Ownership:Membership lists, data and information are and remain the sole property of the BC NDP.

Agreement:

By signing below, the candidate agrees and acknowledges that:

a. BC NDP membership information is provided in trust for use on a temporary basis and will not be used contrary to the provisions of this agreement;

b. BC NDP membership information may be used for the sole purpose of contacting current or lapsed members in the specific campaign for nomination to which this agreement applies; and

c. Any use of BC NDP membership information not expressly permitted by this agreement is strictly prohibited.

By signing below, the candidate further agrees:

d. To be the sole trustee of membership information so entrusted and to personally enforce the terms of this agreement on any member(s) of her/his campaign team who may be privy to some or all of said information;

e. To not release membership information to any individual who is not a member in good standing of the BC NDP or organization pre-approved by the BC NDP for direct use on the candidates behalf pursuant to section (b) above;

f. That all membership lists, data and information will be confidentially destroyed and disposed of with written confirmation of the same to be provided to the BC NDP within thirty (30) days of the conclusion of the Nominating Convention; and

The candidate acknowledges and accepts that there may be sanctions against her/his campaign for nomination, candidacy for office and/or continued Party membership, including disqualification and/or legal proceedings, should unauthorized use of membership information entrusted to her/him occur whether by intentional act, act of omission or negligence.

ADDENDUM C: BC NDP Declaration of Candidate Responsibilities and Personal Disclosure Statement

The Provincial Executive of the BC NDP has the responsibility to approve or reject candidates for nomination and/or election to the BC Legislature as established by the BC NDP Constitution.

Under Section 60 (1) of the BC Election Act, the Party provides written endorsement of all candidates to Elections BC once the writ has dropped in order for the candidate to officially represent the BC NDP on the ballot.

Party policy requires that prospective candidates must complete a Candidate Personal Disclosure Statement, which must be received by the Provincial Director with the Candidate Nomination Package. Prospective candidates must also sign the Declaration of Candidate Responsibilities.

Prospective candidates are also encouraged to review the BC NDP Guide to Nominating Conventions, which is distributed to constituency presidents and is available from Provincial Office and found on the Activist site.

The following disclosure questions are important as they identify personal issues that may become public in the political arena. As part of campaign preparation, the Party, and you as a candidate, need to be aware of potential public scrutiny of personal issues that may arise during the campaign.

Fundraising:

16. Fundraising is a fundamental aspect of election campaigns. How do you plan to raise revenue for your election campaign if successful in securing the nomination? What experience have you had in fundraising? How do you feel about asking people for money to help you get elected?

Integrity and Accountability:
