What is a patent?
• A patent is:
– An Intellectual Property right conferred by a State to
the inventor for a limited period (20 years).

– Which relies on an invention which fulfils the
requirements of patentability.
– That enables the owner to forbid the use of the
invention by third parties without his consent.

Requirements of patentability
To get a patent granted:
• The invention must be new (principle of “novelty”),
• It must involve an inventive step, and
• It must be susceptible to industrial application.
Others:
• Sufficiency of disclosure,
• Clarity (particularly claims must be clear and concise),
• Unity of invention.

Novelty: An invention is "considered to be new if it does not form part of the state of the art“.
The "state of the art" is defined as "everything madeavailable to the public by means of a written or oraldescription, by use, or in any other way, before the date offiling of the patent application“.

"An invention shall be considered as susceptible of industrial application if it can be made or used in any kind of industry".
Sufficiency of disclosure
The description must disclose any feature essential for carrying out the invention in sufficient detail to render it apparent to the skilled person how to put the invention into practice.
A detailed description of at least one way of carrying out the invention must be given.
Examples that describe the invention in a manner
sufficiently complete to be carried out by a skilled in the art
and susceptible to be broadened by a person skilled in the
art.

Clarity
Claims define the scope of the protection, therefore claims must be:
• clear and concise• supported in the description

A claim should be wide enough to prevent other parties from using something similar to the invention but enough clear and concise to be granted

FASE PREVIA a la propuesta:
– Búsqueda de socios y negociaciones requeridas.
– Aspectos jurídicos previos: Acuerdos de confidencialidad y MoU (Memorandum of
Understanding).
– Específicamente en el instrumento para PYME, realización de la evaluación del concepto y
viabilidad de la propuesta: Viabilidad del concepto, Análisis de riesgos, Régimen PI,
Planteamiento del proyecto, Búsqueda de socios, Estudio de diseños, Estrategia de
innovación.
FASE REDACCIÓN de la propuesta:
– Integrar la propiedad industrial e intelectual en la explotación del proyecto: protección y
gestión de los resultados, del nombre de proyecto, del nombre de los productos y de todo el
website, protección de manuales y guías, Software, bases de datos, contenidos web,
gráficos o soportes para difusión.
– Integrar la comercialización y explotación de los resultados, teniendo en cuenta
aspectos jurídicos, situación de mercado y de la competencia (tendencias tecnológicas,
vigilancia de la competencia, escenarios a corto y medio plazo ).
– Aspectos jurídicos: acuerdo de concesión y acuerdo de consorcio.

FASE de IMPLEMENTACIÓN del proyecto:
– Gestión de los resultados de investigación del proyecto teniendo en cuenta la mejor forma
de protección. Informes de patentabilidad / Gestión de marcas y dominios
correspondientes.
– Realización de los estudios pertinentes durante la fase de investigación: Determinar los
desarrollos de la competencia, tendencias tecnológicas, bibliografía de reciente aparición.
FASE de COMERCIALIZACIÓN:
– Negociación con los diferentes actores. Aspectos jurídicos relevantes.
– Redacción y/o revisión de acuerdos de explotación conjunta, licencia o cesión.
– Valoración económica de la tecnología (monetización).
– Informes de Freedom to Operate y/o de informes de infracción, para poder operar en
un determinado mercado con garantías.
– Específicamente en el instrumento para PYME, soporte y apoyo en todas las tareas de
comercialización: Etiqueta calidad para proyectos exitosos; networking, formación,
