Students shall play as a representative of the high school in which they first registered as a bona fide high school student. In case of transfer from one school to another the student shall become eligible be deemed ineligible to participate in interschool athletics in the new school following the acceptance of this transfer-in by the principal (see Transfer Policy and Transfer Form). 2. Transfer Policy: A student who transfers schools is ineligible for interscholastic competition unless they establish their eligibility for participation. The onus is on the student and family to provide the school with information required to establish eligibility to the satisfaction of the SHSAA. 3. Establishing Eligibility: In order to establish eligibility for participation in athletics, students who transfer schools must meet one of the following three (3) conditions: 1. Change of Residence a) Parent to parent move: the student moves to reside with the parent with whom they have not been living. Only two such transfers are allowed in a student’s three years of eligibility. Except as otherwise provided, the residence of any student shall be deemed to be that of the parent to whom custody has been awarded by a court of competent jurisdiction. If no custody order has been entered, the residence shall be deemed to be that of the parent who had actual custody immediately upon separation. OR b) Family move: the student has moved with the parent(s)/legal guardian(s) who have changed residence within the previous 12 months, to reside within the catchment area or normal boundaries of the school at which the student has registered. 2013 Annual General Meeting Resolutions

Bylaws 13/02/01 BE IT RESOLVED that Eligibility to Represent School Teams Bylaw

(Transfer Policy) approved at the 2012 AGM be amended as follows: ELIGIBILITY TO REPRESENT SCHOOL TEAMS

1. Students shall play as a representative of the high school in which they first registered as a bona fide high school student. In case of transfer from one school to another the student shall become eligible be deemed ineligible to participate in interschool athletics in the new school following the acceptance of this transfer-in by the principal (see Transfer Policy and Transfer Form).

2. Transfer Policy: A student who transfers schools is ineligible for interscholastic

competition unless they establish their eligibility for participation. The onus is on the student and family to provide the school with information required to establish eligibility to the satisfaction of the SHSAA.

3. Establishing Eligibility: In order to establish eligibility for participation in athletics,

students who transfer schools must meet one of the following three (3) conditions:

1. Change of Residence

a) Parent to parent move: the student moves to reside with the parent with whom they

have not been living. Only two such transfers are allowed in a student’s three years of eligibility. Except as otherwise provided, the residence of any student shall be deemed to be that of the parent to whom custody has been awarded by a court of competent jurisdiction. If no custody order has been entered, the residence shall be deemed to be that of the parent who had actual custody immediately upon separation.

OR

b) Family move: the student has moved with the parent(s)/legal guardian(s) who have

changed residence within the previous 12 months, to reside within the catchment area or normal boundaries of the school at which the student has registered. Any change in residence must be bona fide. Determination of what constitutes a bona fide change of residence depends upon the facts of each case. In order for a change of residence to be considered bona fide, at least the following facts must exist:

i. The original residence must be abandoned as a residence; that is sold, rented or disposed of as a residence, and must not be used as a residence by another member of the family;

ii. The entire family must make the change and take with them the household goods and furniture appropriate to the circumstances;

iii. The change must be made with the intent that it is permanent.

NOTE to a) and b) above:

i. Under no circumstances can a student have more than one residence for eligibility purposes. It is the obligation of the school to know the residence status of each athlete and to require compliance with these requirements.

ii. Legal Guardianship: Without limiting the generality of the foregoing, when considering eligibility the SHSAA may take into consideration the existence of a Guardianship Order issued by a Court of competent jurisdiction. However, the existence of such a Court Order shall not be determinative of the issue of the eligibility of any student to participate in SHSAA governed athletic activities.

OR 2. Directed by Legal Authority

a) The student is directed by legal authority to move from their current school to a different jurisdiction. Without limiting the generality of the foregoing, for the purpose of the transfer policy “legal authority” shall include but shall not be restricted to:

i. a Court of competent jurisdiction; and ii. any department or agency of the Provincial or Federal government acting within the

scope of its authority or pursuant to an Order of a Court of competent jurisdiction; and

iii. any school board or school authority acting within the scope of its authority or pursuant to an Order of a Court of competent jurisdiction.

b) A student whose custody has been established by court order or social service agency decision is eligible for participation at the school to which he or she is assigned.

3. In the event that a student cannot satisfy the requirements for eligibility as set out in

paragraphs 1(a), 1(b), 2(a) or 2(b), then the SHSAA may in its absolute discretion determine a student to be eligible upon proper completion of a Transfer Form (page 155) that shall contain:

a) Signatures of approval from the principal and the athletic director of the school receiving the student; and

b) A signed statement from at least one parent or legal guardian stating that the primary reason for the transfer is for an educational purpose, and that the transfer is not being made primarily for an athletic purpose or primarily so that the student can participate in athletics; and

c) An acknowledgement signed by the student and his/her parent/legal guardian stating that they understand that the student is ineligible to participate in SHSAA governed activities. The school may apply for the reinstatement of the student's eligibility but the student is ineligible until such time that the SHSAA office rules upon the eligibility given the submission of a written report by the receiving school. Any student that transfers within their three-year eligibility period, will be ineligible at the second school in any activity they participated at their 'home' school during the previous year. The student will be eligible immediately at the new school in all activities they did not participate in at their 'home' school. Should the student have an additional year of eligibility at the second school, they would be eligible in all activities after having sat out their one year.

d) An acknowledgement signed by the student and his/her parent/legal guardian stating that they understand that the student shall not be allowed to participate in SHSAA governed athletic activities at a second school in the same sport during the same season, except in the event that the SHSAA determines the move has occurred due to circumstances listed in the policy as paragraph 1(a), 1(b), 2(a), 2(b). Unless in the sole determination of the Executive Director, it is in the best interests of the student to do so.

Transfer Policy Appeals

Where a member school is dissatisfied with the application or interpretation of the Transfer Policy, or if the school feels that there are extenuating circumstances, the school principal has the right to appeal, in writing, the decision on transfer to the SHSAA Executive Director. The Executive Director will investigate the appeal and report to the Executive Council. The Executive Council decision may be appealed to a Board of Review. Undue Influence No student shall be subjected to undue influence by an individual or group of individuals to induce or cause him/her to transfer from one school to another for athletic purposes. If allegations of recruiting are made against a school, the burden of proof in substantiated form

must be borne by the accusing party. Allegations of recruiting that are substantiated will be processed as infractions according to the section of the Bylaws known as Breach of Bylaws by Coaches or Supervisors and Breach by Members. Violations Violations of this policy could be subject to a period of suspension from participation in interschool sport of up to one year at the discretion of the Executive Director.

4. Grade 9 Students may participate in team sports at the school they would normally attend upon promotion to Grade 10 provided that the student otherwise meets eligibility requirements.

NOTE: Students may only participate on one school team, which will participate in division, district

b) A signed statement from at least one parent or legal guardian stating that the primary reason for the transfer is for an educational purpose, and that the transfer is not being made primarily for an athletic purpose or primarily so that the student can participate in athletics; and

c) An acknowledgement signed by the student and his/her parent/ legal guardian stating that they understand that the student is ineligible to participate in SHSAA governed activities. The school may apply to the SHSAA using the transfer form for the reinstatement of the student's eligibility given the submission of a written report by the receiving school before the (appropriate) next appeal deadline; and allowed only one transfer during his/her 3 years of eligibility to participate in SHSAA governed athletic activities; and

d) An acknowledgement signed by the student and his/her parent/ legal guardian stating that they understand that the student shall not be allowed to participate in SHSAA governed athletic activities at a second school in the same sport during the same season, except in the event that the SHSAA determines the move has occurred due to circumstances listed in the policy as paragraph 1(a), 1(b), 2(a), 2(b). Unless in the sole determination of the Executive Director, it is in the best interests of the student to do so.

2. The following individuals are eligible for approval as coaches or supervisors by the

Association: a) teachers previously employed by the Member operating the school in which the individual

wishes to coach; b) active substitute teachers from the school; c) other employees of the Member who work in the school as teacher aides or assistants;

or d) other individuals who have completed the 'Fundamentals of Coaching' on-line

coaching program.

3. a) Individuals seeking approval as head coaches or supervisors eligible to participate in events organized or sponsored by the Association or its Members must provide the following to the school and/or board of education: i) confirmation that they have not been a high school student during the past four years

(individuals within this four-year period may coach but cannot be the sole individual responsible to coach or supervise a school team or student-athlete), and

ii) has at least two letters of reference which attest to the qualifications and suitability of the individual to supervise and coach students of school age, and

iii) has completed or is currently enrolled in the 'Fundamentals of Coaching' module offered on-line at SchoolCoach.ca, and

iv) agrees to provide to the Member a clear criminal record check if requested to do so by the Member. Members shall request such checks unless in their opinion, considering the best interests of the students, it is unnecessary to do so.

SHSAA Executive Amendment by Jody Kerr (EX) / Ryan Nichols (SE) to read:

BE IT RESOLVED that the SHSAA amend the bylaw regarding approval of non-faculty coaches, effective

September 2014-2015 school year, to read:

3. a) Individuals, not previously approved under this bylaw, seeking approval as head coaches or supervisors eligible to participate in events organized or sponsored by the Association or its Members must provide the following to the school and/or board of education: i) confirmation that they have not been a high school student during the past four years

Saskatoon and schools located within 10 km of the boundaries of Saskatoon and Regina which are not physically located in and associated with a defined town, village, hamlet or First Nation be classified as 3A should their enrollments otherwise have placed them as 1A or 2A effective September 2014: CLASSIFICATION OF SCHOOLS

Policies 13/03/01 BE IT RESOLVED that the following be amended to the Policy section:

JEWELLERY

For the safety of the competitor and their opponents, all jewellery must be removed for any SHSAA

sanctioned interschool athletic event except golf, cross-country, volleyball, curling, badminton and track & field (except high jump and pole vault). In volleyball, jewellery may be removed or taped as per national rulebook.

SHSAA Executive Amendment by Barclay Patterson (EX) / Amanda Miazga (NW) to read: 13/03/01 BE IT RESOLVED that the following be amended to the Policy section:

JEWELLERY

DEFEATED EXECUTIVE COUNCIL INFORMED THE DISTRICT PRESIDENTS ON WEDNESDAY THAT THIS RESOLUTION WILL BE MOVED AFTER 13/03/13 AFTER ALL GUIDELINES ARE AMENDED. 13/03/03 Whereas: Given the fact that there is more and more being asked of our teacher/coaches in

the daily duties of teaching and; that their workload is also increasing; and recognizing that the Association must do all it can to protect the welfare of our coaches and respect their family time; this guideline will now become policy. Given that the provincial government has mandated that school not begin until the day following Labour Day, practices for all activities (other than Football because of the safety aspect) shall not begin until the first day of school. BE IT RESOLVED that effective 2014-2015, the Guidelines for Interschool Competition (start dates

and maximum number of contests) become policy and as such, should a school breach this policy, the school will forfeit their involvement in that current year's SHSAA playoffs. Background: It is indeed a philosophy and mandate of this Association that the value students

receive from school sport is not about how many games they play, but that they learn the skills of the sport through practice, and develop their life skills through their involvement with school sport. SHSAA Executive

13/03/04 BE IT RESOLVED that the Guidelines for Interschool Competition (start dates and maximum

If three teams are tied with identical records after pool play then the following tie-breaker will be used to determine the placing of each team in the tie-breaker games:

Teams tied with records of 1 win and 2 losses - the regional champion shall be placed in tie-breaker #2 and the remaining teams will play in tie-breaker #1 (if there are two regional champions then the winner of the round robin game between the regional champions shall be placed in tie-breaker #2)

Teams tied with records of 2 wins and 1 loss - the regional champion shall be awarded first place and the remaining two teams will play in tie-breaker #1 (if there are two regional champions then the winner of the round robin game between the regional champions shall be awarded first place)

13/11/02 BE IT RESOLVED that the Association adopt the following clarification on the general rules of cross

country effective September 2013: 5. PROVINCIAL MEET REGULATIONS:

d) The provincial cross-country meet will begin at 1:00 p.m. and continue on the approximate time schedule and order as follows:

1:00 p.m. – Midget Girls 1:55 p.m. – Junior Boys 1:15 pm. – Midget Boys 2:20 p.m. – Senior Girls 1:35 p.m. – Junior Girls 2:40 p.m. – Senior Boys

Note: Because the recommendation states that the course be built as a 1km loop and a

2km loop, it is not possible to begin any race before the previous race has been completed. There is also an expectation that the host provide an ATV that follows the last runner of any race. This would make it a safety concern for any race that is on the course following the ATV. This is a resolution based on the recommendation of the Cross Country Advisory Group.

Basketball 13/12/01 Whereas: The Association is cognizant of the fact that it is an expensive proposition for school

boards to budget to have the lines redone in their schools' gymnasiums and the fact that the new FIBA rectangular key is not that much different than the old FIBA trapezoid key with regards to playability or game tactics: BE IT RESOLVED that the Association allow play to occur on courts that have either the old

of three points as follows: 1) Team Winning 2 – 0 = 3 points 2) Team Winning 2 – 1 = 2 points 3) Team Losing 1 – 2 = 1 point

Points are calculated for all matches played, involving the entire round. 1) Match won/lost ratio 2) Games won/lost ratio (using all matches in the round robin) 3) Total points for/against ratio (using all matches in the round robin) 3.1 If this still leaves 2 players/pairs tied, then the match between them

is used to determine the next two placings. 3.2 If three or more players/pairs are still tied after the above three

criteria are applied, the ranking will be established by drawing lots.

NOTE: Once the three-way tie is broken, the match results between the remaining two teams will be used to determine the placement.

a) If still tied, then the team with the fewest points scored against them in matches played between the teams involved will be declared the winner.

b) If still tied, then the team with the fewest points scored against them in the matches played involving the entire round will be declared the winner. c) If still tied, the winner will be declared by playing a single-game, match-style tournament against the teams involved, with opponents deciding upon a draw performed by the commissioner.
