ISSUE/AGENDA ITEM TITLE:Consideration and Approval of a Resolution Providing for the Assessment of the Annual Cost ofMaintaining of Parking Facilities in Established Parking Maintenance Districts

BACKGROUND/SUMMARY:In the early and mid 1980's, DeKalb County approved the development of several single familydetached subdivisons within the unincorporated areas of the County that included "Parking Pads"located with the public right-of-way of the roads within the development instead of traditionaldriveways for each lot. As part of accepting this design, DeKalb set up, and included languageon the approved plats, special taxing districts for these developments to partially cover the costof the maintenance of these parking pads. In 2012, DeKalb County assessed the lots that werewithin the "Parking Maintenance" districts within these developments at a rate of $12.50 per lotper year.

Two of these developments that had these established Parking Maintenance Districts, Haven

Brook and Park Creek, are included within the boundaries of the City of Brookhaven. When theCity took over responsibility for maintaining the public roads within the city limits, we also tookover the responsibility for maintaining the parking pads within these two developments. Tooffset the costs of this maintenance, we are recommending the City Council approve to continuethe assessment of the lots within the Haven Brook and Park Creek developments for the ParkingMaintenance Fee at the same rate previously assessed by DeKalb County. Based on the numberof lots in these developments, this fee is expected to generate about $1000 per year in revenuefor the General Fund.

A RESOLUTION PROVIDING FOR THE ASSESSMENT OF THE ANNUAL COST OF

MAINTAINING OF PARKING FACILITIES IN ESTABLISHED PARKING MAINTENANCE

DISTRICTS

WHEREAS, Article IX, Section II Paragraph 6, of the Constitution of the State of Georgiaauthorizes and empowers the City Council of the City of Brookhaven, Georgia toestablish districts for the purpose of maintaining parking facilities for single familyresidential lots located within the public right-of-way, and to levy a specialassessment or fee against all property served by these functions; and

WHEREAS, DeKalb County, prior to the incorporation of the City of Brookhaven on December17, 2012, had established Parking Maintenance Districts within the boundaries ofthe City; and

WHEREAS, in the Plat filed in DeKalb County Plat Book 80, Page 14 on June 14, 1985 forHaven Brook Subdivision stated that All single family residential lots on this platare included in a special taxing district for funding the maintenance of parkingprovided by this development.; and

WHEREAS, in the Plat filed in DeKalb County Plat Book 76, Page 121 on December 8, 1983for Park Creek Subdivision stated that All single family residential lots on thisplat are included in a special taxing district for funding the maintenance ofparking provided by this development.; and

WHEREAS, on January 17, 2013, the City of Brookhaven took over responsibility for all theStreets and Public Right-of-way within the boundaries of the City; and

WHEREAS, in the 2012 tax year, DeKalb County levied a special assessment or fee againstall property served by the functions of the established Parking MaintenanceDistricts.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF

THE CITY OF BROOKHAVEN, GEORGIA as follows:

That in the 2013 tax year, a special assessment be levied against all property served bythe functions of the established Parking Maintenance Districts of the Haven Brook Subdivisionand the Park Creek Subdivision at the rate of Twelve and 50/100 Dollars ($12.50) per lot.

SO RESOLVED AND EFFECTIVE on this the 11th day of June, 2013.
