Yesterday, MTA ChairmanJoseph Lhota backed theNYPD’s controversial confisca-tion of a public bus to trans-port Occupy Wall Street pro-testers who were arrested atZuccotti Park on March 17, thesixth-month anniversary ofthe movement.

“When you have situationslike this and the police deter-mine that they need to getfrom point A to point B, wewill help them,” Lhota said.

Protesters said police offi-cers stopped an M5 bus, whichruns the length of Manhattanfrom South Ferry to the GeorgeWashington Bridge, aroundmidnight by Zuccotti Park.They said the NYPD made pay-ing passengers get off and intheir place boarded dozens ofarrestees. Police rerouted thevehicle to the Midtown Southpolice precinct.

It is unclear if those riderswho were kicked off were re-

imbursed for their fare.Drivers who object to work-

ing with police can opt out ofdriving prisoners, Lhota said,because the police departmenthas officers trained to drivebuses. Lhota said the MTA of-ten works with other cityagencies to transport people inemergencies, like 9/11 andduring Tropical Storm Irene.

“This relationship betweenthe transit authority and theNYPD goes back to as long asthe transit authority has beenaround,” said Lhota.

But Occupy Wall Street pro-testers stormed yesterday’sboard meeting to voice theiranger. “Public resources havebeen commandeered by a pri-vate army,” said Shawn Carrie,22, an OWS protester who wasarrested on March 17, refer-encing when Mayor MichaelBloomberg infamously de-clared on Nov. 29, “I have myown army in the NYPD.”

Well before rush hour, pro-testers sneaked into subway

stations and chained openmore than 20 entrancesacross the city.

Padlocks were reportedlydiscovered at 135th Street onthe 3; 116th Street on the 6;Halsey Street on the L; NinthAvenue on the D; BeverlyRoad on the Q; and CarrollStreet on the F stop in Brook-

lyn; as well as Steinway Streetand 65th Street on the R inQueens, among other stations.

The gates were open atabout 5 a.m. and the MTA cutmost of them down by 8:30a.m.

Protesters said theyworked in conjunction with“rank-and-file” workers from

the Transport Workers UnionLocal 100 and the Amalgamat-ed Transit Union.

A union spokesman deniedthe TWU was part of theattack.

After days of deliberation anda deadlocked jury, a judge de-clared a mistrial yesterday inthe case of Michael Pena, 27,a police officer accused ofraping a woman in Inwoodlast year.

But Pena still faces up tolife in prison. The jury decidedhim guilty of multiple countsof sexual assault on Tuesdayand he will be sentenced forthose convictions on May 7.

“In this brutal attackagainst an innocent youngwoman, the defendantshowed no mercy,” ManhattanDistrict Attorney Cyrus Vancesaid yesterday. ”At sentencing,we will recommend that hereceive none.”

The victim, who was incourt for the trial, reportedlysobbed when Judge RichardCarruthers announced that hewould end the trial.

The judge decided to de-clare a mistrial when the juryforewoman told him yester-day that they could not arriveat a verdict on the four rapecounts against Pena.

Jurors had told the judgethat they were deadlockedon the rape charge, but hadreached a consensus in a par-tial verdict convicting him ofsexual assault. The judge pre-viously had urged them tokeep deliberating.

Pena was charged last yearafter cops responded to a 911call in Inwood. A school-teacher, 25, on her way towork, said that he asked herfor directions to the train andthen pulled out a gun andforced her into a courtyard,where he allegedly raped her.

Accused of disabledabuseQUEENS. A couple accused of locking a partiallyparalyzed former neighbor intheir apartment for morethan a year remained heldwithout bail yesterday,authorities said.

The battered woman, 58,

who suffered a broken arm,ribs and a dislocated shoulder,was discovered by policeresponding to a 911 callplaced by her niece after shewas unable to reach her byphone for months, QueensDistrict Attorney RichardBrown said.

Police found the womanlocked in an empty room, ly-ing huddled on the floor. Shewas bleeding from the headand severely malnourished,said officials.

When Reebok introduced agreen New York Jets T-shirtwith the number 15 and starNFL quarterback Tim Tebow’sname on it last week, NikeInc. says its rival was misap-propriating Nike’s rights.

In a lawsuit in U.S. DistrictCourt in New York, Nike ac-cused Reebok of taking unfairadvantage of “Tebow-Mania”— the phenomenon surround-ing the quarterback whomoved to the Jets from theDenver Broncos. Tebow hasdrawn attention across theUnited States not just as asportsman, but for his opendisplays of his evangelicalfaith on the field.

Reebok, a unit of Adidas,“has no authorization fromMr. Tebow or anyone else to

use Mr. Tebow’s name or otheridentification on such Jetsproducts,” read the lawsuit,dated March 27 and madepublic yesterday.

Nike said only they are au-thorized and licensed to useTebow’s name on football-re-lated products.

The Adidas unit was pro-ducing and selling Tebow-

identified Jets apparel prod-ucts “in order to capitalize onthe public’s short-lived in-tense consumer appetite forsuch products, and to preventNike from doing so,” accord-ing to Nike’s suit.

And Tebow himself is ap-

parently even getting involvedin the battle. A representativeof Tebow wrote to Reebok onMarch 23 and demanded thatit discontinue using his nameand remove the products fromall locations, the lawsuit said.REUTERS

New York City made the top10 in an international list ofthe best cities for parks, com-piled by travel guide From-mer’s. And the city’s parksjust might get better thissummer.

New York joined Barcelona,Melbourne and London,deemed Frommer’s, whichgave a special nod to iconicCentral Park.

“Central Park is the city’sbest known patch of green,”the travel guide writes. From-mer’s also noted scenic FortTryon Park in upper Manhat-tan and Gramercy Park, whichrequires a key to enter.Prospect Park gets a shout-out, as does neighboringBrooklyn Botanic Garden. Inthe Bronx, the guide suggestsvisiting Pelham Bay Park.

And, in good news for NewYorkers, there will be severalnew additions to the city’sbeloved parks this summer:Williamsburg’s McCarrenPark pool will reopen on June28 after 28 years and $50 mil-lion in renovations.

The new pool will accom-modate 1,500 swimmers. Thepool has been the setting ofsummer concerts since 2005and is being built into a year-round recreation center,which, in addition the pool,will include a snack shop anda rooftop cafe.

After canceling concertslast year, the New York Phil-harmonic’s “Concerts in theParks” series will also returnthis summer.

The beloved free, outdoorconcerts will be held in a parkin each borough during the

month of July.Other new scenery will in-

clude Rockaway Park inQueens. That park will featurea new lawn and enhancedcoastal dunes, with more treesplanted nearby. The Parks De-partment hopes to have mostof the work done this sum-mer, when they estimate itwill be 77 percent finished.

But you don’t have to waitfor another season of parkadventures.

Last week’s warm weathermeans some cherry blossomshave already bloomed at theBrooklyn Botanic Garden.

And next week, the HighLine will expand its hours forthe spring, opening from 7a.m. to 10 p.m. instead of clos-ing at 7 p.m.

If you have to work, justbring your laptop — the citywill add Wi-Fi to six new parksthis year, from the High Lineto Flushing Meadows CoronaPark in Queens.

The pool at McCarren Park in Williamsburg will reopen on June 28 after being renovated.

One ‘Touch’ creates a thousand ripples

If Kiefer Sutherland wanted toplay a role as far away from“24” hero Jack Bauer as possi-ble, he may have found it onthe new Fox drama “Touch.”

As Martin Bohm, a working-class widower struggling toprovide for his son, 11-year-oldJake, Sutherland is all despera-tion and heart where Bauer wasfearless and stoic.

“The character was so vastlydifferent, and the tone of thepiece was so vastly different,that that was part of [the‘Touch’ script’s] appeal,”Sutherland admits. But pullinga 180 on his résumé wasn’t the

only draw.“I had to read it a second

time to make sure that all ofthe things that were affectingme were affecting me on a per-sonal level as opposed to tryingto manage a career,” he says.“And the second pass had a pro-found effect on me. Does it hap-pen to also be a nice diversionfrom ‘24’? Yes. But I believe,honestly, that the reason that Imade the choice was because itspoke to me.”

Part of what, well, touchedthe actor was the central rela-tionship between father andson. All of those tender quali-

ties we’re not used to seeingthe actor portray are height-ened when it’s revealed thatJake is gifted — he is able toidentify the patterns connect-ing everyone and everything inthe world — but he is emotion-ally challenged, unable tospeak, and he refuses to let any-one, even his dad, touch him.

“The real driving force formy character is to just simplycommunicate with his son,”Sutherland says. “He wants tohave as normal a relationshipas he possibly can with his son,which I think every parent canrelate to.”

As the father of two daugh-ters — and grandfather to twoboys — Sutherland says, “Idon’t think anybody has a childand ... doesn’t want to be thebest they can possibly be forthat child. Martin is never go-ing to have the perfect, idyllicrelationship with his son,” heexplains, “and so there is a cir-cumstance, a kind of weight onboth characters where they justwill never completely win. Andthat is something that I amdrawn to certainly as an actor.”

It’s all connected

Jake is able to see theinterconnected nature of theworld and, with his father’shelp, makes sure there are nosnares in the web thatweaves together our lives. It’sa premise that gives “Touch”a message of hope.

“This show … explains thatthings happen for a reason,”Sutherland says. “Very muchlike the wildebeest that isstung by a bee in theSerengeti and starts a stam-pede and creates a dust cloudthat rises ... and starts a stormin the Gulf, there is a causeand effect to everything.There’s something wonder-fully comforting about think-ing that everything has apurpose and that there is nosmall moment.”

+After enduring the typical dailychaos, how do New York’s fun-ny people unwind? More chaos,although in a more controlledform. Improv comedy is the artof saying yes, embracing spon-taneity and surrendering to theoften bizarre whims of your fel-low man. It could be the officialsport of the MTA.

“It’s all about listening andkeeping yourself open to themoment,” says Magnet Theaterimproviser Louis Kornfeld.“You learn to throw yourselffully into a situation withoutknowing the outcome — andall you have is the other peoplearound you.”

All of the big, New York im-prov theaters, such as TheMagnet, Upright CitizensBrigade and The Pit, offer a safeplace to put yourself out there,as well as be a little vulnerable.

“A lot of the work teachesus to peel off the layers of coolthat we accumulate over the

years so as not to embarrassourselves. Being okay with em-barrassing yourself is a virtuein improv,” says Kornfeld. Try itout for yourself on Thursdaynights at their popular MagnetMixer, where improv novicesand experts alike can sign upto perform a quick scene to-gether in front of an audience.

But be careful: It’s a closecommunity you’re entering.After graduating from NYU in2000, Julie Klausner, the poly-math podcaster behind HowWas Your Week, took classes,

performed and eventuallytaught at UCB.

“The spirit of UCB is defi-nitely a collaborative one and asocial one,” she says, “Youlearn to work and play wellwith others.” Klausner addsthat most of her professionalrelationships can be tracedback to UCB. “I really do con-sider it my alma mater.”

If performing isn’t for you,UCB also offers writing classes.After dropping out of Yale LawSchool, Jessica Dweck movedto New York to pursue comedy,but found the open-mic scenefrustrating. If you’re serious,friends told her, go to UCB.
